1 requested to be included in this SAD in order to receive this service2 Also the entire Industrial Park has significant drainage issues during3 storm events A survey was sent to all the owners in the park to4 determine the level of interest of including the whole park in the5 SAD for drainage improvements The results of the survey will be6 presented to the Governing Body7 4 Hapsburg Road The landowners of this street in Rio Rancho Estates8 Unit 20 have approached the City with a petition to be included in

9 SAD 9 for the purpose of a drainage improvement The properties10 along this street have a significant natural arroyo running through11 their back yards and would like the city to investigate the feasibility12 and costs of having a storm drain installed and directing the arroyo13 flow into it A petition from these residents is included as

14 Attachment II The owners of 10 out of 14 properties have signed15 the petition16

17 IMPACT18 Approval of this resolution authorizes the next step in providing19 infrastructure improvements that are generally well supported by the

20 residents of this District Rejecting a SAD would prevent these21 improvements from taking place at this time Creating a provisional22 order improvement district directs additional investment to build public23 infrastructure funded by the benefiting property owners The24 infrastructure improvements protect the residents and lessen recurring25 city maintenance

26 ALTERNATIVES27 Adopt or reject this resolution enabling creation of Special Assessment28 District 9 Modifications can be made to the scope of improvements29 but not the process required by state law

I RELATING TO THE PROPOSED RIO RANCHO NEW MEXICO SPECIAL2 ASSESSMENT DISTRICT NO 9 DIRECTING STAFF TO CONTRACT ENGINEER S TO3 PREPARE SUBMIT AND FILE WITH THE CITY CLERK CERTAIN PRELIMINARY4 PLANS ESTIMATES OF COSTS ANDASSESSMENT PLATS WITH ADDENDUM ALL5 IN CONNECTION THEREWITH AND DECLARING THE OFFICIAL INTENT OF THE CITY6 TO REIMBURSE ITSELF WITH THE PROCEEDS OF A FUTURE TAX EXEMPT7 BORROWING FOR CERTAIN CAPITAL EXPENDITURES RELATING TO THE8 DISTRICT

10 WHEREAS the City Council the Council ofthe City of Rio Rancho the City is oftheII opinion that in the general interest ofthe City and specifically property within12 the proposed district it is necessary that certain streets and parts thereof13 which may include but not be limited to storm drainage facilities the14 Drainage Improvements and paving the Street Improvements sanitary15 sewer lines the Sanitary Sewer Improvements waterlines the Water16 Improvements and certain private utilities to include electric power natural17 gas and communications the Private Utility Improvements be constructed18 installed improved and otherwise acquired all within the City collectively the19 Improvements be constructed installed improved and otherwise acquired20 all within the City collectively the Improvements and21

22 WHEREAS for the purpose of designation and identification it is desirable that the23 Improvements be known and identified as Rio Rancho New Mexico Special24 Assessment District No 9 the District and25

26 WHEREAS the Council has determined that it is in the best interest of the City to make27 certain preliminary expenditures related to the Improvements and capital28 expenditures on the Improvements and the Council currently intends and29 reasonably expects to participate in a taxable or tax exempt borrowing to30 finance such expenditures within 18 months of the date of such31 expenditures or the placing in service of the Improvements whichever is later32 but in no event more than 3 years after the date of the original expenditure33 of such moneys and34

35 WHEREAS the Council desires to declare its official intent pursuant to 26 C F R S36 1 150 2 to reimburse the City for such capital expenditures with the37 proceeds of the City s future taxable or tax exempt borrowing Any capital38 expenditures related to the Improvements and preliminary expenditures39 made by the City prior to completion of the taxable or tax exempt borrowing40 may be reimbursed from the proceeds of the borrowing41

42 NOW THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF43 RIO RANCHO

2 Section 1 That the City Engineer is directed to engage a firm the Engineers3 Professional Engineers duly licensed under the laws of the State of New Mexico who are4 hereby directed to prepare submit and file with the City Clerk the following5

6 A Preliminary plans for the contemplated Improvements showing7 1 For each type of street a typical section of the proposed improvements the8 type of material to be used and the approximate thickness and width of the9 material approximate location of type within the project preliminary design

10 grades plotted against existing ground elevation andII 2 For each type of storm sewer drain storm water conveyance or pond12 sanitary sewer water line electric natural gas telephone the type of13 material and the approximate diameter s of all trunk lines stub outs14 collection lines mains approximate location within project preliminary15 design grades plotted against existing ground elevations and16 3 For each other major improvement component a general description17

18 B An estimate of the Improvements total cost by lump sum or unit prices The19 estimate of the cost shall also include without limiting the generality ofthe foregoing20 the advertising appraising tax reimbursement capital improvement expansion21 construction period interest reserve fund financing engineering printing legal and22 such other expenses as in the judgment of the Engineers are necessary to pay the23 complete cost of the Improvements24

