This application is accompanied by an Environmental Impact Statement (EIS) and a Natura Impact Statement (NIS). This application relates to a development that will require an Industrial Emissions Directive licence from the Environmental Protection Agency.

The Planning Application, EIS and NIS may be inspected or purchased at a fee not exceeding the reasonable cost of making a copy at the offices of the Planning Authority during its public opening hours (9.30- 16.30 Monday- Friday) at Fingal County Council, Grove Road, Blanchardstown, Fingal, Dublin 15. Conditions and Reasons

1. The development shall be carried out in its entirety in accordance with the plans, particulars, specifications, and information lodged with the application on the 15th August 2013, save as may be required by the other conditions attached hereto.

REASON: To ensure that the development shall be in accordance with the permission and that effective control be maintained.

2. The tonnage of waste accepted for treatment at the facility shall not exceed 90,000 tonnes per annum.

REASON: To clarify the nature and scope of the permitted development.

3. All ameliorative proposals contained within the EIS shall be strictly complied with.

REASON: In the interests of the proper planning and development of the area.

4. The hours of operation of the proposed facility shall be as stated in the environmental impact statement. (i.e. on a continuous basis 24 hours per day and seven days per week)

REASON: In the interest of protecting the amenities of the area.

5. Waste shall be accepted into the proposed facility and outputs shall depart from the proposed facility only between 0700 to 1800 hours on Monday to Saturday inclusive. No deliveries shall take place on Sundays or Bank Holidays.

REASON: To protect the amenities of property iri the vicinity.

6. Site development and building works shall be carried out only between the hours of 08.00 to 18.00 Mondays to Fridays inclusive, between 09.00 to 13.00 on Saturdays and not at all

exceptional circumstances where prior written approval has been received from the planning authority.

REASON: In order to safeguard the amenities of property in the vicinity.

7. Artificial light sources relating to the proposed development shall be designed to avoid light nuisance at sensitive sources. Lighting shall be positioned and fixed to be directed downwards and inwards to the site.

REASON: To protect the amenities of property in the vicinity and to minimise light pollution

8. a) The applicant is required to employ a qualified archaeologist to monitor all ground works associated with the development.

b) Should archaeological material be found during the course of monitoring, the archaeologist may have work on the site stopped, pending a decision as to how best to deal with the archaeology. The developer shall be prepared to be advised by the Department of Arts, Heritage and the Gaeltacht with regard to any necessary mitigating action (e.g. preservation in situ, or excavation) and should facilitate the archaeologist in recording any material found.

c) The Planning Authority and the Department of Arts, Heritage and the Gaeltacht shall be furnished with a report describing the results of the monitoring.

REASON: To ensure the continued preservation (either in situ or by record) of places, caves, sites, features or other objects of archaeological interest.

9. Details relating to tonnage, origin, destination, composition and nature of material arriving and departing from the proposed facility shall be recorded and made available to the planning authority on an annual basis.

REASON: To provide for monitoring of material utilising the facility and to assist in assessing impact on the road network.

a) Prior to commencement of development the applicant shall submit for the written agreement of the Planning Authority a project construction and demolition waste management plan for development at this site. ·

b) Prior to commencement of development a detailed survey of the entire site to identify potentially in-scope equipment including transformers, capacitors, power factor correction units, switchgear, welders, lighting ballasts and other equipment that may contain PCB which may not have been previously identified; and verify the PCB contamination status of any in-scope equipment:

(i) Via documentation from equipment suppliers/manufacturers, or as appropriate. (ii)Via testing using an analytical method conforming to IEC 61619.

c) All storage tanks shall be surrounded by a bund capable of retaining 110% of the volume of the largest single tank within the bunded area. The intake and outlet for the tanks shall be positioned inside the bund. Provision shall be made to remove and dispose of the rainwater so as to ensure the specified volume is always available within the bund.

