Maratha reservation: SC to beginday-to-day hearing from July 27

AGENCYNEW DELHI, JULY 15

The Supreme Court onWednesday announced that itwill start from July 27 day-to-day final hearing on thepetitions challenging theconstitutional validity of aMaharashtra law grantingreservation to the Marathacommunity in education andjobs. A bench headed by JusticeL Nageswara Rao said that thefinal hearing on the matter willbegin from July 27 on a day-to-day basis through videoconference as the chances ofphysical hearing are bleakbecause of the COVID-19pandemic. The apex court askedthe lawyers appearing for all theparties to decide amongstthemselves the modalities of thehearing and who will take howmuch time.

The top court also refusedto pass an interim stay on theorder of the Bombay HighCourt, which upheld theconstitutional validity of theMaharashtra law, observing thatthe same was also declined by itearlier.

During the hearing, senioradvocate Shyam Divanappearing for one of thepetitioners submitted before theSupreme Court that this type of

a case needs to be heard in aphysical court. Petitionersargued that the reservationbreaches the 50 per cent ceiling

set by the Supreme Court forreservations in each State, andclaimed that the High Courtoverlooked certain fundamental

and legal clauses. They alsoargue that the state does nothave the authority or law tocreate a class like Maratha as aseparate socially andeducationally backward class. This should only be under theauthority of the UnionGovernment and not the Stategovernment, petitioners'lawyers argued. The bench washearing two appeals, includingone filed by J Laxman Rao Patilchallenging the Bombay HighCourt order that upheld theconstitutional validity of thequota for the Marathacommunity in education andgovernment jobs in the state.

The Bombay High Courthad on June 27, 2019, observedthat the 50 per cent cap on totalreservations imposed by theSupreme Court could beexceeded in exceptionalcircumstances.

Another appeal filed byadvocate Sanjeet Shukla, arepresentative of 'Youth forEquality', said the Socially andEducationally BackwardClasses (SEBC) Act, 2018,enacted to grant reservation tothe Maratha community peoplein jobs and education, breachedthe 50 per cent ceiling onreservation fixed by the topcourt in its judgment in theIndira Sawhney case.

The Supreme Court verdict bestowing the role ofshebait (manager) of the deity of the famed SreePadmanabhaswamy temple in Thiruvananthapu-

ram on the erstwhile royal family of Travancore andproviding for the formation of two committees for itsmanagement will hopefully bring closure to the vexa-tious issue of heirship and administration which hasbeen lingering for over a decade. While the exroyals willcontinue to be the trustees, the temple would now be runby a five-member administrative committee, headed bythe district judge of Thiruvananthapuram and have thechief priest, a representative each of the trustee, the gov-ernment of Kerala and the Union ministry of culture. The committee will function under the guidance of athree-member advisory committee, headed by a retiredjudge of the Kerala High Court; its other members willbe a nominee of the trustee and a reputed chartered ac-countant. The court has also ordered the audit of thetemple accounts for the last 25 years, in an attempt tobring transparency in the running of the great temple, which rose to international fame after a court-orderedaudit of its inventory of discovered treasures in the formof gold and precious stones worth several lakh crore ru-pees deposited in its underground storage. The apexcourt order has come on an appeal filed by UthradomThirunal Marthanda Varma, the head of the ex-royalfamily, against the 2011 order of the Kerala High Courtdirecting the Kerala government to take control of thetemple after finding that the family had no legal backingto administer the temple once the last ruler of Travan-core Sree Chithira Thirunal Balarama Varma passedaway in 1991. The Supreme Court has in effect broughtthe temple, which has been exclusively and continuouslymanaged by the royals at least for the last two-and-a halfcenturies, under the control of a new system which re-flects the democratic transition of the nation: three out offive members in the administrative committee now rep-resent the state. This is a welcome move. It is a fact thatthe issue of administration of royal-run temples can cre-ate troubles for a secular democracy as its principlescould be in conflict with the claims presented by cus-toms, rituals and traditions. The courts will naturally becalled upon to adjudicate between them. The court’s jobin this case was made easier by the ex-royals, whochanged their stance mid-way and told the court that thetemple was no longer a private property. It must be re-membered that the historic order of the Supreme Courtallowing women’s entry to the hill shrine of Sabarimalabased on constitutional principles of equality has notbeen able to bring closure to the issue as yet.

