Town Planning Board Guidelines on Submission of Master Layout Plan underSection 4A(2) of the Town Planning Ordinance (TPB PG-No. 18A)

The Town Planning Board Guidelines on Submission of Master Layout Plan under Section4A(2) of the Town Planning Ordinance (TPB PG-No. 18A) are relevant to the applications.The major relevant points are as follows:

(a) the Town Planning Board may require all applications for permission in an area zonedas “Comprehensive Development Area” (“CDA”) to be in the form of the MasterLayout Plans (MLPs) and supported by other relevant information;

(b) in general, the MLP should include plans showing the location of the “CDA” site andthe general layout of the whole development, and a development schedule showing themain development parameters;

(c) if the “CDA” site is not under single consolidated ownership, the applicant should berequired to demonstrate that the proposed phasing of development has taken dueconsideration of the development potential of the lots which are not under hisownership. The corresponding gross floor area (GFA) and flat number distribution aswell as provision of Government, Institution and Community (GIC), open space andother public facilities in each phase should be clearly indicated;

(d) the MLP should be supported by an explanatory statement which contains an adequateexplanation of the development proposal, including such basic information as landtenure, relevant lease conditions, existing conditions of the site, the character of the sitein relation to the surrounding areas, principles of layout design, design population,provision of GIC, recreation and open space facilities including responsibility for theirconstruction cost and operation/management, vehicular and pedestrian circulationsystem including widths and levels of roads/footbridges and whether they would behanded back to the Government on completion; and

(e) additional information such as traffic impact assessment, environmental assessment,hazard assessment, visual impact assessment and drainage/sewage impact studies mayalso be required.

(o) design and construction of the proposed reclamation of the existing anchorage and theproposed seawall to the satisfaction of the Director of Agriculture and Fisheries or ofthe TPB;

(p) submission of a development programme and the implementation of the proposeddevelopment according to the programme to the satisfaction of the D of Plan or of theTPB;

(q) setting back of the park boundary and facilities from the Tsing Ma Control Area andthe Lantau Airport Railway Protection Area to the satisfaction of the Director ofHighways or of the TPB;

(r) design and provision of the architectural feature at the central hill top to a maximumheight of 70mPD with a view to addressing the potential visual impact to thesatisfaction of the D of Plan or of the TPB;

(s) design and provision of ferry and bus services to the satisfaction of the C for T or ofthe TPB;

(t) submission and implementation of a revised contingency transport plan for trafficarrangement in case of inclement weather or other emergency situations to thesatisfaction of the C for T or of the TPB;

(u) submission of an environmental assessment including a noise impact assessment and arevised ecological impact assessment, and the provision of mitigation measures to beidentified therein to the satisfaction of the DEP or of the TPB;

(v) submission of an assessment on the impact of the proposed development and otherplanned developments of Ma Wan on the water supply system in Ma Wan and, ifnecessary, the upgrading of water supply system, not limiting to submarine pipeline(s)and service reservoir(s), to cater for the additional water demand arising from theproposed development to the satisfaction of the Director of Water Supplies or of theTPB;

(w) submission and implementation of detailed plans for the preservation and restorationof historical relics, buildings and structures, including the kiln to the north-east of the

existing sheltered anchorage, the kiln near To Tei Kung Kok, the gable wall of theformer Custom Stations, Tin Hau Temple, commemorative tablets, a rock inscription“Mui Wai”, the Fong Yuen Primary School and other sites of historic importance tothe satisfaction of the Secretary for Home Affairs or of the TPB;

(x) submission of a detailed assessment of the potential noise impact of the proposeddevelopment on noise sensitive receivers including Fong Yuen School, and theimplementation of mitigation measures identified therein to the satisfaction of theDEP or of the TPB;

(y) submission of a supplementary ecological impact assessment with additionalinformation on habitat identification and compensatory planting, and theimplementation of mitigation measures identified therein to the satisfaction of theDirector of Agriculture, Fisheries and Conservation (DAFC) or of the TPB;

(z) estimation of the quantity of waste arising from the estimated visitor attendance andthe arrangement of the waste delivery to the satisfaction of the DEP or of the TPB. Itshould be demonstrated to the satisfaction of the DEP that this additional quantity ofwaste generated by visitors can be coped with by the waste transfer station to beprovided on the northern part of Ma Wan;

(aa) submission and implementation of detailed plans for the preservation and restorationof historical relics, buildings and structures, including the kiln to the north-east of theexisting sheltered anchorage, the kiln near To Tei Kung Kok, the gable wall of theformer Custom Stations, Tin Hau Temple, commemorative tablets, the rockinscription “Mui Wai” and any other sites of significant historic importance that maysubsequently be discovered within the application site to the satisfaction of theDirector of Leisure and Cultural Services (DLCS) or of the TPB;

