Customs in the Budget The 2015 Budget Review contained three proposed customs and excise amendments that have received no media coverage as yet: (i) Uniform appeal and dispute resolution procedures for taxes administered by the South African Revenue Service (Sars) are proposed by aligning the procedures under the Customs Control Act, the Customs Duty Act and the Customs and Excise Act with dispute resolution procedures under the Tax Administration Act; (ii) ad valorem excise duties on digital cinematographic cameras and projectors above R250 000 per unit are to be abolished on 1 April 2015; and (iii) a tyre levy (environmental levy) is to be implemented in the last quarter of 2015.

Frozen chicken meat dumpingOn 27 February 2015 Sars announced the imposition of definitive (final) anti-dumping duties on frozen bone-in portions of fowl of the species Gallus Domesticus – commonly known as chicken – classifiable in tariff subheading 0207.14, originating in or imported from Germany, the Netherlands and the United Kingdom (UK).

Sugar tariff increaseSars on 27 February 2015 announced an increase in the rate of customs duty on sugar, classifiable in tariff subheadings 1701.12 (beet sugar), 1701.13 (Cane sugar specified in Subheading Note 2 to this Chapter), 1701.14 (Other can sugar), 1701.91 (Containing added f lavouring or colouring matter) and 1701.99 (Other), from 142.5c/kg to 207.1c/kg in terms of

the existing variable tariff formula.

Upholstered Furniture TariffComment on the proposed amendment of the wording for qualifying fabrics under Rebate Item 320.01/5407.61/01.06, 320.01/5903.20.90/01.08 and 320.01/5907.00.90/01.08 for the manufacture of upholstered furniture is due by 13 March 2015. The application was lodged by the Textile Federation of South Africa (Texfed) who reasoned that it had major difficulties with the wording, scope and coverage of the three qualifying fabrics under the rebate provision in the form that they had been introduced as there were fabrics that were manufactured locally that met the description of the qualifying fabrics in the rebate provision.

Glass Sunset Review Comment on the sunset review investigation on

clear float and drawn glass, classifiable in tariff subheadings 7004.90.90, 7005.29.17, 7005.29.23, 7005.29.25 and 7005.29.35, originating in or imported from the Republic of China and India, is due by 01 April 2015. The application was lodged by PFG Building Glass, the only producer of clear float in the Southern African Customs Union (Sacu), who alleged that the expiry of the anti-dumping duties would likely lead to continuation or recurrence of dumping and the recurrence of material injury.

The fact that the Gauteng 25-year transport policy is based on volume growth at the existing and future rail-served inland terminals renders it somewhat questionable in an environment where these volumes are actually decreasing and the proposed new terminal is in serious doubt.

That was a theory put forward to FTW by Francois Nortje, a Gauteng property developer specialising in logistics developments and reacting to our February 13 article headlined “Is TNPA rethinking the dig-out port?”

“The context of this is based on the fact that Transnet was too optimistic in its growth projections for container volumes,” he said. “If you think that there is a re-think on the dig-out port due to less containers than anticipated, there must be a massive re-think on inland terminals. This because they are not only affected by the

factors that affect the dig-out port, but also extensively by the de-stuffing of containers in Durban for whatever reason.”

On this de-stuffing issue, Nortje again referred to an FTW article – this time of November 28 last year and headlined “Interesting

transhipment anomaly on Durban-Jo’burg route”.

Here we attributed the Transnet Freight Rail (TFR) market share loss to container imbalances, where imports

into SA were arriving mostly in 40-foot (12-m) boxes, but exports from Gauteng were mostly in 20-ft (6-m) boxes – and there was, therefore, no use for 40-ft containers in Gauteng, and Durban

de-stuffing was the growing preference.

But Nortje added to this another reason for increased de-stuffing.

In this, he quoted Mitchell Brooke of Citrus Growers' Association (CGA) writing for Fruit SA.

The failure to resolve the legality of transporting the high-cube containers (HCCs) to inland destinations on standard semitrailers is likely to promote the development of double handling of boxes from the docks on “container trailers” to warehouses and depots, according to Brooke.

“This,” he added, “will lead to further increases in the proportions of containers de-stuffed in the port cities for reloading of sorted goods as break-bulk onto interlinks for long-haul transport.”

According to Nortje, it must also be recognised that the more frequent usage of these

larger containers will obviously lead to lower numbers of containers entering the country, and proportionally reduce the rail share of box transport. Also, it will be natural to de-stuff these HCCs because of weight issues.

“The bottom line is,” he said, “containers are unpacked in Durban and left there and Transnet totally loses its share of that part of the market.”

Nortje also highlighted the variable swing in electricity prices versus diesel prices – with diesel having actually dropped in price because of the plunge in crude oil costs.

But, with electricity prices being increased by a yearly amount approved by the energy regulator and the budget just having tacked an additional levy on it, this power source is on a steep upward climb.

“The Transnet trains use our ever-more-expensive

electricity and surely are now uncompetitive compared to the truck on price,” said Nortje.

“Transnet had low market share in the past because of the long time delays compared to the truck. Surely it has got much worse for them now? They cannot compete on time or price.”

