Julie also placed 4th in the discus.

Seconded by Councillor Garrison THAT Kingston City Council extend congratulations to Natalie Lambert, who touched shore completing her marathon swim at 9:20 a.m. on Tuesday, August 28th. She completed the 57-km swim from Sackets Harbor, N.Y., to Kingston in an unofficial time of 23 hours and 15 minutes. At the age of 14, Natalie has become the youngest swimmer to cross Lake Ontario.

REPORTS REPORT NO. 87 OF THE CHIEF ADMINISTRATIVE OFFICER (CONSENT)

Report No. 87 To the Mayor and Members of Council: The Chief Administrative Officer reports and recommends as follows: All items listed on the Consent Report shall be the subject of one motion. Any member may ask for any item(s) included in the Consent Report to be separated from that motion, whereupon the consent report without the separated item(s) shall be put and the separated item(s) shall be considered immediately thereafter. THAT Council consent to the approval of the following routine items: (a) Land Lease with Douglas Edward Hinton for Ravensview Subdivision Lot 7 of Plan 525

THAT Council authorize the Mayor and Clerk to execute a lease with Douglas Edward Hinton for the land known as Lot 7, Plan 525, municipally known as 879 LaSalle Boulevard, in the City of Kingston for a term of seven (7) years commencing September 1, 2007, to and including August 31, 2014, at a rental rate of $1,848 per annum, subject to Consumer Price Index (CPI) adjustment annually on September 1, in a form satisfactory to the Director of Legal Services. (b) Proposed License Agreement with Joanne Clarke, Carrying on Business as “Little Bits Day Care” for Space

within Meadowcrest Community Centre at 360 Kingston Mills Road THAT Council authorize the Mayor and Clerk to execute a license agreement, in a form satisfactory to the Director of Legal Services, with Joanne Clarke, carrying on business as Little Bits Day Care, in the building municipally known as 360 Kingston Mills Road, in the City of Kingston for a term of three (3) years commencing October 1, 2007, or as soon thereafter as the building can be made ready for the day care, for a license fee of $12,000 per year, comprised of $9,700 in fees and $2,300 to be applied toward property taxes, with the said fees being subject to Consumer Price Index (CPI) adjustment annually on the anniversary of the commencement date beginning with the first anniversary in 2008;

- and further - THAT Council authorize the Mayor and Clerk to execute an agreement, in a form satisfactory to the Director of Legal Services, to effect the transfer of the license agreement at a later date from the name of the licensee to the name of a company to be incorporated and owned by the licensee for the day care operation;

- and further - THAT Council authorize a maximum expenditure of $44,550, which includes a 10% contingency, for initial repairs to the Meadowcrest Community Centre in the fiscal year 2007, with funding being provided by the Facility Repair Reserve Fund, which is to be partially replenished from the annual license fee net of operating costs and property taxes. THAT Queen’s Alma Mater Society be granted an exemption to Noise Control By-Law No. 2004-52, Schedule B, to permit an outdoor concert at Miller Parking Lot behind Miller Hall at 36 Union Street on Friday, September 7, 2007 from 3:00 p.m. to 7:30 p.m. for set-up and sound testing, and then from 8:30 p.m. until 12:00 p.m. midnight for the concert itself;

- and further - THAT Queen’s University Arts and Science be granted an exemption to Noise Control By-Law No. 2004-52, Schedule B, to permit an outdoor semi-formal at Agnes Benedickson Field off 5th Field Company Lane on Saturday, September 8, 2007 from 6:00 p.m. until 8:00 p.m. for set-up and sound testing, and then from 8:00 p.m. until 12:00 p.m. midnight for the semi-formal itself. (e) Award of Tender for the Construction of the K & P Trail to L.A. Knapp Inc.

