Tandag, Surigao del SurRe:Whether or not it is legal to hold cockfight during barangay fiestas and Araw ng Barangay even if there are no licensed cockpits in the barangays concerned.
Dear Atty. Luna:
In reply to your above-captioned query, please be informed that, as a general rule, cockfighting is allowed only in licensed cockpits (Sec. 5 [d], PD 449). However, the only instance where cockfighting can also be validly held in playgrounds or parks is when the same is conducted for the entertainment of foreign dignitaries or for tourists or for returning filipinos, commonly known as balikbayan, or for the support of national fund-raising campaigns for charitable purpose (Sec. 5 [e], PD 449), upon resolution of the sangguniang bayan or panlungsod (Secs. 447, 458 [3] [v], Local Government Code) provided, that this privilege shall be extended for only one time for a period not exceeding three (3) days, within a year.
