1 Partner company

A partner company within the meaning of this manual is:

a subcontractor having received an order,

a customer,

a company having received an order by our customer.

In the following, the term Partner Company is used.

2 Definitions and abbreviations

For definitions and abbreviations, see the List of Definitions and Abbreviations of Blohm+Voss.

3 Work Safety, Health and Environmental Protection Objectives of Blohm+Voss B.V. & Co. KG

We pursue work safety, health and environmental protection in a proactive way. This particularly includes

the avoidance of accidents at work the protection of the health of own and external employees the avoidance of environmental damage

It is our endeavour to continuously reduce the environmental load and the consumption of resources and energy and to protect both human beings and the environment. What makes us stand out are the excellent relation to our environment and the public and the proactive cooperation with the authorities.

These objectives apply to both our own employees and the employees of our partner companies. This will be considered for the selection of and the cooperation with partner companies.

6 Conditions of work at the yard Blohm+Voss B.V. & Co. KG

For partner companies and their subcontractors working at the Blohm+Voss B.V. & Co. KG yard, yard facilities or locations and construction sites of ships (in the following „Yard“), the following conditions are material part of the contract or are accepted as contractually agreed, unless otherwise agreed upon.

Partner companies and subcontractors undertake to observe statutory provisions at Blohm+Voss B.V. & Co. KG locations.

6.1 Scope of orders, billing

Basically, the partner company has to execute the order placed with it, itself. When the partner company choses to pass this order on to a subcontractor the partner company shall inform Blohm+Voss B.V. & Co. KG accordingly in writing and, in any case, before such work is started, naming the subcontractor company and its contact. Unless Blohm+Voss B.V. & Co. KG opposes the execution of the work by that specific subcontractor or subcontractors, the partner company shall arrange an agreement with such subcontractor/s with respect to the conditions of work at the yard.

Regulations and requirements concerning work safety and environmental protection shall remain unaffected by any special agreement and shall apply to any party involved. Statutory provisions valid in Germany and regarding work safety and environmental protection are material part of these conditions of work at Blohm+Voss B.V. & Co. KG locations.

Services and the provision of material provided by the works fire brigade / work safety department will be invoiced by Blohm+Voss B.V. & Co. KG accordingly in compliance with the prevailing scale of charges (unless otherwise agreed with Blohm+Voss B.V. & Co. KG in writing).

6.2 Work rules, working hours

Both working hours and breaks shall be adapted to those prevailing at Blohm+Voss B.V. & Co. KG. For work outside normal working hours, the responsible object engineer/coordinator of Blohm+Voss B.V. & Co. KG shall be asked for approval first. In principle, the presence at the yard is permitted only to provide services.

Partner companies shall nominate and delegate a German-speaking site manager. The form Recognition of the coordinator shall be completed, signed and, before starting the work, handed over to the object engineer/coordinator of Blohm+Voss B.V. & Co. KG.

To execute service or delivery orders at the yard, the partner companies and their subcontractors shall only employ persons with a valid work permit and the certificates required by German law. For the employment of foreign workers from the European Economic Zone, the certificates (A1 or E 101, E 102) are required.

The originals of the work permit and the certificates need to be presented for each employee to the ID Card Issuing department of Blohm+Voss B.V. & Co. KG before starting work for the first time at the yard. Blohm+Voss B.V. & Co. KG is entitled to prepare copies of these originals and request the presentation of the originals at any time. In the event the status changes, Blohm+Voss B.V. & Co. KG has to be informed immediately and the relevant employees have to be replaced.

While at the yard or on board ship, all employees of the partner company and its subcontractors shall wear a hard hat with the company name and logo as well as the name of the person on it.

In addition, all equipment on board (such as ladders or tool boxes) needs to be marked so as to identify the owner without further ado.

6.3 Provision of space and erection of buildings

If available, storage rooms, offices, workshops and social rooms or free space on the yard for depositing or storing goods or for the erection of storage und office containers or other light-construction buildings intended for such use can be made available for partner companies and their subcontractors.

The allocation of rooms and space is made upon the written request of the partner company and upon examination by the BU Production Services and upon consultation of the project managers or the object engineer/coordinator. The allocated room/space shall be maintained by the user. The rent will be invoiced in compliance with the valid scale of charges.

The use of the rooms and the erection and operation of buildings shall conform to the law and shall be in compliance with the relevant regulations. The supervisory personnel is permitted to examine the rooms and buildings at any time for the prevention of hazards. Orders given by such personnel shall be followed.

The use of the rooms and spaces allocated to the partner companies to execute work for third parties requires the prior written approval by Blohm+Voss B.V. & Co. KG.

Upon completion of the work, the residual material shall be removed from the rooms / spaces used by the partner company and its subcontractors within one week and the rooms / spaces shall be handed over clean and free from faults and free from any kind of contamination. Upon expiry of this deadline, Blohm+Voss B.V. & Co. KG is entitled to clear and clean the rooms / spaces at the expense of the partner company and its subcontractors. At the end of the contract, the rooms / spaces shall be returned to the object engineer/coordinator.

Telephone and Internet connections shall be requested in writing and shall be unsubscribed as soon as they are not used any more. The connection costs, the rates and costs as a result of no unsubscription shall be borne by the partner company - also for its subcontractors. Surface mail addressed to partner companies and sent to the yard can be collected during normal working hours from the Poststelle. Services in this respect provided by Blohm+Voss B.V. & Co. KG will be invoiced accordingly as agreed.

Camping and living on the premises and the outside parking areas is not permitted. Statutory provisions shall apply.

6.4 Support workers, material, facilities and equipment

Basically, neither support workers, material, facilities, equipment (tools, machines, means of transport, cranes, etc.) nor assistance such as the repair of equipment of the partner companies or their subcontractors will be provided by Blohm+Voss B.V. & Co. KG.

If, for the execution of the agreed services, such provision is required, the partner company or its subcontractor has to request such assistance/provision from the object engineer/coordinator. The assistance/provision will be invoiced upon the written confirmation of the request in compliance with the scale of charges.

The use of facilities and plants provided by the yard is at the risk of the partner company/subcontractor. When facilities or plants need to be changed/modified the object engineer/coordinator of Blohm+Voss B.V. & Co. KG needs to be informed accordingly. Arbitrary changes are not permitted.