THAT Council authorize the Mayor and Clerk to enter into an agreement with L.A. Knapp Inc., for clearing grading and various other improvements as outlined in Tender No. PWES-EN-2007-08, Construction of the K & P Trail for the 15 km. rural section of the K & P Trail which runs from the Little Cataraqui Creek north to Orser Road, for the amount of $274,225.71, being the lowest bid received. Report No. 88 To the Mayor and Members of Council: The Chief Administrative Officer reports and recommends as follows: (1A) STAFF BRIEFING - Mr. Denis Leger, Commissioner of Corporate Services, will speak to Council regarding the

proposed license agreement with Queen’s University for space within the Kingston Memorial Centre and other ice facilities.

(1) Proposed License Agreement with Queen’s University for Space within the Kingston Memorial Centre and

Other Ice Facilities THAT Council authorize the Mayor and Clerk to execute a license agreement with Queen’s University for three ice-skating seasons, commencing September 1, 2007 to April 30, 2010, with an option for Queen’s University to renew for two additional seasons at prevailing rates as set by Council, for use of ice at the City’s ice facilities, including but not limited to the Kingston Memorial Centre, in a form satisfactory to the Director of Legal Services;

- and further - THAT the said agreement respects the rights of the Kingston and District Agricultural Society to hold its annual Fall Fair at the Memorial Centre;

- and further - THAT any reduction in the annual operating deficit of the Memorial Centre which results from the City entering into this license agreement with Queen’s University be shown as an annual operating budget contribution to the Memorial Centre Revitalization Project until or unless otherwise determined by Council during its annual operating budget deliberations. (2) Lafarge Environmental Review Tribunal Hearing

THAT Council authorize Legal Services to seek party status for the City of Kingston at the hearing of the appeal of certificate of approval Number 3479-6RKVHX (air) for the Bath Cement Plant owned by Lafarge Canada. August 16, 2007 1. Application for Final Condominium Approval for a Single Storey, Three Unit Industrial Building at 738 Fortune

Crescent THAT the application for Final Plan of Condominium Approval submitted by 1517849 Ontario Limited with respect to a three unit industrial building at 738 Fortune Crescent, BE EXEMPTED under Section 9 (6) of the Condominium Act from the provisions of Section 51 and 51.1 of the Planning Act that would normally apply under Section 9(2) of the Condominium Act; AND BE IT FURTHER RESOLVED that Final Approval be granted to the Plan of Condominium submitted by 1517849 Ontario Limited, a three unit industrial building at 738 Fortune Crescent, subject to the Owner entering into a Condominium Agreement with the City, which Agreement shall provide further notice to the Condominium Corporation and present and future purchasers of the conditions contained within the registered Site Plan Control Agreements and that the Condominium Corporation will be responsible for maintaining the approved Site Plan works and fulfilling any conditions of the Agreements; AND BE IT FURTHER RESOLVED that, following the execution of the Condominium Agreement, the Director of Legal Services be authorized to forward the necessary signed and stamped originals and required copies of the Final Plan of Condominium to the Land Registry Office for registration.

2. Revised Tree By-Law and the Associated Guidelines THEREFORE BE IT RESOLVED that the Revised Tree By-Law (attached as Exhibit ‘A’ to Report No. PC-07-051 of the Planning Agenda) BE APPROVED for all three readings; AND BE IT FURTHER RESOLVED that the Tree By-Law Guidelines, the Guidelines for the Completion of an Arborist’s Report, and the Guidelines for Tree Preservation and Protection (attached as Exhibits ‘B’ through ‘D’ to Report No. PC-07-051 of the Planning Agenda) BE ADOPTED; AND BE IT FURTHER RESOLVED that the Tree By-Law revised in 2007 shall be reviewed two years after it has been adopted in light of the experience applying it; AND BE IT FURTHER RESOLVED that such review shall include public consultation; AND BE IT FURTHER RESOLVED that the Planning Committee shall report to Council on the need or lack thereof of further amendment. Report No. 90 To the Mayor and Members of Council: The Kingston Municipal Heritage Committee (LACAC) reports and recommends as follows:

