EXTRACTS OF JUDGMENT OF DELHI HIGH COURT DATED 29-04-2013 DISMISSING THE PETITION OF UNION OF INDIA AGAINST THE JUDGMENT DATED 01 NOV, 2011 OF PRINCIPAL BENCH OF CAT, NEW DELHI

The Delhi High Court delivered its judgment regarding rectification of pension of pre-2006 retirees on 29 April, 2013. The coram consisted of Hon'ble Justice Mr Pradeep Nandrajog and Hon'ble Mr Justice V. Kameshwar Rao

The Court referred to the Govt of India O M issued on 28 Jan,2013, whereby they granted the th

revision of pension of pre-2006 retirees on the basis of the actual recommendations of 6 CPC, as per the O M No 38/37/08 P&PW(A) dated 01-09-2008 , albeit, from 24 Sept 2012 onwards only. In the light of this, the court concluded as under:“2. The only issue therefore which survives is, with respect to paragraph 9, of the office memorandum afore noted which makes it applicable with effect from September 24, 2012, and thereby denying arrears to be paid to the pensioners with effect from January 01, 2006. 3. In short, the Government of India has tacitly admitted that it was in the wrong and that the Tribunal is correct.”

The court analyzed various aspects of the issues of revision of pension based on the th

recommendations of 6 CPC, various orders / instructions issued by the govt from time to time and the contentions put forward by the pensioners. It referred to the cases of Nakra and Maj Gen SPS Vains as also the judgement of Punjab & Haryana High Court, concurring with the latter's judgement in W.P © No 19641 / 2009 dated 21 Dec, 2012 , wherein it was contended “ …. pension of the pre-2006 retirees should not be less than 50% of the sum of the minimum of the pay in the Pay Band and the grade pay thereon corresponding to the pre-revised pay scale held by the pensioner at the time of retirement. However, as per the OM dated 3.10.2008 revised pension at 50% of the sum of the minimum of the pay in the pay band and the grade pay thereon, corresponding to pre-revised scale from which the pensioner had retired has been given a go-by by deleting the words 'sum of the' 'and grade pay thereon corresponding to the pre-revised pay scale' and adding 'irrespective of the pre-revised scale of pay plus' implying that the revised pension is to be fixed at 50% of the minimum of the pay, which has substantially changed the modified parity/formula adopted by the Central Government pursuant to the recommendations made by the VI CPC and has thus caused great prejudice to the applicants. According to us, such a course was not available to the functionary of the Government in the garb of clarification thereby altering the recommendations given by the VI CPC, as accepted by the Central Government. According to us, deletion of the words 'sum of the' 'and grade pay thereon corresponding to the pre-revised scale' 'and addition of the words 'irrespective of the pre-revised scale of pay plus', as introduced by the respondents in the garb of clarification vide OM dated 3.10.2008 amounts to carrying out amendment to the resolution dated 29.08.2008 based upon para 4.1.47 of the recommendations of the VI CPC as also the OM dated 1.9.2008 issued by the Central Government pursuant to the aforesaid resolution, which has been accepted by the Cabinet. Thus, such a course was not permissible for the functionary of the Government in the garb of clarification, that too, at their own level without referring the matter to the Cabinet….” Based on these, the court issued the final orders as under:8. We are in complete agreement with the reasoning of the Division Bench of the Punjab & Haryana High Court and adopt the same and do not burden ourselves any further. We conclude by noting that as regards the substance of the view taken by the Tribunal, even the Central Government accepts its correctness, but insists to make the same applicable prospectively. 9. The writ petitions are dismissed. The decision of the Full Bench of the Tribunal is upheld but without any order as to costs.

Bench judgement in the said OA.iii) Necessary orders will be issued by the DoP on acceptance of the judgement by the Govt.iv) Minimum Pension of all CG Pensioners shall be revised as per accepted Recommendations of the Sixth CPC - as Notified vide GOI Resolution dated 29-8-2008;v) By implication, DoP OM dated 28-1-2013 will become implementable from 1-1-2006 (instead f 24-9-2012);vi) Minimum Pension of all CG Pensioners shall be fixed w.e.f. 1-1-2006, @ 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.1/1/2008-IC dated 30-8-2008.vii) Minimum Pension as above from 1-1-2006 will be payable forthwith, to the concerned Pre 2006 Pensioners – whose Revised Pension had been fixed at a level lower than Col 9 of the ANNEXURE attached herewith. It will now be fixed as per Col 9 of the Annexure. (For the Table,kindly visit the website rscws.com)viii) a) Revised PPOs shall be required from PSA / PAO of the office from which the Pensioners last retired.

b) Banks will take action to revise Pension & the Arrears on receipt of Revised PPOs & Orders of DOP as per judgement.ix) All this is subject to the Provision that the Govt. does not file an SLP in the Supreme Courtx) In case the SLP is filed in 3 Months from the date of judgement of Delhi HC, then it will depend on the decision of the SLP.(It is hoped that the Govt. would not file the SLP, in view of the National Litigation Policy as well as in view of the merits of the case, besides other factors – taken note of in the concurring judgements of various Benches of the CAT, Punjab & Haryana High Court and Delhi High Court.)

Orders for revision of 1/3rd restored pension of absorbees, who had drawn lump sum payment on absorption were issued vide this Department O M of even number dated 15 9 2008. As per para 2A of the said OM, the full pension of the absorbees was notionally revised w e f 1 1.2006 in accordance with the instructions contained in this Department O M No 38/37/08-P&PW(A) dated 1 9 2008 The payment of DR and additional pension to old pensioners is regulated on the basis of the notional full pension2 Instructions have been issued vide this Department s OM No.38/37/08- P&PW(A) dated 28 1 2013 for stepping up of the pens on of pre-2006 pensioners w e f 24 9.2012. Early Decision – No need to pay Arrears on DA and 7th CPC

(by igecorner, on April 24th, 2013) Decision in the right time –will avoid more funds to allocate as arrears!At last, the most eagerly awaited announcement of additional dearness allowance has been declared by the cabinet, due from January 2013 to Central Government employees and Pensioners.( on 22 April,2013)

