This addendum adds to or modifies the contract documents for the above project. This addendum shall supersede all previously issued specifications, addenda and any other written or verbal direction. The modifications within this addendum shall be made part of the contract documents and shall be subject to all applicable requirements thereto:

Question #1: Will the Mandatory Job Walk form be provided for us since it is required to be submitted with the proposal? Response #1: The Confirmation of Attendance at Mandatory Job Walk form (00600) will not be required to submit with the bid proposal.
Question #2: For the Subcontractor’s list, does the $$ Value of Work column need to filled in? Response #2: Yes, for each Subcontractor listed include the dollar value of the work to be performed on the project.
Question #3: Attachment A lighting audit - Soria Interior line 248 missing quantity for LED Emergency Driver Response #3: Attachment A – Detailed Lighting Audits has been revised to include (50) LED Emergency Drivers included in the scope of work for Soria Elementary, Interior line item 248. Use Attachment A – Detailed Lighting Audits V2 as your source of site information for bidding.
Question #4: Is the proposed fixture description (1x4x2 T8 LED w/ Driver) a Type A TLED with new electronic ballast or Type C TLED with LED driver? Response #4: The contractor will be responsible for proposing LED linear T8 lamp that meets the performance specifications and compatible remote LED driver. See below for revised performance specifications for T8 LED lamps:

Question #5: Is there a checklist of items required for a complete offer? Certain forms (such as CERTIFICATE OF WORKERS' COMPENSATION INSURANCE) are not clear if they are required for the offer or post award. Response #5: See Section 00210, Bid Proposal Form - Section 1.3 ‘Documents Comprising Bid Proposal’ for list of documents to include with bid proposal. Confirmation of Attendance at Mandatory Job Walk (00600) is not required to submit with bid proposal. Question #6: Section 00510: What qualifies as "physical barrier at the Work Site" Response #6: Contractor must provide 6’ temporary fencing securing contractor staging area containing equipment, tools, storage containers, materials, etc. Question #7: Page 127 of Attachment B states:"$1,000,000 per occurrence $2,000,000 General Aggregate limits" but page 118 is quite a bit higher.
Response #7: The insurance provided by Contractor for Commercial General Liability Insurance must adhere to the insurance coverage amounts listed in Section (00800) Special Conditions. The contractor shall provide and maintain the following coverage amounts:
Commercial General Liability Insurance Per Occurrence $2,000,000 Aggregate $5,000,000 Question #8: Can you provide the light output (Lumens) requirements rather than the wattage? Response #8: Only ‘Proposed Watts’ for replacement solutions will be provided as a benchmark for acceptance. All installed material must be DLC listed and meet the minimum efficacy (lumens per watt) levels for LED lamps and fixtures. Question #9: 1x4x4 T8 LED w/ Driver-56W" is to be dimmable or not? Response #9: See response #4. Question #10: 2x4 LED Flat Panel-40W" is to be dimmable or not? Response #10: See Lighting Specifications - SECTION 26 51 00 - INTERIOR LIGHTING, Part 2 – Products, Section 2.3.B for Indoor Luminaire, Troffer, LED Flat Panel performance requirements. Question #11: For the proposed "LED Par38 E26 Dimmable-17W", the existing is Par30", which lamp is it? Response #11: Attachment A – Detailed Lighting Audits has been revised to include LED PAR30 dimmable lamps as the proposed fixture retrofit solution. Use Attachment A – Detailed Lighting Audits V2 as your source of site information for bidding. See below for PAR 30 lamp specifications. B. Lamp Type: PAR 30/38 1. Available Manufacturers: Subject to compliance with requirements, manufacturers offering products that may be incorporated into the Work include, but are not limited to, the following:

