    For years the law in Michigan has rec-

    ognized that an owner of land separated from

    a lake front by a public road would enjoy

    riparian rights in the waterfront.

    Last year the Michi-

    gan Supreme Court held

    that the dedication of a

    road to the public on a

    plat would limit the rights

    of those property owners.

    Now the Courts will

    examine the language of

    the old plat to determinewhether the platters in-

    tended to restrict the

    dedication of the road.

    In the absence of such restriction the

    Court concluded that the riparian rights were

    included in the dedication and accordingly,

    no longer available to the private property

    owner.

    The case could have ramifications on

    those lot owners who have maintained

    docks or other shore improvements on the

    other side of the road.

    Property owners need to review the

    recorded plat of their subdivision to de-

    termine whether their use of the property

    on the other side of the road could be af-

    fected.

    Traditionally, the nexus of the landlord-

    tenant relationship has been one thing andone thing only the rent.

    Beyond that monthly check, the twodidnt get involved in each others financialmatters. They didnt need to. They didntwant to.

    Its always been this is your business;this is my building. Im the landlord; yourethe tenant. Good luck, said ChuckSchneider, a local real estate developer whoowns numerous commercial properties in Ox-ford and Lake Orion.

    But given these difficult economic times,Schneider, who serves on Oxfords DDAboard, came to the realization that this age-old relationship must change and evolve iflandlords wish to lease the glut of emptybuildings on the market right now and entre-

    preneurs wish to start new businesses or ex-pand existing ones.

    In his view, landlords must now fulfill therole banks once played by providing the capi-tal entrepreneurs need. By doing so, land-lords will fill their empty buildings and overtime, see their rents increase.

    Rather than be left with an empty buildecorated by a for-lease sign, Schneidecided to be proactive and purchase alassets.

    I bought the place lock, stock and rel, he said. Here we have a clientelehave a staff. We have a furnished buildAre we going to cast these 16 (employadrift, or do we try and keep this placeing?

    Schneider says landlordmust act as banks

    Now that 2011 is almost here, you maywant to make some New Years resolutions.Planning to volunteer? Go to the gym moreoften? Learn a new language? All worthyambitions, of course, but this year, why notadd some financial resolutions as well?

    Which resolutions shouldyou make? Here are a fewideas to consider:

    Boost your retirement ac-counts. No matter how oldyoull be in 2011, one thing iscertain youre a year closerto retirement than you were in2010. And thats why youllwant to increase your contributions to yourretirement accounts. If your salary is goingup in 2011, boost the amount you defer foryour 401(k) or other employer-sponsored re-tirement plan, such as a 403(b) plan (if youwork for a school or other tax-exempt organi-zation) or a 457(b) plan (if you work for astate or local government). With tax-deduct-ible contributions, tax-deferred growth ofearnings and several investment options,these types of plans are tremendous ways tosave for retirement. And try to max out yourtraditional or Roth IRA, too.

    Ring in some New Yearsfinancial resolutions

    Look for opportunities. With the uncer-tainties in the economy and the volatility ofthe financial markets, many people decide tohead to the investment sidelines for a while.Yet, this environment may actually be a goodone for investors with patience, disciplineand the ability to look beyond yesterdaysheadlines. For one thing, many quality secu-rities are now good values. Also, were stillseeing low inflation and low interest rates factors that may lead to greater economicdemand and improved strength in the finan-cial markets.

    Dont over-react to market swings. Overthe past few years, weve seen plenty of sud-den, sharp swings in the financial markets,and youre likely going to see more of themin 2011. Dont over-react to either the upsor the downs of the market. Over-reactingleads to short-term thinking and success-ful investors are the ones who can maintain along-term perspective.

    Rebalance when necessary. At least oncea year, review and rebalance your portfolio,as necessary, to make sure it still reflects yourgoals, risk tolerance and family situation, allof which can change over time.

    When it comes to the world of business, sitting in a class-room learning a bunch of theories can come in handy, but itdoesnt compare to the value of gaining some hands-on ex-perience in the real world.

