Identifying Potential Inventions
§ Specific considerations§ Does the subject matter include at least one technical feature that was either…
§ (1) not previously disclosed, released, or otherwise publicly known, or
§ (2) Was disclosed, released or publicly known for less than one year?
§ Would inclusion of this feature in a product provide ADTRAN with a competitive advantage?§ Does this feature solve a technical, functional, or operational problem?§ Would ADTRAN’s competitors likely want to include this feature, or would it be difficult for them
to design a competing product that did not include this feature?§ Would third-party use be detectable?§ Will this feature be included in a standard, or be used for multi-vendor interoperability, or be
