Safety: unlocking new business opportunities

Following the IRU Logistics and Innovation Forum held in Amsterdam in 2018 which attracted over 150 participants, and the IRU World Congress which brought together more than 1,000 transport industry, business and government representatives, IRU launches the second edition of its Logistics and Innovation Forum.

We want the IRU Logistics and Innovation Forum to be the new networking hub for innovative road transport solutions. On an annual basis. With a recent IRU survey showing that safety represents one of the biggest innovation opportunities for transport operators, this year’s

event will focus on safety as a core mission – and business opportunity – for the industry. At last year’s Forum, multiple transport associations and IRU members attended the event.

Jointly, these members represented more than 559,400 members of their own, mainly transport operators from across Europe and beyond. That network, extending well into more than half a million haulage, logistics and mobility operating companies, attracted leading service providers including Daimler FleetBoard, DKV, EuroToll, Wtransnet and TomTom who wanted to engage with IRU members.

Many IRU associate members, including companies such as Continental, IVECO, Kapsch, MAN, Michelin, Scania, UPS and Volvo, are also keen to engage with IRU members on this topic.

The IRU Logistics and Innovation Forum is a unique opportunity for you to meet market leaders and showcase transport operators from your country and association. TERMS AND CONDITIONS

1. Definitions

“Agreement” shall mean the sponsorship booking form, its Annex and the present “Terms and Conditions”. “Exhibitor/Sponsor” shall mean any person, firm or organization who/which selects a partnership level/sponsorship package and to whom/which the Organizer allocates a space or a speaking slot in the below-said event. “LIF” shall mean the event, the Logistics & Innovation Forum, which will take place on 21 February 2020, at the Sofitel London Heathrow Hotel. “Official contractor” shall mean the company (Mathys SA) in charge of the design, manufacturing and overall management of custom stands. “Organizer” shall mean the International Road transport Union (IRU).

2. Application for participation and acceptance

All applications for participation to the event shall be made through the sponsorship booking form. The sponsorship booking form shall be submitted to the Organizer to the following email address: IRU Partnerships [email protected]. The Organizer shall send the corresponding invoice to the Exhibitor/Sponsor. The submission to the Organizer of the signed sponsorship booking form shall be deemed to be confirmation of participation and full acceptance of the entire Agreement. The Organizer shall be bound by the Agreement upon submission by the Organizer of the corresponding invoice to the Exhibitor/Sponsor. The Agreement shall terminate upon the completion of the LIF event.

3. Rental of stand fitting, design and signs

The individual design of the stand is the concern of each individual Exhibitor. Each Exhibitor shall contact the Official contractor for furniture, fittings, fixtures and utilities. The nature of the design shall be subjected to the construction regulations applicable to the event venue and to the Organizer’s approval.

4. Terms of payment

a) 100% of the total amount indicated in the chosen partnership level/sponsorship package.

b) The invoice shall be paid within 30 days of the date of its receipt.

c) For any other additional services (such as internet connection, other materials not included in the partnership level/sponsorship package, etc), payments must be made in full, in advance, within the timeline indicated in the invoice.

d) Payment within the timeline indicated in the invoices is a prerequisite condition for the Sponsor/Exhibitor’s participation in the event and/or use of the stand.

e) In the event of default of payment within the timeline, the Exhibitor/Sponsor’s application shall be deemed to be cancelled and 100 % of the total amount indicated in the chosen partnership level/sponsorship package is due by the Sponsor/Exhibitor to the Organizer as a penalty fee. The Organizer shall reserve the right to claim all payment due from the defaulting Exhibitor/Sponsor. The Exhibitor/Sponsor shall not be entitled to any form of compensation whatsoever, whether for loss of profits or otherwise.

5. Withdrawals/cancelation

The Exhibitor/Sponsor will not be permitted to withdraw from, cancel, alter or reduce in any way his/her/its booking of the event. In such cases

Exhibitor/Sponsor will provide written notice to the Organizer. The Organizer may consider special cases and, in its sole discretion, grant partial refunds to the Exhibitor/Sponsor. The amount of the possible refund depends on how many weeks prior to the start of the event the withdrawal/cancelation is made known to the Organizer.

Cancellation fee:

a) More than 12 weeks prior the event: 50% of the total amount indicated in the chosen partnership level/sponsorship package.

b) Within 8 weeks prior the event: 100% of the total amount indicated in the chosen partnership level/sponsor package.

