    HISTORICAL BACKGROUNDRepublic Act No. 3931 was signed into law on June 18, 1964 to create the National Water and Air Pollution Control Commission to implement that States environmental policy to maintain a reasonable standard for the air and water quality of the country Industrial development began to accelerate in the early 60s, however, pollution became a concomitant problem, particularly in the Greater Manila Area.

  • P.D. 984 POLLUTION CONTROL LAWHISTORICAL BACKGROUNDOn August 18, 1976, R.A 3931 was revised by P.D. 984 reorganizing the Commission from a multi-headed to a single-headed agency and to make the National Pollution Control Commission more effective and efficient in the discharge of its functions and more responsive to the demands of the times occasioned by the accelerative phase of the countrys industrialization program.P.D. 984 transferred the Commission from NSDB (National Science Development Board) to the Office of the President.

  • P.D. 984 POLLUTION CONTROL LAWSECTION 6 : Powers and FunctionsSalient power and functions of the Commission: Determine the location and magnitude of pollutionDevelop comprehensive multi-year and annual reports. Submit 60 days after year-end and annual report to the President.Set-up effluent, stream, ambient and emission standards and promulgate rules and regulations.Issue orders or decisions to compel compliance with the provisions and its IRR only after proper notice and hearing.Issue, renew, or deny permits. The Commission may impose fees or charges for the issuance or renewal of permit.Serve as arbitrator for the determination of reparations, or restitution of the damages and losses resulting from pollution.Consult, participate, cooperate and enter into agreement with other agencies of the government, and with affected political groups, political subdivisions, and enterprises in the furtherance of the purpose of this Decree.

  • P.D. 984 POLLUTION CONTROL LAWSECTION 7 (a) : Public HearingPublic hearings shall be conducted by the Commissioner, Deputy Commissioners or any senior official duly designated by the Commissioner prior to issuance or promulgation of any order or decision by the Commissioner requiring the discontinuance of discharge of sewage, industrial wastes or other wastes into the water, air or land resources of the Philippines.SECTION 7 (b) : Appeals to CourtAny decision of the Commission, in the absence of an appeal therefrom as herein provided, shall be final 15 days after the date of notification, and judicial review thereof shall be permitted only after any party claiming to be aggrieved thereby has exhausted the remedies before the Commission. The Commission shall be deemed to be a party to any judicial action involving any decision.

  • P.D. 984 POLLUTION CONTROL LAWAny person found violating or failing to comply with any order, decision or regulation of the Commission for the control or abatement of pollution shall pay a fine not exceeding five thousand pesos per day for every day during which such violation or default continues; and the Commission is hereby authorized and empowered to impose the fine after due notice and hearing.