25 C An assessment plat showing the area to be included in the District and an

26 addendum thereto showing the amount of maximum benefit estimated to accrue to27 each tract or parcel of land in the District on the front foot zone area or other28 equitable basis and including an Engineer s Report on the method used in29 determining such benefits30

31 Section 2 The Improvements shall be constructed for and the District shall be generally32 comprised of the following streets areas and parts thereof33

Section 3 The contemplated construction of the Improvements shall consist of andinclude the following

A The Storm Drainage Improvements shall include excavation grading trenchingremoval and replacement of any obstacles pipe laying construction of culvertshead walls manholes backfilling rip rap and concrete run downs Acquisition ofeasements or title of properties required for storm water conveyance structures and

ponds All Storm Drainage Improvements shall be located within the street right ofway drainage right of way or appropriate easement

B The Street Improvements shall include excavation embankment and pavingconsisting of compacted subgrade asphaltic concrete surface and drainagestructures including curb gutter paved ditches or equivalent controls33

35 C The Sanitary Sewer Improvements shall include excavation trenching pipe laying36 and backfilling removal and replacement of any paving and other obstacles37 collection lines shall be polyvinyl chloride pipe or where necessary ductile iron38 pipe manholes shall be located in street intersection or as required Main stubs39 shall be provided at locations where future intersections or extensions are

40 anticipated Collection line shall generally be located 10 feet off the centerline ofthe4 rights of way Service stubs shall be provided per City standards for services and42 extend beyond the public right of way43

44 D The Water Improvements shall include excavation trenching pipelaying valves45 pressure reducing valves fire hydrants and backfilling removal and replacement of46 any paving and other obstacles distribution lines shall be polyvinyl chloride pipe or

47 where necessary ductile iron pipe service lines shall be provided per City standards48 for services49

50 E The Private Utilities including electric natural gas cable and telephone shall5 include all excavation trenching placement junctions backfilling and service52 extensions to the public utility easements and beyond as necessary

Section 4 For each of the contemplated Improvements the basis of assessment shall

generally be as follows

A For Drainage Improvements the assessment will be levied against those tracts or

parcels of land situated wholly or partially within the drainage basin in which and

through which the Drainage and Street Improvements are being placedAssessments will be levied against each tract or parcel of land on an area basis in

proportion to the drainage that each tract or parcel of land contributes to the totalbasin flow and or in proportion to the flood protection received by and the eliminationof potential flooding to the access to each tract or parcel of land due to theconstruction of the Drainage Improvements and the diversion of drainage flows bythe platted street system

B For Street Improvements the assessment will be levied on an area unit or front footbasis against those tracts or parcels of land abutting those portions of the streets

being improved and to pay the costs of improving intersections on a unit basis

against those tracts or parcels of land abutting that portion of any street which iswithin one half of the distance to the next intersection from an intersection which isbeing improved and which is formed in part or whole by said street or where the

intersecting street dead ends without intersecting another street after suchintersection against those tracts or parcels abutting that portion of the street

extending from the intersection

C For Sanitary Sewer Improvements the assessment will be levied on a front footbasis against those tracts or parcels ot land abutting the street right ot way in whichand through which the Sanitary Sewer Improvement shall be placed Sanitarysewer service connections will be assessed against those tracts or parcels of land inthe District on a direct cost basis to each such tract or parcel of land specificallybenefited by such service

D For Water Improvements assessments will be levied on a front foot basis againstthose tracts or parcels of land abutting the street right of way in which and throughwhich the Water Improvements shall be placed Water service connections will beassessed against tracts or parcels of land in the District on a direct cost basis toeach such tract or parcel of land specifically benefited by such service

39 E For Private Utilities Improvements electric natural gas cable and telephone the40 assessments will be levied on a front foot basis against those tracts or parcels of41 land abutting the street right of way in which and through which the Private Utilities42 Improvements shall be placed Private Utilities Improvements will be assessed43 against tracts or parcels of land in the District on a direct cost basis to each such44 tract or parcel of land specifically benefited by such service45

46 F The basis of assessment set forth in paragraphs A through E of this Section 4 may47 be modified by the Engineers in preparing the addendum to the assessment plat and48 Engineer s Report if the Engineers find that such modification is necessary or

49 advisable to more equitably distribute the assessment of benefits associated with50 any of the Improvements Any such modifications are subject to Council approval by

subsequent resolution2

3 Section 5 The City presently intends and reasonably expects to participate in a taxable or

4 tax exempt borrowing within 18 months of the date of the preliminary expenditures or

5 expenditure of moneys on the Improvements or the date upon which the Improvements are

6 placed in service or abandoned whichever is later but in no event more than 3 years after7 the date of the original expenditure of such moneys and intends to reimburse the City s

8 funds used to advance the expenditures from the proceeds of the borrowing9