Despite all these factors, Nortje noted that the two neighbouring inland terminals of Kascon and City Deep were having billions spent on them to upgrade their capacity to a total of 700 000 TEUs a year by 2019, according to TFR’s 2014 Rail Development Plan.

But the TFR plan stated that, even with upgrades, the forecasted container volumes would exceed the current terminal capacity by 2022 – thus additional terminal capacity would be required in order to meet rail’s desired market share.

Trade logistics ignored in budget BUDGET 2015

Anyone reading the 2015 budget speech of finance minister Nhlanhla Nene would be hard pressed to identify any commitment to increasing South Africa’s competitiveness through investment in the total logistics value chain.

Following president Jacob Zuma’s lead in his State of the Nation address, Nene paid scant attention to freight logistics.

The word “harbour” is not mentioned once in the speech.

“Port” appears in the sentence “Port health services have also been shifted from provinces to the national department”.

Nene claimed that there had already been some success in the government’s plan to develop the ocean economy through Operation Phakisa. “Already this has led to investment of

R9.6 billion in Saldanha Bay.”

“Support for the oceans economy has been allocated R296 million over the next three years. This will enhance our climate change research and management of ocean resources,” he said.

Roads received a bit more attention, with the first mention being “roads that are impassable when it rains” as one of the “infrastructure failures” that “many South Africans regularly experience”.

The next mention was that R1.8 billion would be spent on the accident-prone 120 kilometre-long Moloto road, between Mpumalanga and Pretoria which carries 60 000 commuters a day.

Local roads have been packaged together with 220 water and sanitation projects. A total of R80 billion is budgeted for the three.

The next mention is when referring to

the Gauteng toll system,

which will be

undergoing a makeover. Hauliers and

transporters will be affected by an increase of 80.5c/litre in fuel taxes, made up of an increase in the Road Fund levy of 50 cents and the general fuel levy of 30 cents a litre.

Absa wealth and investments marketer and analyst Chris Gilmore described the increases as “alarming”.

Single transport regulator The department of Transport will be establishing a single transport economic regulator by 2019.

“The department’s intention is to deal with regulatory shortcomings across the transport sector, which will lead to better pricing and more efficient transport infrastructure and services.”

Ongoing investment in OR Tambo and Cape Town InternationalDirect international f lights through Eastern Cape airports remain grounded by the Airports Company of South Africa, which plans to continue investing in Cape Town and OR Tambo, according to the Department of Transport.

The company is expecting to issue bonds in 2017/18 to raise funds for the realignment of the Cape Town International Airport runway and the remote aprons at OR Tambo International Airport.

75% of SANRAL-managed roads need replacing Faced with a crumbling roads network, the South African National Roads Agency will be putting its funding into maintenance rather than new projects, according to the Department of Transport.

In its expansion of the national budget the department says “with approximately 75% of the road network that is managed by the agency beyond its designed life, expenditure on goods and services, largely to contractors for road maintenance, is expected to increase to R21 billion in 2016/17.”

Total spending is expected to increase at an average annual rate of 0.2% over the medium term as 21 403km of the road network holds active routine maintenance contracts.

One twentieth of the budget – or R1.1bn – will be spent on the upgrade of the R573 Moloto Road linking Pretoria and Mpumalanga.

10 more special economic zones plannedTen more special economic zones (SEZs) are planned by the department of economic development.

In its budget notes the department says the main policy shift in the SEZs is from funding operators to funding bulk and shared infrastructure.

There are presently five SEZs, at Coega and East London in Eastern Cape,

Saldanha Bay in Western Cape, and Richards Bay and Dube Trade Port in KwaZulu-Natal.

The department says it plans to designate and roll out 10 new SEZs in all nine provinces. Prefeasibility and feasibility studies for the zones will be concluded in 2015/16.

Commenting on the amendments to the National Road Traffic Regulations 2000, Francine Hattingh, senior manager – marine liabilities at Eikos Risk Applications, said that the definition of ‘consignor’ under amended regulation 1, which includes a person “who has possession of or control over the goods immediately before the goods are transported by road”, is a wide definition which in her view may be deemed to cover freight operators as well as cargo owners, depending on the contracting arrangements of the parties.

Thus the new regulation 330D whereby “a Consignor or Consignee of goods shall not transport goods on a public road or accept goods unless such transportation is fully insured for damages that can occur as a result of an incident” may be a duty often imposed upon freight forwarders and not only upon

cargo interests.  A freight forwarder is

often the party who contracts with the haulier (or vehicle operator) on behalf of its cargo owning clients.  Where the forwarder does not do so as an agent for the cargo owner, but contracts with the haulier in a principal capacity, it appears that the forwarder may be interpreted to be the ‘consignor’ and thus the onus would fall on it to ensure that “the transportation is fully insured”.  Similarly it is possible that the freight forwarder may be denoted as the ‘consignee’, who also carries an obligation to ensure the cargo and transportation risks are fully insured.

“Cargo owners or freight

operators contracting in a principal capacity, which may be interpreted as the “Consignor” under the new regulations, should ensure that they have liability cover

in place and not only marine/cargo insurance which only covers the goods themselves,” she added.

