S. R. O. No. 254/2017.—In exercise of the powers conferred byclause (b) of sub-section (1) of section 3 of the Minimum Wages Act,1948 (Central Act 11 of 1948) read with sub-section (2) of section 5thereof and in supersession of the Notification issued under G.O. (Rt.)No. 2697/2008/LBR dated 20th October, 2008 and published asS.R.O. No. 1120/2008 in the Kerala Gazette Extraordinary No. 2378dated 3rd November, 2008, the Government of Kerala after considering the

8objections and suggestions received on the draft proposal published as perNotification No. 20326/E1/2015/LBR dated 14th January, 2016, in theKerala Gazette Extraordinary No. 193 dated 27th January, 2016, asrequired under clause (b) of sub-section (1) of section 5 of the said Actand after consultation with the Minimum Wages Advisory Boardconstituted under section 7 of the said Act, hereby revise the minimumrates of wages payable to the employees employed in the Oil Mills sectorin the State of Kerala as specified in the Schedule hereto annexed and fixthe date of publication of this notification in the Gazette as the date onwhich the revised rates shall come into force.

Dearness AllowanceIn addition to the basic wages, all the time-rated workers and the

Tinkers and Coopers included among the Piece-rated workers and all themonthly rated employees and office staff included in Category I, II and IIIare to be paid Dearness Allowance on the basis of the Consumer PriceIndex numbers for the month concerned in the new series, ie.,1998-99=100, published by the Department of Economics and Statistics,Government of Kerala for the district headquarters concerned at thefollowing rates:

(1) For the time-rated and piece-rated workmen at the rate of onerupee per one point per day in excess of 250 points excludingthe sweeper (Part-time).

(2) For the monthly paid staff and workmen at the rate of ` 26 perone point per month in excess of 250 points.

Note:—Dearness Allowance shall be paid in Wayanad District based onthe Consumer Price Index Numbers published for MeppadiCentre and in Idukki District based on the Consumer Price IndexNumbers published for Munnar Centre.

Service weightage

All the categories of workmen (including office staff) who havecompleted not less than three years continuous service in any establishmentor under an employer as on the date of commencement of the finalnotification are entitled to get service weightage included in their basicwages at the rate of one per cent of the revised basic wages for everycompleted year of service subject to a maximum of ten per cent.

Bata for night shift

A minimum rate of ` 20 in addition to the wages may be paid for allcategories of workers who have to work during night.

Calculation of daily/monthly wages

The monthly wages for categories in respect of which the dailywages have been fixed shall be calculated by multiplying daily wage ofthe respective category by twenty six and the daily wages for categoriesin respect of which monthly wages have been fixed shall be calculated bydividing the monthly wages by twenty six.

Higher wages

In case the employees working in any establishment/oil mill areactually in receipt of higher wages than the revised minimum wages, theyshall be entitled to get the benefit of such higher wages continuously.

Government have fixed the minimum rates of wages payable to theemployees employed in the Oil Mills sector in the State of Kerala as perNotification issued under G. O. (Rt.) No. 2697/2008/LBRdated 20th October, 2008 and published as S.R.O. No. 1120/2008 in theKerala Gazette Extraordinary No. 2378 dated 3rd November, 2008.Government have now decided to revise the existing minimum rates ofwages in the said industry after considering objections and suggestions onthe draft proposal published as per Notification No. 20326/E1/2015/LBRdated 14th January, 2016, in the Kerala Gazette Extraordinary No. 193dated 27th January, 2016, and after considering the advice of the MinimumWages Advisory Board constituted for this purpose.

The notification is intended to achieve the above object.
