Sealed / closed Tenders are invited under two bid system for “Transportation of 3- Wheelers

& Spares By Road From SIL - Lucknow to Various Warehouses Located Across the

Country” for the period 2015-17 . The tender document can be obtained from the office of

Sr.Mgr.(Materials) by making a payment of Rs.1000/- (Rupees One Thousand Only) towards

the cost of tender documents by way of Demand Draft favoring “Scooters India Limited”

payable at Lucknow . In case the tender documents are downloaded from the website , than

the cost of tender document i.e. Rs.1000=00 is to be enclosed in the form of DD favoring

“Scooters India Limited” payable at Lucknow along with the filled-in Tender / Bid documents.

1. In case Price bid is found to be different from the un priced price bid in any manner,

the offer will be rejected summarily.

2. The price bid of only those bidders will be opened, whose Technical bids are

qualified in all respects.

3. In case of conflict between General Terms and Conditions (Annexure-II) and any

other special or typed conditions (Annexure- III ), the latter shall prevail to the extent

applicable.

4. The rates shall be quoted both in figures and words also in the Price bid. In case of

Annexure-I

Scope of Work

Providing tucks having fully covered body in single / double decks construction ( suitable for transportation of automobiles like 2 / 3 / 4 wheelers ) for transportation of 3 Wheelers and spares manufactured at SIL , Lucknow by road to various warehouses of the company located across the country . The loading pattern is defined in the special terms and conditions (Clause 6). The present production level is approx.15, 000 nos. vehicles per annum which the company has planned to increase in the next 02 years period . Annexure – „II‟

General Terms and Conditions of Enquiry & Contract for the Services

3 Firm Price

Quoted prices shall remain firm and fixed till complete execution of the order. In case

firm price is not acceptable price variation (increase or decrease) formula, bench

mark prices along with supporting documents only in the case of two bid system

shall be furnished for consideration and approval of SIL, before opening of price bid.

4 Quotation

The quotation and any order resulting from this enquiry shall be governed by these

General Terms and Conditions of enquiry and contract for the supply of Services and

the vendor quoting against this enquiry shall be deemed to have read and agreed to

the same, unless specifically stipulates any different terms or conditions which

subsequently agreed by SIL on specific case to case basis.

Sealed quotations with Bidder‟s distinctive seal, superscribing enquiry number, date

and due date are to be submitted so as to reach on or before due date & time,

addressed to Sr. Manager (Materials)Scooters India Limited, P.O. Sarojini

Nagar, Lucknow 226 008, U.P.(India) In the case of Two-part bid, each inner

cover shall clearly be labelled as a) Technical & Commercial Bid containing

technical data/ drawings/ catalogues/ quality plans as applicable along with

commercial terms and conditions & copy of the price bid with the price columns left

blank (unpriced price bid), b) Price bid containing prices quotes as per scope of

work. Installation and/or commissioning charges shall be spelt out in absolutely lucid

terms, taking into account total charges, rather than quoting vaguely, such as

charges per man-day or charges per engineer per day etc. If the price bid was

found later to be different from the unpriced price bid in any way, the offer

shall be rejected summarily.

5 Tender/Technical bid Opening:

Unless specified otherwise, tenders/ technical bids will be opened on appointed date

and time as mentioned in the enquiry or as communicated changed date/time, if any,

in the presence of such of those Bidders who may be present.

6 Delayed/ Late Tender:

Any tender received after the due date shall be treated as late tenders and will not

be considered.

7 Validity of Quotation:

All quotations shall be kept open for acceptance for a period of ninety days from the

date of opening of Tenders/ Technical bid and this shall be deemed to be an express

condition of all quotations. The rates shall be quoted in both figures and in words.

In the case of Two-part bid, the vendor should furnish technical clarifications, if any,

within stipulated time mentioned, failing which, it will be construed that the vendor is

not interested in the tender and SIL shall not consider the offer for further evaluation.