In general the announcement of dearness allowance has been made in the month of March every year. But this year this has been declared in the month of April. Though it was announced after some delay, there is no loss, as the dearness allowance hike has to be paid with effect from 01-01-2013.Before this announcement, there was a rumor that 50% dearness allowance will be merged with basic pay or otherwise dearness allowance will not be hiked, but the cabinet committee decision cleared these doubts.Employees and Pensioners will get one more month arrear from January to April. Government has to allocate more funds as arrears due to delay.If the decisions concluded in the right time, there will be no chance to allocate more fund for the payment of arrears and also prevent practical problems to accounting staff.Even the National anomaly committee, after six years it was formed, has not solved all the problems raised due to the implementation of 6th CPC.After the implementation of 6th CPC in 2008 with effect from 01.01.2006 , arrears had to be paid to Central Government servants. To avoid the additional financial burden, the Central Government decided to pay the arrears' in two installments in 2008 and 2009. For this, government had to allocate more fund from budget. It can be avoided by early constitution of 7th pay commission.So, to find the solution to all including disbursing authorities, setting up of 7th Central Pay Commission at early stage to implement in the right time, the same is demanded by the central trade unions and associations.Every decision in the right time –will avoid more funds to allocate as arrears!Source : govtempdiary.com *****Ministry of Finance (Department of Expenditure), O M No. 1(2)/2013-E.II(B) dated: 25th April,

2013.Subject: Payment of Dearness Allowance to Central Government employees – Revised Rates

effective from 1.1.2013.The undersigned is directed to refer to this Ministry's Office Memorandum No.1(8)/2012-E-II (B)

dated 28th September, 2012 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 72% to 80% with effect from 1st January, 2013.2. The provisions contained in paras 3, 4 and 5 of this Ministry's O.M. No.1(3)/2008-E-ll(8) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.3. The additional Installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.4. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.6. P P G & P vide No F. No 42/13/2012-P&PW (G) dated 02 May, 2013) ***** CASE FOR UNIFORM RISE IN PENSION ACROSS THE BOARD

BPS and RSCWS have decided to file a case for uniform rise of Pension to all Pre-2006 Pensioners in S 4 to S 23 at par with S 24 to S 34. The association has prepared synopsis of the Case and a Table showing Comparative 'Rise in Pension 'with uniform multiple Factor of three times of Basic Pension.A comprehensive Table has been prepared by the association showing at a glance the following details:

(a) How great injustice had been done within the "Homogeneous Group" of Pre 2006 Pensioners even after the issue of DOP orders dated 28-1-2013, as in the minimum Pension rise for scales in PB 1 & PB 2 (S 4 to S 23) is only about 2.5 to 2.7 times as compared to 3 to 3.4 times for S 24 and above ( S 24 to S 34). It is in violation of Articles 14 and 39 of the Constitution of India as it discriminates within a homogeneous group of Pre 2006 Pensioners.

(b). DOP orders dated 28-1-2013, in any case deals with the stepping up of the Minimum Pension" - leaving majority of the Pensioners in the lurch (who got only 2.26 times rise) , thus causing much frustration and loss to a large number of Pensioners.

(c) The rise with COMMON MULTIPLE FACTOR OF THREE TIMES RISE IN BASIC PENSION, would substantially benefit all Pre 2006 Pensioners at all levels.

(d) The rise of Pension even with Full Parity with Post 2006 Pensioners (including GP / Grade Pay) will be much smaller than the rise with uniform multiple factor of 3 .

The Case for Full Parity has been turned down by many Benches of the CAT and appeals in some cases are pending in some High Courts. A new case need not be filed for the same at this stage.

The case for "Uniform Rise of 3 Times in BP to all Pre 2006 Pensioners" is all together different and is much stronger as it involves discrimination within a homogeneous group of Pre 2006 Pensioners. It should be strongly and effectively pursued in Courts of Law.

The undersigned is directed to say that instructions were issued vide this Department OM No.41/21/2000 dated 16/11/2000 for issue of Identity Cards to Central Govt. Pensioners (copy enclosed). Representations have been received in this Department that some departments are not issuing the pensioners' Identity Cards in accordance with the above instructions.

All Departments/Ministries in the Govt. of India are requested to issue suitable instructions to the offices under their control to issue Identity Cards to Pensioners in accordance with the instructions issued in this Department OM No.41/21/2000-P&PW(D) dated 16/11/2000. The undersigned is directed to say that the Parliamentary Standing Committee on MHA in para 26 of its 60th report has inter-alia. Recommended that Government should favourably consider on priority the desirability of issuing Identity Card on retirement to each Central Government employee. The recommendations are reproduced below:- "26.2 The Committee feels that it would be in fitness of things if the civilian employees are also issued Identity cards indicating the details such as last post held before retirement, pay scale of the post last held period of service rendered etc. which the retired employee can carry on his person for identification as and when needed. 26.3 The Card may also include on the reverse the retired employees Blood Group, his residential address and telephone number, if there is one. 26.4 The Committee strongly recommend that the Government should favourably consider on priority the desirability of issuing such cards on retirement to each Central Government employee."

2. The recommendations made by the Parliamentary Standing Committee has been carefully

examined. It has been decided that I. Cards will be issued by various Ministries/Departments/offices to

its retired/retiring employees and the expenditure on providing a laminated I .Card will be borne by the

pensioner. This Department has devised a format in which 1Cards are to be issued to pensioners

(specimen enclosed). It will be the responsibility of the concerned Ministry / Department to work out the

expenditure that may be involved in issuing a laminated I. Card to pensioners and the card may be issued

at the request of the Pensioner, on cost recovery basis.

ThirruvananthapuramFor CGHS cards , as dependant , what is the meaning of the word “ family “The term 'family' means and includes:-“Husband or wife as the case may be and other dependant family members.Dependant Family Members: parents, sisters, widowed sisters, widowed daughters, minor brothers and minor sister, children and step-children wholly dependent upon the Government Servant and are normally residing with the Government Servant”.Also now include , dependent divorced / separated daughters ( including their dependant minor children) and step-mother.The term dependency means that income from all sources including pensions and pension equivalent of DCRG benefit is less than Rs.3500/- plus amount of DA on Basic pension of Rs3500/- per month. However, there is no such clause as dependency in respect of spouse.What is the procedure to register with the CGHS? Pensioners: One can get a CGHS card made from the office of AD / JD of the City. Forms can be downloaded from CGHS Website or can be taken from office of AD / JD of city between 1000 am to 1230 pm.Documents required(i) Application in prescribed format (ii)Proof of Residence (iii) Proof of Stay of dependents (iv)Proof of age of son (v) Disability certificate, if any in case of sons aged 25 & above, who would otherwise cease to be a beneficiary. (vi) Photos of eligible family members (vii) Surrender Certificate of CGHS Card while in service (only in those cases where CGHS Card was issued while in service) (viii) Attested copies of PPO & Last Pay Certificate

(ix) Draft for required amount towards CGHS contribution – in the name of 'P.A.O., CGHS New Delhi' in Delhi-and in the name of 'AD, CGHS of the city'

In case PPO is not ready for any reason there is option to get a provisional card on the basis of Last Pay Certificate.