Only tested, calibrated and approved plants and equipment marked as such may be used.

The use of any facilities provided must not result in any obstructions or hazards. Emergency exits need to be kept free at any time. Signs need to be placed distinctly and visibly.

The claiming of such facilities during normal working hours will be coordinated in view of the yard requirements. The partner company and its subcontractors shall protect the plants and equipment

provided by Blohm+Voss B.V. & Co. KG against damage, loss and theft, maintain the plants and equipment properly and return them to the correct place immediately upon the end of use. Plants and equipment not returned at the end of the job or returned in unserviceable condition will be invoiced at replacement value.

Blohm+Voss B.V. & Co. KG shall not be liable for personal injuries or damage to property as a result of insufficient care in the course of the execution of the work.

6.5 Energy and water supply

The tapping of energy (gas, oxygen, compressed air, electricity) is only permitted upon consultation of the object engineer/coordinator first.

Required connections to energy outlets depend on the existing infrastructure and only plants/equipment that comply with regulations shall be connected. The energy consumption will be read off meters, if available.

Electric energy, technical gases and tap water are provided in the usual form depending on the existing supply systems as far as directly required for the execution of the work. The partner company and its subcontractors have to make sure that energy is consumed economically. The provision of energy outside normal working hours is subject to the approval of the object engineer/coordinator. Costs will be invoiced in compliance with the prevailing scale of charges.

If Blohm+Voss B.V. & Co. KG, for reasons of force majeure or other circumstances which cannot be avoided or changed by reasonable measures, is not able to distribute or supply energy as agreed, the obligation of Blohm+Voss B.V. & Co. KG is suspended until the reasons or the trouble and their effects have been eliminated. Price reductions and or claims for damages as a result of energy failures are excluded.

The partner company and its subcontractors shall inspect the quality and characteristics of the media, the location and the scope of the connections as well as the standard of the energy distribution facilities before claiming the media. Questions need to be discussed with the responsible object engineer/coordinator, and the persons tapping the energy need to be informed on the correct use. The equipment such as hoses, fittings and technical gases need to be rented from Blohm+Voss B.V. & Co. KG and shall be kept in excellent condition. Repairs shall be made by Blohm+Voss B.V. & Co. KG only. Own equipment must not be used. During longer interruptions of work (e.g. breaks) and at the end of a working day, the hoses need to be removed from the rooms, properly stored and secured against unauthorized use.

6.5.1 Power supply

Electric energy must only be tapped via properly protected power connections. Therefore, only consumers in compliance with VDE and correct connections must be used. Connecting work or work on main switchboards must only be performed by authorized yard personnel. Costs in connection with such work shall be borne by the partner company - also for its subcontractors.

The provided power current has a voltage of 400 V / 50 Hz. Standard outlets are 63 A/32 A/16 A via CEE connections. Higher loads need to be connected directly.

The electric power supply for small machines and auxiliary lighting has a voltage of 220 V/50 Hz.

On board ship, Blohm+Voss B.V. & Co. KG provides workplace illumination and on site distribution (power current and AC distributors). The lighting equipment is the property of Blohm+Voss B.V. & Co. KG.

Isolating transformers, lamps for safety extra low voltage, explosion lighting und equipment and lamps with a special degree of protection, e.g. IP65 and higher, are not provided by Blohm+Voss B.V. & Co. KG (unless otherwise agreed with Blohm+Voss B.V. & Co. KG in writing).

The electrical equipment used by the partner company and its subcontractors has to comply with the prevailing DIN, VDE and DGUV regulations. Test documentation needs to be held available.

Cable extensions for power systems, hand-held equipment and portable lamps are not provided by Blohm+Voss B.V. & Co. KG. Cable drums shall be fully unreeled before use.

6.5.2 Acetylene and oxygen supply, flame cutting hoses and gauges

For safety reasons, the use of acetylene and oxygen bottles as well as the use of liquid gas in general is not permitted on board ship.

For cutting and welding work, Blohm+Voss B.V. & Co. KG provides and maintains a central supply system with distributor boxes (gas / oxygen units) and air distributors (trolleys). Planning is done by the partner company and its subcontractors and the object engineer/coordinator jointly.

The supply is realized through the ATEX system, i.e. the fuel gas is fed pressureless via negative pressure boxes to the distributors and acetylene is drawn in by the injection effect of the burner. This has the advantage that in the event of a damage to the burner hose the suction effect stops, the negative pressure box closes and no more gas escapes. There is no hazard as a result of a defective mixing nozzle following the failure of the injector effect.

For the use of the ATEX system, burners with special injector nozzle sets as well as gas hoses with a larger cross-section than that of gas bottle supply systems are required. The gas hoses are connected to the negative pressure boxes without gauges. For oxygen supply, no bottle pressure reducers must be used. Oxygen hoses have to be connected via intake pressure reducers.

For these reasons and to ensure that only tested and faultless tools are used, only burners, hoses and pressure reducers of Blohm+Voss B.V. & Co. KG must be used, which will be provided upon request by the object engineer/coordinator. The use will be invoiced to the partner company and its subcontractors according to the current scale of charges.

Defective units and hoses need to be replaced. Repairs must only be carried out by Blohm+Voss B.V. & Co. KG!

The partner company has to ensure that both its employees and those of its subcontractors handle the rented material with care and, for their own safety, keep it in faultless condition.

When the partner company or its subcontractors do not return hoses or tools or return them in damaged condition the partner company shall reimburse the costs for the repair or the replacement.

An inspection sticker on the burner hoses shows that the hose has been inspected. For such marking and the proper handling of autogenous welding equipment, acetylene and oxygen hoses, see Section 9 - Generally valid work instructions.

6.6 Light

Blohm+Voss B.V. & Co. KG provides lighting for spaces, walkways and rooms.

6.7 Heating and air conditioning

In the event that heating or air conditioning is required during the execution of the work and personnel of Blohm+Voss B.V. & Co. KG and of its partner companies and their subcontractors are present at the same time, heating and air conditioning will be provided and operated by Blohm+Voss B.V. & Co. KG.

