    JUDGMENTThe appeal from the judgment of the FederalCourt of Appeal, Number A-208-09, 2009FCA 246, dated August 14, 2009, heard onNovember 13, 2009, is allowed in part withcosts to the respondent. The application forjudicial review of the government's decisionand policy not to seek the repatriation of therespondent is allowed in part. This Courtdeclares that through the conduct ofCanadianofficials in the course of interrogations in2003 and 2004, as established on theevidence, Canada actively participated in aprocess contrary to its international humanrights obligations and contributed to therespondent's ongoing detention so as todeprive him ofhis right to liberty and securityof the person guaranteed by s. 7 of theCanadian Charter of Rights and Freedoms,contrary to the principles of fundamentaljustice.

    JUGEMENTL'appel interjete contre l'arret de la Courd'appel federale, numero A-208-09, 2009CAF 246, en date du 14 aout 2009, entendu Ie13 novembre 2009, est accueilli en partie avecdepens en faveur de l'intime. La demande decontr6le judiciaire de la decision dugouvernement et de sa politi que de ne pasdemander Ie rapatriement de l'intime estaccueillie en partie. La Cour declare que,compte tenu de la conduite de responsablescanadiens lors d'interrogatoires menes en2003 et 2004, telle qu'elle est etablie par lapreuve, Ie Canada a activement participe 11 unprocessus contraire aux obligationsinternationales qui lui incombent en matierede droits de la personne et a contribue 11 ladetention continue de l'intime, de telle sortequ'il a porte atteinte 11 son droit 11 la liberte et11 la securite de Ia personne que lui garantitI'art. 7 de la Charte canadienne des droits etlibertes, et ce, de maniere incompatible avec Ce._QS e justice fondamenlale.