The data is entered through computers and entered in data base and a print out is issued same day for immediate use. Plastic cards are subsequently sent to the residence of the card holder by post.Serving employees:- Serving employees submit the forms in prescribed format enclosing photos of eligible family members and submit to the Ministry / Department/Office , where he / she is employed. The application form shall be forwarded by the Ministry / Office /Department to the office of Addl. Director CGHS of city for preparation of card. Print out is issued for immediate use andHow long does it take to get the CGHS Cards? Normally computerized printout of index card is issued on the same day. Plastic cards are sent to the residence in '3' weeks time.Whom Should I approach in case the CGHS Card is not issued to me in the prescribed time?Contact Joint Director (HQ), CGHS, Bikaner House, New Delhi in case of Delhi and Addl. Director of City in case of other cities.What should I do if I lose my CGHS Cards ? Application is to be submitted to AD/JD along with two photographs and a IPO for Rs. 50/- for issue of duplicate card. Indian Postal Order payable to “ P.A.O. CGHS Delhi” if in Delhi or “ Additional Director of the CGHS City “ in respect of other cities

After retirement three months grace period is given to get CGHS card made.

Advice of Government specialist is required only for the specific treatment procedure / investigation to be undertaken. There is no need to specifically refer to any empanelled hospital/ diagnostic lab. It is the choice of beneficiary to undergo the treatment / investigations at any of the empanelled hospitals / diagnostic laboratories after obtaining permission from competent authority.CMO Incharge does not refer me to Pvt. Shri Ravi Kumar, representative of the authorized chemist, was advised to continue to ensure timely and correct supply of L P medicines and drugs to avoid inconvenience to CGHS beneficiaries. The e tendering process for Local supply of medicines and drugs is scheduled to be held on 01 April, 2013.Availability of Drugs in the WC:

As per records, there are 13 Generic items and 191 Proprietary items available in the WC. Amenities for the beneficiaries:

The CMO informed the members that as per the latest instructions from higher CGHS authorities, the timings of the CGHS Wellness Centers, w e f 01 April,2013 will be from 8.00 a .m to 3.00 p.m. with a lunch break of half an hour from 1.00.to 1.30 p.m.

The members wanted to know about the progress of empanelment of private hospitals and diagnostic centres especially for such important diagnostic tests as ECG, Echo, TMT and Holter etc. The CMO informed that till date no diagnostic center has been empanelled for these tests, however, as the

continued empanelment has been allowed by CGHS authorities, it is expected that the problem will be solved soon.

The CMO also intimated about a recent problem regarding treatment of cancer in private empanelled hospitals has crept up, where these hospitals are not entertaining our patients, who are issued the required medicines' from the CGHS dispensary, for chemotherapy.

The CMO also intimated that our Wellness Center has earned praise from the CGHS beneficiaries from other places also, as every effort is made to render best services to them , after verifying their identity and status through the computer network. Staff Punctuality & Behavior:

The conduct and behavior of the staff of the Wellness Center has been good. They are courteous and helpful to the senior/aged CGHS beneficiaries. Cleanliness & Maintenance of Wellness Centre: It was pointed out that due to the shortage of municipal water supply, and its stoppage for some hours in the day, the wellness center is facing problem in maintaining the cleanliness of the toilets for patients use in the later part of the day. In addition, the rush of large number of OPD patients at the Wellness Center continues to pose problem for proper maintenance and cleanliness of the Wellness Center. Add Director CGHS may look into the aspect of additional CGHS Wellness Center in the Chandigarh region at the earliest. Grievance Redressal:The complaint box was opened by Shri S R Bhardwaj, and two letters were found. One of the letters from Shri Santokh Singh praised the action of Mr Mohan Singh, a CGHS employee, for recovering his pack of medicines which he had inadvertently forgotten in the wellness center The second letter from one of the CGHS beneficiaries pointed out the unhealthy and poor condition of the toilets in Grover Eye Hospital, Sector 35 A Chandigarh, an empanelled eye hospital for CGHS beneficiaries. This was endorsed by Shri M S Toor, who had undergone eye cataract surgery in this hospital recently. The CMO undertook to take up the case with Add Director CGHS, Chandigarh for required action. *****

Dr. Ashwani Kumar Seniaray, CMO (NFSG) In-charge CGHS Wellness Center No 1, Welcomed the members of the Advisory Committee and gave a brief review on the working of CGHS. The members enquired about the status of Cardiology investigations ECG, Echo & TMT. The CMO incharge informed the members that the process of online tendering is underway. MRS status/Pendency of claims :

As per the information from AD CGHS office, Chandigarh, the Medical Reimbursement Bills of the CGHS pensioner beneficiaries have been cleared up to Feb 2013, and cheques are being dispatched. MRC bills for March 2013 are under process.Performance of Local Chemist :

Shri Raj Kumar, representative of the authorized chemist, was advised to continue to ensure timely and correct supply of L P medicines and drugs to avoid inconvenience to CGHS beneficiaries.

The CMO incharge informed the members that the process of online tendering for the appointment of new ALC is also underway. Availability of Drugs in the WC :

As per records, there are 12 Generic items and 177 Properietary items are available in the WC. The members suggested that the AD may be requested to expedite the process of supply of annual demand medicines through GSMD.Amenities for the beneficiaries :

The CMO informed the members that as per the latest instructions from higher CGHS authorities, the timings of the CGHS Wellness Centre is changed, to 8.00 a.m. to 3.00 p.m. with a lunch break of half and hour extension count er of teh CGHS wellness centre. Mr. Toor pointed out that, if according to the existing guidelines the serving employees of the covered area are add ed to the extension counter than the status will remain the same consequently more waiting time for the patients. Mr ML Pangotra pointed out that the waiting time for the patients to see the Doctor at wellness centre at present is 2 to 3 hours and suggested that more doctors and staff should be posted immediately to ease out the situation.