Question #12: In "2x2 LED Flat Panel W/ SM BOX-30W" please clarify the "SM Box"? Can another self-contained fixture be used? e.g. "UFO syle"? Response #12: Proposed fixture must be surface mounted. Proposed fixture must include the surface mount box or hardware for installation on a hard lid ceiling. Material substitutions are no longer allowed, use Attachment A – Detailed Lighting Audits V2 as your source of site information for bidding. Proposed lighting retrofit solutions will be reviewed by the contractor and the District prior to construction to finalize material and hardware requirements. Question #13: is "2X2X2 ULAMP T8 LED-30W" Type A, B or C?
Response #13: The contractor will be responsible for proposing LED linear T8 lamp and compatible remote LED driver. Proposed retrofit solution has been revised to include a new remote LED driver. Use Attachment A – Detailed Lighting Audits V2 as your source of site information for bidding. Question #14: SORIA EXTERIOR Bldg 8 "26W CFQ/ EMERGENCY WALL PACK" to 2xLED G24D/Q: Please confirm this is a relamp. Response #14: The wall pack located on Building 8, labeled in Attachment A – Detailed Lighting Audits as ‘26W CFQ/Emergency Wall Pack’, will only require a lamp retrofit and not a fixture replacement. Question #15: Please confirm that no building permit is required for this work. Response #15: Obtaining permits are not required. Nor is this a DSA stamped project. Question #16: Please confirm that no building code "compliance certification" is required for this work. Response #16: Title 24 compliance certification is not required. All work is to be installed to current building codes. Question #17: Please confirm that no building code "acceptance testing" is required for this work. Response #17: Acceptance testing is not required. Question #18: Please specify the safety certifications and Written-Plan requirements (LOTO, Fall Protection etc). Response #18: Contractor must abide by all Cal/OSHA safety and health laws and regulations applicable to this project and required by law and as called out in the specifications. Question #19: Will the contingency cover costs such as 480V fixtures (as yet unknown). Response #19: The allowance is to be used for unforeseen conditions at the discretion of the District. Requests to utilize the project contingency allowance for changes that exceed the scope of work or material requirements will be evaluated by the District on a case by case basis. To our knowledge there are no 480V fixtures on this project. Question #20: By asking for individual-line-item and/or by-location unit pricing, is it possible that the project will be divided in portions some way? Response #20: No. Project will not be divided up into portions. Question #21: Any items that are required to be tamper-proof? Response #21: There are no tamper-proof light fixtures required on the project. Question #22: Please describe in detail what changes or additions to the seismic restraint do you require? In that connection what type of ceilings is above the drop ceilings? (wood, metal, concrete, etc) Response #22: Construction specifications for installation of seismic support for lighting fixtures in or on grid-type suspended ceilings can be found in Lighting Specifications - SECTION 26 51 00 - INTERIOR LIGHTING, Part 3 – Execution, Section 3.1. It is assumed there is primarily wood above the grid-type suspended ceilings. The contractor shall thoroughly investigate and satisfy itself of the conditions affecting the work prior to construction start. Question #23: Which measures do the seismic restraint changes apply to? Response #23: All recessed troffer fixtures replaced with new LED luminaires will require new seismic reinforcements in accordance with the construction specifications. Question #24: Are you aware of any asbestos studies or concerns? Response #24: The AHERA 3-Year Asbestos Report including Kamala School is attached to this addendum. Note that OSD will be independently verifying asbestos location included with SOW prior to summer work start. If any abatement is needed, OSD will independently work to abate asbestos prior to scheduled work start.
Question #25: for "6.5" RECESSED CAN 26W CFQ 1L" to LED Recessed Can Dimmable-14W A. Does the existing have the necessary dimming wiring? Line/0-10V, etc B. What type of dimming do you require? Response #25: The proposed LED fixture must be dimmable (0-10V) but installing dimming functionality is not required. Question #26: On the T8 Lamps the specs call out for “w/driver”. At the meeting we were told the you are asking for Type A. My understanding of Type A are fluorescent ballast compatible and don’t come with a driver. Can you clarify what the district would like included? Response #26: See response #4. Question #27: Also, on the indoor luminare, trouffer, integrated retrofit kit, I don’t see any on the audits under proposed fixture. Just want to make sure I’m not missing anything. Looks like everything is calling out a T8 or T5. Response #27: There are no indoor luminaire troffer, integrated retrofit kits required in the scope of work. Question #28: I have gone through the worksheet and would like to know the estimated value for this project. Response #28: See Addendum Item 1.4 below for revised project estimate. Question #29: Also I like to verify that all rooms with an asking value for occupancy sensors will require one? Response #29: Attachment A – Detailed Lighting Audits list the quantity and type of occupancy sensors, either wall or ceiling, to be installed in each space. Question #30: On Attachment A- It calls out in proposed fixture for LED lamps with Driver- In specification it calls for Type A LED lamps- LED lamps that require a driver are Type C- Does the District want Type A LED lamps with new ballasts or does the District want Type C LED lamps with new drivers? Are the LED lamps with driver/ballast the contractor's choice? Response #30: See response #4. Question #31: On Attachment A- It calls out in proposed fixture for 2x4 LED Flat Panel. Does the District want Flat Panel New fixtures or are other types of new LED fixtures and retrofit kits acceptable as listed in Attachment C? I'm trying to clarify what is acceptable to the District do to the stated limited budget for the project. Response #31: The proposed retrofit solution ‘2x4 LED Flat Panel’, must include a new Indoor Luminaire, Troffer, LED Flat Panel. Retrofit kits are not an acceptable retrofit solution for the ‘2x4 LED Flat Panel’ material specification. Question #32: If new drop-in flat panel or 2x4 LED fixtures are being installed can the contractor use the existing seismic cable/tie-wire or does the District require new wires? Is there a District standard requiring 4 tie-wire per fixture no matter the weight on the new fixture or is current code acceptable? Response #32: Contractor must replace seismic reinforcements on existing troffer fixtures with new seismic cable when installing new Indoor Luminaire, Troffer, LED Flat Panels. Construction specifications for installation of seismic support for lighting fixtures in or on grid-type suspended ceilings can be found in Lighting Specifications - SECTION 26 51 00 - INTERIOR LIGHTING, Part 3 – Execution, Section 3.1. Question #33: On the exterior fixtures calling out occupancy sensors. Does the district want motion sensors or photocells? Response #33: Attachment A – Detailed Lighting Audits has been revised to remove occupancy sensors from wall packs and canopy fixtures from the scope of work at Soria Elementary, Exterior. Photocells and high/low outdoor PIR occupancy sensors are required for the proposed parking lot pole fixtures. Use Attachment A – Detailed Lighting Audits V2 as your source of site information for bidding. Question #34: Is the work being perform during first or second shift? Response #34: All work at Kamala Elementary and Marshall Elementary may be performed during first shift. Soria Elementary has been selected as a potential candidate to hold Summer School with the tentative schedule being
6/25/18 – 7/20/18 from 8:00 AM to 3:00 PM, this may require work to be performed during second shift. The District Bid Proposal Form Section (00210) has been revised to include an alternate bid item for additional labor costs performed at Soria Elementary in the event the District will require work during second shift at this site. Please include additional labor costs, if any, required to perform work outside of these hours. The basis for contract award will include evaluation of contract price, including any additional costs listed for alternate bid items. See attachment to this addendum for revised District Bid Proposal Form Section (00210). Question #35: What is the estimated budget for the project? Response #35: See Addendum Item 1.4 below for revised project estimate. Question #36: Is there any painting required if needed or is this something the District handles if new exterior fixtures leaves an imprint from old fixture? Response #36: Yes, the District requires painting for any fixture that does not cover the entire imprint from the existing fixture. The District will not provide the paint, contractor must provide all material and labor required to complete this portion of the scope of work. Question #37: On Soria Interior audit it has Fluorescent Emergency Ballast at the bottom but no count is given. Are there any fluorescent Emergency Ballast at Soria? Response #37: See response #3. Question #38: On Kamala Exterior is has under existing lights 20W LED Kit Flood then under proposed fixture it has 20W Wall Pack. Are these lights to be changed to a LED wall pack. Response #38: Yes, these fixtures were previously modified with an LED diode retrofit kit and do not provide the proper illumination for the space. The proposed LED fixture may not provide additional energy savings but the District requests these fixtures to be replaced with new LED fixtures. Question #39: Would like to know if prequalification is required and also if you can provide us the Engineer's estimate for this project? Response #39: Prequalification prior to the bid deadline is not required, a statement of qualifications as defined in the Request for Qualifications/Request for Proposal must be included with the bid proposal. Item No. 1.2 Specification Reference: Attachment A – Detailed Lighting Audits – Soria - Exterior Description: Post top fixture lamp designation The exterior post top fixtures located on the exterior of Soria Elementary, identified ‘175 MH POST TOP’ in Attachment A – Detailed Lighting Audits, line item 11, is a 175-watt metal halide, medium base lamp. Tabbara Corporation (TC) has prepared the enclosed documentation based on a combination ofprevious asbestos inspection data prepared and provided by others, along with limited fieldobservations and interviews with Oxnard Elementary School District staff. TC makes norepresentations regarding the accuracy of the enclosed data and will not be held responsible forany incidental or consequential loss or punitive damages including but not limited to, loss ofprofits or revenues, loss of use of a facility or land, delay in construction or action of regulatoryagencies. The collected data and recommendations are for the exclusive use of the client for thesite described in this report.

