Is it Wrong Not to Belong As a REALTORreg member the bridge to golden opportunities begins during your indoctrination As of August 2015 you are one of 1151403 members and the largest trade association As REALTORSreg our contributions and services are feltmdashand even if those we serve sometimes donrsquot yoursquore appreciated by Americans from all walks of life Our skills knowledge and Code of Ethics have never been as important as they are today Generation after generation we become the architects of our National Associationrsquos growth of service and involvement in the communities we serve This is a chance to participate and recognize the vision of what we accomplish on every level of service throughout our community Selfless community support has always been essential to our success nationwide Thatrsquos why the question of the day is ldquoHow can RPAC help me thriverdquo At our recent social I approached several fellow REALTORSreg about contributing to RPAC our national political action committee Participation is strictly voluntary and not required The response was tremendous positive and encouraging To those that joined a sincere and appreciative thank you Your contributions will go a long way in protecting the rights of homeownership and our industry One REALTORreg questioned the necessity of

RPAC when they donrsquot see anything change politically Well my fellow REALTORreg herersquos my reply Because of RPAC our voices and call to action yielded the following Added a felony charge to any criminal who

lures or entices a Realtor to a property with the intent to do harm

Prevented a proposal creating daily fines of $200 for any sign in any public right of way How often do you use such signs for your listings 10 days for 1 sign = $2000 Implemented civil penalties for unlicensed real estate practices

Defeated lawyer-only closing requirements Passed tougher reciprocity requirements on applicants from other states

Mandated criminal history background checks for real estate license applicants (including fingerprinting)

Approved legislation allowing agents to incorporate and form limited liability companies Passed a 3-year statute of limitations on complaints to the Real Estate Board

Passed landmark agency disclosure legislation Defeated mandatory rental inspection legislation Fairer determination of basis for recordation and grantorrsquos taxes

Defeated statewide grantorrsquos tax legislation Introduced ldquoAffordable Housing Trust Fundrdquo legislation

Defeated recordation fee increase helliphelliphellipand the list goes on Because of RPAC we are able to do our jobs

and protect our clients from legislation that does not impair or penalize the pursuit of the American Dream

Listing content fuels the real estate industry and displaying photographs of real properties online is now a vital part of the real estate professionalrsquos marketing plan Sellers use photographs to market properties and buyers rely on those images to select which properties to visit MLSs distribute property listings through proprietary databases that include the listing photographs Moreover MLSs in turn often license their property listing databases including broker-provided photographs to third-party portals such as REALTORcom and other websites and vendors

Improper use of listing photographs however can create legal problems for agents brokerages and MLSs Authorship and ownership of photographs within the real estate industry is ldquofracturedrdquo Who authored the photograph and who can use what photograph and in what way varies across the industry Listing photographs may be taken by homeowners real estate agents MLS or brokerage employees or professional photographers Photographs may be owned or licensed to different parties in a variety of ways A misunderstanding of how you may use the photographs for property listings could make you vulnerable to a copyright lawsuit

For example copyright infringement of listing photographs is central to the recent lawsuit VHT Inc v Zillow Group Inc No 215-cv-1096 (WD Wash 2015) VHT purportedly retains ownership in the listing photographs and only grants non-exclusive licenses to brokers to use the photographs solely in connection with marketing active property listings In the complaint VHT alleges that Zillow uses VHTrsquos photographs without authorization in connection with ldquosoldrdquo properties and on Zillowrsquos home design website ldquoDigsrdquo VHT argues that these uses exceed the scope of VHTrsquos limited license to use the photographs in connection with active property listings The case is still pending

It is crucial to know what rights you own in photographs and how those rights permit you to use the photographs To reduce your risk of copyright infringement you should

Review photography agreements to assess what rights were granted or conveyed Audit your use of listing photographs to ensure compliance with the relevant agreements Determine how you will use photographs and ensure future agreements permit those uses and Maintain records of all assignments and licenses

In late August Hampton Neighborhood Commissioner and VPAR PPC member Peggy Todd joined Susan Gaston VPAR Legislative Consultant to meet with Jason McBride and Dan Mccormick from the Cityrsquos Housing and Neighborhood Services Division in the Department of Community Development On topic were the various neighborhood master plans and how best to move forward in a more comprehensive manner to planning the Cityrsquos future housing needs There is much more to come on this issue but the seeds have been sewn and VPAR is taking the lead as a stakeholder on the issue

The Board of the Ft Eustis Civic Leaders Association (ECLA) toured Ft Eustis on September 3rd and VPARrsquos Legislative Consultant attended the briefing and tour of the installation We will be working with other community leaders to bring new attention to Ft Eustis as an economic driver looking ahead to revenue-enhancing opportunities that can be created for the City the Base its operations and its land mass It is likely as well that a Joint Land Use Study (JLUS) an exercise that is similar to a comprehensive plan will be developed for Ft Eustis VPAR has communicated to the Command our desire to be a stakeholder in that important effort

VPAR and HRRA presented their jointly- proposed position statement supporting the creation of the Virginia

Shoreline Resiliency Fund to the VAR Public Policy Committee at its August 26th meeting The position statement was drafted for consideration into inclusion for the 2016 VAR Legislative Package The fund would create a low-interest loan program to help residents and businesses that are subject to recurrent flooding It is anticipated that monies from the Fund could be used to mitigate future flood damage This and a myriad of other issues proposed by local associations throughout Virginia will be brought up for final consideration at the VAR Convention in Williamsburg next month HAPPY 10th BIRTHDAY to HOUSING VIRGINIA Housing Virginia is the statersquos seminal affordable housing advocacy organization that celebrated its first decade with an event in early September that included thanks from Governor Terry McAuliffe The Virginia Association of REALTORSreg (VAR) was a founding partner in the creation of Housing Virginia Kit Hale VAR past president and current NAR REALTORreg Party liaison chairs the non-profit and was instrumental in its creation In considering the decade of impact that Housing Virginia has had in advocating for housing affordability and the availability of safe and quality housing across the Commonwealth REALTORSreg were specifically thanked for their commitment to creating housing opportunities for

The Consumer Financial Protection Bureau Know Before You Owe Online Tools

NAR announced this week that ldquoCFPB rolled out a set of online tools to help consumers get better acquainted with what the Know Before You Owe initiative means for them in advance of upcoming changes to the mortgage closing process

The new tools released today are intended to improve consumers understanding of the mortgage process aid in comparison shopping and help prevent surprises at the closing table Rule changes associated with Know Before You Owe go into effect October 3

Consumer Financial Protection Bureau Director Richard Cordray and National Association of Realtorsreg 2015 First Vice President-Elect Elizabeth Mendenhall reccently met to announce the changes

ldquoRealtorsreg play an important role in keeping consumers educated about changes in the home buying process and that includes rules related to the Know Before You Owe initiativerdquo said Mendenhall ldquoThe journey to homeownership begins with REALTORSreg and CFPBrsquos new online tools are a great resource for agents to help clients shop for a mortgage and prepare for the changes coming their wayrdquo

The CFPBrsquos online tools are directed at consumers who may still be unaware of the Know Before You Owe initiative ldquoOur new mortgage forms reduce the information gap between lenders and consumers shedding light on a process that often feels like a mysteryrdquo said Cordray ldquoIt is time consumers have more power in the mortgage process and our new forms and online tools will help make that a realityrdquo

The toolkit offers a guide to the new mortgage closing forms a closing factsheet a disclosure timeline and educational videos to assist consumers REALTORSreg across the country have worked through the summer to educate themselves on rule changes related to Know Before You Owe so they can continue providing expert advice to clients when the new rules go into effect