11. (a) Prior to the commencement of development, the applicant, or an agent acting on behalf of the application, shall submit, for the written approval of the Planning Authority & the Environment Department either

~

(i) Evidence of a determination by the Environmental Protection Agency under Article 27 of the European Communities (Waste Directive) Regulations, 2011 for any feedstock to the anaerobic digester,

Or,

(ii) A declaration from the Environmental Protection Agency on the requirement for a waste licence, waste facility permit or certificate of registration under Article 11 of the Water Management (Facility Permit & Registration) Regulation, 2007, as amended for the feedstock proposed in this application or any amended feedstock material.

(b) The applicant, or an agent acting on behalf of the application, shall comply with the advice provided by the Environmental Protection Agency under an Article 11 request in relation to the requirement for a waste licence, waste facility permit or certificate of registration in advance of the operation of this development or any change made to the operation.

REASON: In the interest of environmental protection.

12. That a comprehensive landscape plan with full specifications and bill of quantities including screen planting shall be submitted and agreed in writing with the Planning Authority prior to the commencement of development on site. Landscaping and boundary treatment works shall be completed prior to the operation ofthe proposed development. Additional screen planting shall be incorporated along the southern boundary of the site to screen the proposed development at this location.

REASON: In the interests of the proper planning and development of the area.

13. During the construction phase of the proposed development, noise levels at the site (when measured at noise sensitive locations in the vicinity) shall not exceed 55 dB(A) between 0800 and 2000 hours, Monday to Friday inclusive, and 0800 and 1300 hours on Saturdays, and shall not exceed 45 dB( A) at any other time. The hours of construction shall be confined to the period indicated above except in the event of emergencies.

REASON: To protect the amenities of property in the vicinity.

14. Prior to the acceptance of waste, dust levels at the site boundary and sensitive locations shall not exceed 350 milligrams per square metre per day averaged over a continuous period of30 days (BergerhoffGaugc). Details of a monitoring programme for dust shall be reviewed on an annual basis and these reviews shall be submitted for the written agreement

-of the Planning Authority. The developer shall carry out any amendments to the

programme required by the planning authority following the annual review.

REASON: In the interest of maintaining the amenity of adjoining landowners.

Prior to the commencement of development the applicant is advised to liaise with the Greater Dublin Drainage Project Team regarding the exact construction details of the proposed rising main such that this can be incorporated into the final design ofthe GOD pipeline.

16. The water supply aud drainage infrastructure, including the disposal of surface water, shall comply with the following technical requirements of the Planning Authority:

a) Prior to commencement of development the applicant shall agree in writing the details and requirements of the Water Services, Operations Section with regard to the extent of new network required and the connection to the public foul system.

b) Foul sewage pumping stations shall comply with Fingal County Council Mechanical Section's "Requirements and Standards for Submersible Sewage Pumping Stations" June 2008

c) Prior to commencement of development, the applicant shall agree in writing the details of the bunding arrangements surrounding the anaerobic digestion area and the waste water treatment plant.

d) Foul sewage pumping stations shall comply with Fingal County Council Mechanical Section's "Requirements and Standards for Submersible Sewage Pumping Stations" June 2008

e) No foul drainage shall discharge into the surface water system under any circumstances.

f) The foul drainage shall be in compliance with the "Greater Dublin Regional Code of Practice for Drainage Works Version 6.0" FCC April 2006.

g) Prior to the commencement of development the applicant shall submit details of measures to minimise the risk of water pollution from the consttuction site during the construction stage. Details of the control of water pollution from construction sites should be in accordance with CIRIA C532 "Control of water pollution from constmction sites. Guidance for consultants and contractors" or similar approved.

h) Prior to the commencement of development the applicant shall agree in writing with the Water Services, Planning and Strategic Infrastmcture Department the details of the storm cell attenuation area.

i) No surface water/ rainwater shall discharge into the foul sewer system under any circumstances.

j) The surface water drainage shall be in compliance with the "Greater Dublin Regional

REASON: In the interest of the proper planning and sustainable development of the area.