SECTION 1
GENERAL INFORMATION
A. Designated Person Responsibilities:
The AHERA regulation maintains that the overall responsibility for the Asbestos Operationsand Maintenance Program shall be the Designated Person, whose duties are as follows:
1. Oversees activities of Asbestos Coordinators, consultants, Contractors and approvesasbestos removal and replacement projects scope of work.
2. Direct supervision and implementation of the Operations and Maintenance Programincluding:
a. Yearly notification of Management Plan review to building staff and legal guardians,b. Six month periodic surveillance and three year re-inspections recordkeeping,c. Training of custodial staff (minimum 2 hour asbestos awareness training),d. Labeling of ACBMs within mechanical areas,e. Direct responsibility for recordkeeping system regarding training, abatement projects,
air monitoring, renovations that will impact the ACBMs.
B. EPA Category Codes for ACBM:
EPA has formulated a seven (7) category numerical assessment code depending on the typeand condition of ACBM as follows:
1. Damaged or significantly damaged thermal system insulation ACM.2. Damaged friable surfacing ACM.3. Significantly damaged friable surfacing ACM.4. Damaged or significantly damaged friable miscellaneous ACM.5. ACBM with potential for damage.6. ACBM with potential for significant damage.7. Other/any remaining friable ACBM or friable suspected ACBM.
Each ACBM re-inspected in each school is categorized within one of these assessment codes.
ACM Application Types:
Asbestos Containing Building Materials are divided into the following application types:
Thermal system insulation (TSI): Insulation applied to mechanical heat and coolingsystems, including, pipes, boilers, flue breechings, ducts, tanks and fittings.
Surfacing Materials: Material that is spray-applied or trowelled applied to walls, ceilingsor structural components (i.e. plasters, acoustical finishes and fireproofing).
Miscellaneous Materials: All other asbestos materials, including floor tiles, ceiling tiles,transite board and cloth materials.
C. ACBM Assessment Criteria:
1. Damaged ACBM: That material which has deterioration, delamination, water damage,lacks cohesion, is blistered, crumbling, gouged, marred heavily, abraded, or in any wayhas lost its structural integrity over more than 1% but less than 10 % of the surface area ifthe damage is evenly distributed or less than 25%, if the damage is localized in one areaof the homogeneous area. Categorized as fair condition.
2. Significantly Damaged ACBM: That material which has deterioration, delamination,water damage, lacks cohesion, is blistered, crumbling, gouged, marred heavily, abraded,or in any way has lost its structural integrity over at least 10% of the surface area if thedamage is evenly distributed or at least 25% if the damaged is localized. Categorized aspoor condition.
3. Good Condition ACBM: ACBM with no visible damage or deterioration in less than onepercent of the material and/or coverings.
4. ACBM with potential for damage: Pertains to circumstances in which:
a. Friable ACBM is in an area regularly used by building occupants, includingmaintenance workers, currently in intact (good) condition.
b. There are indications that there is a reasonable likelihood that the material or itscovering will become damaged, deteriorated or delaminated due to factors such aschanges in building use, changes in O&M practices, changes in occupancy orrecurrent damage.
Note: All ACBM in good condition is considered to have a potential for damage.
5. ACBM with potential for significant damage: Pertains to circumstances in which:
a. Friable ACBM is in an area regularly used by building occupants, includingmaintenance.
b. Indications show that there is a reasonable likelihood that the material or its coveringwill become damaged, deteriorated or delaminated due to factors such as changes inbuilding use, changes in O&M practices, and changes in occupancy or recurrentdamage.
c. The material is subject to major or continuing disturbance, due to factors including,but not limited to accessibility or under certain circumstances, vibration or airerosion.
D. Recommended Response Actions:
During the re-inspection, Tabbara Corporation did not identify any damaged ACBM. Newlyidentified and assumed ACBMs during the 2016 re-inspections should be sampled andanalyzed for their asbestos content. Materials analyzed to be negative for asbestos could bedeleted from the asbestos inventory for that school.
Damaged materials in the schools should be removed or repaired in order to insure theschools are in compliance with the AHERA regulation. Damaged ACBMs with over threelinear or three square feet listed in the reports should be repaired or removed by a licensedabatement company and final clearance air testing performed in accordance with the AHERAregulations.
AHERA regulations state that the response actions chosen for other than small scale/shortduration repairs (less than 3 square or linear feet), must be designed and conducted bypersons accredited to design and conduct response actions.
Areas containing damaged and significantly damaged thermal system insulation withinmechanical rooms including crawl spaces, boiler rooms, restroom pipe chases and aboveceilings should be accessed only by 16-hour asbestos-trained personnel. ACBMs within thesemechanical areas should be labeled with asbestos warning labels. Proper precautions, workpractices and personal protective equipment should be utilized to perform work within theserestricted areas. At a minimum, each member of the custodial/maintenance staff should have2 hour asbestos awareness training.
Each material listed as ACBM with Potential for Damage (good condition) should bemonitored for any changes in condition during the six-month periodic surveillance. Thesematerials are currently intact and in good condition and should be included in the operationand maintenance plan protocols. No response actions are required at this time. If thesematerials are to be impacted by renovation work, the asbestos material should be removed bya licensed contractor.
SECTION 2
OVERVIEW AND OBJECTIVES
This Re-inspection Report for asbestos management has been prepared by Tabbara Corporation(TC) for Oxnard Elementary School District for the following locations: Chavez ElementarySchool, Curren Elementary School, Driffill Elementary School, Elm Street Elementary School,Harrington Elementary School, Kamala Elementary School, Lemonwood Elementary School,Marina West Elementary School, McKinna Elementary School, Rose Avenue ElementarySchool, Sierra Linda Elementary School, Fremont Middle School, and Haydock Middle School.The purpose of this plan is to describe a program for controlling exposure to asbestos in campusbuildings. The principal elements of this program involve requirements and responsibilities forsurveys, employee notifications, proper work procedures for activities that have the potential todisturb ACM, and proper disposal of asbestos wastes.
Asbestos-containing materials (ACM) have been used widely in the construction industry. Whilethe use of ACM in new building systems has ceased for most major applications, the presence ofACM in older building systems is still widespread. At the above mentioned locations, assumedACM that were observed are: Acoustic ceiling panels, 12" x 12" acoustic ceiling and walltiles & associated mastic, plaster, drywall, joint compound, padded panel mastic, mirrormastic, transite panels, wainscot & associated mastic, baseboard & associated mastic,resilient floor tile & associated mastic, vinyl sheet flooring & associated mastic, resilientsheet flooring & associated mastic, mastic associated with carpet, mastic associated withhardwood flooring, epoxy flooring, window putty, spray applied fire proofing, and stucco.In most cases, these listed ACM do not pose a health hazard if left undisturbed with exception ofthe following schools: McKinna Elementary School - Bldg. 9 Room 901: 12" x 12" GreyResilient Floor Tile & Associated Mastic. Fremont Middle School - PE Bldg. PE Offices &Gym: 9" x 9" Brown Resilient Floor Tile & Associated Mastic. These materials should berepaired or removed by trained personnel to prevent further damage. Furthermore, activities thathave the potential to disturb ACM must be carefully managed to prevent fibers from becomingairborne and creating an inhalation hazard.
AHERA requires that each Local Education Agency (LEA) perform inspections to identify ACMin each of the school under its authority; develop, implement and update asbestos managementplans; take appropriate response actions; safely maintain ACBM; and comply with AHERA’srecord keeping requirements.
Under §763.84 of the AHERA Rule, the LEA have the following responsibilities:
• Ensure that the activities of any persons, who perform inspections, reinspections, andperiodic surveillance, develop and update management plans, develop and implementresponse actions, and conduct operations and maintenance activities that are incompliance with all of the AHERA requirements.
• Ensure that all custodial and maintenance workers are properly trained.• Ensure that workers and building occupants are notified at least annually about activities
related to ACBM
• Ensure that short-term workers who may come in contact with asbestos in the school areprovided with the locations of all ACBM and suspected or assumed ACBM.
• Ensure that warning labels are properly posted.• Ensure that management plans are available for inspection.• Appoint a designated person to ensure proper implementation of the AHERA
requirements.• Ensure that the designated person receives adequate training to perform duties assigned• Consider whether any conflict of interest may arise among personnel undertaking
activities related to the ACBM in the school.
Sections 763.85-763.99 of the AHERA Rule detail the specific responsibilities of the LEA.These responsibilities are listed below:
• Inspections: An accredited inspector must conduct each school building inspection underthe authority of the LEA. This involves a visual inspection of all buildings for friable andnon-friable ACBM, sampling such materials, and having samples analyzed by anaccredited laboratory and/or in accordance with AHERA regulations.
• Reinspections: An accredited inspector must conduct a reinspection of all friable andnon-friable ACBM in each school building at least once every three years.
• Assessment: For each inspection and reinspection, an accredited inspector must provide awritten assessment of all friable ACBM in the school building.
• Management Plan; Each LEA must complete an asbestos management plan for eachschool under its authority. An accredited management planner must prepare themanagement plan based on the results of the inspection. In the management plan, themanagement planner recommends appropriate response actions, prepares cost estimateson the response actions, and schedules the response actions. The management plan mustbe updated on a timely basis.
• Response Actions: Based on the recommendations of the management planner, the LEAmust select the appropriate response actions consistent with the assessment of theACBM. The designated person must see to it that the response actions are carried out in atimely manner and in compliance with AHERA requirements.
• Operations and Maintenance: The LEA must implement an operations and maintenanceprogram whenever any friable ACBM is present in the building under its authority.Where material identified as non-friable ACBM is about to become friable as a result ofactivities performed in the building, it must be treated as friable and thus must also besubject to an O&M program.
• Training: AHERA requires that building inspectors, management planners, projectdesigners, contractors/supervisors, and asbestos workers be accredited before they canperform asbestos-related activities.
• Notification: The LEA must issue the following notifications regarding asbestosidentified in its schools.
o An annual notice to all workers and building occupants, or their legal guardians, of allinspections, reinspections, and activities being conducted to control asbestosexposure, including periodic surveillance and asbestos removal, that are planned or inprogress.
o An annual written notice informing parent, teacher and employee organizations of theavailability of the management plan for their review.
o A notice, to short-term workers (e.g., telephone repair workers, utility workers, orexterminators) who may become in contact with asbestos in a school, identifying thelocation of ACBM in the building
• Periodic Surveillance: The LEA must conduct periodic surveillance in each buildingunder its authority at least once every six months after a management plan is in effect.
• Record keeping: Records involving the inspection of and response to ACBM must bekept in a centralized location in the administrative office of both the school and the LEA.The following records must be kept:
• Descriptions of preventive measures and response actions taken for friable and non-friable ACBM.
o Sampling Informationo Periodic Surveillance informationo Training Informationo Information on initial and additional cleaning performed.o Information on operations and maintenance activities, including information on any
maintenance activities disturbing friable ACBM.o Information on any fiber-release episodes.
• Warning Labels: The LEA must attach a warning label immediately adjacent to anyfriable or non-friable ACBM located in routine maintenance areas (such as boiler rooms)at each school building.