8 Revision of Price bid:

In case there is any change in scope of work during technical evaluation, bidders

shall be asked only the price implications for the amended portion and not the

revised price for the entire offer. The original/price implications received shall be

opened only on the date to be decided and the price implications are to be opened

after technical evaluation and shall be intimated to the qualified bidder.

9 Price bid Opening:

Unless specified otherwise in the enquiry, the Price bids of technically qualified

vendors shall be opened with prior intimation in the presence of such of those

Bidders who may be present.

2 Conformity to Specifications:

The services should be of the best quality and shall be conforming to SIL

specification/scope given in enquiry. Offers without details of specifications/

applicable catalogues will not be considered and are liable to be rejected. Values

otherwise agreed upon by SIL, no deviation/amendment in services required could

be made. Offers without undertakings which may be required will not be considered

and liable to be rejected.

11 Transportation:

Unless otherwise agreed upon, transportation if involved up to the specified

destination shall be in Vendor‟s scope .

12 Taxes and Duties:

Unless specified otherwise in the enquiry. All Indian suppliers shall clearly mention

Sales Tax/ VAT, Excise Duty, and Service Tax etc, if any, payable in addition to the

quoted price and indicate applicable rates/ percentage, item-wise and will be paid

only if Registration Number under State (TIN)/ Central Sales Tax or Service Tax is

specifically mentioned in the Bill/Invoice. Vendors without a Sales Tax/VAT

registration and Service Tax registration will not be considered.

13 Insurance:

Adequate insurance including accidental insurance of the employees of the vendor

shall be the responsibility of the vendor and SIL in no circumstances shall be liable for

the same.

2 Terms of Payment:

Payment will be made within 45 days after receipt, inspection and acceptance of the

services as per scope of work (and where involved, Erection and commissioning of

services at SIL/Destination) by Crossed Cheque and no Bank commission charges

are admissible unless otherwise specified. The Cheque will be sent by registered

post and SIL is in no way responsible if loss occurs due to delay by postal authorities

and cheques falling into improper hands or through forgery or fraud. For foreign

suppliers, the preferred payment term will be on site Draft basis and bank charges

shall be to the respective accounts. In case supplier desires payment through e-

transfer, the same should be specifically mentioned along with requisite details. If the

vendors quoted terms are different from SIL standard payment terms, interest@

2.5% plus SBI PLR per annum (or as indicated in the enquiry) will be loaded to the

quoted prices for difference of payment period.

15 Bank charges

Unless otherwise specified, in case of payment through bank, respective bank

charges shall be to respective account.

16 Part / Split ordering:

Vendor shall quote competitive price and best services for all the items mentioned in

the enquiry. SIL reserves the right to reject partial quotations. However, SIL reserves

right to Order part of the item/ scope of work of the enquiry and split the order among

qualified vendors.

17 Repeat order

The service contract can be extended for a specified period as mentioned in the

tender with mutual consent and prior approval of SIL at the same rates, terms and

conditions as that in the initial order.

18 Performance :

The services shall be subjected to inspection verification and certification of the

various parameters specified in Scope of work by authorised officer and also tests, if

necessary, and the company decision regarding the acceptability of the services

shall be final and binding on the vendors.

19 Consequences of Failure to Deliver:

For any deficiency / unsatisfactory services provided by contractor which is not in

conformity to the scope of work mentioned in the tender and which may hamper SIL

operations, a deduction of 1.0% of monthly compensation per day shall be made

subject to maximum 2% of monthly compensation from their monthly bill or otherwise

specifically mentioned in the specified terms & condition of the tender which shall

supersede the condition on consequences of failure to deliver in the general

condition.

20 Recovery of Dues:

SIL shall recover any amount due from the vendor or any amount outstanding to the

credit of the vendor with SIL and/or by legal action.