6.8 Plant security

Access to the yard of personnel of partner companies and their subcontractors to carry out the work is only permitted upon registration, receiving safety instructions (see Section 6.12) and wearing a valid yard ID card. Employees of a partner company and its subcontractors have to identify themselves by means of a yard ID card with photo or, when the photo is missing, additionally with their ID card or passport.

The yard ID card needs to be carried along always. The yard ID card must not be passed on to other persons.

All employees of a partner company and its subcontractors are obligated to have themselves inspected when ordered by the management. When leaving through the yard’s entrance each employee has to provide proof that he/she is permitted to carry along material, tools, etc. Property of Blohm+Voss B.V. & Co. KG must not be removed from the yard without a special permit or for purposes not previously permitted.

Unauthorized access to plants, buildings or rooms other than for executing the work is not permitted.

6.9 Driving and parking at the yard

Driving and parking at the yard has to be restricted to a minimum. Exceptions are deliveries and the transport of employees and material to the objects.

Crane operation must not be hindered. Driving on the premises requires full attention and caution due to the operations at the yard.

Access by car only through the main entrance Gate 1, Hermann-Blohm-Str. 3. Access by lorry and all deliveries (also by car) through Gate 4 - Incoming goods.

At the entire yard, the German Road Traffic Regulations shall apply. In particular, the priority-to-the-right-rule needs to be observed. The maximum velocity at the yard is 20 km/h!

Driving in the docks is permitted only for the loading and unloading of material. The vehicles have to be removed immediately after. Trips for transporting persons or for purposes other than loading or unloading are not permitted.

Heavy transports and industrial trucks, in particular when loaded, always have the right of way. Overhanging goods not marked as such have to be expected on transport vehicles and trailers.

When dark, poorly lighted vehicles, forklift trucks, bikes, etc. should be expected at the yard. Production vehicles such as cranes, machines, etc. are not lighted. Parking in restricted areas is neither permitted at night.

Riding a bike is not permitted inside halls and in docks 5 and 12.

When passing dock bridges the maximum load of 30 t (docks 5/10/11/12) and 40 t (dock 16) must not be exceeded.

6.9.1 Parking areas

For visitors to Blohm+Voss B.V. & Co. KG, a parking area to the left of the main entrance is available which is closed with a barrier. Upon the return of the yard ID card issued after registration, the gate keeper will provide a coin to open the barrier.

Employees of partner companies and their subcontractors may park their car on the outside parking area to the right of the main entrance.

Parking at the yard is permitted only on the official parking areas marked as such.

Blohm+Voss B.V. & Co. KG shall not be liable for damage caused by third parties.

Obstruction of the yard traffic during production hours is to be avoided. Blohm+Voss B.V. & Co. KG is entitled to remove obstructing vehicles at the cost of the partner company and its subcontractors.

For large projects, if required, additional parking areas will be provided by the project management and marked as such.

Parking on hatched or marked surfaces and in way of cranes, in front of access roads or hall doors, in docks and on the dock pontoon is prohibited.

6.9.2 Parking permit

Upon request, access permits to pass the main gate may be issued for comprehensive work. Such access may be requested at the same time when requesting the yard ID card. The permit is valid only for the registered car.

Only the parking area named on the ID card must be used. Parking outside the named parking area is not permitted. The permit has to be hooked at the inside mirror behind the windshield when entering the yard and must only be removed after leaving the yard. The parking permit may be revoked at any time without giving a reason, but in particular when not observing these regulations. After expiry, but at the latest when terminating the work at the yard, the permit has to be returned to the permit-issuing office without being asked to do so. The prevailing parking order needs to be observed.

6.10 Security check

For naval projects, the partner company and its subcontractors are obligated to have their employees registered with the BMWi [Federal Ministry of Economics and Technology] and subjected to a security check so as to avoid delays with work in security areas.

The security officer of Blohm+Voss B.V. & Co. KG is entitled to bar specific employees of partner companies and their subcontractors from working at the yard.

6.11 Taking photographs, videos, etc.

With respect to security, the taking of photographs or videos, the preparation of sketches or the use of other optical recording methods is prohibited at the entire yard. In the event of non-compliance, Blohm+Voss B.V. & Co. KG is entitled to confiscate films, tapes, sketches, etc. Taking photos is permitted only upon the approval of the object engineer/coordinator.

The distribution of flyers and propaganda material is prohibited. Political actions at the yard are prohibited as well.

6.12 Safety at work and health protection

6.12.1 Basic safety instructions

Employees of partner companies or their subcontractors are not permitted to access the yard to carry out their work without having received safety instructions.

There are two methods of safety instructions:

Approved partner companies are requested to instruct their employees through the work safety video of Blohm+Voss B.V. & Co. KG via the Internet, before starting the project. The request for this shall be passed to the Work Safety and Environmental Protection department (e-mail: [email protected]). The instruction certificate has to be sent to the Work Safety and Environmental Protection department.

Upon completion of the safety instructions, the relevant employee is cleared electronically so that a yard ID card can be issued.

6.12.2 Project- and activity-specific instructions

The object engineer/coordinator instructs the site manager of the partner company on the project- and activity-specific conditions, the project- and activity-specific hazards and the regulations (RA, OI and WI). The project-specific instructions shall be observed as well as the other general regulations.

The partner company will receive Annex A - Project-specific documents and the related instructions.

The instructions are confirmed on the form Project-specific safety instructions certificate.

6.12.3 Yard, work and project-specific safety instructions

Before starting to execute the order of Blohm+Voss B.V. & Co. KG, the partner company shall instruct its employees and those of its subcontractors on the hazards they may encounter during work and on the yard- and project-specific hazards. The site manager of the partner company shall be responsible for this.

Evidence that the safety instructions have been received is made according to DGUV Regulation 1, Section 4 by the form Safety instruction certificate according to Section 9 Joint-valid documents. The form is available at the operations office Elbhalle Room 130. On request, these certificates have to be submitted to the Work Safety and Environmental Protection department.

The partner company has to nominate a person vis-á-vis Blohm+Voss B.V. & Co. KG responsible for the observation of safety regulations. This person is confirmed on the form Recognition of the coordinator. The task can be fulfilled by the site manager, the Safety and Health Coordinator or the Work Safety Officer of the partner company.

