Ozark Gateway Association of REALTORS® Directors Minutes

9:30 am Thursday, May 28th, 2015 Present: Dave McGarrah, Spencer Aggus, Seth Dermott, John Yaple, Ron Franklin, Jennifer Reaves, Judy Lowe, Danny Ross, and Carol Ferguson. Staff Present: Kim Cox Roll call was taken by sign in. Meeting was called to order by Dave McGarrah, President. Motion was made to approve the minutes from the April BOD meeting. Motion was made to approve Agenda as emailed. John Yaple, Officer/Treasurer.

Received financials for April 2015 as emailed. Motion made and approved to accept financials for April 2015. Motion made to approve $3800 to budget for wage increases. Motion made to approve $1000 for sponsorship at MR Banquet, President-Elect Miles Noennig Installation.

Kim Cox for Director/MLS Chair Report. Discussed recommendation to educate the membership on Cancelled vs Withdrawn statuses. Motion made to ask Flex to set the MLS to keep Cancelled listings

for 3 years before purging. A recommendation is being made to the Governing Docs Committee to only allow information regarding the listing property to be allowed in Public Remarks

Section, no vendor or 3rd party repository information allowed. Motion made to approve logo pictures be allowed on virtual tours (Policy will need verbiage updated). Discussion was had on a courtesy notice to members regarding Buyer’s Agents to confirm that the listing has been updated by the Seller’s agent to either

Core Standards have submitted to State and National, approval already received by MR, awaiting only NAR approval. Issues with Flex that need to be worked through; Sentrilock integration having some issues. VOW’s; Kim speaking with legal counsel at MR and NAR for guidance in minimum broker services. Realtor.com sent request for last 3 years of sold data; OGAR rules prohibit this, also a non-disclosure state.

Spencer Aggus, President-Elect’s Report Strategic Planning – No meeting this month. Possibly finished for the year. Program & Events – No quorum. Governing Documents – See attached minutes. Proposed Bylaws changes will go on September ballot. Below are approved Policy changes:

Motion change MLS Rules #2.27 – Advertising to Advertising/Branding and add the following new verbiage: Personal and or company adver-tising on the MLS system outside of the approved fields is prohibited (3/05). There will be a regulation of the 90/10 rule on all logo brandings; logos must first be submitted and approved through the association staff; logos shall not include broker ’s address, email address, website address, or phone numbers; branding does NOT allow the use of business cards or yard signs; all logos must be in the bottom right hand corner of the photograph(s). If agent’s listing is policed for a logo violation of these branding and advertising rules they will be notified of a 48 hour period to correct the violation(s) and then incur a $25 per day fine until the corrections have been made.

Motion to change Policy & Procedure in “Nominating” Section to add under State Directors: Duties include nominating backups for any state director positions in case a serving member cannot complete all years of their term.

Motion to add the word “Active” to the following current policy (MLS Policies, page 11): Association staff has the ability to automatically reassign “active” listings to the listing broker upon transfer, drop or waiver of a REALTOR® member, unless the broker notifies the association staff to do otherwise in writing.

Auction Task Force – Researching a way to protect members and still allow the listings to be input in the MLS (with conditions). Membership & Community Services – See attached minutes. A motion was made and seconded to approve the conditional memberships as listed below.

The petition shall be filed with the Association Executive at least two weeks before the election on Sep-

tember 17th. The AE shall send notice of such additional nominations to all members eligible to vote before the election.

Safety is a top concern for many real estate agents, especially when meeting a client somewhere other than the office.