The members also suggested that the AD CGHS Chandigarh may be requested to freeze issuing of CGHS cards to the new applicants with immediate effect and should recommend for opening of new CGHS Wellness Centre with adequate staff to accommodate new members. This action will help to bring down the working pressure on the existing wellness Centre at sec 45 Chandigarh.Staff Punctuality & Behavior :

The conduct and behavior of the staff of the Wellness Center has been good. They are courteous and helpful to the senior/ aged CGHS beneficiaries.Cleanliness & Maintenance of Wellness Center : The wellness Centre is clean and well maintained. Grievance Redressal : The complaint box was opened by Sh. SR Bhardwaj, and a letter by RS Bhamra was found suggesting that the beneficiaries with basic pay of more than Rs. 35,000 should be allowed to attend directly the doctors of wellness centre. The CMO incharge informed the members that there is no such orders for preferential treatment on the basis of basic pay of the individual. However he can avail the benefit of senior citizens. Mr. Rajpal Sharma suggested that a meeting of the representatives of the empanelled hospitals should be arranged with the members of the advisory committee and the AD to disscuss the problems faced by the beneficiaries. Mr. Toor presented the grievance of Mr. BS Athwal regarding referral of his wife to Silver Oaks Hospital for investigations/emergency. It was informed by the CMO I/C to the members that In case of emergency the patient can go directly to the emergency of empanelled hospital and there is no need for prior permission. Further there is no provision of admission for investigations only. In this case the patient Mrs Amrik Kaur w/o Mr. Athwal was given permission for Medical consultation from Medical Specialist of SOH on 12.04.13 vide OPD referral no: 1473, which the patient didn't avail till 17.04.13 . The specialist of Max Hospital also didn't admit the patient till 17.04.13.

CCCGPA Letter to Kumari Selja Hon'ble Union Minster for opening of CGHS Dispensary at Panckhula

Sub : Opening of CGHS Wellness centre in Panchkula.

Respected Madam,

It is humbly submitted that all the Association's of Pensioners of Central Government residing in and round the Tri-city have submitted a number of requests for opening CGHS dispensary in Panchkula. The government of India has expressed its inability to meet our genuine demand due to financial constraints and shortage of Para-Medical staff. The reply of the Government of India has not been appreciated by the beneficiaries of CGHS and they feel that the Government is not considerate to mitigate the sufferings of CGHS beneficiaries and is ignoring the welfare of the senior citizens.

It is brought to your kind notice that the only one wellness center is operating in Sector - 45 Chandigarh. As per norms, 2000 cards justify to open a new CGHS wellness centre in a city, where as there are 8500 registered card-holders with more than 24000 beneficiaries in Chandigarh as on 31st March, 2013 and there is only one CGHS wellness centre. The number of patients visiting the wellness centre roughly ranging from 350 to 400 daily on average bases thus putting an enormous load on the existing dispensary

There are about 2000, beneficiaries of CGHS residing in Panchkula alone which justify independently CGHS dispensary. At present they have to shell out heavy amount of money as transport charges besides unbearable physical strain. Due to heavy rush of work, the 'wellness centre' is unable to supply the indented medicines the same or the next day. Indented medicine are normally supplied on teh third day. This causes a lot of inconveniences to the patients from Panchkula. Besides this, the wellness centre is so over-crowded that sometimes elder patients have to wait for hours before their turn comes for checking/investigation.

This state of affairs was brought to the notice of Sh. Pawan Kumar Bansal, Hon'ble Minister of Indian Railway Government of India with a request to take up the matter with health and family welfare Ministry . He was kind enough and recommended the opening of CGHS dispensary at Panchkula as a measure to give relief to the existing CGHS dispensary at Sector - 45, Chandigarh and assuring better health care for pensioners at Panchkula.

During the SCOVA meeting held on 19-02-2013 chaired by Sh. Naraina swamy, Hon'ble Minister of Pensioner & Pensioners Welfare Govt. of India. Mr. Rajpal Sharam SCOVA members from Chandigarh pleaded the opening of CGHS dispensary at Panchkula is imperative. He further requested that the Health Ministry and Family Welfare should open it under the arrangement of relocation as has been done in the case of Jammu, Bhopal, Shillong and some other stations. In the absence of any objection from official side, Sh. Naraina Swamy, Hon'ble Minister assured that the would take up this case with the Ministry of Health and Family Welfare.

In view of the position explained above, favourable recommendations of Sh. Pawan Kumar Bansal Hon'ble Union Minister of Railways and the assurance given by Sh. Naraina Swamy, Hon'ble Minister P & PW, this is the most opportune time for pursuing the case at your level for opening CGHS wellness centre at Panckhula. You are therefore requested to kindly take up the case with MOH & FW Govt. of India in consultation with Ministry of pension & Pensioners welfare which will definitely hasten the opening of CGHS wellness centre at Panchkula.

platform numbers and daily availability of seats.The Delhi division of Northern Railway has resumed its disabled Facebook page after Hindustan

Times in February published a report, “Flooded with complaints, railways logs off FB.”Passengers can get information regarding three railway stations in the Capital — Old Delhi,

Hazrat Nizamuddin and New Delhi.Divisional railway manager (Delhi) Anurag Sachan said, “Use of technology would provide

information conveniently and save time. Passengers should make maximum use of this facility.”“You must have a Facebook account. Type Delhi Division Northern Railway in the search box and

click “About”. You will see two addresses. The first link () will give information on arrival/ departure of trains and platform numbers,” he said.

“The second link () will have information on availability of seats/berths in all classes after the final charts have been prepared,” Sachan said.

First launched about two years ago on March 8, 2011, for passenger feedback and to ensure better facilities, the Facebook page had gradually become a one-way traffic. Faced with a barrage of complaints, the authorities stopped responding on the page.

A set of railway officials was supposed to update the page on an hourly basis. People uploaded pictures, shared links and posts. But the railway authorities cited “technical reasons” and “disabled” the page to avoid “negative publicity.”

“The daily footfall of passengers at railway stations in Delhi alone is 10 lakh. A lot of people these days use social media.