6.12.4 Risk assessments and operating instructions

The partner company and its subcontractors are obligated to prepare risk assessments with respect to their activities at the yard. The same applies to operating instructions in the event they do not yet exist (see below).

Employees of partner companies and their subcontractors are instructed by means of the work safety video of Blohm+Voss B.V. & Co. KG by Blohm+Voss B.V. & Co. KG followed by a test. Thereupon, a work safety certificate is issued. A copy of this certificate has to be presented to the object engineer/coordinator before starting the work.

Risk assessments and operating instructions have to be submitted to the object engineer/coordinator. The resulting safety measures and arrangements shall be coordinated and initiated with the object engineer/coordinator before starting the work.

Safety critical work such as the handling of machines and equipment and the handling of hazardous substances according to the Dangerous Chemicals Ordinance are regulated by operating instructions of Blohm+Voss B.V. & Co. KG and apply to the work at the yard.

6.12.5 Accident prevention regulations

The partner company undertakes to make sure that its employees and those of its subcontractors observe the relevant accident prevention and work safety regulations, the generally recognized safety-related and occupational health-related rules and the environmental protection regulations. This also applies to in-company regulations of Blohm+Voss B.V. & Co. KG.

Blohm+Voss B.V. & Co. KG is member of the trade association Norddeutsche Metall-Berufsgenossenschaft, Hannover. The accident prevention regulations and performance directives of Norddeutsche Metall-BG shall apply as amended. The trade association requirements of the partner company and its subcontractors remain unaffected. The partner company and its subcontractors are obligated to provide all equipment and take all precautions required to observe the requirements and regulations including the code of practice.

In addition to this, all laws, ordinances, regulations and rules shall be observed. In particular, the following regulations need to be observed when working at the yard:

All accident prevention regulations, their performance directives, the applicable trade association information (old ZH1 documents: regulations, safety rules, principles and information sheets), legislative texts, etc. can be inspected at the Work Safety and Environmental Protection department (Tel. 040-3119-1953).

6.12.6 Selected work instructions

The generally valid work instructions listed in Section 9 and the project-specific instructions of Annex A have to be observed by the partner company and its subcontractors.

If special work instructions do not exist but are required for the relevant work, they shall be prepared by the partner companies and coordinated together with the object engineer/coordinator.

6.12.7 Personal protective equipment (PPE)

Wearing the personal protective equipment is mandatory at the yard. See Yard Layout - Section 5.

The partner company has to make sure that its employees and those of the subcontractors are equipped properly.

6.12.8 Rigging of loads

The rigging of loads and the operation of cranes according to safe work procedures must only be done by trained riggers of Blohm+Voss B.V. & Co. KG (equipped with an orange hard hat/orange safety helmet with face shield).

In exceptional cases, employees of partner companies and their subcontractors may rig loads, provided this has been authorized by the object engineer/coordinator of Blohm+Voss B.V. & Co. KG and instructions pursuant to DGUV regulations have been received. Such employees need to be equipped with orange hart hats.

6.12.9 Safety devices, preventive measures

Safety facilities, including fire extinguishing systems, must not be removed, blocked, deactivated or misused. Hoses for technical gases need to be kept in perfect condition and have to be removed from tanks and confined spaces during longer interruptions of work and breaks.

Scaffoldings and fall-arrest systems must only be built, erected, assembled, modified and maintained by specialist companies ordered by Blohm+Voss B.V. & Co. KG.

When, during the execution of the service by the partner company or its subcontractors, the formation of explosive air mixtures is to be expected, the object engineer/coordinator and the Work Safety and Environmental Protection department need to be informed before starting the work.

The partner company and its subcontractors have to provide and maintain explosion-proof equipment that may be required for the execution of the work.

Sources of danger shall be eliminated immediately or safeguarded respectively. The object engineer/coordinator needs to be informed immediately.

At the end of the daily work, workplaces shall be left tidied up and safeguarded.

6.12.10 Release „Hot work“

"Hot work" means: working with naked flame or arc; flying sparks or work creating sparks; heating of components that may cause ignition.

Hot work may only be carried out with a Hot-work Permit and placing a fire watch and needs to be approved by the object engineer/coordinator (tank construction/industrial service: project manager). For reasons of fire prevention, the object engineer/coordinator (tank construction/industrial service: project manager) will contact the works fire brigade to provide a fire watch.

Hot work inside tanks must only be carried out upon the approval of the object engineer/coordinator, as tanks may contain dangerous substances. Before access, the tanks shall be inspected by a certified trade chemist. Only after having issued a gas-free certificate the tank may be accessed.

6.12.11 Working on tankers

Work on tankers is subject to project-specific instructions.

Work may only be started upon the approval by a commission of four (HPA, work safety department, certified chemist, fire brigade) in the form of a safety certificate. In addition, a gas-free certificate needs to be displayed that is to be renewed daily.

6.12.12 Operation of technical equipment

Cranes, industrial trucks, hydraulic work platforms and forklift trucks must only be operated by employees of partner companies and their subcontractors after having submitted a valid operation permit. Forklift truck operators of foreign companies have to produce a training certificate and an order to operate such trucks.

6.12.13 Drugs, alcohol, smoking

It is not permitted to bring alcohol-containing or other intoxicating beverages to the yard, consume them at the yard or to appear at the yard for work primed or intoxicated.

Smoking is permitted only at zones marked as such. Otherwise, smoking is prohibited as signposted as well as on ships and inside tanks containing hazardous substances.

6.13 Environmental protection

Our company is aware of the responsibility to the human kind and the environment.

The company undertakes not only to observe all environmental protection acts and ordinances but, in addition, is looking out for an environmentally aware handling of energy and raw material.

To us, an open, internal and external communication is the cornerstone of an efficient and effective environmental protection.

We await from our partner companies and their subcontractors that they support us in our endeavour to environmental protection and our environmental objectives, among others, by:

avoidance of waste and residues,

separation and environmentally compatible disposal of residues,

economic use of energy and resources,

correct handling of hazardous substances,

fast and regular waste disposal,

avoiding and reducing of immissions,

protection of the ground and waterbodies against contamination,

preparation of emergency measures within the scope of work for us.

