A nother busy month has passed and we now head into what is our busiest time of year.
At the time of writing this article, 356 new metropolitan and urban licences had been issued by the Taxi Services Commission.
This trend is concerning and if it continues at this rate the industry, the government and taxi users could face significant challenges.
Two marketsare at play

Taxi Services Commissioner Graeme Samuel was reported in The Age newspaper as say-ing this growth was not a concern. In the ar-ticle published on 15 August he stated that “the market was ‘working perfectly’, dismiss-ing predictions taxi numbers will soon soar.” He went on to say that, “I can’t imagine there is going to be 255 new taxis on the road, the market would say that doesn’t make a hell of a lot of sense, but we’ll see about that”.
Suffice to say the VTA does not share the view of Mr Samuel on this occasion.
What many seem to fail to understand is that there are two markets at play - one is for the provision of taxi services and one is for access to taxi licences.
Perhaps the taxi licence one is ‘working per-fectly’ but the taxi service one is not because supply is overtaking demand at a rapid pace. Despite how I have described it, it is impossi-ble to divorce the two markets. In my view, this is a clear market failure and demonstrates why licence regulation is required.
What we always argued is, you need to link these two markets by increasing supply of li-cences only in proportion to increases in de-mand for services. This would help address the market failure and build a stronger relation-ship between supply and demand.
Unfortunately, due to the failure the market is unable to achieve this equilibrium.
Further to Mr Samuel’s comment that there won’t be additional licences on the road - so what will happen to the additional licences?
Will they simply disappear? No, of course not because they still have a value. Their value is the return they derive via the leasing of the li-cence or the operation of the licence.
The licence holder will have to make a deci-sion, lower their price as Mr Samuel suggests (in which case they will remain on the road), or operate and drive the vehicle themselves (in which case they remain on the road).
Two other matters which continue to be front
of mind are the Knowledge test and the 45/55 split.
To the latter first, the VTA have commissioned an accountancy firm to do audits of operator businesses across the state. This information will be presented to the TSC and the Minister so an informed decision can be made about this policy setting. While we happily accept that driver earnings need to improve, if gov-ernment choose to intervene as they have, it is their responsibility to ensure an appropriate balance is struck.
In relation to the Knowledge test, the high fail-ure rate is obviously a key concern. We accept that training will need to change to meet the new requirements, however, flatly reject the notion that the only reason for the high failure rate is due to poor training. Given the majority of those who sit the test have not undertaken the training this is clearly not the case.
The VTA will embark on a significant cam-paign over the coming weeks and months to promote the need to do training before sitting the test - it is extremely unlikely people will be simply able to rock up off the street and pass the test.
We have also asked the TSC to look at some process issues around the test which they have started to do. At the end of the day, mak-ing derogatory comments in the media about the quality of training and avoiding any re-sponsibility for the problem will not resolve the issue.
Finally, the VTA model bailment agreement is now complete and available on our website. I highly recommend you use it and, as always, cannot impress the importance for divers and operators to have a written agreement that clearly sets out rights and responsibilities.

To help meet passenger demand, peak service taxis will be authorised to operate additional hours during this cruise ship season, which begins 7 October 2014.

On the dates contained in the cruise shipping schedule, metropolitan peak service taxis are authorised to oper-ate for the carriage of passengers from the Station Pier precinct, Port Melbourne between the hours of 7.00 am and 3.00 pm.
All taxi drivers are encourages to support and service this growing tourism market. Taxis can access Station Pier for passenger drop off and collection from the managed taxi rank once security has undertaken a quick identification check.
The VTA research conducted prior to the fare increase earlier this year, showed that the average fare for trips taken by cruise ship passengers was over $50. D
VTA MODEL bailment agreement
The VTA’s model bailment agreement has been finalised and is now available on their website - www.victaxi.com.au.The model agreement complies with all implied conditions and contains clauses about common operational arrangements.
The VTA has kept the agreement as simple as possible, with minimal input required from parties to the agreement. Sched-ule 3 to the agreement allows Permit Holders and Drivers to agree to additional terms or vary any of the standard terms.
The VTA strongly encourages everyone to ensure they have a written bailment agreement in place to protect all parties inter-ests. D

