Service Charge & Insurance Collection

Stage 1.Instruct Penham Excel online or by fax to

collect the Insurance & Service charge debt.

Stage 2.Upon instruction, an automated letter beforelegal action will be issued, providing 7 clear

days for the tenant to respond and make payment. A charge of £75.00 is made to the debtor for the issue of the letter. No fee is

incurred by the client.

Stage 3 (A)Payment is Made

Payment is issued to client via an immediatebank transfer.

Stage 3 (B)Non Payment

Legal case prepared, documents collated, charge added to file of £195.00 for the creation of the documents for Wilkin Chapman LLP to progress.

Stage 4 (A)Legal Action commences through Wilkin Chapman

LLP. High Court Enforcement Officer given the powers of entry by the Ministry Of Justice to collect the

outstanding amount or issue proceedings through Bankruptcy, Winding up or third party debt order.

Commercial Rent Collection

FREE collection Used for seizing goods. Usual result is that tenant makes payment to prevent goods being

removed and sold. (No court action necessary).

Instruct Penham Excel, Certificated Enforcement Agents online or by fax. Statutory £75.00 compliance charge is added to the debtors account.

Stage 1:Notice/Compliance

Penham Excel issue the Statutory Compliance Letter giving the tenant

seven clear days to pay or enter into a satisfactory payment plan

Stage 2:Enforcement

No contact from tenant, action moves to Stage Two Enforcement.

Enforcement Officer attends premises to take control of goods. Statutory

charge of £235.00 plus 7.5% of any Debt amount over £1,500.00

Stage 3:Sale

Tenant cannot / will not pay or instalment plan is

broken. Landlord has option to escalate to

Stage Three Enforcement Removal and Sale. Statutory charge of

£110.00 Plus 7.5% of any debt amount over

£1,500.00

Tenant pays in full within compliance period,

monies remitted to client same day

How Do you instruct Penham?

Go to www.penhamexcel.co.uk and complete the Instruction to collect Service Charge / Insurance form. (This can be sent electronically via our web site).

What Happens Next?

A Pre-Legal Letter will be issued to the tenant requesting payment. If being instructed to collect the rent at the same time this can accompany the letter of Compliance for the rent arrears. If payment is received at this stage it is remitted same day from our clients account to any account of your choice.

What happens if no payment is made for the Insurance / Service charge?

Our team in the Commercial Rent Arrears department will put together a legal pack complete with all the documents relating to the initial instruction. They will liaise with Wilkin Chapman LLP ready for Court action.

What are the charges to the Landlord / Property management company for the legal action?

Simply Nothing, all charges are born by the tenant which includes the Letter before Legal action, the combining of the documents fee and the Wilkin Champan’s charges for the action taken. The only charge that would be made in an unsuccessful case would be the court fee as this is a disbursement payable by ourselves to the courts; all other charges would be simply dismissed.

How Successful is the court action?

Very, we do not just stop with a Court Judgment, any debt value over £600 is transfered by ourselves to the High Court. We can then look to enforce the debt as High Court Enforcement Officers.

What other action can take place if needed at this stage?

Bankruptcy (Against an individual not a Ltd Company and with this no judgment is required before action commences)

Winding Up (Used against companies and again with this no judgment is required before action commences)