6.13.1 Environmental protection regulations

The partner company and its subcontractors undertake to render the service in such a way that residues are avoided or can be exploited harmlessly and can be disposed in compliance with legal provisions.

Packing material is the property of the partner company and its subcontractors and has to be removed by them immediately from the production area and the yard and disposed at their costs.

It is possible to dispose the waste through the waste disposal contractor of Blohm+Voss B.V. & Co. KG, however, at the cost and the responsibility of the partner company.

The partner company shall be liable vis-á-vis Blohm+Voss B.V. & Co. KG for any damage resulting from any violation of the environmental protection regulations by the partner company or its subcontractors. The partner company shall indemnify Blohm+Voss B.V. & Co. KG against any claims of third parties as a result of such violation.

The partner company and its subcontractors will be informed by the object engineer/coordinator on any changes to the environmental protection regulations.

6.13.2 Hazardous waste

Unavoidable hazardous waste („Hazardous waste“ pursuant to Section 41 Sentence 2 KrW-/AbfG [Waste Avoidance, Recycling and Disposal Act], with reference to the European Waste List (mainly the decisions of the commission 2000/532/EC and 2001/118/EC), shall be reported to the waste disposal officer of Blohm+Voss B.V. & Co. KG before starting the work.

The execution and the correct keeping of records of the disposal is an inseparable part of the scope of supply of the partner company and its subcontractors.

6.13.3 Waste and residue disposal

The partner company and its subcontractors are responsible for the disposal of waste and residues. They have to make arrangements with the object engineer/coordinator for a proper disposal who then organizes the disposal and brings the providers / waste disposal companies in touch with them.

Unavoidable waste shall be collected and disposed separately.

The mixing of residues results in an elaborate subsequent separation at the residue collection hall. The costs for such subsequent separation would have to be borne by the partner company and its subcontractors. The mixing of oil residues with other substances would result in the disposal of the entire container contents as oil residues and is particularly expensive.

Any other method of disposal not mentioned above and the disposal of hazardous substances need to be planned by means of a disposal concept and disposal records have to be kept. The applicable laws and regulations such as the Federal Immission Control Act, the Waste Avoidance, Recycling and Disposal Act, the Water Resources Act, the Hazardous Goods Ordinance, in-company safety regulations and operating instructions need to be observed.

6.13.4 Water treatment plant/pollution of water

The washing water resulting from the high-pressure cleaning of the hull and the hydroblasting water produced by the Dockmasters is collected in the storage tanks of the dock waste water treatment plant located in floating docks 10, 11 and 16 and dry dock Elbe 17. From there, the water is continuously fed to the cleaning process.

During the entire docking time, the water treatment plant of the docks is continuously in operation. Any dock water as well as rain- and groundwater are permanently collected in tanks and cleaned.

To make sure that the cleaning process is not disturbed and the capacity of the plant is not exceeded, it needs to be considered that:

the various levels are interconnected by openings,

that they are not sufficiently ventilated,

a multitude of activities may be executed at the same time,

a multitude of activities entail the risk of ignition,

activities are performed by various companies.

Partner companies and their subcontractors are held responsible that:

no ballast water gets from the ship to the waste water cleaning system,

the draining of ballast water is realized by drain plugs and cleaning units and is then removed from the dock via hoses,

waste water and sewage of the ship are collected in tanks and are directly disposed,

no waste water produced during any kind of work on the ship as a result of cleaning operations and other work, neither from the dock, must be discharged into the river,

return water of cooling systems of the ship or other plants is to be discharged directly from the dock,

any measures in connection with the discharge of fluids in the dock need to be coordinated with the engineer/coordinator,

contamination by oil or paint (spillage) shall be stopped, spreading restricted and cleaning be started immediately,

if there is a danger that such contamination gets into the port waters, the emergency department needs to be called immediately (EMERGENCY NUMBER 20). Partner companies shall inform the object engineer/coordinator immediately,

in the event of an oil alarm, countermeasures need to be started immediately and to be continued until the danger does not exist any more,

the measures listed in the operating instruction Behaviour in the event of Oil Accidents need to be taken into account,

if there is a danger that oil contaminated water gets into the collection tank of the dock, the water treatment plant operator shall be informed immediately, to stop the extraction from the tank, the operation of the plant and to clean the system.

6.14 Medical service

In the event of an acute illness or injury, the medical service will provide first aid. A copy of an Accident Notice / first aid book entry will be submitted upon request.

The partner company and its subcontractors are responsible for the report to the relevant trade association.

Any accident at the yard subject to be reported shall be reported to the Work Safety and Environmental Protection department by submitting a copy of the Accident Notice sent to the trade association.

The partner company and its subcontractors undertake to keep records of the occupational health examinations that are required for certain jobs. Such health examinations may be performed by the Medical Service of Blohm+Voss B.V. & Co. KG against the reimbursement of costs.

Services provided by medical service personnel of Blohm+Voss B.V. & Co. KG (occupational physicians, assistants, paramedics, accident stations, etc.) and/or the provision of material (e.g. ambulant medical care, medical treatment of any kind, occupational health examinations, assessment of fitness for work, etc.) shall be reimbursed by the partner company and its subcontractors and will be invoiced by Blohm+Voss B.V. & Co. KG according to the prevailing scale of charges (unless a relevant service contract has been concluded with Blohm+Voss B.V. & Co. KG, including such services).

6.15 Fire prevention

The partner company and its subcontractors shall observe the Fire prevention regulations of Blohm+Voss B.V. & Co. KG.

At the end of work, the working area as well as the recreation and wardrobe rooms shall be left in such a state that an outbreak of fire or the danger of an accident are excluded.

The prohibition of hot work in specific areas has to be strictly followed.

Combustible transport packing must not be stored on board but has to be removed immediately.

The fire brigade has to be contacted for the delegation of fire watches (see Section 6.12.10 “Release of hot work”).

All persons working at the yard shall prevent accidents, the outbreak of fire and extinguish fires, if any.

6.15.1 Fire Prevention Regulations, Part A - Publicly displayed

The Fire Prevention Regulations, Part A (publicly displayed) applies to everybody at the yard of Blohm+Voss B.V. & Co. KG.