21 Arbitration & Forum for Legal Proceedings:

All disputes arising in connection with indigenous/foreign services shall be settled

through arbitration held at Lucknow, U.P., India and arbitrator shall be appointed by

C&MD, SIL. Any dispute whatsoever in any way arising out of or relating to a

Purchase order shall be referred to Arbitration of the Chief Executive of Scooters

India Limited.

The Courts at Lucknow, U.P., India only shall have jurisdiction in respect of any suit

or other legal proceeding arising from or relating to this contract.

The rights and remedies of SIL stated in these General terms and conditions shall be

in addition and supplemental to its rights and remedies under law and custom or

usage of trade or business and shall in no way be deemed to limit, curtail, supersede

or derogate from its said rights and remedies

22 Conflict among other Terms and Conditions

In case of any conflict between these General Terms and Conditions or any other

special or typed conditions agreed to for a particular Purchase order, the latter shall

prevail to the extent applicable.

23 Non Assignments

The Purchase order shall not be assigned by the vendor to any other party without

prior written permission from SIL that too only in special circumstances.

24 Govt. Policy

The existing policy of the Government of India with regard to Purchase

Preference to Public Sector Enterprises or SMES shall be applicable

25 Control Regulations

Vendor shall arrange for services as per scope of work in strict conformity with the

control regulations applicable and after obtaining permits and registration, if any,

under the regulations in force from time to time.

27 Only those offers will be considered which are in line with Scooters India Ltd. ( (SIL)

requirements and are unconditional.

28 SIL reserves the right to accept or reject any bid without assigning any reasons.

29 SIL reserves the right to call bidders for making technical presentation before

finalizing the bids.

30 The Tender should be deposited in the tender box kept at the Administrative Building Scooters India Limited, Sarojini Nagar, and Lucknow or sent by Registered/ Courier only so as to reach on or before schedule time. The offer so received shall be opened in the office of the SM (Materials) or on any convenient subsequent date in the presence of Bidder / representatives who so ever like to be present.

31 No Email /Telegraphic /Fax quotation shall be accepted. Offers received after due date & time shall not be considered.

32 For all other Terms & conditions, if the offer is not confirming to the same, SIL at its discretion shall load the same and the loading pattern shall be intimated to the bidders before price bid opening. However SIL reserves the right to cancel a bid in case of non-acceptance of any terms and conditions finally arrived before price bid opening.

33 SIL reserves the right to issue addendum to tender documents to clarify, amend, modify, supplement or delete any conditions, clauses or terms stated. The addendum so issued shall form part of the original tender.

34 In case the offer is not accepted the Bidder shall not be entitled to claim any cost, charges, expenses incidental to or incurred by the Bidders in connection with the tender. The Bidders shall have no right to issue addendum to tender document to clarify, amend, supplement or delete any of the conditions or clause or items stated there in

35 Bidders must ensure the following while submitting the tender:

(i) THAT EVERY PAGE OF TENDER DOCUMENT IS DULY SIGNED BY THE BIDDER BEFORE SUBMITTING THE TENDER.

(ii) THAT IN ALL CASES, RATES QUOTED AGAINST INDIVIDUAL ITEM/LOT IS/ ARE INVARIABLY QUOTED IN FIGURES AS WELL AS IN WORDS

(iii) The Quotation should be free from overwriting and erasures. Corrections and additions, if any, must be attested. Supplier should indicate in the quotation dimensions (Size), weight; rate etc., in the metric system unless the enquiry calls for different unit.

36 In case of any clarification regarding tender documents & Technical details, Party may visit SIL on any working day with prior appointment & contact SM (Malts).

37 Services provided shall be as per SIL schedule. Services schedule as decided by SIL shall be applicable

38 Party to quote lead time; preferably lead time of 15 days from award of contract by SIL. Correct date of effecting services in the event of an order should be indicated in the offer.

39 Scope of work and scope of services is also enclosed separately

40 EMD will be as per details indicated separately. Failure of the successful bidders to comply with conditions hereof would render him liable for rejection and in term forfeiture of Earnest Money Deposit (EMD) apart from any other actions the company may take action at its sole discretion.