August 13, 2007 1. Notice of Intent to Designate 186 Frontenac Street

WHEREAS 186 Frontenac Street is a property of cultural heritage value; and, WHEREAS Section 29 of the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 authorizes the Council of a Municipality to enact by-laws to designate real property; and, WHEREAS the Kingston Municipal Heritage Committee requested staff prepare a designation by-law for this property and is in agreement with pursuing the designation of this property; THEREFORE BE IT RESOLVED THAT Council serve Notice of Intent to Designate 186 Frontenac Street to be of Cultural Heritage Value under Part 4 of the Ontario Heritage Act and authorize City Staff to proceed with fulfilling the requirements of a Notice of Intent to Designate as defined in Section 29 (3) and (4) of the Ontario Heritage Act and to include the designation of the interior to include the original layout of interior spaces; fireplace wall, with three arches, the central one containing a concrete surround and wooden mantel, with corner inserts in each arch; oak flooring; and wooden staircase;

- and further - THAT Council approve funding for an external evaluation to be conducted by a qualified Heritage consultant outside the City in an amount not to exceed $2000. (Note: Information regarding the designation of this property is attached as Schedule Pages 73-76)

2. Notice of Intent to Designate 151 Union Street

WHEREAS 151 Union Street is a property of cultural heritage value; and, WHEREAS Section 29 of the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 authorizes the Council of a Municipality to enact by-laws to designate real property; and, WHEREAS the Kingston Municipal Heritage Committee is in agreement with pursuing the designation of this property; and, WHEREAS the Kingston Municipal Heritage Committee is requesting staff prepare a designation by-law for this property and is in agreement with pursuing the designation of this property; THEREFORE BE IT RESOLVED THAT Council serve Notice of Intent to Designate 151 Union Street to be of Cultural Heritage Value under Part 4 of the Ontario Heritage Act and to include the designation of interior features and authorize City Staff to proceed with fulfilling the requirements of a Notice of Intent to Designate as defined in Section 29 (3) and (4) of the Ontario Heritage Act. (Note: Information regarding the designation of this property is attached as Schedule Pages 73-76)



REPORTS (CONTINUED) REPORT NO. 90 OF THE KINGSTON MUNICIPAL HERITAGE COMMITTEE (LACAC) 3. Final Approval of a Heritage Property Grant for 948 Hwy 2 East

WHEREAS the owner of 948 Hwy 2 East has requested final approval for Heritage Grant Application HG-13-2006; and, WHEREAS as per the requirements as per By-Law No. 2005-258, “A By-Law To Establish A Heritage Grants Program”, a site visit to review the completed works was completed; THEREFORE BE IT RESOLVED THAT Heritage Property Grant HG-13-06 for 948 Hwy 2 East BE APPROVED for the repointing of the exterior walls of the house;

- and further - THAT staff be authorized to issue a cheque for $2000.00 as per the process outlined in By-Law No. 2005-258, “A By-Law To Establish A Heritage Grants Program”.

4. Approval in Principle of an Application for Phase IV – Dome Restoration Including Painting of Existing

Columns, and Window Replacement and Copper Roofing at 21 Court Street known as Frontenac County Court House THAT Application P18-109-052-2007 for a property located at 21 Court Street known as Frontenac County Court House requesting approval for Phase IV – dome restoration including painting of existing columns, and window replacement and copper roofing BE APPROVED IN PRINCIPLE;

- and further - THAT as this property is protected by an agreement held by the Ontario Heritage Trust, that the applicant ensures that the Ontario Heritage Trust approves all proposed works.

5. Approval in Principle of an Application for Phase VI - 4th Floor Stone Restoration and Front Portico at 216

7. Approval of an Application for Replacement of Existing Cedar Shakes and Shingles Roofing with Fibreglass

THAT Application P18-060-046-2007 for a property located at 80 Barrie Street requesting approval to repair front pillars BE DENIED;

- and further - WHERE the Council refuses the application, the owner may, within thirty days after receipt of the notice under Subsection (4) of Section 33 of the Ontario Heritage Act, apply to the Council for a hearing before the Review Board; and, THAT applications requesting a hearing before the Conservation Review Board may be filed with the office of the Clerk of the City of Kingston, 216 Ontario Street, Kingston, ON K7L 2Z3 within 30 days of the receipt of this notice.