    Marketing students from Oxford High School got the op-portunity to do just that when they did some job-shadowingat Funky Monkey Toys in downtown Oxford.

    Last week, two marketing students visited the store eachday and spent an hour learning and experiencing what itslike to own and operate a small business.

    Theyve been great, said Tom Jones, owner of FunkyMonkey Toys. Theyve come prepared with questions andhave been very enthusiastic.

    As part of their job-shadowing, students learned how towork the cash register by waiting on actual customers.

    When inventory arrived, the students learned how to pro-cess the packages, input the items into the stores computer,price the toys and place them on the shelves. I wanted it to

    be interactive instead of just me lecturing, Jones said.He also explained to students the marketing strategy be-

    hind why his stores merchandise is arranged the way it is andhow his play area for kids helps promote business.

    Jones is certainly no stranger to the high schools DECAClub, a group for students interested in marketing and busi-ness. Thats why he agreed to host the job-shadowing.

    I was very familiar with the program. I was in the club inhigh school, he said. There were some local businessesthat helped me out at the time and actually gave me a jobwhen I was 16. So, I thought Id repay the favor.

    We live in a world in which popular cultureexerts a great deal of influence over our chil-dren.

    Tim also volunteers histime at the fashion shows,the Womens Expo, and theChristmas parade.

    Tim has always been onethe Chamber can count on to get a job dand will be missed not only for his expe

    but also for his great sense of humor and dcation.

    The chamber of commerce has some ex-citing events coming up. On January 15thwe will have our 1st Annual Red Carpet Cham-ber Appreciation and Community AwardsGala, which will be held at Oxford High

    School. The event is open to chamber mem-bers, guests and everyone in the community.Tickets are only $15, which includes appetiz-ers and refreshments. Tickets are availableat the chamber of commerce office or byphone at 248-628-0410.

    The chamber board does continue to in-vestigate whether a merger with the OrionArea Chamber of Commerce makes sense andbrings value to chamber members. We havereceived a good deal of feedback and someconcerns from members who took part in afocus group and from others in the commu-nity. We are looking carefully at those con-cerns and preparing answers to questionsthat have been raised. Once that happenswe will be doing a presentation to our cham-ber members, most likely at a luncheon in

    March, so stay tuned for more informationon that.

    The chamber is also looking at ways wecan give our members more networking op-portunities in the New Year.

    We really hope that members realize thatnetworking has been very successful formany of members, and encourage all of ourmembers to take part, we want to make sureyour value received exceeds your chamberinvestment.

    When it comes to the fast food game, thereare more choices now than theres ever been.

    But judging by the reception Oxford gaveit, McDonalds is still the undisputed king ofthe hamburger business.

    On Dec. 17, Oxfords new McDonalds res-taurant officially opened for business withso much fanfare one would have thought anew battleship was being christened.

    Both the interior and the outside of thestore look very nice, said owner JackMcMahon. I just hope we live up to ourpress notices.

    The new restaurant, which features dualdrive-through lanes, is located on the westside of M-24, south of Ray Rd. and north ofMarket St.

    I have waited for this day for a long timeand Im just thrilled to have it, said Oxfordstore manager Joan Halsted, whos beenwith McDonalds since 1976 and won twoRay Kroc awards.

    The old McDonalds at 280 N. Washing-ton St. was demolished last week after ap-proximately 30 years of service to Oxford.

    Its the same crew; we just moved to anew location, Halsted noted.

    Members of the Oxford Wildcats varsityfootball team were on hand to help raise a

    massive American flag in front of the newrestaurant. They were joined by veteransfrom American Legion Post 108.

    OHS choir students performed the NationalAnthem followed by a few holiday tunes.

    This was more than I could have everanticipated or hoped for, said Halsted, re-ferring to the ceremony. Its so neat to havethe community here. Im speechless.

    McMahon cut the ceremonial ribbon withmembers of his management team and theone and only Ronald McDonald.

    McMahon expects to see increased busi-ness at the new location, especially frommorning commuters headed south on M-24.

    This is the breakfast side of the road,he said.

    I think with the double drive-throughsystem, well be able to wait on people twiceas fast, Halsted added.

