THIS CAUSE is before the Court sua sponte . On May 26, 2016 the above-named

defendant filed a Motion to Dismiss Indictment (ECF No.174). Based on the Court’s review of

the record, it is hereby,

ORDERED AND ADJUDGED that both parties shall respond, written or orally, to this

question from the Court regarding said motion at the Status Conference hearing that is scheduled

for Tuesday, May 31, 2016 at 2:00 p.m.: What remedies, if any, are available to the court were

the court to find that the described conduct in Defendant Shapiro’s motion is a systemic,

consistent and/or pervasive practice of or on behalf of the United States Attorney’s Office?