SECTION 5
RESPONSE ACTIONS
Response Action: There are primarily five response action options which may be applied by theLEA to any friable ACBM.
1. Removal2. Repair3. Encapsulation4. Enclosure5. Maintain
Based on the technician’s observations, some damage was observedand was listed in Section 1 Overview and Objectives; therefore, aresponse action is required.
The Management Plan directs the LEA to apply one or more of these methods to each functionalspace with friable ACBM. By no means do these descriptions waive the requirement forcontacting an EPA-accredited Project Manager prior to initiating major asbestos activities(activities involving greater than three square linear feet of ACBM); nor do these descriptionsrepresent specifications for project performance. Rather, they are provided to describe in detailwhat is meant by the Management Planner’s recommendation.
1. Removal – Removal as described herein is equivalent to the abatement method prescribedand regulated under the OSHA standard Title 29 CFR Part 1926 Subpart A, section1926.58 (Asbestos Standard for Construction Industry). Under this regulation, quantity ofmaterial is not a variable for determining the removal technique employed. This isconsistent with the Management Plan’s intent, in that, when removal of friable ACBMwas recommended, the functional space with friable ACBM must be handled in such away as to reduce exposure potential to the lowest possible level using a range of availableremoval techniques.
Removal is usually accomplished with the confines of a “regulated area” as defined in theabove referenced standard. However, as long as airborne asbestos fiber concentrations arecontrolled using approved techniques in accordance with OSHA standards, the workpractices used for removal are not strictly mandated. The method(s) employed to removefriable ACBM must be sufficient to meet all applicable clearance standards outline inSubpart E, section 76.90 (in addition of meeting OSHA worker protection standards.)
Additionally, the selected technique(s) should be governed by principles of “state-of-the-art” work practices as well as the most recent and stringent regulatory authority(s) inforce. This means that simple regulatory compliance may not be sufficient to ensureproper abatement.
The selected removal techniques should be weighed carefully against the exposurepotentials and the liability associated with initiating an action. A discussion of “state-of-the-art” work practices is provided in 29 CFR 1926.58 Appendix F (non-mandatory)“Work Practices and Engineering Controls for Major Asbestos Removal, Renovation, andDemolition Operations.”
Any ACBM remaining following the completion of a removal response action must beincluded in the O&M Program.
2. Repair – Repair of friable ACBM is a method of restoring the material’s structuralintegrity. In cases where repairing ACBM will require a limited amount of removal,repair may also involve the installation of replacement materials.
In the context of small scale, short-duration O&M activities, repair should not involve thedisturbance of greater than three square linear feet of ACBM and should only beaccomplished with the authorization of a qualified representative of the LEA through thePermit System.
Major repair activities (greater than three square or linear feet of ACBM) must bedesigned by an EPA-accredited Project Manager.
Thermal system insulations are commonly repaired through the application of repair clothwith a bridging encapsulant and re-applying a cover or jacket. Surfacing materials areonly rarely repaired (e.g. applying patching compounds to surfacing or miscellaneousmaterials.)
Any ACBM which remains after completing an encapsulation response action must beincluded in the O&M Program.
3. Encapsulation: Encapsulation of friable ACBM is a method of restoring or reinforcing thematerials structural integrity. It may be used in concert with repair activities as a meansof stabilizing damaged friable materials. Encapsulation is also employed as a means oflocking residual fibers to polyethylene sheeting following “regulated area” removalprojects. The EPA has estimated that true encapsulation is appropriate in only 20% ofabatement contexts.
There are two primary types of encapsulation; bridging agents and penetrating agents. Astheir names imply, bridgers coat the surface of friable ACBM to provide impactresistance, while penetrants coat and penetrate to increase the cohesive (and sometimesadhesive) strength of the material’s internal matrix. Penetrants are commonly applied tofriable Surfacing or Miscellaneous ACBM (e.g. sprayed acoustical ceiling materials)while bridgers are used to repair TSI. Both are used for post-removal encapsulation(residual fiber lockdown) in different contexts.
Any ACBM which remains after completing an encapsulation response action must beincluded in the O&M Program.
4. Enclosure/Encasement: in some rare circumstances, the LEA may elect to enclose orencase friable ACBMs_ Enclosure involves the construction of airtight, impermeable,permanent barriers around the ACBM. Encasement (or spray applied enclosure) methodinvolves low-pressure spray application of a one-to-two layer shell which is then boltedinto structural elements.
This is not usually an appropriate alternative and, consequently should only be prescribedby a Management Planner upon visitation to the site and evaluation of the methods’efficacy (suitability for protecting human health and the environment) in each proposedcontext. Any ACBM which remains after completing an enclosure/encasement responseaction must be included in the O&M Program.
5. Maintain: Inclusion of a material in the O&M Plan is the minimum response actionoption allowed for any functional space with friable ACBM. Also, inclusion in the O&MPlan is mandatory for any friable ACBM which remains after completing any of theabove major asbestos activities.
O&M Program inclusion requires the initiation of a number of activities or preventivemeasures with the goal of reducing a material’s fiber release potential on an ongoingbasis until the material can be removed.
SECTION 6
GLOSSARY OF TERMS
Air erosion: the passage of air over friable ACBM which may result in the release of asbestosfibers.
Asbestos: the asbestos forms varieties of Chrysotile (serpentine); crocidolite (riebeckite); amosite(cummingtonite grunerite); anthophyllite; tremolite; and actinolite.
Asbestos-containing material (ACM): any material or product which contains more than 1percent asbestos.
Asbestos-containing building material (ACBM): surfacing ACM, thermal system insulationACM, or miscellaneous ACM that is found in or on interior structural members or other parts ofa school building.
Asbestos debris: pieces of ACBM that can be identified by color, texture, or composition, ormeans dust, if the dust is determined by an accredited inspector to be ACM.
Damaged friable miscellaneous ACM: friable miscellaneous ACM which has deteriorated orsustained physical injury such that the internal structure (cohesion) of the material is inadequateor, if applicable, which has delaminated such that its bond to the substrate (adhesion) isinadequate or which for any other reason lacks fiber cohesion or adhesion qualities. Suchdamage or deterioration may be illustrated by the separation of ACM into layers; separation ofACM from the substrate; flaking, blistering, or crumbling of the ACM surface; water damage;significant or repeated water stains, scrapes, gouges, mars or other signs of physical injury on theACM. Damaged or significantly damaged thermal system insulation ACM: thermal system insulationACM on pipes, boilers, tanks, ducts, and other thermal system insulation equipment where theinsulation has lost its structural integrity, or its covering, in whole or in part, is crushed, water-stained, gouged, punctured, missing, or not intact such that it is not able to contain fibers.Damage may be further illustrated by occasional punctures, gouges or other signs of physicalinjury to ACM; occasional water damage on the protective coverings/jackets; or exposed ACMends or joints. Asbestos debris originating from the ACBM in question may also indicatedamage.
Encapsulation: the treatment of ACBM with a material that surrounds or embeds asbestos fibersin adhesive matrix to prevent the release of fibers, as the encapsulant creates a membrane overthe surface (bridging encapsulant) or penetrates the material and binds its components together(penetrating encapsulant).
Enclosure: an airtight, impermeable, permanent barrier around ACBM to prevent the release ofasbestos fibers into the air.
EPA Worker Protection Rule: extends the protection afforded by OSHA to all employees inasbestos abatement who may have been excluded from protection by OSHA.
Fiber release episode: any uncontrolled or unintentional disturbance of ACBM resulting invisible emission.
Friable: when referring to material in a school building means that the material, when dry, maybe crumbled, pulverized, or reduced to powder by hand pressure, and includes previouslynonfriable material after such previously nonfriable material becomes damaged to the extent thatwhen dry it may be crumbled, pulverized, or reduced to powder by hand pressure.
Friable asbestos-containing material (ACM): any material containing more than one percentasbestos which has been applied on ceilings, walls, structural members, piping, duct work, or anyother part of a building, which when dry, may be crumbled, pulverized, or reduced to powder byhand pressure. Includes non-friable asbestos-containing material after such previously non-friable material becomes damaged to the extent that when dry it may be crumbled, pulverized, orreduced to powder by hand pressure.
Friable asbestos-containing building material (ACBM): any friable ACM that is in or oninterior structural members or other parts of a school or public and commercial building.