The ASEAN Forum on sub-re-gional development held in Hanoion July 14 was the first activity ofthe bloc to discuss measures to cre-ate harmony and connect theMekong sub-regional cooperationprogrammes with ASEAN and oth-er sub-regions, thus contributing tothe common goal of narrowing de-velopment gaps in ASEAN andbuilding a strong ASEAN Commu-nity, he said. Raising some solu-tions to promote coordination andconnectivity among economic cor-ridors of ASEAN's sub-regions,Dung said the involved partiesshould work together to devisepolicies and mechanisms to addressborder gate issues. tance of physical to digital connec-tivity. In this post-COVID-19 peri-od, digital connectivity is becom-ing more and more important tosubstitute and complement physi-cal connectivity.

Since 1992, ADB and otherdonors have supported the cooper-ation of Greater Mekong Sub-re-gion, which comprises Cambodia,Laos, Myanmar, Thailand, Vietnamand China's Yunnan Province andGuangxi Zhuang Autonomous Re-gion.

"We [ADB] have worked inthree different layers, firstly, work-ing directly within ASEAN,Greater Mekong Sub-region. Sec-ondly, we have worked on cross-border projects, in which two coun-tries will be connected better.Thirdly, we have worked in-coun-try projects. Each country will in-crease capacity to be connectedwith others," he told media.

Caitlin Wiesen, UNDP Resi-dent Representative in Vietnam, shared several challenges in theMekong River Basin due to fast so-cio-economic development exacer-bated by climate change. They in-clude extreme droughts, forestfires, flash floods, heavy rains, ris-ing sea levels, typhoons and salt-water intrusion. Examining the association be-tween eight different types of ELSand youth-onset depression, theauthors found that while sometypes of ELS were not associatedwith MDD, other types of stress, including emotional abuse, wereassociated more strongly withMDD than a broader assessmentof ELS.

"Researchers have document-ed that early life stress increasesthe risk of developing depressionin adulthood. We wanted to knowthe degree to which it was associ-ated with depression earlier inlife--specifically during childhoodor adolescence," said lead authorJoelle LeMoult, PhD, a researcherat the University of British Co-lumbia, Vancouver, Canada.

"Given that earlier onset ofdepression often mean a more re-current course across the lifespan. We found that exposure to earlylife stress more than doubled thelikelihood someone will develop

youth-onset depression. Thesefindings indicate that there is anarrow window between adversi-ty and depression during whichwe have the opportunity to inter-vene," added LeMoult.

The findings are based on ameta-analysis of data from 62journal articles and over 44,000unique participants. Studies thatassessed early life stress and thepresence or absence of MDD be-fore the age of 18 years were alsoincluded. Compared to youth whowere not exposed to ELS, youthwho were exposed to ELS were

2.5 times more likely to developMDD (OR=2.50; 95 per cent CI[2.08, 3.00]). The authors alsoconducted eight additional meta-analyses to examine the associa-tion between different types ofELS and a diagnosis of MDD dur-ing childhood or adolescence.Sexual abuse, physical abuse, death of a family member, domes-tic violence, and emotional abusewere associated with a significant-ly higher risk for youth-onsetMDD; in contrast, poverty, ill-ness/injury, and exposure to a nat-ural disaster were not.

Five years ago, NASA'sNew Horizons space-craft made history. Af-

ter a voyage of nearly 10years and more than 3 billionmiles, the intrepid piano-sized probe flew within7,800 miles of Pluto. For thefirst time ever, we saw thesurface of this distant worldin spectacular, colored detail.