41 Excise duty, if leviable, service tax etc., documents need to be given. Payment on this account shall be regulated against document only.

42 The party should give a certificate that they agree to the scope of work and services sought.

43 In case, any of the documents/ information furnished is found to be false/ forged, the action by SIL (i.e. inclusion of the firm in holiday list apart from other penal action) shall be binding.

44 Party should give following declarations: a. We, hereby certify that we have not been blacklisted by any Public Sector

Undertaking / Public Department. b. I have gone through the terms and conditions given in your above tender

form, is accepted and agreed by us.

45 Registration, if applicable under The Micro, Small Medium Enterprises Development Act, 2006 may be mentioned giving registration number and date. If not mentioned, it shall be construed that the vendor is not covered by the said Act.

46 Force Majeure: If SIL or the vendor be prevented from discharging its or their obligation under their

Agreement by reason of all acts of God including fire, earthquake, flood etc and other force majeure like war, violence, riots, lockout, strikes etc or on account of any other cause beyond SIL or the vendor‟s control and interfering with the execution of contract for services as scheduled, the time for delivery of services shall be

postponed by the time or times during which delivery of services is prevented by any such causes as hereinabove mentioned.

N Provided that in the event of such delay exceeding 90 days, the party other than the

party which invokes the force majeure may, at their option, cancel this agreement by notice in writing to the other party in respect of the undelivered quantity of services without, however, any right against or being responsible to the other party for such cancellation.

R The party invoking force majeure shall, within 15 days of the occurrence of force

majeure causes, put the other party notice intimating the cessation of such causes. If force majeure condition continues beyond a period of six months, SIL or the vendors may at his option cancel this agreement by notice in writing to the other party in respect of the undelivered quantity of services without, however, any right against or being responsible to the other party for such cancellation.

47 Negotiations:-

Vendor shall quote competitive price and best delivery to avoid negotiations.

Annexure-„III‟

Special Terms And Conditions

1. Earnest Money Deposit

Bidders are required to deposit a sum of Rs.1,00,000/- (Rs.One Lakh Only) alongwith

quotations as EMD in form of FDR / DD / BG valid for 06 months from the date of

opening of tender . SIL will not pay any interest on the amount of earnest money

deposited by the Bidder .The Earnest Money Deposit will be refunded to the

unsuccessful bidders after conclusion of the tender.. Bidder must note that all those

tenders / bids which are not accompanied with the Earnest Money Deposit shall be

summarily rejected .

2. Validity

The Bidder should keep their offer open for acceptance for a period of 120 days from

the date of opening of the tender and cannot amend or withdraw the offer within this

period . Violation of this clause will result in forfeiture of the Earnest Money deposit .

3. Security deposit

Bidders will have to maintain a maintain a security deposit of Rs.1,00,000/- ( Rs.

One Lac only ) in shape of FDR / BG in favor of the company for the entire period of

the validity of the order towards security for the due performance of the job / contract

awarded to him . Upon satisfactory completion of the contract the security deposit

will be refunded without interest . Successful bidders can also get their EMD

converted into Security Deposit . SIL will not provide any interest on the same .

4. Responsibilities of the transporters

The contractor shall not be indirectly or directly concerned or in any deal with

otherwise than in accordance with the terms of the contract or give or promise

to pay directly or indirectly either money or fee under the designation of

customs or otherwise.

Contractor shall be responsible for the acts and accidents committed by the

person employed by him either inside/outside of the factory.

Contractor shall be responsible for compliance with all obligations and

restrictions imposed under Motor Vehicle Act and Rules as applicable on date

and also local laws where as applicable.

In case of breakdown/accident or any other exigencies involving the vehicle

provided for loading, the contractor will be liable to provide replacement of the

same and information in this regards must be submitted to SIL immediately

for necessary direction from SIL authorities.

