(i) The determination of aeronautical tariff by the Authority in respect of Hyderabad, 3rd Bangalore, Cochin Airports, for the Control Period, and, in respect of

2nd Chandigarh Airport for the Control Period, is already in progress and completion of the process will take time. The Authority, has, therefore, decided that the tariff applicable as on 31.03.2021 may be further extended for a period of 06 (six) months w.e.f. 01.04.2021 to 30.09.2021 or till the determination of tariffs for the relevant Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum.

(i) The tariff determination for 3rd Control Period is due for the above mentioned airports (refer Table-II). Out of these 08 airports, it is ascertained that the commercial operat ions at 03 airports namely Guwahati, Trivandrum, and Jaipur , are due to be handed over by AAI to M/s Adani, shortly , post privatization. It is, therefore, expected that the submission of MYTP/ATP for these airports by the new Operator will take more time.

(ii) In respect of the remaining 05 airports, the Authority is in receipt of MYTP/ATP in respect of few airports, for which tariff determination process is initiated. MYTP/ATP in respect of other airports is expected shortly.

(iii) Keeping in view that the tariff determination process for all the above mentioned 08 AAI managed airports will take more time, the Authority, has, decided that the tariff applicable as on 31.03.2021 may be extended for a further period of six (06) months w.eJ. 01.04.2021 to 30.09.2021, or, till the determination of tariffs for the 3rd Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum .

(i) M/s Adani vide their letter no. ALiALlCO/AERA-IT/2021/1, letter no. AMIALICO/AERA-IT/2021/1 & letter no. AAIALICO/AERA-IT/2021/1 dated 25.01 .2021, has requested the Authority to extend the existing tariff, applicable as on 31 .03.2021, for a further period of 06 (six) months up to 30.09.2021 for Lucknow, Mangaluru, and Ahmedabad Airports. In the aforementioned letters M/s Adani has also stated that they shall be submitting the MYTP/ATP for the three airports (i.e. for Ahmedabad & Lucknow Airports for the 3rd Control Period, and, LLO. Marigaluru for 151 Control Period) by May 2021.

(ii) The Authority, has therefore, decided that the existing tariff, applicable as on 31.03.2021, may be extended for a further period of six (06) months w.eJ. 01.04.2021 to 30.09.2021, or, till the determination of tariffs for the relevant Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum .

ORDER

In view of the above, to avoid any regulatory vacuum in respect of the tariffs being levied by the regulated entities, the Authority, in exercise of powers conferred by Section 13(1) of the Airport Economic Regulatory Authority of India Act, 2008 hereby orders that:­

(i) The Airport Operators (listed at Table I, II, & III) are allowed to continue the levy of existing tariff, applicable as on 31.03.2021 , on interim basis, for a further period of 06 (six) months w.e.f. 01.04.2021 to 30.09.2021 or till the determination of tariffs for the relevant Control Period, whichever is earlier.

(ii) The Airport Operator may ensure compliance of the Order.

In the matter of arrangement to continue to levy the existing tariffs in respect of Chaudhary CharanSingh International (CCSI) Airport, Lucknow, vide Order No •. 37/2018-19 dated 16.02.2018 and Order NO.24/2020-21 dated 02.07.2020 regarding Economic Regulation of Aeronautical Services provided by the Airport Operator with effect from 02.11.2020 to 31.03.2021.

AERA has determined the Aeronautical charges of AAI Chaudhary Charan Singh International (CCSI) Airport, Lucknow, vide Order No. 37/2018-19 dated 16.02.2018 (for aeronautical charges) and Order No.24/2020-21 dated 02.07.2020 (additional landing charges i~liey.. ()fa.boli,~i()118f FIC by GoI w.e.f, 15th January 2020) for the znd Control PeriⅈJ~lratip t'b·~H63.2021.

2. Adani Lucknow International Airport Ltd vide letter No. ALIAL/CO/AERA­IT/2020/1 dated 17.09.2020 has submitted that Airports Authority of India has selected Adani Group for operation, management and development of Chaudhary Charan Singh International (CCSI) Airport, Lucknow for 50 years and as part of the transition process, Adani Group has formed a Special Purpose Vehicle namely, Adani Lucknow Internatio Airport Limited, IAL). 3. ALIAL, vide its letter no. ALIAL/CO/AERA-IT/2020/1 dated 17.09.2020, has further stated that they need some time to submit MYTP for the consideration of the Authority, and, requested the Authority to allow continuation of the existing aeronautical tariff from the date of COD till determination of tariff by AERA based on submission of MYTP by ALIAL as per the provisions of AERA Regulatory Framework. 4. MI also confirmed vide mail dated 20.10.2020 that Adani Lucknow International Airport Limited (ALIAL) will start the Commercial Operations (COD) w.e.f 02.11.2020. The MOD between the GOI and ALIAL was also signed on 21.10.2020.