Timely intimation about payment of additional fee under RTI Act 2005Ministry of P, P G and P(Dept of P & T) O M F.No.12/31/2013-IR dated 11 Feb.2013Subject: Timely intimation about payment of additional fee under RTI Act 2005.It has been brought to the notice of the Central Information Commission that some CPIOs inform the information seeker about the additional fee under sub section 7(3) of the RTI Act at the fag end of the thirty days period prescribed for providing the information under sub-section 7(1) of the RTI Act.2. The Central Information Commission in one of its orders has mentioned that while there cannot be any hard and fast rule about when exactly the intimation about the photocopying charges should be conveyed to the information seeker, it is implied in the prescribed time limit that the demand for the photocopying charges must be made soon after the RTI application is received so that the information seeker has time to deposit the fees and receive the information within the prescribed thirty days period. If the information sought is not voluminous or is not dispersed over o large number of files, computation of the photocopying charges should not be a time consuming task. As soon as the RTI application is received, the holder of the information should decide about how much information to disclose and then calculate the photocopying charges so that the CPIO can immediately write to the information seeker demanding such fees.3. This may be brought to the notice of all concerned for compliance. *****

Guidelines for New Mobile ConnectionsDept of Telecom (DoT) has issued revised instructions to Cellular Mobile Telephone Service and Unified Access Services Licensees vide letter dated 09.08.2012 on verification of Mobile Subscribers after review of existing instructions. New instructions are aimed at improving customer verification compliance. These instructions inter-alia prescribe the following:(i) A passport size photograph should be pasted on the Customer Acquisition Form (CAF) and the documents as proof of identity and proof of address of the subscriber should be attached with the CAF.(ii) The person at the Point of Sale has to get the CAF duly filled and signed (in case of illiterate person thumb impression) by the subscriber with date. The authorized person at PoS has to record in the CAF

that he has seen the subscriber and matched the photograph attached on the CAF with the subscriber and verified his copies of documents of proof of address and proof of identity attached with the CAF with the original and has to put his signature on the CAF & all attached documents.(iii) The mobile connection is to be activated only after the requirement of filling up CAF and copies of documentary proof as per requirement have been fulfilled by the customer and the subscriber details have been updated in the subscriber database of the Licensee and the employee of licensee has verified the same.(iv) After activation of SIM also the subscriber is to be tele-verified by the Licensee.As far as retailers are concerned, they are contractors of the licensees and these instructions are not addressed to the retailers.The detai led instruct ions dated 09.08.2012 are avai lable at DoT websi te at

In these instructions, apart from the penalties prescribed in other instructions issued form time to time, the following additional provisions of penalty have inter-alia been made in these instructions:(i) In case, the Licensee fails to intimate about the disconnection to TERM Cell within 7 days of disconnection, a penalty of Rs. 3000/- per connection per week or part thereof shall be levied.(ii) If it is detected that the number was not actually disconnected on or before the date of confirmation/disconnection, then a penalty @ Rs. 1000 per day from the date of intimation to the Licensee to the date of actual disconnection shall be levied in addition to the penalty for non-disconnection.The following provisions have inter-alia been re-iterated in these instructions regarding point of sale/ franchiseorged document cases:(i) Police complaint/ FIR shall be lodged by the Point of Sale (PoS)/Franchisee against the subscriber in case forged documents are submitted by the subscriber and originals are also forged.(ii) Licensee shall lodge FIR/ Complaint against the subscriber and Franchisee/PoS in case of failure of PoS/Franchisee in lodging complaint/FIR against subscriber.(iii) The Licensee shall lodge the compliant / FIR against the Franchisee/ point of sale and financial penalty shall also be imposed in case forgery has been done by point of sale/ franchisee.(iv) In case action as above is not taken by the Licensee or Licensee itself is involved in forgery, Telecom Enforcement Resource & Monitoring (TERM) Cell of DoT shall lodge Complaint/ FIR against Licensee. Penalty shall also be imposed on all such forged cases.(v) Where it is found that the act of issuing connections was done by PoS using the document of some other subscriber or any person, or the documents were forged by the franchisee/PoS, the concerned PoS/franchisee may be terminated by the Licensee in addition to lodging of complaint / FIR against it. Other Licensees shall also terminate/ not appoint any such PoS.In the new instructions, some additional safeguards have been made in the interest of national security. As reported by CGEWHO Schemes are planned after conducting a demand survey and thereafter making attempts to acquire land from State Government Authorities. In case of non-availability of land from State Government Authorities, housing schemes are planned as turnkey projects wherein land is also provided by the construction agency.Hence no definite time frame can be planned for such housing schemes. Allotment of houses under each Scheme is made to eligible applicants after the draw. The specific allocation of dwelling unit number in a particular project is made at the time of the completion of the project. Allotment has been made in the following housing schemes:

CGEWHO housing Schemes are initially planned with an anticipation of getting the processes completed as per estimates and plan.However, prior permission has to be obtained from statutory municipal and development authorities and No Objection Certificates from related state departments like fire, airport, environment etc. before commencement of construction. Even after the completion of the works, the requisite completion/occupancy certificate from the statutory authorities and subsequent service connections viz. electricity, water, sewage etc. also get delayed which are beyond the control of CGEWHO.This was stated by Shri Ajay Maken, Minister of Housing & Poverty Alleviation in a written reply to a question in the Lok Sabha. ACTIVITIES OF AFFILIATED ASSOCIATIONS

PARAMILITARY FORCES RETIRED OFFICERS ASSOCIATION, CHANDIGARHth

Meeting of the association was held on 26 April, 2013 in the Station Officers Mess. CRPF Campus, Halomajra, Chandigarh (Airport Road), followed by lunch. The officers discussed various problems concerning pension and CGHS and healthcare. The officers were briefed about revision of

thpension as per Govt's Memo of 28 January, 2013 and revision of PPOs. The detail of the court cases filed by PMF officers regarding denial of NFU status to them was also discussed. It was intimated that six cases filed in this respect have been clubbed together and the judge had sought some info from the govt advocate at the time of its hearing on 23 April, 2013. Next date of hearing is scheduled for August, 2013.

Pensioners have been made to suffer over the past several years only on account of an illegal

and unjust “Clarificatory” order issued by the DOP&PW (vide OM dated 3-10-2008) – mis-

interpreting the decision of the Union Cabinet on Sixth Pay Commission recommendations vide

GOI Resolution published vide MOP (DOP&PW) No 38/37/08-P&PW (A) dated 29-8-2008.