Spain Hundreds of taxi drivers went on strike in June, protesting the unregulated pri-vate service that was taking their busi-ness.
India“According to the Economic Times, three Uber competitors — Meru Cabs, Easy Cab, and Mega Cab — have writ-ten to the Reserve Bank of India, com-plaining that Uber is violating foreign-exchange laws.”
Brazil Uber might face legal problems if the government of Sao Paulo pushes for the suspension of its service. For ex-ample, a few weeks ago “three cars were found providing services through Uber in Sao Paulo and the drivers had to pay fines of $900 on average.”
VancouverThe city attorney claims that the service is illegal: “Though the me-ter UberX uses does not look like a traditional taxi meter that measures time and distance as the ride pro-gresses, it still fits within the definition of (a) taxi meter [under city code].”
United StatesThe taxi lobbies are putting enor-mous pressure on local govern-ments to block Uber in their cit-ies. In Milwaukee, five taxi groups are “suing the city of Milwaukee, hoping to block an ordinance that provides a path to legalization for mobile ride-booking apps.” In Cali-fornia, New York and DC, Uber has faced numerous cease-and-desist orders. The 2014 Gertrude Street Projection Festival is celebrating its
seventh year of staging inner Melbourne’s most visible and
accessible free large scale arts festival.

The metro taxi licence average price of $286,563 is based on the 8 genuine market based transactions that occurred in the metropolitan zone during August 2014.The Taxi Services Commission’s standard practice is to only count those licence transfers where a genuine market based transaction has occurred. They do this by applying a number of standard business rules. The aim of these business rules is to identify genuine market based transfers of taxi licences and to base average price calculations on these transactions only.
Therefore, where it appears a non-market based licence transfer has occurred, these transactions are excluded in the calculation of licence values. An example is where a licence holder transfers the licence to a new business name but still retains ownership of the licence. D

AFRICA In Kinshasa, the capital of DR Congo, there is no maximum number of passengers allowed. As long as the taxi can drive, everything is allowed on board that won’t fly off. Scenes like this are not only common in Africa, but also in Asia, where for many people shared taxis are the only way to cover long distances. D
DUBAI The 14 kilometre Dubai Creek divides the city with two million residents into two districts. Since there aren’t many bridges, water taxis come in handy. Only small wooden boats, which carry up to 20 people and are known as abras, are permitted on the creek. A one-way trip costs 0.22 euros (US$0.30), making it the cheapest taxi in the world. D
THAILAND A taxi ride in Thailand can be an adventure. Getting into a tuk tuk - a three-wheeled moped - requires strong nerves and a calm stomach. It’s much more comfortable to take a four-wheeled sedan. And, did you know that monks in Thailand have special status and can ride for free? D
VENICE is famously crisscrossed with canals rather than streets of asphalt. Motorized taxi boats may be commonplace, but true romantics continue to choose the old-fashioned gondolas, hoping the gondolier will serenade them on their journey. Careful, though. Network services and your taxi
From 30 June 2014, a number of amendments to the Transport (Compliance and Miscellaneous) Act 1983 and associated regulations took effect. As a result, permit holders now have more flexibility in accessing network services.
Traditionally in Victoria, each taxi has been ‘affiliated’ with an organisation known in the past as a Depot or a Network Service Provider, and now known as a Taxi Booking Service. This arrangement was generally understood to be compulsory and exclusive.
The regulations administered by the Taxi Services Commission (TSC) now support alternatives to the traditional ‘affiliation’ arrangement.
The TSC encourages Permit Holders to consider their options and obligations for the agreements they enter into with Taxi Booking Services.
Guidance notes in relation to network services are now available on the TSC website <www.taxi.vic.gov.au>. D

The Knowledge test is now the method for accrediting metropolitan and urban taxi drivers, including some drivers upon renewal of their accreditation.
Drivers who have been accredited for less than five years continuously before their renewal is due are re-quired to complete modules of the Knowledge test to keep driving in certain zones.
Renewing taxi drivers in the Melbourne metropolitan zone will need to pass the Geographical Assessment and Driver Behaviour modules of the Knowledge test.
Urban zone drivers must pass the Driver Behaviour module.
Until 31 December 2014, driver accreditations due for renewal in the metropolitan and urban zones will be renewed for a further nine months.
From 1 January 2015, drivers who do not successfully complete the Knowledge modules by the required time will no longer be able to drive a taxi or hire car in zones that require the Knowledge.
They will be able to continue driving in zones where Knowledge competency is not required.

