Energy Performance Certificates – What are they, why are they important and why is the 1st of April 2018 is important?

What is an EPC?Broadly speaking, since 2008 an Energy Performance Certificate (EPC) has been required when a property is built, sold or let, subject to a limited number of exceptions. It may also be necessary where a building has been modified to include certain services such as that which condition the indoor climate (e.g. air conditioning).An EPC must be carried out by an accredited Energy Assessor. It will provide information to the potential owner or tenant as to the property’s energy use and costs together with a recommendation report as to how to reduce energy usage and reduce costs. The report will remain valid for 10 years unless superseded.

Exempt PropertiesThe few limited exceptions where an EPC will not be required are as follows.• listed or officially protected and the minimum energy

performance requirements would unacceptably alter it*

• a temporary building only going to be used for 2 years or less• used as a place of worship or for other religious activities• an industrial site, workshop or non-residential agricultural

building that doesn’t use much energy• a detached building with a total floor space under 50 sqm• due to be demolished by the seller or landlord and they

have all the relevant planning and conservation consents*Listed buildings are not necessarily automatically exempt from the requirement to have an EPC and the onus will be on the property owner to understand whether their property is required to have an EPC or not. Advice from an approved assessor is advised.

Vacant buildings and demolitionA building is also exempt if all of the following are true:• it’s due to be sold or rented out with vacant possession• it’s suitable for demolition and the site could be redeveloped• the buyer or tenant has applied for planning permission

to demolish it

April 2018 – Minimum Energy Efficiency Standards As of 1st April 2018 Landlords will not be able to let a property or renew an existing tenancy if the property in question has an EPC rating of below E (i.e. F or G).

Where a property is already let and has an with a rating of band F or G there will be a backstop date of 1st April 2020 for residential properties and 1st April 2023 for non-domestic property. Failure to comply may result in a fine for non-compliance.

What to do if your property is rated F or GContact an approved Energy Assessor and have an up to date EPC carried out to ensure that it is up to date and in order for the appropriate measures to be identified within the recommendation report. You will then need to carry out the measures identified within your recommendation report for improving your property’s performance. Your Energy Assessor will be able to advise of how to proceed with the improvements and then, once complete, obtain a further EPC to show the new energy rating.

There are limited exemptions and where you believe that your F or G rated property qualifies for an exemption it must be registered on the PRS Exemptions Register which will be available via .Gov.Uk website 1st October 2017.