6. Movement of exhibits

a) The Exhibitor shall bear the responsibility and expenses for transport of exhibits to the event venue.

b) The Exhibitor shall make their own arrangements for the storage and warehousing of the exhibits, subject to the written approval of the Organizer.

c) The Exhibitor shall submit a list of exhibits to the Organizer at least 30 days prior to the start of the event.

d) No exhibits or other goods will be permitted to leave the event venue. The Exhibitor shall indemnify the Organizer against any loss or damages due to delay or damage to the event venue.

7. Insurance and Liability

The Organizer, its directors, trustees, offices, employees, agents and representations, will not be responsible for the safety of articles of any kind brought into the event by the Exhibitor or Sponsor, their employees, agents or contractors, members of the public or any person whosoever. Exhibitors shall ensure that they are fully covered by insurance. The period of insurance shall be from the time the Exhibitor first enters the event venue until all its exhibits have been properly removed to the satisfaction of the Organizer. The Exhibitor/Sponsor shall indemnify and hold the Organizer, its directors, trustees, offices, employees, agents and representations, armless with respect to all costs, claims, liabilities, losses, demands, proceedings and expenses to which the Organizer, its directors, trustees, offices, employees, agents and representations may in any way be subject as a result of any act of omission of the Exhibitor or Sponsor, their representatives, employees, agents, contractors. If the Organizer so demands, the Exhibitor/Sponsor shall provide proof to the Organizer that the Exhibitor/Sponsor has adequate insurance coverage. The Organizer shall not in any event be held responsible for any loss or damages whatsoever including loss of profits suffered by the Exhibitor/Sponsor as a result of any circumstance/cause beyond its control.

8. Security Responsibility

During the event, security of exhibits, stands and furniture is wholly the responsibility of the Exhibitor, its employees, agent or contractor and the Organizer, its directors, trustees, offices, employees, agents and representations shall not be responsible for any losses, damages or injuries to person incurred. Under no circumstances shall the Organizer accepts any responsibility or liability however arising with respect to damage, theft or loss of any property, goods,

articles or things however placed, deposited or brought into or left upon the premises either by the Exhibitor/Sponsor for his/her/its use or purpose or by any other person and the Exhibitor/Sponsor must indemnify the Organizer, its employees, agents and offices in respect thereof.

9. Damage to venue

The Sponsor/Exhibitor shall take good care of and shall not cause any damage or permit or suffer any damage to be done to the event venue or to any part or parts there of or to any fittings, equipment or other property therein, and shall pay for damages thereto (including accident damage and damage by fire) caused by act or omission of the Exhibitor or Sponsor, their employees, agents, representatives or contractors.

10. Intellectual Property

Neither the Exhibitor/Sponsor nor the Organizer shall acquire any right, title or interest in or to any intellectual property rights, names or marks of the other. The Exhibitor/Sponsor acknowledges, in particular, that the Organizer owns the name and mark “IRU” and IRU’s associated logo(s) (the “IRU Marks”) and nothing in this Agreement gives the Exhibitor/Sponsor rights to use IRU’s Marks without the Organizer prior written consent. All intellectual property rights in or arising out of or in connection with the event shall be owned by the Organizer without prejudice to the Exhibitor/Sponsor’s intellectual property rights.

11. GDPR information notice

In the context of the IRU Logistics and Innovation Forum, International Road Transport Union (IRU) (“IRU”) processes information about you which constitutes “personal data”. IRU considers the protection of such personal data an important matter and has therefore adopted a Global Privacy Policy, available at https://www.iru.org/privacy-policy.

We invite you to carefully read this Global Privacy Policy, which sets out in more detail in which context we are processing your personal data and explains your rights and our obligations in that respect.

12. Miscellaneous

Exhibitors/Sponsors shall comply with all rules, regulations and laws imposed or laid down or prescribed by the government, public authorities and owners or managers of the event venue.

The Exhibitor/Sponsor warrants that it has full right power and authority to enter into the Agreement and is not bound by any agreement with any third party that adversely affect this Agreement.

This Agreement shall not create, nor shall it be construed as creating, any partnership or agency relationship between the parties.

The contents, form and effects of the present Agreement are subject to the laws of Switzerland. Any dispute, controversy or claim arising out of or in connection to this Agreement including the validity, invalidity, breach or termination thereof shall be resolved by arbitration in accordance with the Swiss Rules of International Arbitration of the Swiss Chambers’ Arbitration Institution in force on the date when the Notice of Arbitration is submitted in accordance with these Rules. The number of arbitrators shall be one or three. The seat of the arbitration shall be Geneva, Switzerland. The arbitral proceeding shall be conduct in English.