9. Approval in Principle of an Application for Renovations at 12 Drummond Street

THAT Application P18-456-059-2007 for a property located at 12 Drummond Street requesting approval for renovations to the building, a possible addition to the rear of the building with an increase in roof height of the rear addition and the construction of a two car garage in the rear yard BE APPROVED IN PRINCIPLE.

10. Approval in Principle of an Application for an Addition to the House at 236 James Street

THAT Application P18-448-062-2007 for a property located at 236 James Street requesting approval for renovations to the building BE APPROVED IN PRINCIPLE with the understanding that the possibility of moving the addition further back on the property be investigated, which in so doing may minimize the impact on the second storey window and avoid the construction of a second floor deck.

11. Approval of an Application for the Repair and Restoration of Nine Single Hung Windows 194 King Street East

WHEREAS the owner of 194 King Street East has requested final approval for Heritage Grant Application HG-003-2007; and, WHEREAS as per the requirements as per By-Law No. 2005-258, “A By-Law To Establish A Heritage Grants Program”, a site visit to review the completed works was completed; THEREFORE BE IT RESOLVED THAT Heritage Property Grant HG-09-2007 for 194 King Street East, BE APPROVED for the repair and restoration of nine single hung windows;


12. Approval of an Application for Rebuilding Front Steps and Repointing 112 Montreal Street

WHEREAS the owner of 112 Montreal Street has requested final approval for Heritage Grant Application HG-001-2007; and, WHEREAS as per the requirements as per By-Law No. 2005-258, “A By-Law To Establish A Heritage Grants Program”, a site visit to review the completed works was completed;




THEREFORE BE IT RESOLVED THAT Heritage Property Grant HG-001-2007 for 112 Montreal Street, BE APPROVED for rebuilding front steps and repointing;


13. Approval of an Application for Repairs to Include Straightening East Wall Parapet, and Reflashing to Match West Wall for 178 Ordnance Street WHEREAS the owner of 178 Ordnance Street has requested final approval for Heritage Grant Application HG-006-2006; and, WHEREAS as per the requirements as per By-Law No. 2005-258, “A By-Law To Establish A Heritage Grants Program”, a site visit to review the completed works was completed; THEREFORE BE IT RESOLVED THAT Heritage Property Grant HG-006-2006 for 178 Ordnance Street BE APPROVED for rebuilding front steps, repairs to include straightening east wall parapet, and reflashing to match west wall;


14. Notice of Intention to Designate 87-111 Norman Rogers Drive also known as ‘Rodden Park’, ‘The Upper Farm’

and ‘The New Farm’ WHEREAS 87-111 Norman Rogers Drive also known as ‘Rodden Park’, ‘The Upper Farm’ and ‘The New Farm’ is a property of cultural heritage value; and, WHEREAS Section 29 of the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 authorizes the Council of a Municipality to enact by-laws to designate real property; and, WHEREAS the Kingston Municipal Heritage Committee is in agreement with pursuing the designation of this property; and, WHEREAS the Kingston Municipal Heritage Committee has requested staff prepare a designation by-law for this property and is in agreement with pursuing the designation of this property; THEREFORE BE IT RESOLVED THAT Council serve Notice of Intent to Designate 87-111 Norman Rogers Drive to be of Cultural Heritage Value under Part 4 of the Ontario Heritage Act and authorize City Staff to proceed with fulfilling the requirements of a Notice of Intent to Designate as defined in Section 29 (3) and (4) of the Ontario Heritage Act. WHEREAS 80 Gore Road (914 Highway 15) also Known As ‘Ruttan House’, ‘Maclean Park’, and ‘Hawthorn Cottage’ is a property of cultural heritage value; and,