Her advice to hauliers, defined as “Operators”

under the regulations, “is to ensure that they have a liability policy in place and not merely a GIT policy which only covers the goods and may have many exclusions. It is therefore wise to employ an insurance broker that can offer you a product that covers both requirements.”

Africa’s gross domestic product (GDP) is expected to reach US$2.6 trillion by 2020 and air cargo into Africa is expected to triple by 2025. The largely untapped intra-Africa trade market could considerably boost these figures, provided that major trade barriers are removed.

“A lot of infrastructural and other challenges affect land-based modes of transport, such as road and rail, but cargo can fly to almost any developed destination in Africa – and quickly,” said Nico Bezuidenhout, acting CEO at South African Airways (SAA), when he delivered the keynote address at the Air Cargo Africa 2015 conference in Johannesburg last week.

He added that road and rail infrastructure was making headway, but not as fast as airport infrastructure development and investment in aircraft. “Furthermore, global airlines are establishing partnerships with regional and domestic airlines to expand their reach on the continent, creating increased

air accessibility. By 2017, African skies will be open for business,” said Bezuidenhout.

He commented that goods such as pharmaceuticals, mobile communication products, electronics and automotive parts were all in high demand in Africa, with that demand set to increase twenty-fold in some cases. “These commodities have always traditionally been moved by air due to their light weight, high value and an urgent demand from consumers,” Bezuidenhout said.

Fitsum Abady, managing director of Ethiopian Cargo Services, agreed with Bezuidenhout’s optimistic picture, adding that the continent’s economic growth was the second fastest on the globe and that the continent’s GDP was projected to grow by around 6% per annum over the next decade. “Africa is no longer perceived by the global trading community as the dark continent but one with a bright future. However, there are still major trade barriers which could negatively impact airfreight

growth and the industry needs to work with its other trade partners to address these,” he said.

One of the major barriers, according to Abady, is the high operational costs for air cargo carriers. “We have a wide directional imbalance in the African freighter market, with low load factors on the global exports side, which adds to the operational costs,” he commented.

Added to that is the fact that the jet fuel price in Africa is twice that of the global average. “In traditional global markets such as the United States, Europe and Canada, the average price of jet fuel is around US$2.50 per litre. In Africa it is over US$5,” Abady pointed out.

“It also seems as if the Sars plan may be a foregone conclusion, judging by the recent amendment to section 54(3) of the VAT Act, gazetted on 20 January 2015, which will take effect on April 1, 2015. In terms of this amendment agents are required to furnish their clients with

a statement within 21 days of the end of the month in which the goods were imported. This statement must, among other things, contain a receipt number proving the payment of deferred duty and VAT to Sars.

This amendment therefore does not permit staggered deferment payments, in respect of which a receipt would only be received after the required 21 days of the following month.

However, the amendment would make perfect sense if all deferments ran from the first to the last day of each month.”

In an unprecedented move among multinationals in South Africa, logistics major Ziegler has sold a share of its South Africa business to a black-owned consortium headed up by ex BHP Billiton executive chairman Dr Xolani Mkhwanazi.

“It’s part of a move to create diversity and sustainability in our business,” Ziegler ZA CEO Sean Moore told FTW. “We need to align our business with the demographic of the land – and we believe that this will add enormous value for our customers, many of whom have supported us for almost 20 years.”

Convincing the shareholders of the 107-year-old European company, which owns 100% of every Ziegler business in the rest of the world, was no easy task.

But their objective in entering the SA market was to gain a foothold on the continent, and they realised that this could only be achieved by playing according to the local rules

of the game, said Moore.The move elevates Ziegler

to level 3 BEE status, with level 2 in its immediate sights, says Mkhwanazi, who has assembled a high profile team to make up the consortium which includes logistics specialist Peter Ndlovu and a 30% female component, along with financial and marketing muscle.

The move adds enormous value for Ziegler and our next priority is to develop the 4PL business in South Africa, says Moore. “Our group owns over 1 million sqm of warehousing in Europe and we want to replicate that model in South Africa. This will involve acquiring more warehousing space and rolling out the full 4PL product. We have all the IT systems and structures in place in South Africa – all we need to do is deploy them and take advantage of them.”

An important element of the company’s 4PL ambitions will involve enterprise development. “It’s a space where we are very active – but we want to be more active. The owner driver scheme, for

example, failed in our industry because it became difficult to manage and became very expensive. We need to find a sustainable model that encompasses the same concept but doesn’t come at the same cost. At worst it needs to be revenue neutral,” said Moore.

Ziegler will be looking at a similar enterprise development concept in its warehousing ambitions. “As a business we subcontract over 10 000 tons of warehousing – which we shouldn’t be doing. If we can find a sustainable enterprise development partner who can take that on and be revenue neutral, it will be hugely beneficial. Level 2 BEE status is only attainable through those kinds of concepts,” he said.

The new BEE consortium will have a 25% + 1 shareholding in the business. Moore remains the majority shareholder with the remainder in the hands of the European company.

“We are probably the only multinational that is properly empowered,” said Mkhwanazi.