Functional space: a room, group of rooms, or homogeneous area (including crawl spaces or thespace between a dropped ceiling and the floor or roof deck above), such as classroom(s), acafeteria, gymnasium, hallway(s), designated by a person accredited to prepare managementplans, design abatement projects, or conduct response actions.
High-efficiency particulate air (HEPA): refers to a filtering system capable of trapping andretaining at least 99.97 percent of all monodispersed particles 0.3 rim in diameter or larger.
Homogeneous area: an area of surfacing material, thermal system insulation material, ormiscellaneous material that is uniform in color and texture.
Inspection: an activity undertaken in a school building, or a public and commercial building, todetermine the presence or location, or to assess the condition of, friable or non-friable asbestos-containing building material (ACBM) or suspected ACBM, whether by visual or physicalexamination, or by collecting samples of such material. This term includes reinspections offriable and non-friable known or assumed ACBM which has been previously identified. Theterm does not include the following:
1) Periodic surveillance of the type described in 40 CFR 763.92(b) solely for the purpose ofrecording or reporting a change in the condition of known or assumed ACBM;
2) Inspections performed by employees or agents of Federal, State, or local governmentsolely for the purpose of determining compliance with applicable statutes or regulations;Or
3) Visual inspections of the type described in 40 CFR 763.90(i) solely for the purpose ofdetermining completion of response actions.
Local education agency:1) Any local educational agency as defined in section 198 of the Elementary and Secondary
Education Act of 1965 (20 U.S.C. 3381).2) The owner of any nonpublic, nonprofit elementary or secondary school building.3) The governing authority of any school operated under the defense dependents’ education
system provided for under the Defense Dependents’ Education Act of 1978 (20 U.S.C.921, et seq.).
Major fiber release episode: any uncontrolled or unintentional disturbance of ACBM, resultingin a visible emission, which involves the falling or dislodging of more than 3 square or linear feetof friable ACBM.
Management Plan: a site-specific guidance document that the LEA designated person mustfollow in managing the ACBM present in a school building.
Minor fiber release episode: any uncontrolled or unintentional disturbance of ACBM, resultingin a visible emission, which involves the falling or dislodging of 3 square or linear feet or less offriable ACBM.
Miscellaneous ACM: other, mostly nonfriable ACM, products and materials (found on structuralcomponents, structural members or fixtures) such as floor tile, ceiling tile, construction masticfor floor and ceiling materials, sheet flooring, fire doors, asbestos cement pipe and board,wallboard, acoustical wall tile, and vibration damping cloth.
Miscellaneous material: interior building material on structural components, structural membersor fixtures, such as floor and ceiling tiles, and does not include surfacing material or thermalsystem insulation.
Non-friable: material in a school building which when dry may not be crumbled, pulverized, orreduced to powder by hand pressure.
Operations and maintenance program: a program of work practices to maintain friable ACBMin good condition, ensure clean up of asbestos fibers previously released, and prevent furtherrelease by minimizing and controlling friable ACBM disturbance or damage.
Potential damage: circumstances in which:1) Friable ACBM is in an area regularly used by building occupants, including maintenance
personnel, in the course of their normal activities.
2) There are indications that there is a reasonable likelihood that the material or its coveringwill become damaged, deteriorated, or delaminated due to factors such as changes inbuilding use, changes in operations and maintenance practices, changes in occupancy, orrecurrent damage.
Potential significant damage: circumstances in which:• Friable ACBM is in an area regularly used by building occupants, including maintenance
personnel, in the course of their normal activities.• There are indications that there is a reasonable likelihood that the material or its covering
will become significantly damaged, deteriorated, or delaminated due to factors such aschanges in building use, changes in operations and maintenance practices, changes inoccupancy, or recurrent damage.
• The material is subject to major or continuing disturbance, due to factors including, butnot limited to, accessibility or, under certain circumstances, vibration or air erosion.
Preventive measures: actions taken to reduce disturbance of ACBM or otherwise eliminate thereasonable likelihood of the material’s becoming damaged or significantly damaged.
Public and commercial building: the interior space of any building which is not a schoolbuilding, except that the term does not include any residential apartment building of fewer than10 units or detached single-family homes. The term includes, but is not limited to: industrial andoffice buildings, residential apartment buildings and condominiums of 10 or more dwelling units,government-owned buildings, colleges, museums, airports, hospitals, churches, preschools,stores, warehouses and factories. Interior space includes exterior hallways connecting buildings,porticos, and mechanical systems used to condition interior space.
Removal: the taking out or the stripping of substantially all ACBM from a damaged area, afunctional space, or a homogeneous area in a school building.
Repair returning damaged ACBM to an undamaged condition or to an intact state so as toprevent fiber release.
Response action: a method, including removal, encapsulation, enclosure, repair, operations andmaintenance that protect human health and the environment from friable ACBM.
Routine maintenance area: an area, such as a boiler room or mechanical room that is notnormally frequented by students and in which maintenance employees or contract workersregularly conduct maintenance activities.
School: any elementary or secondary school as defined in section 198 of the Elementary andSecondary Education Act of 1965 (20 U.S.C. 2854).
School building:1) Any structure suitable for use as a classroom, including a school facility such as a
laboratory, library, school eating facility, or facility used for the preparation of food.
2) Any gymnasium or other facility which is specially designed for athletic or recreationalactivities for an academic course in physical education.
3) Any other facility used for the instruction or housing of students or for the administrationof educational or research programs.
4) Any maintenance, storage, or utility facility, including any hallway, essential to theoperation of any facility described in this definition of “school building” underparagraphs (1), (2), or (3).
5) Any portico or covered exterior hallway or walkway.6) Any exterior portion of a mechanical system used to condition interior space.
Significantly damaged friable surfacing ACM: damaged friable surfacing ACM in a functionalspace where the damage is extensive and severe.
Small-scale, short-duration activities (SSSD): tasks such as, but not limited to:1) Removal of asbestos-containing insulation on pipes.2) Removal of small quantities of asbestos-containing insulation on beams or above
ceilings.3) Replacement of an asbestos-containing gasket on a valve.4) Installation or removal of a small section of drywall.5) Installation of electrical conduits through or proximate to asbestos-containing materials.
SSSD can be further defined by the following considerations:1) Removal of small quantities of ACM only if required in the performance of another
maintenance activity not intended as asbestos abatement.2) Removal of asbestos-containing thermal system insulation not to exceed amounts greater
than those which can be contained in a single glove bag.3) Minor repairs to damaged thermal system insulation which do not require removal.4) Repairs to a piece of asbestos-containing wallboard.5) Repairs, involving encapsulation, enclosure, or removal, to small amounts of friable
ACM only if required in the performance of emergency or routine maintenance activityand not intended solely as asbestos abatement. Such work may not exceed amountsgreater than those which can be contained in a single prefabricated mini-enclosure. Suchan enclosure shall conform spatially and geometrically to the localized work area, inorder to perform its intended containment function.
Surfacing ACM: interior ACM that has been sprayed on, toweled on, or otherwise applied tosurfaces (structural members, walls, ceilings, etc.) for acoustical, decorative, fireproofing, orother purposes. Surfacing material that is ACM.
Surfacing material: material in a school building that is sprayed-on, troweled-on, or otherwiseapplied to surfaces, such as acoustical plaster on ceilings and fireproofing materials on structuralmembers, or other materials on surfaces for acoustical, fireproofing, or other purposes.
Thermal system insulation: material in a school building applied to pipes, fittings, boilers,breeching, tanks, ducts, or other interior structural components to prevent heat loss or gain, orwater condensation, or for other purposes.
Thermal system insulation ACM: insulation used to control heat transfer or preventcondensation on pipes and pipe fittings, boilers, breeching, tanks, ducts, and other parts of hotand cold water systems; heating, ventilation, and air-conditioning (HVAC) systems; or othermechanical systems that is ACM.
Vibration: the periodic motion of friable ACBM which may result in the release of asbestosfibers.