WHEREAS Section 29 of the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 authorizes the Council of a Municipality to enact by-laws to designate real property; and, WHEREAS the Kingston Municipal Heritage Committee is in agreement with pursuing the designation of this property; and, WHEREAS the Kingston Municipal Heritage Committee has requested staff prepare a designation by-law for this property and is in agreement with pursuing the designation of this property; THEREFORE BE IT RESOLVED THAT Council serve Notice of Intent to Designate 80 Gore Road to be of Cultural Heritage Value under Part 4 of the Ontario Heritage Act and authorize City Staff to proceed with fulfilling the requirements of a Notice of Intent to Designate as defined in Section 29 (3) and (4) of the Ontario Heritage Act. (Note: A copy of the draft by-law is attached as Schedule Pages 86-94) (See By-Law No. (2), 2007-166)

16. Approval of Designation for 40 Sir John A. Macdonald Boulevard WHEREAS Section 29 of the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 authorizes the Council of a Municipality to enact by-laws to designate real property, including all buildings and structures thereon, to be of cultural heritage value or interest; and, WHEREAS Council has consulted with its Municipal Heritage Committee and has approved the NOTICE OF INTENT to designate for a property located PLAN 54 PT B182; RP 13R18756 PARTS 11 to 20 inclusive, as illustrated in Schedule “A” of By-Law No. 2007-167, known as 40 Sir John A. Macdonald Boulevard on August 22 & 23, 2006; and WHEREAS notice of the designating by-law was published in the Kingston Whig Standard, which is a newspaper having general circulation in the municipality, on August 24, 2006; THEREFORE, the Council of The Corporation of the City of Kingston hereby enacts as follows:

1. To designate as being of cultural heritage value and interest the following property in the City of Kingston: (a) 40 Sir John A Macdonald Boulevard

2. The above mentioned property is more particularly described in Schedule “B” of By-Law No. 2007-167 attached” attached hereto.

3. A copy of the designating by-law shall be registered against the property affected in the proper land registry office. The City Clerk is hereby authorized to cause a copy of this by-law to be served on the owner of the land described in Schedule “B” of By-Law No. 2007-167 attached hereto and on The Ontario Heritage Trust and to cause notice of the passing of this by-law to be published in the Kingston Whig Standard.

4. This by-law does not apply to the property affected, or to any adjacent lands, so long as the affected property or adjacent lands are held by Her Majesty the Queen in right of Canada (the "Federal Crown") .This by-law shall apply to any portion of the affected property or adjacent lands which cease to be owned by the Federal Crown , and shall be in full effect in relation to any other purpose including section 2.6.3 of the Provincial Policy Statement (2005), or any superseding policy statement.

5. This By-Law shall come into force and take effect on the date of its passing. (Note: A copy of the draft by-law is attached as Schedule Pages 95-107) (See By-Law No. (3), 2007-167)

- and further - THAT Council approve the disbursement of up to $285,724 from the Best Start Reserve Fund for the development of an estimated 67-77 new childcare spaces as a component of this Childcare Service Plan;

- and further - THAT Council authorizes the Mayor and Clerk to enter into contractual agreements in a form that is satisfactory to the Director of Legal Services, for funding of these childcare expansion projects with: o Frontline Nursery School for an upset amount of $ 28,304 o La Garderie Croque Soleil for an upset amount of $ 319,456 o Pladec Day Care for an upset amount of $ 48,764 and o Rubber Duckie Daycare for an upset amount of $ 49,200;

- and further - NOTWITHSTANDING the statement on page 5 of the Child Care Service Plan noted as Exhibit ‘A’ to Report ARCP-07-024 which reads ‘This policy will be reviewed internally; taking into consideration other socio-economic factors and service date. Staff will consult with the licensed childcare programs in the fall of this year and finalize the policy by the end of the 2007 calendar year’, that staff be directed to bring the Wait List Policy to Council for approval.