2. a) The said order of DOP(P&PW) dated 3-10-2008, has since been quashed by as many as

11 (Eleven) different Benches of CAT as well as by Punjab & Haryan High Court (in 40 Cases

filed by different Applicants) - as per details in Annexure I submitted herewith.

2. b) Full Bench of Central Administrative Tribunal (CAT) Principal Bench New Delhi, had held

as under in OA 655-2010 decided on 1-11-2011,

30. In view of what has been stated above, we are of the view that the clarificatory OM dated 3.10.2008 and further OM dated 14.10.2008 (which is also based upon clarificatory OM dated 3.10.2008) and OM dated 11.02.2009, whereby representation was rejected by common order, are required to be quashed and set aside, which we accordingly do. Respondents are directed to re-fix the pension of all pre-2006 retirees w.e.f. 1.1.2006, based on the resolution dated 29.08.2008 and in the light of our observations made above. Let the respondents re-fix the pension and pay the arrears thereof within a period of 3 months from the date of receipt of a copy of this order. OAs are allowed in the aforesaid terms, with no order as to interest and costs.”

3. Petition of the Government of India (against the jugement of CAT New Delhi in OA 655 –

2010), has been “Dismissed” by a Division Bench of Delhi High Court in WP 1535 – 2012 vide its

judgement Dated 29-4-2013, where in Delhi High Court has upheld the said judgement of CAT

and has concurred with the Judgement of the Punjab and Haryana High Court in W.P.(C)

No.19641/2009 R.K.Aggarwal & Ors. Vs. State of Haryana & Ors. and has held as under:“8. We are in complete agreement with the reasoning of the Division Bench of the Punjab & Haryana High Court and adopt the same and do not burden ourselves any further. We conclude by noting that as regards the substance of the view taken by the Tribunal, even the Central Government accepts its correctness, but insists to make the same applicable prospectively. 9. The writ petitions are dismissed. The decision of the Full Bench of the Tribunal is upheld but without any order as to costs.”

4. With the above cited verdict of Delhi High Court, it is very clear that the pension has to be re-

fixed in accordance with Resolution dated 29-8-2008 w.e.f. 1-1-2006 as per the directive of

CAT.

5. MOP(DOP&PW) vide its OM No F.No.38/37/08-P&PW(A) dt 28.01.2013, had already

accepted the above principle prospectively from 24-9-2012, and ordered as under:

“2. --------- pension of pre-2006 pensioners as revised w.e.f. 1.1.2006 in terms of para 4.1 or para 4.2 of the aforesaid OM dated 1.9.2008, as amended from time to time, would be further stepped up to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the

Minutes of the CCC GPA Managig Committee meeting held on 21.03.2013 under the Chairmanship of Sh. M. L. Panghotra at Khukhrain Bhawan, Sector 45, Chandigarh

The list of the participants is as per attendance RegisterAt the outset Sh. M. L. Panghotra, Chairman CCCGPA welcomed representatives of all the

affiliated pensioner's associations with CCCGPA Chandigarh. He lauded the efforts made by the Secretary General and executive members for making the Pensioners's day a great success. He appreciated the contribution being made by the affiliated associations enabling Coordination committee to project the pensioner's burning problems to GOI for rederessal. The chairman informed the house that the reputation of CCC GPA is on the upward swing in the eyes of Ministry of (P & PW) which would further help us in getting our problems resolved Expeditiously. 2. Welcoming the participatnts, Raj Pal Sharma Secretary General CCCGPA who has attended many SCOVA meetings in teh past stated that SCOVA has been partially successful in achieving the aims & objects fro which it was created in 1986. Secretary General castigated the un helpful attitude of Serving Officers. He added that these officers should be considerate to the pensioners as they will also join the ranks of pensioners after retirement. While appreciating the efforts made by teh Department (P & PW) in coordinating with several other Ministers/Departments for redressal of pensioner's grievances, yet lot remains to be done, particularly by the concerned Ministries to whom the complaints are referred. He narrated with sense of dismay & disappointment as to how the finance Ministry GOI has been going all out for installing impediments in implementation of Honourable Courts Verdicts pronounced in favour of Pensioners.

There after, regular agenda of the meeting was taken up.1. Adoption of minuets of meeting held on 16.10.12

Secretary General read out the minutes of last CCCGPA Managing body held on 16.10.2012 to the house and the same were approved for adoption without any addition or alteration.

2. Opening of CGHS Dispensary at Panchkula. Secretary General informed that during the SCOVA Meeting held on 19.2.2013, this case was presented forcefully by him to MOS who chaired the meeting. After hearing the Secretary General, MOS (PP) decided that he would take up the matter with Ministery of Health and family for opening dispensary at Panchkula.

3. Empanelment of Hospitals & Diagnostic Centre at Chandigarh.Secretary General informed that the notification for revival of Continuous empanelment of Hospital & Diagnostic centre has been received by the Additional Director CGHS Chandigarh for implementation.

4. Enhancement of fixed Medical Allowance. Secretary General informed that this demand has been rejected at all available forums.

5. Extension of CSD facility to defence retired Personals.Secretary General informed that the Secretary (Pension) GOI desired during the SCOVA meeting held on 19.02.2013 that the issue being specific to the Ministry of Defenc, the SCOVA is not the correct forum to address these issues. In view of this item was closed. How-even, the Secretary General assured that CCCGPA will continue to pursue this case.

6. Extension of C.G.H.S. Membership to P & T Pensioners.Ministry of Health informed that extension of CGHS benefit to P & T Pensioners on payment of Subscription on yearly basis was allowed on the basis of Court decision. It would not be possible for them to extend the benefit of te Membership to such P & T pensioner Ministry of Health also mentioned that the problem will be solved to a large extent after the merger of 19 P & T dispensaries in 12 cities with C.G.H.S.

7. Anomaly in fixation of Pension of BSNL retires.Secretary General told that Department of Telecommunication informed that the order were issued on 27-09-2011 to the effect that the absorbees in BSNL are also entitled for minimum of pension at not less than 50% of the minimum of pay in the scale of pay held by them at the time of retirement. How-ever, the DOT is still getting representation from BSNL retire on this subject. The matter is under examination with DOT. It was decided that DOT will take final decision on the matter by 31st March 2013.