Melbourne Airport update
Price notification
Several country and regional Taxi Permit Holders have chosen to price notify since the introduction of the sys-tem on 30 June this year.
Price notification allows country and regional Taxi Per-mit Holders to set their own fares in accordance with the needs of their passengers and the costs faced in running a taxi business in these areas.
A list of Permit Holders who have price notified can be found on the Taxi Services Commission website <www.taxi.vic.gov.au>. You can search by Permit Holder in the search bar on the notified fares page to see the fare structures these permit holders have chosen to implement.
A new integrated ground transport hub will be built at Melbourne Airport on Service Road North, between Grants Road and Departure Drive. The transport hub will create a pick-up and drop-off zone for vehicles including taxis, buses, and private and rental cars.
The project team continues to work with stakeholders to minimise impacts as the airport continues operat-ing around it. The project is due to be completed in early 2016. D

Those wanting to drive a metropolitan or ur-ban taxi, or a metropolitan hire car needed to pass the Knowledge to become an accred-ited driver.
The Knowledge consists of three modules – general assessment, driver behaviour and a geographical assessment.
Following monitoring of the test and feedback received by the industry, the TSC is in the pro-cess of developing a new standalone module specifically for hire car drivers (Metropolitan Hire Car Knowledge module).
It is anticipated that the new module will be introduced in late 2014.
In the meantime, transitional arrangements are now in place for drivers wanting only to apply for hire car accreditation.

From 15 September 2014, new applicants will not have to sit the Knowledge test, but will need to:
• hold a full and current Victorian driver licence
• have held a full and current driver licence in an Aus-tralian state or territory or in New Zealand for a mini-mum period of six months
• apply for a National Police Certificate
• complete an Application for accreditation to drive a commercial passenger vehicle and private bus form
• have a doctor complete the medical section of the form.
If granted, new hire car accreditation will be issued for a maximum of nine months.
The new metropolitan hire car module must be completed within nine months, in order to retain the ability to drive a metropolitan hire car. D

Spring time bringssneezes and snifflesThe correct name for hay fever is seasonal allergic rhinitis. Even though it was known that pollen rather than hay was the cause as far back as the early 1800s, the term hay fever is still frequently used.

Allergic rhinitis symptoms are caused by the body’s immune response to in-haled pollen, resulting in chronic inflammation of the eyes and nasal passages. Symptoms include runny nose, itching, nasal congestion, irritable and watery red eyes, and itchy ears, throat and palate.
• Allergic rhinitis affects 1 in 5 Australians
• Allergic rhinitis predisposes people to more frequent sinus infections
• People with allergic rhinitis can get tired and run down due to poor quality sleep
• Severe allergic rhinitis impairs learning and performance in children, re-sults in more frequent absenteeism in adults and reduced productivity
• Allergic rhinitis makes asthma more difficult to control
• Pollen can also trigger asthma
Some people with severe allergic rhinitis (hay fever) think that their allergic rhi-nitis turns into asthma or will make them tight in the chest or wheeze. However, pollen can directly trigger asthma as well as allergic rhinitis (hay fever). Small particles containing allergen can penetrate deep into the airways of the lung. Thunderstorms can also contribute to this - when pollen granules come into contact with water, starch granules are released that are small enough to be breathed into the airways, causing allergic rhinitis and asthma in some people.
In Australia pollen numbers are lower on the east coast where the prevailing winds come from the sea and where there is protection from westerly winds by the Great Dividing Range. Pollen numbers are higher on the Victorian south coast because the prevailing winds are from the north carrying pollen from the northerly grasslands. In South Australia and Western Australia, the concentration of pollen can vary according to the prevailing winds.
Allergenic grasses in the southern part of Australia are mostly Northern hemi-sphere grasses, with the main flowering period in October - December.
Wattle is frequently blamed for early spring symptoms but allergy tests (skin prick tests) seldom confirm that Wattle is the true culprit. There are many spe-cies of Casuarina or Australian Oak trees, which produce pollen throughout the year and may cause allergic rhinitis (hay fever) symptoms at any time of the year.

Tips for reducing pollen exposure• Stay indoors until after midday (if possible). This will reduce your exposure. Try to avoid going out on
windy days or after thunderstorms.
• Wear sun glasses to protect your eyes.
• Do not mow the grass, and stay inside when it is being mown. Wear a mask when mowing
• Keep windows closed both at home and particularly when in your car (and where possible use recirculating air conditioning in your car).
• Do not picnic in parks or in the country during the pollen season.
• If you are sensitive to particular weeds or trees around your home, have them removed.
• Shower when you arrive home and bathe your eyes frequently with a wet washer.
Seek advice from your pharmacist or doctor about medications or treatments that will relieve your symptoms. Although drugs do not cure allergies, the medicines available for treatment are much more effective with fewer side effects than those available 20 years ago. D