(bb) submission and implementation of design of facade treatment and exterior appearanceof the renovation/refurbishment of existing village structures to the satisfaction of Dof Plan or of the TPB;

(cc) submission and implementation of emergency vehicular access, footpaths,loading/unloading and drop-off areas to the satisfaction of the C for T or of the TPB;

(dd) design and implementation of road connection to the adjoining proposed resort hotelat Ma Wan Lots Nos. 151, 214, 215, 218 and 219 to the satisfaction of the C for T orof the TPB;

(ee) submission and implementation of a comprehensive traffic and transport plan withcontingency transport measures in case of inclement weather or other emergencysituations for the entire Ma Wan development, including the proposed theme park inthe south of the Island, to the satisfaction of the C for T or of the TPB;

(ff) submission of a noise impact assessment on existing and proposed noise sensitivereceivers and the provision of mitigation measures including those to address theimpact of railway and aircraft noises to the satisfaction of the DEP or of the TPB;

(gg) submission of an ecological impact assessment with additional information on habitatand vegetation survey, fauna species record and the implementation of ecologicalmitigation measures to be identified therein to the satisfaction of DAFC or of theTPB;

(hh) design and implementation of the waste delivery arrangement to the satisfaction of theDEP or of the TPB;

(ii) design and provision of drainage and sewage treatment and disposal facilities to thesatisfaction of the Director of Drainage Services or of the TPB;

(jj) submission and implementation of archaeological investigation and detailed plans forthe preservation and restoration of historical relics, buildings and structures, includingthe kiln near To Tei Kung Kok, the gable wall of the former Custom Stations, TinHau Temple, commemorative tablets, a rock inscription “Mui Wai”, the Fong YuenPrimary School and other village structures of historical importance to the satisfactionof the DLCS or of the TPB;

(kk) submission of a development programme for full completion of Phases 1 and 2 andthe implementation of the proposed development according to the programme to thesatisfaction of the D of Plan or of the TPB;

(ll) design and implementation (including the submission of the operational arrangement)of Coach Area 1 for Ma Wan Park Phase I, and Coach Area 2 for future Ma Wan ParkPhase II, transport contingency and overflow from other recreation/tourismdevelopments in Ma Wan to the satisfaction of the C for T or of the TPB;

(mm) submission and implementation of a comprehensive traffic and transport plan with aneffective control mechanism for coach access to Ma Wan and contingency transportmeasures in case of inclement weather or other emergency situations for the entire MaWan development (including the proposed theme park in the south of the Island) tothe satisfaction of the C for T or of the TPB;

(nn) design and provision of the proposed facilities and vehicular access underneath MaWan Viaduct including the protective measures for the Viaduct to the satisfaction ofthe Director of Highways or of the TPB;

(oo) submission of a noise impact assessment on existing and proposed noise sensitivereceivers and the provision of mitigation measures including those to address thenoise impact of railway and aircraft, and outdoor performance venues in the proposeddevelopment to the satisfaction of the DEP or of the TPB; and

(pp) submission and implementation of archaeological investigation or detailed plans forthe preservation and restoration of historical relics, buildings and structures, includingTin Hau Temple at Ma Wan Town, Stone Tablets of the Old Kowloon Customs and arock inscription “Mui Wai” to the satisfaction of the DLCS or of the TPB.

(a) to note the comments of the District Lands Officer/Tsuen Wan & Kwai Tsing(DLO/TW&KT) of the Lands Department (LandsD) that the applicants should apply toher office for rebuilding on the lots. The rebuilding applications, if received, will beconsidered by LandsD acting in the capacity as the landlord at its sole discretion andthere is no guarantee that such applications will be approved. In the event any suchapplications are approved, they will be subject to such terms and conditions, includingamong others, the payment of requisite fees, as may be imposed by LandsD;

(b) to note the comments of the Chief Building Surveyor/New Territories West of theBuildings Department that in case DLO/TW&KT decides not to issue the certificates ofexemption for the site formation works and/or drainage works associated with the NewTerritories Exempted House developments, such works will require prior approval andconsent under the Buildings Ordinance. In the circumstance, an Authorized Personshould be appointed as the coordinator for the proposed works;

(c) to note the comments of the Director of Fire Services that the fire safety requirements asstipulated in “New Territories Exempted Houses – A Guide to Fire SafetyRequirements” published by LandsD should be complied with; and

(d) to note the comments of the Director of Drainage Services that the a minimum size of200m diameter for the sewerage should be used as required in Section 5.1.1 ofSewerage Manual.
