Paul Barton

A business delivering complex projects which included a high element of process & manufacturing.

Primary clients were in the pharmaceutical, food and beverage; education and MOD sector.

Kier Group (14 years)

Kier Major Projects - (8 years) – Project Surveyor / Regional Commercial Manager South

The major projects delivery arm of Kier Construction where I was initially project commercial lead and latterly responsible for project delivery of up to 4 projects at any on stage with values ranging between £30M and £80M

Primary clients were in the office, retail, leisure and healthcare (P21) sector.

Tarmac Major Projects - (7 years) – Senior Surveyor

The major projects arm of Tarmac Construction responsible for the delivery of central London project. Leading support team responsible for closing out open and troubled accounts and gathering cash in another operating division and then transferred to Tarmac Professional Services where I acted as site based Clients Quantity Surveyor on several major MOD projects, together with other various assignments including commercial support for Tarmac in Berlin.

Experience

General

I have abroad range of experience and have delivered projects / services in various contracting

environments including traditional, design and build, fixed price, target price, reimbursable, EPCM (V)

construction management, Joint Venture and consultancy.

My roles have also involved me various start up and restructured business where I have been

responsible for the development of the whole business infrastructure as well as commercial controls.

Contract Knowledge

Experience in negotiating and drafting head and subcontract documentation, ensuring the correct

allocation of risk and clarity of scope of deliverables.

Particular detailed experience of NEC Forms (Options A; C; E; F; PSC; SC; Framework and Short

Form), JCT (D&B, IFC), Bespoke forms, Services Appointments and license agreements.

Outside of mainstream contracting the business’s I have been involved in have afforded me exposure

to reseller arrangements, sales team agreements and cooperation / teaming agreements

Procurement & Commercial Strategy

Detailed experience of developing procurement and commercial strategy and processes geared

around controlling project risks and delivering profitable outcomes to stakeholders.

Recruitment & Team Management

I have been responsible for the recruitment, management and development of commercial teams at

project and company level and was responsible for developing the Commercial Development guide

and performance review used throughout Kier.

I pride myself of a low attrition rate and the success of the team. The maximum team size under my

management was circa 30 at BLLT. I have been responsible for putting in place the commercial

infrastructure for all the operating divisions identified under Kier Ltd

Dispute

Whilst driven to achieve amicable resolution to difficult situations I have lead dispute management in

both litigation and adjudication.

My offensive litigation was for a disputed sum of £16M under a process contact which also involved

two adjudications totalling £5M for the building elements of the same project. We were successful on

all counts.

Defensive adjudications were related to a structural and infrastructure subcontracts with a 50:50

success rate.

Risk Management Keen focus on understanding all the project/company risk and putting in place strategy to manage the risk by. Risk management process put in place at key tiers of delivery.

Mergers, Acquisition and Restructure Experience in merging and restructuring business units within a company, integrating new company into the group, setting up new company in a structure suitable for sale and developing and presenting due diligence information in respect of potential sale of a business to significant corporation Consideration of aspects which add to business value and working with legal and corporate finance consultants

Reporting, Management & Performance Indicators Development, production and interrogation of reporting formats, review of whole project and business indicators to establish balanced view of health and identify corrective action requirements

BIM & Technology Involved in the front end of the digitization of the construction industry with an enhanced knowledge of how technology is likely to affect project delivery