17. That all necessary measures be taken by the contractor to prevent the spillage or deposit of clay, rubble or other debris on adjoining roads during the course of the works.

REASON: To protect the amenities of the area.

18. The developer shall pay the sum of € 712,088 to the planning authority as a contribution towards expenditure that was and/or that is proposed to be incurred by the planning authority in respect of public infrastructure and facilities benefiting development in the area of the Authority, as provided for in the Contribution Scheme for Fingal County made by the Council. The phasing of payments and the provision of security to ensure payment shall be agreed in writing with the planning authority prior to the commencement of development.

REASON: It is considered reasonable that the payment of a contribution be required in respect of the public infrastructure and facilities benefiting development in the area of the planning authority and which is provided, or which is intended to be provided by, or on behalf of the Local Authority.

Notes: The applicant or an agent acting on behalf of the applicant shall apply for a trade effluent discharge licence under the Water Pollution Act 1977 as amended, to control the discharge of fats, oils and grease (FOGs) to the sewer and any other trade effluent that is intended to be discharged to the sewer and shall comply with the conditions associated with that licence.

The applicant or an agent acting on behalf of the applicant shall ensure all hauliers of waste hold a valid Waste Collection Permit for the waste material collected from the site and that the waste material is delivered to authorised waste recovery/disposal facilities. The applicant shall comply with the requirements of the Waste Management Act 1996 as amended in relation to waste generated as a result of any activity at this site.

All materials intended for landspreading shall comply with the Waste Management (Use of Sewage Sludge in Agriculture) Regulations, 1998 & 2001 and the EC (Good Agricultural

out in Code of Practice for the Use ofBiosolids in Agriculture: Guidelines for Local Authorities and Wastewater Treatment Plant Operators (DoELG, 1999) and Guidelines for Fanners (DoELG, 1999). The applicant shall hold a licence under the Industrial Emissions Directive 2010 for this waste facility from the Environmental Protection Agency and comply with the conditions associated with that licence. The applicant shall apply for approval for the treatment of animal by-products as required under Article 15 ofEU Regulations No. 1977/2002 for the operation of the plant from the Department of Agriculture, Food and the Marine.

NOTE:

All buildings must now be designed and constructed in accordance with the Building Regulations. The Building Control (Amendment) Regulations, 2009 came into effect on 1st October 2009.

With the exception of houses and cettain agricultural buildings, a Fire Safety Certificate/Revised FSC (please refer to Regs) is required for all buildings (including apartments and flats), extensions and alterations and changes of use which are covered by the Building Regulations.

A Commencement Notice (Building Control Regulations 1997 to 2009) must be submitted to the Building Control Authority (not less than 14 days and not more than 28 days before development commences) in respect of all buildings other than

• Buildings which require a Fire Safety Certificate under the Regulations and where a person intends to commence work on the construction of a building before grant of the relevant Fire Safety Certificate. (See 7 Day Notice below)

• Disability Access Certificates/Revised Disability Access Certificates.:-from the 1st of January 2010, a certificate of compliance with respect to Part M of the Second Schedule of the Building Regulations (Disability Access Certificate) shall be required in respect of all works or a building to which Part Ill (Fire Safety Certificates) refers.

• Exempted development for the purposes of the Planning and Development Act 2000 and the Regulations made thereunder.

A 7 Day Notice is required where a person intends to commence work on the constmction of a building before grant of the relevant Fire Safety Certificate. The Notice must be submitted not less than 7 days in advance of commencement of work and must be in accordance with the requirements of Atticle 20A(2) of the Regulations.

A number of the conditions attached to the planning permission may need compliance submissions to be lodged and agreed prior to commencement of development. Please submit 5 copies of all documentation in relation to compliance submissions. Failure to comply with a condition of the planning permission is an offence under Section 151 of the Planning and Development Act 2000.