INSPECTOR INFORMATION
AHERA Certified Inspectors, Certified Site Surveillance Technicians or Certified AsbestosConsultant:
• AHERA trained Building Inspectors, Certified Asbestos Consultants (CACs) or SiteSurveillance Technicians (SSTs) will participate in conducting periodic inspections andO&M program maintenance (if needed).

The Environmental Protection Agency (EPA) is releasing this updated document in conjunction with the National Parent Teacher Association (PTA) and the National Education Association (NEA) due to an ongoing concern about asbestos in elementary and secondary schools nationwide.
This pamphlet can help parents and teachers answer questions and learn the facts about asbestos in schools. It also outlines the responsibilities of school boards and other school officials to protect school children and employees from possible exposure to asbestos.

sbestos fibers can cause serious health problems. If inhaled, they can disrupt the
normal functioning of the lungs. Three specific diseases – asbestosis, lung cancer, and another cancer known as mesothelioma – have been linked to asbestos exposure. These diseases do not develop immedi-ately after inhalation of asbestos fibers; it may be 20 years or more before symptoms appear.
In general, as with cigarette smoking, the more asbestos fibers a person inhales, the greater the risk of developing an asbestos-related disease. The most severe health problems from asbestos exposure have been experienced by some workers who held jobs in industries such as shipbuilding, where they were exposed to very high levels of asbestos in the air. These employees worked directly with asbestos materials on a regular basis as a part of their jobs. Much uncer-tainty surrounds the risk from
exposure to low levels of asbestos fibers.
Nevertheless, the risk of school children being exposed to even low levels of asbestos is a concern. Acting on this concern, Congress passed the Asbestos Hazard Emergency Response Act (AHERA) in 1986 to protect school children and school employees from exposure to asbestos in school buildings. This pamphlet describes key parts of these federal asbestos require-ments for schools.