The encounter -- whichalso included a detailed lookat the largest of Pluto's fivemoons, Charon -- capped theinitial reconnaissance of theplanets started by NASA'sMariner 2 mission more than50 years before, and revealedan icy world replete in mag-nificent landscapes and geol-ogy -- towering mountains, giant ice sheets, pits, scarps, valleys and terrains seennowhere else in the solar sys-tem.

In the five years sincethat groundbreaking flyby, nearly every conjecture aboutPluto possibly being an inertball of ice has been thrownout the window or flipped onits head.

"It's clear to me that thesolar system saved the bestfor last! We could not haveexplored a more fascinatingor scientifically importantplanet at the edge of our so-lar system. The New Hori-zons team worked for 15years to plan and execute thisflyby and Pluto paid us backin spades!" said Alan Stern,New Horizons principal in-vestigator from the South-west Research Institute,Boulder, Colorado.

Scientists now knowthat, despite it being literallyout in the cold, Pluto is an

exciting, active and scientifi-cally valuable world. Incredi-bly, it even holds some of thekeys to better understand theother small planets in the farreaches of our solar system.

Here are 10 of thecoolest, weirdest, and mostunexpected findings of thePluto system that scientistshave learned since 2015,thanks to data from NewHorizons. Pluto has a"heart," and it drives activityon the planet Pluto's heart --one of the signature featuresNew Horizons observed onapproach and imaged in highresolution during the flyby --is a vast, million-square-milenitrogen glacier. The heart'sleft ventricle, called SputnikPlanitia, literally forced thedwarf planet to reorient itselfso the basin now faces al-

most squarely opposite Plu-to's moon Charon.

"It's a process called truepolar wander -- it's when aplanetary body changes itsspin axis, usually in responseto large geologic processes,"said James Tuttle Keane, aplanetary scientist and NewHorizons team member at theJet Propulsion Laboratory inPasadena, California.

Sputnik Planitia's currentposition is no accident. It's acold trap, where nitrogen iceshave accumulated to make anice sheet that's at least 2.5miles (4 kilometers) thick. The constant imbalance ofthat hefty mass, combinedwith the tidal yanks and pullsof Charon as it orbited Pluto, literally tipped the dwarfplanet so the basin alignedmore closely with the tidal

axis between Pluto andCharon. "That event was alsolikely responsible for crack-ing Pluto's surface and creat-ing the many gigantic faultsin its crust that zigzag overlarge portions of Pluto,"Keane said. The basin isthought to have formed to thenorthwest of its present loca-tion, and closer to Pluto'snorth pole. And should icescontinue to accumulate onthe basin, Pluto will continueto reorient itself.

There's probably a vast,liquid, water ocean sloshingbeneath Pluto's surface

Gathered ices may not bethe only thing that helped re-orient Sputnik Planitia. NewHorizons data from the basinindicated there may be aheavier mass beneath it thatplayed a part, and scientists

suspect that the heavier massis a water ocean.

"That was an astonishingdiscovery. It would makePluto an elusive 'oceanworld,' in the same vein asEuropa, Enceladus and Ti-tan," said James TuttleKeane, a planetary scientistand New Horizons teammember at the Jet PropulsionLaboratory in Pasadena, Cal-ifornia. Several other lines ofevidence, including tectonicstructures seen in New Hori-zons imagery, also point toan ocean beneath Pluto'scrust. Sputnik Planitia waslikely created some 4 billionyears ago by the impact of aKuiper Belt object 30 to 60miles (50 to 100 kilometers)across that carved out a mas-sive chunk of Pluto's icycrust and left only a thin, weak layer at the basin'sfloor.

A subsurface ocean like-ly intruded the basin frombelow by pushing up againstthe weakened crust, and laterthe thick layer of nitrogen iceseen there now was laid ontop.

Recent models based onimages of the planet suggestthat this liquid ocean mayhave arisen from a rapid, vio-lent formation of Pluto.