Stop. Think.Respect.beyondblue’s new national anti-discrimination campaign highlights the impact of racism on the social and emotional wellbeing of Aboriginal and Torres Strait Islander people. Research shows that subtle or ‘casual’ racism can be just as harmful as more overt forms. Imagine being judged in a job interview by the colour of your skin, rather than the strength of your CV. How would you feel if you were watched in a shop or treated differently on public transport?
Why should anyone be made to feel like crap, just for being who they are?
beyondblue’s The Invisible Discriminator campaign has gone viral, with its centrepiece video notching up more than 1 million YouTube views since launching three weeks ago.
The clip depicts non-Indigenous Australians engaging in acts of subtle racism, such as avoiding Indigenous Australians or treating them with suspicion. Its aim is to show the devastating psychological impact that all forms of racism have on Aboriginal and Torres Strait Islander people.
beyondblue CEO Georgie Harman said the video’s popularity highlighted the need for the campaign and showed that Australians are often surprised by the ef-fects of subtle racism on mental health.
“This is an Australian-first campaign and the response to it has been overwhelmingly positive,” she said. “We are grateful that so many Australians have liked, shared and watched this video because we know that racial discrimination continues to fuel the tragic statis-tics around Aboriginal and Torres Strait Islander health and wellbeing. This includes the fact that Indigenous people are twice as likely to die by suicide as non-In-digenous Australians and almost three times as likely to be psychologically distressed.
“We launched The Invisible Discriminator because of-ten when people engage in subtle racism they don’t
realise how harmful it is. Racism, whether it’s subtle or overt, is still racism and it ruins lives. Just like other form of discrimination, it leads to distress, that in turn can lead to depression and anxiety. Research com-missioned by beyondblue shows that many non-Indig-enous Australians still engage in racist acts towards Indigenous people, but I believe this campaign’s mes-sages along with the reaction it’s getting means we are on to something here.”
Shortened versions of the YouTube video have been broadcast on national television and the campaign has also featured on digital media.
The video’s popularity on YouTube means that, once combined with views from Facebook and through dig-ital advertising, it has been seen online by more than 2 million people.

We offer the purity of tradition as well as the boldness of the contemporary. “Melbourne Festival is founded in partnerships with many wonderful colleague organisations. In 2014, almost all involve international collaborations of some sort, providing invaluable opportunities to artists of today and tomorrow, ensuring that the Festival’s impact is not over in 17 days.” The 29th Melbourne Festival shines a spotlight on a new world of global circus -‐ an incredibly fast-‐changing art form that has a particular relevance to Melbourne. The program features companies from Europe, North America, Asia and Australia: Cirque Eloize, Nanjing Acrobatic Troupe, Circa, NICA, Flying Fruit Fly Circus, Dislocate, D’Irque & Fien and Circus Oz. Audiences will be astounded by European artistic legend, Heiner Goebbels’ When the Mountain Changed Its Clothing, an epic-‐scale production featuring 40 teenage girls from Slovenia; along with Carsten Holler’s spectacular, life-‐size Golden Mirror Carousel; and can embrace a residency from the UK’s Aurora Orchestra – one of the most exciting outfits in modern classical music. The Festival hosts a retrospective of revolutionary New York choreographer Trisha Brown, who retired in 2012. From All Angles highlights the searching intelligence of Trisha Brown’s work and the impact of her practice, with performances of 18 works from 1973 to 2011, the year she created her last pieces.
Music lovers are spoiled for choice with an exclusive concert from legendary techno producer and DJ Jeff Mills and a 60-‐piece orchestra; Greek superstar Mihalis Hatzigiannis performs with the MSO in an outdoor concert at the Bowl; award-‐winning composer Clint Mansell will perform a sweeping retrospective of his film compositions; Irish-‐American supergroup The Gloaming play their Australian premiere performance at Hamer Hall; Grammy Award-‐winning guitarist, Pat Metheny; and the second year of the Hadyn for Everyone program, including the much-‐loved Quartets at Sunset series.

ASSAULT IN ST KILDA The man was at a bar on Acland Street when a fight broke out on the dance floor and he hit the other man with a glass around 2am on 10 August 2014. He was last seen walking along Barkly Street towards Carlisle Street.
The man is described as Southern European in appear-ance, approximately 165cm to 175cm tall, unshaven and was wearing a white singlet, black shirt and dark coloured jeans.
Police have released images of a man whom they be-lieve may be able to assist them in their enquiries.