2. City Hall Area Integrated Events Strategy - Fanfayr

WHEREAS at the regular meeting of Kingston City Council held on 10th July 2007 a motion from the Arts Recreation & Community Policies Committee which reads in part:

THAT no action be taken on the following motion: 2) THAT Fanfayr be given the option of continuing to operate at the Confederation Basin on Canada Day

weekend as has been the practice for the last 25 years. was considered and LOST, and;

3. Extension of a Lease for the Kingston Artist’s Association Incorporated

WHEREAS a stable arts community is vital to the well being of any city; and, WHEREAS arts organizations require an assurance of stable accommodation; THEREFORE BE IT RESOLVED THAT Kingston City Council allow the City to enter into a Lease Amendment Agreement with the Kingston Artists’ Association Incorporated extending the lease for a period of three (3) years commencing on October 1, 2007 and expiring on September 30, 2010, with the option for the tenant to cancel the lease at any time upon giving to the City thirty (30) days’ prior written notice, and with a further option for the City to cancel the lease at any time, without compensation of any kind to the tenant, upon giving to the tenant nine (9) months’ prior written notice, and provided that the tenant is not in default under the terms of the lease, September 30, 2008 shall be the earliest date on which the City would be entitled to issue such notice of cancellation.

4. Tett Centre Development and Tenant Relocation

THAT staff be directed to develop a plan to address the concerns of the tenants of the J.K. Tett Centre regarding their relocation during the renovation of the J.K. Tett Centre;

- and further - THAT staff work with the various tenant groups of the J.K. Tett Centre in order to develop the plan;

- and further - THAT staff report back to Council with recommendations as soon as possible.

5. YMCA Request for Financial Support

THAT the memo from the CEO of the YMCA regarding ‘City of Kingston Support – 25 metre Aquatics Centre Development’ dated 03rd August 2007 be forwarded to Council for action;

- and further - THAT staff prepare a report to Council for 18th September 2007 to explore what would be the financial implications and infrastructure issues to award a grant of approximately $250,000 to the Kingston YMCA. (Note: A copy of the memo is attached as Schedule Pages 134-147)

THAT City Council endorse the following motion from the City of Greater Sudbury: WHEREAS on October 17, 2006, a private members bill (Bill 150) requesting the Ontario minimum wage be increased to $10.00/hour was tabled in the Ontario Legislature;

AND WHEREAS Ontario has 15% of its population living below the poverty level;

AND WHEREAS Statistics Canada reports that close to 40% of people in Sudbury work in private service jobs, and that at least 25% of all jobs in Sudbury are low-wage;

AND WHEREAS Citizens in the City of Greater Sudbury would be amongst the main beneficiaries if Bill 150 is enacted as the number of people living below the poverty level would be reduced if the minimum wage was increased to $10.00 and more residents could spend more in local businesses boosting the local economy;

AND WHEREAS because small businesses must already competitively pay their employees to retain them, a $10.00/hour minimum wage would not adversely affect the small business sector;

AND WHEREAS many local organizations are supporting Bill 150, including the Sudbury and District Labour Council, The Social Planning Council of Sudbury, and The Sudbury Action Centre for Youth;

THEREFORE BE IT RESOLVED THAT the Council of the City of Greater Sudbury, in the spirit of social justice and in recognition of government’s basic role to protect those citizens in our society who are most vulnerable and in need, hereby endorses provincial Bill 150 and petitions Queen’s Park to enact Bill 150. The Bill would raise the minimum wage to $10/hour immediately and not by 2010 as outlined in the spring 2007 Ontario budget;

- and further - THAT copies of this motion be forwarded to the Premier of Ontario, the Minister of Labour, the Minister of Municipal Affairs & Housing, to Kingston area Members of Provincial Parliament, the City of Greater Sudbury, and to the Association of Municipalities of Ontario (AMO).