Pluto may still be tecton-ically active because thatocean is still liquid

Enormous faults thatstretch for hundreds of milesand cut roughly 2.5 milesinto the icy crust coveringPluto's surface. One of theonly ways scientists reasonPluto got those fissures, though, is by the gradualfreezing of an ocean beneath

its surface.Water expands as it

freezes, and under an icycrust, that expansion willpush and crack the surface, just like an ice cube in yourfreezer. But if the tempera-ture is low enough and thepressure high enough, watercrystals can start to form amore compact crystal config-uration and the ice will onceagain contract.

Models using New Hori-zons data showed Pluto hasthe conditions for that type ofcontraction, but it doesn'thave any known geologicfeatures that indicate thatcontraction has occurred. Toscientists, that means thesubsurface ocean is still inthe process of freezing andpotentially creating newfaults on the surface today."If Pluto is an active oceanworld, that suggests that theKuiper Belt may be filledwith other ocean worldsamong its dwarf planets, dra-matically expanding thenumber of potentially habit-able places in our solar sys-tem," said James TuttleKeane, a planetary scientistand New Horizons teammember at the Jet PropulsionLaboratory in Pasadena, Cal-ifornia.

But while Pluto's liquidocean likely still exists today, scientists suspect it's isolatedin most places (though notbeneath Sputnik) by almost200 miles (320 kilometers)of ice. That means it proba-bly doesn't contact the sur-face today; but in the past, itmay have oozed through vol-canic activity called cryovol-canism.

War has a romance attachedto it. Those who don’t haveto fight it love the richness

of its lore and the glory of heroism itbrings in its wake. It’s always beenlike that and will always remain. What it takes to display raw couragelike that exhibited by Col. SantoshBabu and Sepoy Gurtej Singh atGalwan can hardly ever be ex-plained: our salute to them.

That is about the front lines, butwell behind and in between are anequal number of heroes who toilhard to ensure that the front lines arealways kept well supplied withouthaving to look back over their shoul-ders. Rarely are they given therecognition they deserve for thesleepless nights in planning and ex-ecution of operational logistics, which ensures field commandersand troops are always ready to gointo action. I recall a moment at HQ

Northern Command when a senioroperational logistics officer wasasked what he did for his livingwhile the operations staff and for-mations were busy fighting adver-saries and terrorists. Pat came his re-ply to the boss: “I don’t do much. It’s just that there are over 3,000Army vehicles on the roads in J&Kevery day. I ensure their fuelling, re-pair, accident cover, recovery andtraffic control. There are about10,000 troops also on the roads, rail-way stations or airports at any onetime. Moving, accommodating andfeeding them are my responsibility.Should I tell you how many tons offood my staff and logistics units liftfor advance winter stocking everyday by multiple modes of transport?Transit arrangements for all thesebecome imperative.” That is whenhe was asked to stop, or he may havecarried on for another hour describ-

ing his responsibilities related tohabitat, snow clearance, ammuni-tion, labour and what have you. Thatshould give you an indicator of whatis happening up in Ladakh and allthe way down to Udhampur andPathankot. There will be officerspouring over their staff tables andlogistics units working 24x7 to en-sure that every single item requiredfor engagement in operations iscatered for and supplied in sufficientquantity at the right place and theright time. Military contractors willhave their hands full with a multi-tude of items, including transport re-sources. While disengagement is inprogress in Ladakh after the recentdeliberations by military command-ers, intervention by the national se-curity adviser and political owner-ship by the Prime Minister throughhis visit to Leh, it is clear that Chinasimply can’t be trusted.