A sbestos is a mineral found in certain types of rock formations. When mined and processed, it
takes the form of very small fibers which are usually invisible to the naked eye. A typical asbestos fiber is 1,200 times smaller than a strand of human hair. These individual fibers are generally mixed with a material which binds them together so that they can be used in many different products. Because the fibers are so small and light, they can remain in the air for many hours if they are released from asbestos-containing material. This increases the chance that someone will inhale them.
Asbestos became a popular commercial product because it is strong, won’t burn, resists corrosion, and insulates well. Its commercial use in the United States began in the early 1900s, when it was used as insulation in steam engines. Since then asbestos has been used to create about 3,000 different products, including insulation and fireproofing. The peak years of asbestos use in schools were from World War II until the 1970s.
Where Is Asbestos Likely to Be Found?
E PA estimates that there are asbestos-containing materials in most of the nation’s primary,
secondary and charter schools. Asbestos is most commonly used in schools as insulation and in building materials. It has also been used in floor and ceiling tile, cement asbes-tos pipe, corrugated paper pipe wrap, acoustical and decorative insulation, pipe and boiler insulation, and spray-applied fireproofing. The fluffy white substance you may find above a dropped ceiling, for ex-ample, is one type of spray-applied material. The amount of asbestos in

Aa Bb Cc Dd Ee Ff G these products varies widely, from less than 1 to 100 percent, depending on the use. Pipe and boiler insulation typically contains more asbestos than other building materials. The precise amount of asbestos in a product cannot always be deter-mined from labels – since most products used in the past were not labeled – or by asking the manufac-turer. Instead, positive identification of asbestos requires analysis of samples by a qualified laboratory.
When Is Asbestos a Problem?
I ntact and undisturbed asbestos materials generally do not pose a health risk. Asbestos
materials, however, can become hazardous when, due to damage or deterioration over time, they release fibers. If the fibers are inhaled, they can lead to health problems.
The potential for an asbestos-containing material to release fibers depends primarily on its condition. If the material, when dry, can be crumbled by hand pressure – a condition known as “friable” – it is more likely to release fibers, particu-larly when damaged. The fluffy spray-applied asbestos fireproofing material is generally considered “friable.” Pipe and boiler insulation materials can also be “friable,” but they often are enclosed in a Continued on p. 6

he federal government has been regulating asbestos for a
number of years. Progress is being made to limit the uses of asbestos and to identify substitute materials.
AHERA required EPA to develop regulations creating a comprehensive framework for dealing with asbestos in public and nonprofit private elemen-tary and secondary schools. The regulations were published on October 30, 1987.
The AHERA schools rule requires all public school districts and private schools, known as local education agencies or LEAs, to inspect all school buildings for both friable and nonfriable asbes-tos; to develop plans to manage asbestos in schools; and to carry out the plans in a timely fashion. The rule also provides an opportunity for parents, teachers, and other
school employees to become familiar with and involved in their school’s asbestos management program. sawed or otherwise disturbed. Materials such as asbestos cement pipe can release asbestos fibers if they are broken or crushed when buildings are demolished, reno-vated or repaired.
What Are the Proper Methods for Managing Asbestos?
M ost asbestos-contain-ing material can be properly managed where it is. In fact,
asbestos that is managed properly and maintained in good condition appears to pose relatively little risk to students and school employ-ees. Accordingly, the AHERA schools rule rarely requires the removal of asbestos materials.
Proper asbestos management begins with a comprehensive inspection by qualified, trained and experienced inspectors, accredited through an EPA or state-approved training course. Inspecting the condition of asbestos materials – initially with AHERA-accredited inspectors and at least semi-annually with trained custodial or maintenance staff – is extremely important so that changes in the material’s condition, such as
damage or deterioration, can be detected and corrected before the condition worsens. Sometimes normal school or maintenance activities can damage asbestos material and cause fiber release, particularly if the material is “friable.” A thorough initial inspection and regular surveillance can prevent accidental exposure to high levels of asbestos fibers.
The methods (see page 7), in AHERA terminology, are asbestos “response actions.” The last three methods of response actions – encapsulation, enclosure, and removal – and sometimes the second method – repair – must be done by accredited asbestos professionals.
The final response action, asbestos removal, is generally necessary only when the material damage is extensive and severe,

risk. Consequently, all school removal projects must be de-signed, supervised, and conducted by accredited professionals and should be performed in accor-dance with state-of-the-art procedures. In addition, schools may wish to hire an experienced and qualified project monitor to

Only an AHERA-accredited management planner – an asbestos professional with proper training, qualifications, and experience – is
authorized to advise school officials on which response action is appro-priate for a particular situation. The final selection of the proper method is up to school officials after they receive the advice of the school’s accredited management planner.
What Should My School &School District Be Doing?
U nder the AHERA schools rule, each local education agency (LEA, which
means a school district or private school) must take the following asbestos-related actions:
1 Designate and train a person to oversee asbestos-related activities in the school system.
2 Inspect every school building for “friable” and “nonfriable” asbestos-containing building materials.
3 Prepare a management plan for managing asbestos and controlling exposure in each school.
4 Consult with accredited inspec-tion and management professionals
to identify and carry out whatever asbestos actions are necessary and appropriate to protect health and the environment. These actions or methods must be documented in the management plan.
5 Notify the public about the asbestos inspection and the availability of the asbestos man-agement plan for review.
6 Use only properly accredited persons to conduct inspections, to develop the asbestos management plan, and to carry out the appropri-ate response actions.
7 Keep records of all asbestos related activities in the plan and make them available for public review.

School officials may choose a consultant or one of their own employees to oversee their asbes-tos program. This designated person must meet certain training requirements, and serves as the single point of contact for public information about asbestos-related activities in the LEA. He or she is responsible for: • Ensuring that initial asbestos
inspections, re-inspections every three years, and semi-annual surveillance activities are conducted properly by qualified personnel.
• Including results of the inspec-tion in the management plan. The plan must identify all asbestos-containing building materials found in schools and recommend actions for dealing with asbestos hazards.

• Making sure that custodial and maintenance workers receive required safety training and information about the location of asbestos-containing materials in their school. Warning labels must be posted in all routine maintenance areas, such as boiler rooms, where asbestos-containing building materials are found.
• Ensuring that response actions specified in the management plan are carried out according to the plan’s timetables. The regula-tions require that all LEAs were to begin to carry out their management plans no later than July 9, 1989.
• Seeing that all asbestos records required by the regulations are accurately maintained.
• Informing all teacher, parent and employee organizations at least once a year about the asbestos activities in each school and about the availabil-ity of the management plan for their review.