5. Since ALIAL is likely to assume the role of the Airport Operator for Chaudhary Charan Singh International (CCSI) Airport, Lucknow and shall start commercial operations by 02.11.2020, the Authority decided to allow ALIAL to levy the existing tariff as applicable as on 01.11.2020 from the date of commencement of operations by ALIAL Le.02.11.2020 till 31.03.2():?1 for the remaining period of 2nd Control Period.

ORDER

In view of the above, to avoid anyregulatory vacuum in respect of the tariffs being levied by the regulated entities and considering change in the status of Airport Operator at Chaudhary Charan Singh International (eeS!) Airport, Lucknow, the Authority, in exercise of powers conferred by Section 13(1)of the Airport Economic Regulatory Authority of India Act, 2008herebyorders that:

(iii) The Airport Operator shall ensure compliance of the Order.

AERA has determined the tariff of Cargo Handling Services for AAlCLAS at Chaudhary Charan Singh International (CCSI) Airport, Lucknow, vide Order No. 41/2020-21 dated 01.09.2020 for.theist Control Period valid up to 31.03.2024.

ALIAL, vide its letter no, ALIAL/CO/AERA-IT/2020/2 dated 12.10.2020, has stated that AAI Cargo Logistics ana Alii'ed 'Services Company Limited (AAICLAS) will hand over the existing Dome$tic and International Cargo Handling facilities to ALIAL from the date of COD and ' they would -operate the facility in the same manner, as they were operating duringAAI's period. ALIAL further stated that their Cargo Handling Facility will be operated by ALIAL itself and will not outsource the operation to any other agency. Therefore, ALIAL requested to the Authority to allow continuation of the existing Cargo Handling tariff in line with Order No 41/2020-21 dated 01.09.2020 (issued by AERAfor AAICLAS) from the date of COD.

4. AAICLAS also confirmed vide mail dated 29.10.2020 that Adani Lucknow International Airport Limited (ALIAL) will start the Commercial Operations (COD) w.e.f 02.11.2020. The MOD between the GOI and ALIAL was also signed on 21.10.2020. The Commissioner of Customs, Lucknow vide Notification No. 01/2020

dated 16.10.2020 appointed M/s ALIAL as Custodian of cargo brought for customs examination / clearance at CCSIAirport, Lucknow w.e.f, 01.11.2020.

5. Since ALIAL has taken over the Cargo Handling Services at CCSI Airport, Lucknow from AAICLAS and start the commercial operations from 02.11.2020, the Authority decided to allow ALIAL to levy the existing tariff as appli cable as on 01.11.2020 from the date of commencement of operations by ALIAL up to 31.03·2021.

In view of the above, to avoid any regulatory vacuum in respect of the tariffs being levied by the regulated entities and considering change in the status of Airport Operator at Chaudhary Charan Singh International (CCS!) No parking charges shall be levied for the firs-t two hours. Collection Charge: If the payment is made within 15 days of receipt of invoice then collection charges at� 5 per departing passenger shall be paid by AAI. No collection charges shall be paid in case the airline fails to pay the UDF Invoice to AAI within the credit period of 15 days or in case of any part payment. To be eligible to claim this collection charges, the airlines should have no overdue on any account with AAI. VI) Exemption from levy and collection from UDF and PSF (SC) at the Airports

The Ministry of Civil Aviation, Govt. of India vide order no. AV.16O11/OO2/2OO8-AAI dated 30.11.2011 has directed AAI to exempt the following categories of persons

Children (under age of 2 years}, Holders of Diplomatic Passport, Airlines crew on duty including sky marshals & airline crew on board for the particular flight only (this would not include Dead Head Crew, or ground personnel}, Persons travelling on official duty on aircraft operated by Indian Armed Forces, Persons traveling on official duty for United Nations Peace Keeping Missions. Transit/transfer passengers (this exemption may be granted to all the passengers transiting up to 24 hrs. ''A passenger is treated in transit only if onward travel journey is within 24 hrs. from arrival into airport and is part of the same ticket,· in case 2 separate tickets are issued it '#Ould not be treated as transit passenger").

VII) GENERAL CONDITION:

a) Flight operating under Regfonal Cor'l'r''lectivity Scheme will be completely exemptedfrom charges as per order No. 20J201"6;17 dated 31.03.2017 of the Authority fromthe date the scheme is operationali,ed �y GOI.

b) All the above Ch.arges are e_xcluding of GST. GST at the applicable rates are payable inaddition to above charges.

In exercise of power conferred under tlule BBA ofthe Aircraft Rules, l-937, the Central

Government has accorded approval for levy ofrevised Aviation Security Fee (ASF) rates on

air tickets issued on or after 1't April,2021at 00.01 hours as under:

Aviation Security Fee for the domestic passengers will be levied at the rate of Rs.

200/- per embarking passenger.

Aviation Security Fee for the International passengers will be levied at the rate of

US$12 or equivalent Indian rupees per embarking passenger.