The item was discussed in SCOVA meeting held on 19.02.2013. It remained inclusive. 9. Copies of letters from Sh. P. S. Bedi to AS & DG.

Sh. P. S. Bedi Chairman Para Military association has sent representation to AS & DG CGHS for partial modification of instruction issued by teh Ministry of health family welfare vide there no. S. 11011/7/99-CGHS (P) dt. 27.04.2011. The copies of representation were distributed among the members attending the meeting who were asked to make representation on similar lines at their association level also. Secretary General informed the members the coordination committee will also take up the case with the Ministry of Health and family welfare Delhi.

10. Press Conference - Agitation ProgrammeAppreciating the efforts being made by CCCGPA for redressing the grievances of Pensions including the opening of new CGHS dispensaries one at Panchkula, Pensioner including the opening of new CGHS dispensaries one at Panchkula, Once at Chandigarh & One at Mohali, Sh Didar Singh of I.A. & AD suggested that CCC GPA should arrange holding of press conference followed by Agitation in support of Pensioner's demand. The suggestion was agreed to by the house.

11. Mr. Y.P. Doshi of I.A. & A.D. told that Reffel Hospital Panchkula has been recognized by MOH & FM GOI under CS (MA) Rules 1944. He suggested that case for cashless treatment to the central Govt. Pensioners may be taken with MOH. Which was agreed to.

12. Sh. M. S. Multani of I.A. & AD asked that CCCGPA should initiate the demand of One post/one pension on the similar lines of one Rank/one pension in defence. forces. The house agreed to take up the case with GOI.

13. Non-receipt of pensioners Co-coordinator "by Mohali Subscriber"Sh. M. S. Toor President Central Govt. Pensioners Society brought to the notice about unsatisfactory delivery to Copies of Pensioners Coordinator in Sector - 48 C, Puda Complex and Mohali residents. He demanded stream lining of dispatch system so that subscriber get it regularly and timely. The chairman informed the house that editorial board of pensioner's coordinator is seized of the situation and in fact have held two meetings in the recent past and with the implementation of the decision taken, the system of receipt and dispatch has shown a remarkable progress. However efforts are on foot to bring such complaints to the minimum possible level.

The Meeting ended with a vote of thanks to the chair.

Government of India issued orders sanctioning 8% additional Dearness Relief to Central Government Pensioners w.e.f., 1.1.2013. With this, DA/DR has gone up to 80%. While some banks have paid the additional DR with arrears, other banks are in the process of drawing the same.

The modified parity case had came up for hearing in the Delhi High Court on 29.4.2013. The court upheld the Order dated 1.11.2011 of CAT, Principal Bench, New Delhi. Now arrears have to be paid w.e.f., 1.1.2006 to all eligible pre 1.1.2006 pensioners and family pensioners. Government’s Orders in the above regard are expected shortly. Paras 8 and 9 of the judgment dated 29.4.2013 are reproduced below for information:

‘8. We are in complete agreement with the reasoning of the Division Bench of Punjab and Haryana High Court and adopt the same and don’t burden ourselves any further. We conclude by noting that as regards the substance of view taken by the Tribunal, even the Central Government accepts its correctness but insists to make the same applicable prospectively.

9. The Writ Petitions are dismissed. The decision of the Full Bench of the Tribunal is upheld but without any order as to costs’.

The managing committee of Bharat Pensioners Samaj met at New Delhi on 14.4.2013. The Samaj decided to file a case shortly in an appropriate Court/Tribunal in respect of extension of same fitment benefit/application of one and the same factor for revision of pension to all pre 1.1.2006 pensioners and family pensioners. The Managing Committee authorized the Secretary General to take necessary steps in this regard.

The Managing Committee also took note of the fact that while implementing modified parity under V CPC as well as under VI CPC, Government of India have not taken into consideration improved grades and higher grade pays implemented w.e.f., 1.1.96 and 1.1.2006 for purpose of modified parity to those who retired prior to these dates in the same posts saying that they were upgraded posts and upgraded grade pays. For instance, the IV CPC scale of Rs. 1400 – 2300 was replaced by the scale of Rs. 5000 – 8000 w.e.f., 1.1.96 for several categories in railways and those in this higher grade were brought under PB 2 with grade pay of Rs.4200 w.e.f., 1.1.2006. However those who retired prior to 1.1.96 in the same post were treated as having retired in scale of Rs.4500 – 7000 and accordingly modified parity was implemented in their case. Due to this, they were brought under PB 1 with grade pay of Rs.2800 w.e.f., 1.1.2006. Similarly in the case of several categories of retired staff, improved grades and higher grade pays have not been extended for modified parity. As a result, many pre-1.1.96 and pre-1.1.2006 pensioners and family pensioners have been lagging behind those who retired in the same posts after 1.1.96 and 1.1.2006. Thus a serious imbalance has been created between pre and post 1.1.96 and between pre and post 1.1.2006 pensioners and family pensioners. Unless this imbalance is rectified, those who retired prior to 1.1.96 and 1.1.2006 will continue to suffer forever with lesser pensions and family pensions. Bharat Pensioners Samaj is contemplating to take the matter to an appropriate court of law to have the above imbalance rectified.

The Managing Committee of BPS has also decided in its above meeting to hold its 58th Annual Conference on 17th November 2013 at Hyderabad. This meeting will take place at a crucial juncture as the general elections to Lok Sabha will be only a few months away. As per the prevailing political situation in the country, the above elections may be advanced by a few months. In such a scenario, we have to raise our voice in a big way in favour of all our outstanding demands such as 50% DR merger, appointment of VII CPC, raising of fixed medical allowance to Rs1200 pm, raising of rates of pension and family pension, additional pension from 65 years of age onwards, restoration of commuted portion of pension after 12 years, extension of new benefits of VI CPC to past pensioners also, extension of CS(MA) rules to pensioners residing in non-CGHS areas, CSD canteen facility to defence civilian pensioners, issue of smart cards to RELHS beneficiaries throughout the country covering all chronic diseases, removal of distance restrictions for grant of FMA, extension of RELHS to secondary family pensioners, liberalization of RC pass rules, revision of ex-gratia rates of PPF/SRPF beneficiaries and

their families, etc.