handigarh: A pulse oximeter (POM-600) by an Indian company with calibration certification apart from being 100% non-Chinese product was Claunched today. The oximeter by Protonic Medical Systems (PMS) will

come as a great relief in the current Covid–19 pandemic as SpO2 (saturated partial oxygen) measurement is the vital parameter for the patients who are suffering from corona virus. Moreover the calibration certification of the product is utmost important & ensures the exact reading of the device. This noninvasive tool attaches painlessly to fingertip, sending two wavelengths of light through the finger to measure pulse rate and how much oxygen is in one’s system.Aditya Kumar Mohapatra, MD of Protonic Medical Systems Pvt Limited said that in 2002, we have manufactured plasma NTP air sterilizers indigenously and installed in various Institution are in high demand for present scenario of corona pandemic. We are making Indian innovations to manufacture high end technology products. PMS has also developed indigenously manufactured digital infrared thermometer. He said that a study describing the pathological lung changes on CT scans of completely asymptomatic Covid-19 patients , has found that even patients with advanced Covid-19 may show no specific symptoms of respiratory disease. “While asymptomatic carriers of virulent infections are not uncommon, what is worrisome with Covid-19 is that disguised under asymptomatic illness is underlying organ damage.” The research has found lesions consistent with inflammation of the underlying lung tissue, which is not specific to Covid-19 and can be seen in many other forms of lung disease. However, what is bizarre is how despite these changes, patients do not show symptoms of pneumonia or respiratory issues, such as severe shortness of breath. So it becomes more relevant to constantly monitor the SpaO2 or blood oxygen level of the patients & as soon as it drops from less than 95%, patients should immediately contact the treating doctor or Hospital, asserted Mohapatra.

"However many of us, includingmyself, have borne the brunt of thesedelusions and have crazy stories to tellwhich is why it makes it even more ad-mirable to see exceptional youngsters

like @lungingidi doing his bit to repre-sent us all. Thank you brother and allthose who stand up for just causes intheir own way - publicly and privately,"he added. AGENCYNEW DELHI, JULY 15

The Indian cricket team's six-match limited-overs home series against England sched-uled in September is all set to be postponedalong with New Zealand A's visit of thecountry next month due to the COVID-19pandemic.

The BCCI is yet to make any formal an-nouncement in this regard but it is expectedthat it will happen soon.

"England were supposed to play sixgames (three ODIs and three T20 Interna-tionals) during late September. Obviously inthe current circumstances England won't betravelling to India," a senior BCCI officialtold a news agency on conditions of

anonymity.India's Future Tours and Program (FTP)

calendar will be among the main topics ofdiscussion during the BCCI Apex Councilmeeting on Friday. "But I guess a formal an-nouncement will happen once the FTP issueis discussed as it's part of the agenda duringFriday's Apex Council meeting. NewZealand A had a tour of India scheduled inAugust and even that's also unlikely to goahead," the official said.

According to reports in the British me-dia, the white ball tour may now happen inSeptember, next year.

India currently have over 9 lakh positivecases of COVID -19 and the death toll isinching towards the 25,000 mark. India'scase load is the third highest in the world.

Even if the situation in India improvesby September, there was very possibility ofEngland coming.

"Our (BCCI) president (Sourav Gangu-ly), in a recent interview, said that they areplanning for a camp in August if the situa-tion permits. It's common sense that underthese circumstances, no matches can beheld," the official added.

Also, the England tour was scheduled inthe last week of September and with the ICCT20 World Cup in Australia set to be post-poned, the IPL is expected to kick off dur-ing that phase either in India or abroad.

India's cricket team was last seen in ac-tion in March in a series against SouthAfrica at home, which had to be called offmidway because of the pandemic.

"As we saw in the first innings,it was still there a bit, but in thesecond he controlled it a lot better. And that helped him to bring homethe game for us," he added.

En route to the target, Black-wood again formed a solid partner-ship with Shane Dowrich. The

right-handed batsman smashed 95runs as West Indies defeated Eng-land by four wickets.

Blackwood now has an aver-age of 55.00 against England inseven Tests.

"Try to get him irrational, but Ithink he held his own. He looked atthe situation and played it as wellas he could have. So that showsthat his mindset is improving, andthat's all you can ask for," saidSimmons