A s a parent, teacher, student, service worker or other school employee,
the most important thing you can do first is to learn about your school’s asbestos activities. As you do so, remember that the mere presence of asbestos in a school doesn’t necessarily mean that the health of its occupants is endangered. Again, asbestos that is managed properly and maintained in good condition poses relatively little risk. Federal regulations do not require the removal of all friable asbestos from schools until the building is demolished. In fact, during the life of the building, other methods of dealing with the material are often preferable to removal.
In those cases when removing asbestos is deter-mined to be the appropriate
decision, the work must be done under strict controls by trained, qualified and experi-enced asbestos professionals who are properly accredited under AHERA.
Step One: Awareness
Your first step is to make sure your school has prepared an asbestos management plan as required by AHERA. By becom-ing familiar with this plan, you will know if asbestos materials are in the school, what plans the school has for managing this asbestos, and when these activities are scheduled to occur.

There are several simple things you can do to minimize your exposure to asbestos. The most important one is to find out which materials in your school contain asbestos; you should be able to get this information from your LEA’s designated person or from the school’s management plan.
Once you know where asbestos is, use special care to insure that any day-to-day activities, such as repair or maintenance work, do not disturb the material. In fact, special training is required to participate in any maintenance activities which might disturb asbestos. In schools, asbestos-containing materials can also be damaged by student activi-ties. For example, an asbestos ceiling in a gym may be dis-turbed if basketballs or other

ll of us are respon-sible. Making the AHERA schools rule work to protect the
nation’s school children and employees is a joint responsibility of the LEA and its officials, school employees, parents, students,
federal and state governments, and asbestos control professionals.
EPA conducts compliance inspections of a sample of schools each year to make sure they are obeying the law. The Agency is responsible for insuring that schools comply with AHERA and it will investigate reported violations. Since the AHERA schools rule is inten-tionally designed to involve parent, teacher and other school employee organizations, it is impor-tant that you work with your school to make sure that its asbestos program is properly conducted.

U nder AHERA, citizens have the opportunity to be-come informed about
asbestos activities in their schools. If you have a question or concern about those activities, you should first contact your LEA designated person. This person knows the most about the asbestos situation in your school. When you find out who this person is, ask him or her what steps your school has taken, and will continue to take, to meet the requirements of the AHERA schools rule.
The LEA designated person also can tell you which agency in your state government is respon-sible for state AHERA activities. The same agency usually is responsible for reviewing the LEA’s asbestos management plan. This LEA designated person also should be aware of any local asbestos control requirements.
State AHERA designees also are a good source of information. These officials can help you better understand the AHERA schools rule
and can answer questions about your school’s asbestos activities.
Local, state, and national parent and teacher organizations are other good sources of information about asbestos in schools. Many of these

groups worked with EPA in devel-oping the AHERA schools rule, and some have started their own educational efforts to improve understanding of the AHERA requirements and proper asbestos control practices.

1.4 Award of Contract. It is understood and agreed that if written notice of the acceptance of this
Bid Proposal and award of the Contract thereon is mailed or delivered by the District to the
undersigned after the opening of Bid Proposals and within the time this Bid Proposal is required

to remain open or at any time thereafter before this Bid Proposal is withdrawn, the undersigned
will execute and deliver to the District the Agreement in the form attached hereto in accordance
with the Bid Proposal as accepted within seven (7) calendar days after notification of acceptance
and award. Concurrently with delivery of the executed Agreement to the District, the Bidder
awarded the Contract shall deliver to the District: (1) the Labor and Material Payment Bond; (2)
the Performance Bond; (3) the Drug-Free Workplace Certificate; (4) Certificates of Insurance
evidencing all insurance coverages required to be provided under the Contract Documents; (5) the
Certificate of Workers’ Compensation Insurance; (6) Fingerprinting Certificate; and (7) DVBE
Participation Certificate. The Work under the Contract Documents shall be commenced by the
undersigned Bidder, if awarded the Contract, on the date stated in the District's Notice to Proceed
issued pursuant to the Contract Documents. Completion of the Work shall be achieved within the
Contract Time specified in the Contract Documents.
1.5 Notices. All notices or other correspondence shall be addressed to the District and the Bidder
at their respective addresses set forth herein. Notices shall be effective only if in writing and
in conformity with the requirements for service of notices set forth in the Contract Documents.
1.6 Contractor's License. The undersigned Bidder is currently and duly licensed in accordance
with the California Contractors License Law, California Business & Professions Code §§7000
et seq., under the following:

By executing this Bid Proposal, the Bidder hereby certifies that: (a) it is duly licensed, in the
necessary class(es), for performing the Work of the Contract Documents; (b) that such license
shall be in full force and effect throughout the duration of the performance of the Work under
the Contract Documents; and (c) that all Subcontractors providing or performing any portion
of the Work of the Contract Documents shall be so similarly and appropriately licensed to
perform or provide such portion of the Work.
1.7 Designation of Subcontractors. In compliance with the Subletting and Subcontracting Fair
Practices Act (California Public Contract Code §§4100, et seq.) and amendments thereof, each
Bidder shall set forth in the Subcontractors List: (a) the name and location of the place of
business of each Subcontractor who will perform work or labor or render services to the Bidder
in or about the construction of the Work to be performed under the Contract Documents in an
amount in excess of one-half of one percent (0.5%) of the Bidder's Bid Proposal; and (b) the
trade and/or portion of the Work which will be performed by each listed Subcontractor. The
Bidder shall list only one Subcontractor for each trade and/or portion of the Work as is defined
by the Bidder in its Bid Proposal. If a Bidder fails to list a Subcontractor for a portion of the
work in excess of one-half of one percent (0.5%) of the Bidder’s Bid Proposal or if the Bidder
specifies more than one Subcontractor for the same portion of Work to be performed under the
Contract Documents valued in excess of one-half of one percent (0.5%) of the Bidder's Bid
Proposal amount, the Bidder shall be deemed to have agreed that it is fully qualified to perform
that portion of the Work itself and that it shall perform that portion of the Work.

1.8 Confirmation of Figures. By submitting this Bid Proposal, the Bidder confirms that it has
checked all of the above figures and understands that neither the District nor any of its agents,
employees or representatives shall be responsible for any errors or omissions on the part of the
undersigned Bidder in preparing and submitting this Bid Proposal.
1.9 Acknowledgment and Confirmation. The undersigned Bidder acknowledges its receipt,
review and understanding of the Drawings, the Specifications and other Contract Documents
pertaining to the proposed Work. The undersigned Bidder certifies that the Contract Documents
are, in its opinion, adequate, feasible and complete for providing, performing and constructing
the Work in a sound and suitable manner for the use specified and intended by the Contract
Documents. The undersigned Bidder certifies that it has, or has available, all necessary
equipment, personnel, materials, facilities and technical and financial ability to complete the
Work for the amount bid herein within the Contract Time and in accordance with the Contract
Documents. The undersigned Bidder certifies that its bid amount includes funds sufficient to
allow the Bidder to comply with all applicable local, state and federal laws and regulations
governing the labor and services to be provided for the performance of the Work of the Contract
and shall indemnify, defend and hold District harmless from and against any and all claims,