It is indeed very difficult, nay impossible for pensioners and family pensioners to make their ends meet in the context of spiraling inflation and ever rising prices of essential commodities without the government taking early steps to meet our just demands. Unless we, pensioners, put across our demands more effectively, we will not be able to get justice at the hands of the government. It is therefore time for all central government pensioners and their organizations to come together and raise their united voice. It will be the endeavor of Bharat Pensioners Samaj to bring together all pensioners organizations in the common cause. We appeal to our members to extend their full cooperation and support to make the 58th annual conference of BPS a unique one in all respects

DIVORCED WOMEN ENTITLED TO FAMILY PENSION (Supreme Court judgment in SLP © No. 11800 of 2013 arising out of C.C. No.1297 of 2012)The Hon’ble Supreme Court ruled in the above case that a divorced woman is entitled to monthly maintenance even if she has accepted one time permanent alimony under agreement to forego this right, she is entitled to family pension after the death of the ex-husband. The apex court ruled ‘it is incumbent on the government of India, Ministry of Defence, PCDA and Air force authorities to reinstate her right of family pension which will function as maintenance from the dead husband. Pension rules to be changed to cater to such situations’.

CONCESSION TELEPHONE FACILITY TO POSTAL PENSIONERS WHO RETIRED WITH 20 YEARS OF SERVICE AS ON 1.4.1985: CAT/Principal Bench/New Delhi, in their Order dated 31.1.2013 in OA No.16216/2013 – CAT/PB/New Delhi upheld the claim of petitioners for the above facility and directed the concerned authorities to provide the above facility to them within 2 months.

REVISION OF PPOs OF PRE-2006 PENSIONERS AND FAMILY PENSIONERS – UPDATING ESSENTIAL INFORMATION: Department of pension and pensioners’ welfare, government of India, New Delhi in their letter No. 55/44/2012 – P&PW© dated 7.3.2013 had stressed the need to expedite issue of revised PPOs to pre-2006 pensioners and family pensioners updating information. Those pre-2006 pensioners and family pensioners who have not revised their PPOs so far may please approach their pension sanctioning authorities for the above. For change of date of birth/age of family pensioner also, respective pension sanctioning authorities may be approached with documentary proof.

Lie that Saves CHENNAI : Honesty is said to be the best policy, but is it always necessary to be truthful? Or are there

times when a little dishonesty is necessary? How do we decide when to be honest and when to speak an

untruth?

That which does not harm anyone is what needs to be said. If the truth is likely to hurt someone

or harm someone, it would be better to utter false-hood than to be truthful. The lie that saves is better

than the truth that kills, Suki Sivam said in a discourse. He went on to give an example to show how a lie

can save.

A tree and a vine

There was a man who was ill and in hospital . As he lay on the bed, he looked out of a window. All

he could see was a tree and a vine that twisted itself around the tree.

The vine was shedding its leaves, and to the patient, it seemed to mirror his own condition. As

the vine was shedding one leaf after another and was withering away, so was his life ebbing.

The patient felt that just as the vine was dying, so as each day passed, he was nearing death.

The left him depressed. and this depressed state of mind was impeding his recovery.

The patient's friend, who visited him in hospital, was worried that the man would never recover.

The vine kept shedding leaves and was left with just one leaf, and the patient thought that if that

leaf fell, that would be the end of his life. And so he went to sleep in a disturbed state of mind.

Dramatic recovery

The next morning, he woke up and saw the leaf still on the vine, and was relieved. The leaf

stayed on, and from then on, the man's recovery was dramatic, But the truth of the matter was that what

the man saw was not a real leaf at all.

His friend, who had visited him, was an artist. The artist, in order to save his friend's life, had

stayed up the whole night and painted a leaf on the tree trun, making it appear that the vine hadn't shed

its last leaf.

Thus, the illusion that the artist created saved the patient's life. It was deception, but it was a

deception that saved a life.

ONE - FIFTH OF INDIA'S ELDERLY ABUSED AT HOME

More then one-fifth of the elderly across India - 23% said they experienced abuse, a survey by NGO

Help Age India has revealed.

But the good thing is: It is significantly lower from a similar survey in 2012 that showed 31% of

senior citizens had reported abuse_disrespect, verbal abuse, neglect and beating/slapping.

The findings were part of Help Age India's report 'Elder Abuse in India 2013' released on Friday,

on the eve of World Elder Abuse Awareness Day on Saturday.

Nationally, daughters - in - law were the primary perpetrators of abuse (39%) followed by sons

(38%). In tier-2 cities, a disturbing fact emerged that 17% respondents faced abuse at the hands of their

daughters.

The "2013 survey was conducted in 24 cities across 20 states involving 6,548 respondents

above 60 years of age. India has an estimated 100 million senior citizens and their number is expected

to increase to 315 million by 2050.

PERI SCOPE

A TOP- level meeting, chaired by Defence Minister A. K. Antony and attended by all

three service chiefs among others, decided on Friday to forward the rank pay matter to

the office of the country's top law officer, attorney general (AG).

While the Ministry of defence (MoD) sees this as a step towards resolution of the

issue, the armed forces and the veteran community have expressed their frustration over

'buck-passing'.

An Mod official said. "The meeting was convened after it was pointed out that

there were differences between what the Supreme Court ordered and our implementing

order. It was unanimously decided at the meet to forward the file to AG, who is the best

suited to clarify legal positions."

The move had Antony's personal push as "he is keen to sort this out" the official

added. Sources in the MoD said that apart from what will be conveyed to the AG by the

ministry, the uniformed services represented by the Integrated Defence Staff

headquarters were being advised to forward their own representation to the law officer so

as to put up the case in the best possible way.

However, the development has cut no ice with the veteran community which has

branded it as yet another 'delaying tactic' by the MoD The genesis of the controversy lies

in the MoD's selective implementation of the SC order of September 2012 in the rank pay

case. "The ministry has not won a single case (in this connection) be it in the Kerala High

Court or the Supreme Court..Today, they feel the need to go to the AG to interpret the SC

order! This issue is not about legal clarification at all," fumed SC advocate, Group

Captain (Retd.) K. S. Bhati, who has been fighting this case for the Retired Defence

Officers Association (RDOA).

The organisation said Friday's move will "Further strengthen our resolve in taking

MoD babus to the court over contempt."