SIL shall be entitled at all times to carry out any check or inspection of the

contractors trucks / vehicles. Any violation of this will constitute ground for

termination of the contract.

5. Transport through Associates

The transporter / transport agency should have 02 trucks registered in his name /

agency. The subsequent trucks if required by SIL can be provided through

associates .However transporters will be fully responsible for the safe and timely

transportation of goods / vehicles / spares given by company to warehouses .In no

way the transporter / contractor should sublet or transfer the contract or any part

thereof, which tantamount to termination of the contract and there by attracting

penalty of forfeiture of security deposit . No transshipment of the consignment is

allowed except circumstances under permission from SIL . Also the freight charges

will not be paid in case of subletting of the contract .

6. Loading Pattern .

1. The vehicles will be transported by trucks having fully covered body and having

Single / Double Deck (Separate racks ) inside the covered body of truck as

used in transportation of automobiles .. The loading pattern for 01 complete

truck load will be as follows based on single / double deck design of truck :-

2. Bidders who are willing to participate in the tender process are free to visit M/s

SIL Lucknow during working hours to see the vehicles and the system of

loading of 3-Wheelers Chassis in the trucks.

3. SIL reserves the right to utilize optimally the volume / space available in trucks

for transportation of accessories and spare parts and for the same no

additional charges shall be paid by the company .

4. Preference for loading shall be as per the requirement of warehouse and

availability of vehicle load from plant / factory. However SIL shall be at liberty

to maximize loading in the trucks available for loading.

7. Call Letter

(i) The contractor should be ready to arrange the trucks for loading 3-Wheelerss

at the notice by SIL authorize officials. Transporter / transportation agency

shall be communicated for the loads thru phone / SMS / e-mail. The

transporter shall arrange to take delivery of consignment from SIL Lucknow

works within 04 hrs.from the time of advice given to him . In the event of any

dispute, the decision of Scooters India Limited shall be final and binding on

transporters.

(ii) If the contractor fails to provide trucks to SIL for loading against call from SIL.

Officials, a notice of failure will be served to contractor in writing / e-mail . In

event of 3 repeated failures if occurs , the contractor will be black listed.

8. Delivery of Documents

All and every notice requisition or requisitions in person of the contract delivered or

posted to the contractor place of business by registered post acknowledgement due

shall be considered as received by the contractor.

9. Time Schedule

The contractor should ensure that the consignment entrusted to him is transported

and delivered to the destination within the shortest possible time considering average

running of 250 kms in a day .(e.g. If the distance to a warehouse is 600 kms from

Lucknow , than the consignment should be delivered in 03 days time ). If the

consignment reaches the required destination on Sunday or any other national

holidays , the same should be delivered on the next working day and the delay

caused due to holiday / Sunday will not be counted for . In case of traffic

restrictions imposed on account of Security by Govt. agencies like for Elections /

Republic Day / Independence Day measures , the delay shall not be counted for

provided the transporter gives an application in writing with the justification .

10. Quantum OF Business

The company did not guarantee quantum of load to any transporter / transportation

agency. The load will depend on the requirement of the particular warehouse and

the region which is based on market requirement and hence could not be quantified .

SIL will award contract / job for each region to 02 transporters only at the L1

concluded rates only in the tender .

No claim for compensation of the estimated quantity of transport work / load by the

transporters / transport agency shall be entertained .

11. Currency / Validity Of Contract : The contract shall be valid for a period of two years effective from the date of award of contract . However, SIL reserves the right to short close the contract at its discretion. The consignments booked within the contract period shall fall in the scope of contract irrespective of date of deliveries.

12. Extension:

The contract can be extended with mutual agreement between SIL and the approved transporters for a maximum period of 12 months . Such agreements shall be based on acceptance of the lowest rates and terms and conditions of the contract awarded.