    McDonalds and McMahon have enjoyeda long relationship. It all started withMcMahons mother working as Ray Krocssecretary. Kroc built the McDonalds empire.

    The McMahon family opened their firstMcDonalds on Perry St. in Pontiac in 1960.

    My dad, my mother and myself ran thebusiness together, he said.

    Today, McMahon owns McDonalds res-taurants in Oxford, Lake Orion and AuburnHills by Great Lakes Crossing.

    Members of the OHS Wildcatvarsity football team helped raisethis giant American flag in front ofthe new McDonalds restaurant.

    Schneider explained that most banks thesedays arent lending money for small busi-nesses despite their advertised claims.

    The billions of dollars (the federal gov-ernment) gave the banks never filtered downto the consumer, he said. The banks usedit to buy other banks; they didnt use it tomake loans more affordable for people.Theyre not opening up their credit, theyrerestricting their credit.

    Without capital, entrepreneurs looking tostart a new business or expand an existingone cant afford to do it.

    Oakland County has various training

    programs how to write a business plan andhow to decorate your windows. Those aregreat, but weve got to get the person in busi-ness first, he said. Thats where were fall-ing down. The finance piece of that processdoesnt exist. Without that finance piece, thebusiness doesnt exist.

    Most people dont have the workingcapital. They need the money for their housepayment, their car payment, their kids edu-cation and groceries, Schneider explained.

    They dont have the resources to say Imgoing to take X amount of dollars and plunkit here and by the way, I want to have sixmonths savings to feed the meter while thisbusiness is getting off the ground.

    This is where landlords must step in and

    follow Schneiders model of becoming a part-ner or investor in their tenants business ven-ture, as hes done with Walker.

    Im the bank. Im basically financing thepurchase of the business, he said. She paysa start-up rent to get her rolling.

    Over time, Schneider said the rent struc-ture will change and Walker will purchase allthe assets from him, thus becoming the soleowner of the business.

    Gone are the days when landlords couldsimply buy a building and wait for someoneto lease it. Schneider said landlords have tobe more proactive and willing to take a gambleon new businesses with their own money.

    You have to look at the individual andsay, Im betting that you have the skill set todo this, he said. Those are people you

    work with to be successful.Conversely, landlords have to look at

    people who arent qualified, who have noexperience or know-how, no business planor background, and say Im not taking achance on you, Schneider explained. Youhave to be a good judge of people and whatyou think their capabilities are and whattheir skills are.

    Basically, landlords must now fill the roleabdicated by banks to help get the economy

    moving again.We are a credit economy like it or not.

    And when credit goes, this economy goesbecause thats the way its been created,Schneider said. When the credit tightensup, its like putting the brakes on the train. It

    just comes to a stop.The benefits to landlords and the com-

    munities in which they own properties areoccupied buildings and higher rents.

    Once the buildings are full, then rentscan rise. But rents will never rise when youhave empty buildings, Schneider said. Youhave to fill everything up, then create de-mand for the community. Prices will neverrise when you have vacancies and no line ofpeople saying, Hey, I want to go to Oxford.

    Schneider noted that Rochester filled 38stores in one year because the towns DDAwas very aggressive about going out andrecruiting new businesses.

    As for Oxford, were not there yet.We still need to do a lot of work to at-

    tract people to the community, he said.For-lease signs dont say successful andvibrant, they say just the opposite.

    for the New YearWhile New Year's resolutions often

    don't last, this is a great time to be think-ing about goals. Specifically, financialgoals.

    So where do you want to be?Take a quiet hour or two to write

    out your financial vision.Do you want to have a specific

    amount saved? For what purpose? Doyou want to start your own businesson the side? Become completely debt-free? Pay off the mortgage early? Takean early retirement? Remodel yourhome? Build an investment portfolio?Become a major supporter of your fa-vorite charity? Go back to school andfinish that degree? Have enough moneyso work becomes a hobby and not a

    necessity?Don't limit yourself to what you think

    you can do. Give yourself the freedomto dream, to come up with your idealfinancial scenario.

    And here's an important tip: Write itas if it's already in existence.