At present, either Part A “old“ or Part A “new“ of the Fire Prevention Regulations is displayed.

6.16 Liability and yard ban

Blohm+Voss B.V. & Co. KG shall not be liable neither for personal injury to the partner company or its employees or subcontractors and their employees respectively nor damage to equipment, tools, material and other objects of the partner companies or its employees or subcontractors and their employees respectively, unless resulting from wilful misconduct or gross negligence of legal representatives or senior managers of Blohm+Voss B.V. & Co. KG or its legal agents.

The partner company undertakes to keep Blohm+Voss B.V. & Co. KG free from any claims for damages claimed by employees of the partner company, their subcontractors or third parties and which result from the behaviour of the partner company or its employees at the yard.

If the partner company or its employees or its subcontractors or their employees repeatedly and seriously violate one or several regulations, Blohm+Voss B.V. & Co. KG is entitled to terminate the contract without notice and may, effective immediately, prohibit the partner company and its subcontractors from entering the yard. Irrespective of this, Blohm+Voss B.V. & Co. KG shall have the right to prohibit individual employees of the partner company or their subcontractors from entering the yard in the event of violation of the above-mentioned regulations. Any possible contractual obligation of the partner company vis-á-vis Blohm+Voss B.V. & Co. KG remains unaffected.

Driving and parking on the premises of the yard as well as the trespassing of facilities, docks and ships shall be at one’s own risk. Blohm+Voss B.V. & Co. KG shall not be liable for damage to property or economic loss of any kind, unless in the event of gross negligence (wilful intent or gross carelessness) of Blohm+Voss B.V. & Co. KG. In particular, Blohm+Voss B.V. & Co. KG shall not be liable for damage as a result of contamination. On the other hand, Blohm+Voss B.V. & Co. KG reserves the right to claim damages of any kind. Blohm+Voss B.V. & Co. KG shall be reimbursed in the event of any damage, costs and effort caused by the partner company or its subcontractors.

6.17 Recognition of the terms of work at the yard

The partner company recognizes the terms by completing the form Recognition of the terms of work at the Blohm+Voss B.V. & Co. KG yard in accordance with Section 9 Joint-valid documents.

7 Object- and activity-coordination

7.1 Recognition of the coordinator of Blohm+Voss B.V. & Co. KG pursuant to DGUV Regulation 1 Section 6

The partner company recognizes the object engineer/coordinator of Blohm+Voss B.V. & Co. KG of the relevant building site or project.

The recognition of the coordinator by the partner company is done by completing the form Recognition of the coordinator in accordance with Section 9 Joint-valid documents.

The form shall be completed without being requested to do so by Blohm+Voss B.V. & Co. KG before starting the work and submitted to the responsible object engineer/coordinator.

7.3 Explanatory notes on the coordination of work

Basically, the responsible object engineer/coordinator of Blohm+Voss B.V. & Co. KG is the first contact for any issue in connection with the execution of a project. The operational and yard-specific conditions need to be considered. Therefore, all measures shall be coordinated together with the responsible object engineer/coordinator.

7.4 Coordination of work according to DGUV Regulation 1

When the partner company passes on work to subcontractors the partner company has to appoint a person coordinating the work as far as this is required to avoid possible hazards. The partner company has to make sure that this person has the authority to give directions vis-á-vis the subcontractor and its employees.

When the partner company accepts orders the execution of which takes place at the same time and place other orders are executed by other partner companies the partner company undertakes to coordinate such work with the other partner companies as far as this is required to avoid possible hazards.

7.5 Particular provisions for committing partner companies not having received orders by Blohm+Voss B.V. & Co. KG

If, during execution of the work, a partner company passes on work to another partner company and this work is executed at the same time and place, it might be that, despite cautious and careful working of each group of workers, hazards may occur, unless each piece of work is matched to each other as regards time and contents. The partner company requesting the work therefore undertakes to nominate a coordinator. This partner company has to check, already when such work is requested, whether, at the time the execution is to take place, several groups of workers are working at the same place and time and whether hazards are possible. Both the own employees and the employees of other companies need to be considered. This applies to each partner company.

This also applies to companies that have been ordered by the customer directly and execute work on the premises of Blohm+Voss B.V. & Co. KG.

7.6 Tasks of the object engineer/coordinator of Blohm+Voss B.V. & Co. KG

An efficient coordination is only possible when the individual parties involved prepare a detailed job schedule before starting the work. Precondition for this, however, is that the object engineer/coordinator is informed about the start/end of the work, the number of workers and the work methods. Therefore, the object engineer/coordinator is entitled to ask each partner company for all documents required in this respect. The obligation to cooperate is stipulated in DGUV Regulation 1 Section 6.

7.7 Utilization of subcontractors

When a partner company utilizes subcontractors it shall inform the object engineer/coordinator on the required details (name of companies, responsible site managers and period of work). The partner company undertakes to coordinate the work with its own subcontractors according to legal provisions and in the same way. The partner company has to inform its subcontractors on the name of the object engineer/coordinator of Blohm+Voss B.V. & Co. KG before starting the work.

7.8 Authorization to give directives of the object engineer/coordinator of Blohm+Voss B.V. & Co. KG

The responsible object engineer/coordinator of Blohm+Voss B.V. & Co. KG is authorized to give directions vis-á-vis the partner company, its employees and vis-á-vis the subcontractors and their employees.

This authorization to give directives is the basic condition for an effective work of the object engineer/coordinator.

The object engineer/coordinator makes sure that deviations from the plan do not run out of control. In the event deviations are required or in the event of disorder in the schedule, which may result in hazards, the object engineer/coordinator shall change the job schedule accordingly. In such a case, work has to be stopped and may only be continued when the work schedule has been changed and the object engineer/coordinator has explicitly said to continue with the work. The object engineer/coordinator shall immediately inform the responsible person of the groups of workers on any important change in the schedule.

7.9 Coordination and arrangements with the object engineer/coordinator

7.9.1 Obligation to inform

The partner company has to make sure that its responsible site manager is available to the object engineer/coordinator before work is started and at least once a day for coordination purposes. Subject to coordination are the sequence of work, the progress of work and safety-relevant questions.