13. Termination :

SIL reserves the right to either short close or terminate the contract entered in to with any of or all the transporter operators at its discretion without assigning any reason by giving one month notice by registered post acknowledgement due or in person under recorded delivery.

If the transporter fails or neglects or refuses to observe/perform any of the terms and conditions/obligation under the contract , SIL may without prejudice to any other rights, terminate the contract by giving one month notice in writing and recover from the transporter any damage suffered by it on account of the failure, negligence, refusal, violation or breach of contract or any part thereof including the amount by which the cost of completion of the work done by any other agency shall exceed the amount payable to the transporter under this contract.

The transport contract may be terminated at any time without paying any compensation whatsoever to the transporter in case of misbehavior, disobedience, dishonesty ,clandestine insolvency of company , any court order , non sanction of road permit or any other related activities on their part or their failure to fulfill the terms and conditions of this agreement.

14. Traffic Regulations & Requirements:

1. The transporter will operate their vehicles entirely at their own risk and SIL shall not be held responsible for any damage to the vehicle while on the company„s / customer‟s work or when parked in or around the company„s/ customer‟s or any other premises.

2. The Transporter will make their own arrangement for proper parking of their vehicles at overnight / during detention in company‟s / customer‟s premises.

3. The transporter will ensure that all vehicles used for the transportation of consignments under transportation rate contract are covered by a valid insurance policy . Company shall not be liable to pay any damage whatsoever on account of non insurance of the vehicle .

4. Transporter shall ensure that Motor Vehicle Act 1989 (as amended up to date) is strictly followed as applicable. All Vehicles must have proper fitness, valid permits ,valid insurance and drivers having valid drivers license . All related documents / certificates required as per rules should be available in the trucks provided for loading .

15. Route Permit / National Permit Clearance :

The transporter shall arrange required permits from RTO or other concerned authorities and will ensure compliance of any other legal and statutory formalities connected with the transportation of goods at his cost . SIL will not take any responsibility in this regard .The responsibility of taking the permissions from Govt. of India / State Govt. or from local bodies necessitating such requirement relating to Motor Vehicles Act will entirely be of the transporters . SIL does not take any responsibility in this regard.

16. Indemnity:

The transporter shall have to indemnify SIL against all claims for injury or damage to any person or property caused by his negligence or negligence of his employees whilst in SIL premises / sites or SIL‟s Warehouses.

17. Placement Of Vehicles & Lifting Of Consignments:

The vehicles will be normally required to report to our specified places between 8:30 AM to 1:30PM on working days. The transporter should provide

the vehicles normally within 04 hours after getting intimation . However, wherever possible, sufficient advance intimation in writing/e-mail/SMS shall be given for placement of vehicles for loading of the vehicles . The exit timing shall be generally before 4:30 PM or up to 6:30 PM on working days.

The transporter shall also ensure that Motors Vehicle Act/ Rules stipulations are strictly followed. It will be transporter‟s responsibility to deploy proper vehicles to transport consignments covered under the scope of work of the contract.

18. Vehicle Movement Reporting :

The transporter shall report movement / progress of all outgoing consignments through electronic communication systems such as Fax, Mobile, Telephone, E-Mail or web based monitoring system or any other mode as desired by SIL .

19. Detention, Demurrage, Wharf age & Storage: SIL will not pay any detention , demurrage , wharf age , storage or any such charges to the transporter and no claims in this regard will be entertained .

20. Transit Insurance:

1. Transit Insurance shall be arranged by Scooters India Ltd. . In case the truck met with any accident , the transporter is required to lodge an FIR with the nearest Police Station . The transporter will brought back the accidental truck preferably in sealed condition to SIL Works at Lucknow / nearest warehouse as per company instructions .The damages / losses during transit will be borne by transporter, irrespective of insurance or non insurance of vehicles / chassis are loaded in the truck . However transporter will be entirely responsibilities for any external damages of the trucks as per Sec.8 of Carriers Act.1865.