7.9.2 Obligation to inform

All accidents, incidents, damage or deviations from arrangements shall be immediately reported to the object engineer/coordinator.

The partner company and its subcontractors shall report accidents using the form Accident notice for partner companies according to Section 9 Joint-valid documents.

7.9.3 Work safety

Deficiencies or defects in safety devices, scaffolds, etc., missing facilities or conditions as well as other questions in connection with the execution of the orders shall be immediately reported to or discussed with the object engineer/coordinator. The object engineer/coordinator is entitled to demand risk assessments and operational procedures from the partner company and its subcontractors.

7.9.4 Hazardous substances

The transport, handling and storage as well as the processing of hazardous material has to reported to and discussed with the object engineer/coordinator before delivery to the yard. The procedures Delivery of hazardous material and Handling of hazardous substances have to be observed. Storage places have to be mutually agreed upon. For the handling of these hazardous substances, operational procedures need to be submitted or have to be prepared respectively.

7.10 Organization before starting the project respectively activity

Before starting work, the partner company shall be informed by the project manager or coordinator of Blohm+Voss B.V. & Co. KG on the project respectively activity organization.

For projects and activities requiring security cleared personnel, registration is required at least 7 days before starting the work.

Before starting to work, the partner companies shall inform the project management on the shift and site managers. These contacts will then be taken over into the project- respectively activity-specific telephone directory. Changes shall be reported to the project manager or coordinator immediately.

7.10.1 Daily reporting of the number of personnel of the partner company

The partner companies of Blohm+Voss B.V. & Co. KG are obligated to report the number of their own personnel and that of their subcontractors daily (day and night shift) for the respective day in writing,

including the work planned and the duration, to the operations office. Deviations shall be reported the next day.

The daily report of the number of personnel at the yard is done by submitting the form Daily report of services rendered by the partner company according to Section 9 Joint-valid documents. The form is available at the operations office Elbhalle Room 130.

This report shall be submitted by 8.00 h at the latest by fax : 040-3119-3447, over the telephone: 040-3119-8001, by e-mail: [email protected] or personally at the operations office.

This arrangement shall not be applicable to the naval order F125.

7.10.2 Announcement of weekend work of the partner company

The announcement of weekend work at the yard by the partner company is done by submitting the form Daily report of the partner company service according to Section 9 Joint-valid documents.

Work on weekends needs to be especially planned. Among others, crane service or energy supply need to be organized.

Related to the announced work to be carried out, the planning has to consider that neither work safety nor environmental protection are affected (e.g. availability of fire watches, crane operators). In the event of an accident or damage to the environment, it needs to be ensured that all measures of the alarm plan as well as rescue actions can take place unhindered (e.g. crane operators for the rescue of an injured person).

The planned work over the weekend has to be announced together with the announcement of the work on Fridays.

The scheduled number of personnel as well as the availability of the supervising person need to be provided. The announcement of work on Sundays and public holidays, including the statutory approval, shall be in the responsibility of the partner company. Statutory stipulations shall be observed.

7.10.3 Changing rooms, lockers, washing facilities, social rooms, canteen

Upon request, changing rooms with lockers and sanitary facilities can be provided for the employees of partner companies of Blohm+Voss B.V. & Co. KG and their subcontractors. The rooms will be allocated by the BU Production Services upon consultation of the object engineer/coordinator.

The employees have to lock the lockers themselves. Blohm+Voss B.V. & Co. KG shall not be liable for the items kept in the lockers or inside the rooms. Upon completion of the work, the lockers and the rooms shall be returned clean to the responsible person of Blohm+Voss B.V. & Co. KG . Abandoned, closed lockers will be opened and emptied by Blohm+Voss B.V. & Co. KG three days after completion of the work at the latest. The partner company and its subcontractors will be invoiced accordingly based on time and effort.

1 Scope

These work instructions apply to the work on board of any ship or watercraft and other objects at the yard, in the port or on sea, whenever hot work has to be performed in tanks or rooms where hazardous, flammable or harmful-to-health substances are or were stored.

The instructions also apply to tankers in accordance with "Instructions for work on or in the direct vicinity of tanks on tankers" (tanker regulations) when these tanks or rooms are outside the loading space. For cargo tanks on tankers, the tanker regulations are binding.

2 Procedure

The improper use and poorly serviced gas welding equipment, acetylene and oxygen hoses endanger the own life and the life of fellow workers!

The following instructions have been extracted from the current hazard assessment „Working on (with) acetylene lines (hoses)“ and need to be strictly observed. They are to ensure our health at work!

Any acetylene and oxygen hoses issued at the tool crib to Blohm+Voss employees or employees of other companies have been inspected. Each worker is personally responsible for the hoses he has received.

The unauthorized use of other hoses in not permitted.

Gas welding equipment, acetylene and oxygen hoses must only be repaired or modified by persons authorized to carry out such work.

Defective acetylene and oxygen hoses have to be returned to the tool crib and the tool crib personnel has to be informed about such defects.

Acetylene and oxygen hose connections have to be securely tightened to the gas distributor using a wrench (oxygen valve and acetylene non-return valve).

It is insufficient to tighten the union nut by hand only!

Acetylene and oxygen hoses to be connected to a supply station (distributor box) must not be stored in tool boxes, tool cabinets, etc.

When on board ship, each worker has to disconnect both hoses he has used from the distributor.

In addition to this, hoses need to be removed from confined spaces.

Acetylene and oxygen hoses have to be handed over to the tool crib at least every three months in order to be inspected. Only hoses issued by Blohm+Voss must be used. Inspected hoses are provided with an inspection sticker. The inspection sticker shows the date of the next inspection.

Mobile, electrical production equipment

such as electric drills, grinding machines, saws, portable lamps, extensions, etc. need to be handed over every six months at the latest to the tool crib, the electrical workshop or an authorized specialist company in order to be inspected. Inspected electrical equipment shows an inspection sticker. The inspection sticker shows the date of the next inspection.

Winches and chain blocks

have to be inspected at least once a year by an expert. Inspected winches and chain blocks are provided with an inspection sticker. The inspection sticker shows the date of the next inspection.

Steel wire ropes, lifting straps and belts have to be colour marked. Lifting straps and belts have to be marked with cable ties showing the respective colour for the year.

For correct colour codes, contact your customer.

Acetylene and oxygen hoses

have to be handed over to the tool crib at least every three months to be inspected. Only hoses issued by Blohm+Voss must be used.

Inspected hoses are provided with an inspection sticker.

The inspection sticker shows the date of the next inspection.

In addition to the safe operating procedure BA331 BUPS Crane operators and slingers, the following regulations shall apply:

All over the yard, signs have been attached prohibiting the slinging of loads by unauthorized persons.

These signs are to inform persons not permanently working at the yard. For further information, call 040-3119-8000 (dock office / object manager office).

Only persons with a valid authorization to sling loads (not older than one year) are authorized.

Employees and employees of partner companies holding such an authorization wear an orange hard hat.

Crane operators have been instructed only to transport loads that have been attached or checked by persons wearing such hard hat.

For working days after 20:00 h, Saturdays after 14:00 h and Sundays / public holidays, ship’s crews/inspectors have to be informed that scheduled deliveries need to be announced to the object engineer/coordinator.

1 Objective

The objective is to ensure the erection, release and safe working on scaffolds and to reduce or eliminate potential risks.

2 Scope of application

These work instructions apply to:

All scaffolds erected by scaffolding companies on the repair site of the yard and at the harbour.

All employees (own employees, transferred employees and employees of outside companies) working on the scaffolds.

The measures need to be contractually agreed upon through the purchase department, demanded by the object engineers and monitored by the production managers.

3 Terms and abbreviations

4 Procedure

In addition to the safe working procedure BA105 BU PS „Assembly work on scaffolds at the yard“, the following has to be strictly observed:

4.1 Erection of scaffolds

All scaffolds subject to the above-mentioned scope of application shall be erected only by scaffolding companies commissioned and approved by Blohm+Voss. This also applies to scaffolds to be used by outside companies commissioned by B+V.

The erection, conversion and removal as well as the modification of scaffolds must only be done by the commissioned and responsible scaffolding company.

Relevant signs in several languages (see Annex 1) have to be permanently attached by the scaffolding company.

When the assistance of scaffolders is required outside official working hours, e.g. for conversion, extension or additional anti-fall equipment after transport, the scaffolding company has to be notified in time, in exceptional cases 30 minutes in advance at the latest.

The site managers of the scaffolding companies have to support the production managers with the planning of scaffolds.

The width of the scaffold has to be at least 1 m wider at each side than required for working. The lowest platform needs to be considered with at least 1 m below the lower edge of the working area, unless the platform is only required as an access.

When the lowest platform of the scaffold is 3 m higher than the footprint of the scaffold a no-walk-on fall-breaking platform over the entire working area needs to be provided.

The distance of the fall-breaking platform must not be larger than 1.5 m. On the working side, the fall-breaking platform, which is to be provided with railings, has to be as close to the building/object as possible.

The fall-breaking platform must not be used for work, for putting down equipment or any other purpose.

Fall-breaking platforms have to be installed also below individual platforms such as deposit spaces. They have to be designed at least according to load class 4.

Scaffolds on rollers are not provided with a fall-breaking platform.

For surface scaffolds, alternatives for complete fall-breaking platforms need to checked in advance.

Access routes to the working area or the object need to be provided with flights of stairs.

Ladders are permitted only when the access ways are arranged outside the working area and when it is justified, i.e. a short time of use, a low rate of use / few transport activities. In case of doubt, a flight of stairs needs to be provided.

For scaffolds used as an escape route, flights of stairs have to be provided.

Outside ladders are permitted only for heights of less than 3 m above the footprint of a scaffold or a scaffold on rollers.

Stairs and ladders have to be arranged outside of working areas. For each section of a scaffold, the surface load extending over all platforms must not exceed 300 kg/m² (see Annex 3 showing an example). Permissible point-loads need to be discussed with the scaffolding company.

4.2 Releasing of scaffolds

Scaffolds not completed or closed off need to be provided with a sign (see Annex 2).

When the scaffold has been completely assembled the scaffolder arranges an inspection of the scaffold by a qualified person.

The result of the inspection is documented on a release/inspection card (see Annex 4) to be displayed at the scaffold in the plastic cover. An acceptance of the scaffold by the user in writing will not take place.

The contact data of the scaffolder need to be noted on the inspection card.

The scaffolding is to be checked daily by the scaffolder as contractually agreed. The expert of the scaffolding company documents the inspection with date and signature on the release card (Annex 4). The scaffolder has to inspect the completeness and condition of the components of the scaffold as well as the stability.

Load class 4 scaffolds are marked and released using a GREEN card indicating the load class and the permitted surface load of 300 kg/m² (see Annex 4).

When scaffolds, in exceptional cases and due to its design, can only bear a reduced load (e.g. scaffolds on rollers, suspended scaffolds, truss-out scaffolds, etc.) an ORANGE card is issued (Annex 4). Such scaffolds have a surface load restricted to 200 kg/m² according to load class 3.

When for special applications (transports, deposit spaces, crane deposit spaces) and for individual cases a higher, permitted surface load has been agreed with the scaffolding company the scaffolding company approves this space with the higher load class on the green inspection card.

When scaffold platforms are used by third parties, e.g. by crews for transport, the maximum permissible individual load and the permitted surface load need to be permanently marked in way of the scaffold.

For scaffold structures deviating from the recognized rules of scaffold construction, the scaffolding company has to hand over a stability calculation to the project manager before releasing the scaffold structure. This calculation shall be part of the project file.

4.3 Working with and on scaffolds

The precautions and behaviour regulations as explained in the safe working procedure BA105 BU PS „Assembly work on scaffolds at the yard “ shall be strictly observed.

Scaffold components must only be handled by scaffolders.

The independent changing, converting, extending or removing of scaffolds and constructing something with scaffold material, even the smallest platform trestles, is prohibited!

Scaffolders, production managers and any employee have to advise any person not complying with these regulations and report them, if necessary.

Scaffold material, frames, scaffolds on rollers, protective roofs and any other scaffold structures shall only be transported by scaffolders.

Scaffolds at propellers and rudders (propeller trestles) must only be moved by scaffolders.