2. The contract as entered between SIL and the transporter shall in no way nullify, reduce, mitigate or absolve the parties of any responsibility, obligation or liability that may devolve upon them under the Carriers Act, 1865 as amended up to date.

21. Damage / Loss in transportation

The contractor shall be responsible for any loss / damage / shortage / non delivery

while in the course of transportation of consignment . The contractor shall make good

of the loss on actual , after assessment of loss / damages .

22. Route & Distance: The transporter are advised in their own interest to conduct and update / confirm route on their own before carrying the consignment to avoid any delays en route .In specific cases, SIL reserves the right to seek a route survey report from the transporter for which no separate charges shall be payable by SIL,

23. Transit Period :

The timely delivery of consignments is the essence of the contract. Consignment shall have to be transported safely to the destination within the shortest permissible running time considering daily running of 250 kms . for trucks . However the date of dispatch from SIL will not be counted for the transit period .

24. Penalty For Delay In Delivery:

If the consignments are not delivered within the transit schedule [transit time reckoning permissible running plus 02 ( two) days grace period ] , a penalty @ 1% of

the basic freight charges per day of delay or part thereof subject to a maximum of 5% shall be levied and will be deducted from the transporter freight bills .

25. Freight Payment :

The freight bills shall be submitted to SIL , Lucknow immediately after delivery of the consignment duly accompanied by receiving from SIL warehouses / dealers . Payment shall be made within 45 days from the submission of bills by way of Account Payee Cheque . All the freight bills submitted after a delay of 90 days from the date of delivery will be accepted only if transporter explains the delay in writing .

26. Toll Tax:

All Toll Taxes have to be borne and paid by the Transporter / Transport Agency.

26. Octroi / Entry Tax : Transporter shall arrange to pay the Octroi / Entry Tax under conditions warranting and the same will be reimbursed to them along with the freight bill on production of true copy of the original certificate duly authenticated by the concerned product commercial group to whom the original has to be handed over.

27. Distribution of Job:

A. A register will be kept at the security gate which is maintained by SIL -Security Department.. Transporter will enroll their trucks numbers , which are available for loading for the particular region in the register by SIL security personnel. Transporters shall only mention the truck nos. and region only. The names of warehouse in the region are not required to be mentioned. Load shall be given on the basis of seniority of reporting in register for a particular truck .

B. The transporter will have to intimate to SIL for the availability of trucks for particular region on their letter heads on all working days and drop it to box at SIL security gate. Lapse of above system to be followed by the transporter, may loose his truck seniority for allotment of load / work

28. Freight Variation On Account Of Change In Fuel Prices : A. The variation of freight shall only be linked with the revision of Diesel prices .

The Price variation for Diesel shall be reckoned on monthly basis .The increase / decrease in Diesel prices shall be calculated by considering only 25% of the increase / decrease in diesel prices per month considering mileage of 4km / litre . ( e.g. If increase / decrease in rates of diesel comes out to Rs.0.85 per litre in a month , the freight variation allowed shall be Rs.0.22 per km ) . The freight variaion shall be based on the following formula :-

Rx. = Ri - Ro / 4

Rx : Variation in diesel rates for previous month Ri : Rate on the 1st date of Successive Month

Ro : Rate on the 1st date of Previous Month

B. Any increase / decrease so allowed to the transporters will be added to or subtracted from the basic freight rates from the successive months based on the above formula for increase / decrease to be computed on previous month rates of SIL Petrol Pump , which is a HPCL authorized outlet .

C. The increase/decrease on freight rates will be applicable for the successive month .

D. Freight increase on any other account will not the permissible.

29. Rejection of offer

I. SIL reserves the right to reject all tenders fully or party without assigning any

reason and also reserves the right to award the contract fully or party.

II. A tender shall submit the tender which satisfies each and every condition laid

down in this tender document failing which tender will be rejected.

III. SIL does not bind itself to accept the lowest or any tender and reserves the

right of accepting the whole or any part of the tender or portion of it.

IV. Only one tender by one contractor will be allowed . No two or more concerns

in which an individual has a stake as a proprietor or partner shall submit

tender for execution of the same work . It they do so , all such tenders shall

be liable to be rejected .

30. Overwriting and erasing

All entries in the tender document shall either be typed or written legibly. Erasing and

overwriting are not permitted. All deletions and insertions shall be duly signed/

attested by the bidder concerned.

31. Incomplete and defective offer

Conditional tender containing absurd/ unrealistic rates and tender which is

incomplete, not signed and otherwise considered defective and not in accordance

with the tender conditions will be rejected.

32. Letter of Acceptance

The successful bidders will be intimated by letter of acceptance / award of job from

authorized officers of SIL, the issue of which shall form the basis of a legally valid

contract between SIL and the successful bidder.

33. Forfeiture of Security Deposit

Any penalty levied under this contract for non observance of the terms of the contract

specified here under. SIL reserves the right to forfeit the security deposit or recover

the penalty amount from any of the bills due to be paid to the transporters .The

Bidder shall indemnify SIL from any payment of compensation payable to their

employees on account of invocation of workman compensation act, due to

occurrence of such incident while in the course of transportation.

34. Signing Of Tender Documents All the pages of tender documents are required to be signed by authorized signatory The company may ask relevant papers related to authorization of the person signing the tender documents .

35. All updates , amendments , corrigendum etc. will be posted only on SIL website ( if

required ).

MINIMUM TECHNO-COMMERCIAL QUALIFYING CRITERIA

I. Transporter / Transport Agency should have a valid Income Tax Registration (PAN) No. (A copy of PAN Card to be enclosed) .

II. Transporter / Transport agency should have minimum 02 years experience in transportation of automobiles in covered body trucks used for transportation of 2wheelers / 3 wheelers / 4wheelers etc. during the past 05 financial years (Certificate issued by automobile manufacturing company / Job Order / Purchase Order warded to be enclosed ) .

III. Transporter / Transport Agency should have minimum 02 trucks registered in his

name / agency, having valid All India Permit. (Copy of valid registration certificate and permit issued by RTO to be enclosed ) .

IV. Transporter / Transport agency should not be blacklisted by any PSU / Government

department in the past (An affidavit duly notarized to be enclosed ) .

V. Transporter/Transport agency should have achieved a minimum business Turn over

of Rs.40 Lacs per year in the previous 02 financial years 2012-13 and 2013-14 (A

certificate issued by Chartered Accountant / Balance Sheet / Profit & Loss

Account/ITR to be enclosed).

VI. Transporter / Transport agency should furnish tender documents cost ( if tender documents downloaded from website) & EMD by way of Demand Draft in favor of “Scooters India Limited” payable at Lucknow as per the Tender terms .

BID EVALUATION CRITERIA Financial Bids of only those bidders shall be opened who shall fulfill all the Minimum

Techno Commercial Qualifying Conditions as mentioned in Annexure IV which are

Chartered Accountant / Balance Sheet /Profit & Loss Account/ ITR to be enclosed ).

VI. Transporter / Transport agency should furnish tender documents cost ( if tender documents downloaded from website) & EMD by way of Demand Draft in favor of “Scooters India Limited” payable at Lucknow as per the Tender terms

NOTE :

A. The tender shall be evaluated on the basis of lowest financial quote ( rates )

for each region by the bidders and subject to fulfillment of all the minimum

techno commercial qualifying conditions ( Annexure – IV ) as repeated above .

B. The L1 concluded rates for each region will be offered to the L2 for that

region only and only after written acceptance by L2 for accepting L1 rates

for the particular region , they will be considered .

C. In case L2 does not accept L1 rates for the region , L3 will be given an

opportunity for acceptance of L1 rates and only after written acceptance by

L3 for accepting L1 rates for the particular region , they will be

considered .
