I. THE APPLICATION OF CERTIFICATES I.I Aller Approval, Cen,ficate of Design Approval, Cen1ficate of Type Approval or
Cen,ficatc of Works Approval "'II be issued by CCS for the products and manufacturers. Where a product cen,ficatc ,s requ,red by CCS rules , the Approval Certificate cannot replace 1t
I. I.I Design Approval means the cvaluataon process to confinn that the product desagn 1s in comphance with the requarements of CCS Rules and/or other accepted standards through plan approval and prototype, type test
1.1.2 Type Approval means the evaluataon process to confinn the approved manufacturer's capability of continuously producmg products which are m comphance with the requarements of CCS Rules and/or other occepted standards through producl plan approval, type test and on-site audit. Type approval consists of two modes, type approval A and type approval B, which shall be granted to the manufacturer according to manufacturer's ability and level in product quality assurance.
I.I 3 Works Appro,·al means the evaluation process to confinn the manufacturer's capability of continuously producing producls which are in comphance with the rcqu,rements of CCS Rules and/or other accepted standards through product plan approval, type test and on-site audit.
1 2 A umtlbatch inspection of classed or slatulory products is to be documenied as Cen,ficate of Producl or Equivalent document by CCS:
I 2 1 CertiHcate of Product is issued by the Surveyor to show that: i) the product complies with rules; ii) required inspection and test have been carried out; 111) the sample is taken from the product to be inspected; iv) the product has been tested m the presence of the Surveyor or in a specially agreed condition.
1 2 2 Equlvalent Document is issued by the manufacturer and endorsed by the Surveyor to show that: i) the product complies with rules; ii) required inspection and test have been camcd out; iii) the sample is taken from !he product to be inspected, 1v) the product has been tested in the presence of the Surveyor or in a specially agreed condition.
1.3 The classed and statutory products of which the type approval and/or works approval is requJred but the products certificate is not rcquircd1 may be ccrttficd as Manufacturer's document:
1.3.1 The Manufacturer's Document is issued by the manufacturer to show that: i) the product is type approved or works approved by CCS; ii) the product complies with rules: 111) required inspection and test have been carried out; iv) the sample ,s taken from the product 10 be inspected, v) the product has been tested in the presence of the department representat ive authorized by the manufacturer
I .4 A umtlbalch inspection Products other than those specified m rules or statutory requirements is to be documenccd as Inspection Ccrttficat~ or Test Ccrttficate ·
I .4.1 Inspection Certificate is issued by the Surveyor to show that 1) the product standards as dctcnnmcd by the apphcant have been comphcd \\ ith; ii) the mspec11on and test have been witnessed by the Sur\eyor and/or the test repon has been revie\\ed by the Sur\cyor. iii) the sample 1s taken from the product 10 be inspccied
1.4 2 Test Certificate issued by the Surveyor to show that: i) the product has been tested m !he presence of the Sur\·cyor, ii) the sample 1s taken from the product 10 be mspccted
2. INVALIDATION, SUSPENSION AND CANCELLATION OF CERTIFICATE Invaltdat1on 1 suspension and cancellauon of the certificates or equivalent documents issued by CCS by means of approval or ccn,ficatton arc specified m Sec11on I, Chapter 3, Pan I ofCCS Rules forClassificatton ofSea-gomg Steel Ships
3. LIABII.ITY 3 I The service of approval mspection undcnaken by CCS is camed out on the basis that
the designers, manufacturers. owners, sellers. suppliers, repairers, operators and other pan,es fulfill their respecttve respons1b1httes The contents of any rcpons, documents and ccn,ficates issued by CCS cannol d1mm1sh any liability of any pany mentioned above or absolve It therefrom, whatever the module of appro, al mspectton adopted by CCS and its sur\cyors
3.2 Any approvaVmspecuon-rclatcd documents issued by CCS unly reflect the status at the time when the apprO\ al inspection 1s earned ou1 They do not conslttute the description for ownership and mtellectual propeny nghls of the approvcd/mspected factory and product. This Society should nol be affected by any dispute over ownership and intellectual propeny nghts of the approvcd/mspected factory and product
3.3 The approval mspcctton of CCS does not affect and replace any approval and cenification of the manufacturer by any parties that bear no relatton with tlus Society's authorizataon or survey and therefore takes no respons1b1hty for these pan,es CCS does not umJenakc any legal :md economic habihues ansmg from ucccptmg 1h1s Society's certificate without pnor pcm11ss1on from this Society
3.4 CCS will be hable only fur !he loss or damage of contract panics resultmg dareclly from its negligent act . In no e,ent shall CCS be hable for any mdarect or consequenual losses or damage, and any loss of non-contract pan,es
3.5 Notwnhslandmg the previous paragraph, CCS \\Ill be hablc for the loss or damugc due to negligent act Judicially attnbuted cxclusl\ely to CCS and Its employees, agents or other panics actmg on behalf of CCS And m no case shall the amounl of this hab1hty exceed five umcs the fce(s) charged by CCS m respect of the ser\ 1cc(s) m question or 2,000,000 RMB m maximum CCS hab1hly for 1he loss or damage 1s specially c,cluded when such loss or damage anses out of an act ( l) by an employee of CCS uclmg outside the tenns or scope of his/her employment,
or (2) by any agent or other panics acting on behalf of CCS, "hen such act exceeds the
authority granted in writing by CCS to such agent or pan,es 3.6 Any claim for nny loss or damage set fonh nbove 1s to be made m \Hiting within six
monlhs of the date 1he damage first discovered or the loss occurred, failure of doing so will be deemed as an absolute waiver of this right.
4. APPLICABLE LAWS AND ARBITRATION 4.1 The laws of the People's Republic of Chma shall apply to the coming into force,
explanation, implementing, and resolution of dispute of the clause of the cenificatc. 4.2 Unless otherwise agreed with CCS, any dispute of whatsoever nature in respccl to the
service(s) provided shall be referred to Chma Mant1me Arb11rat1on Commission and arbitrated in accordance with its arbitration rules effect!\. c at the time of request for arbitration. The arbitration award shall be final and bmdmg upon both interesled panies.

Upon satisfactory inspection, and the Quality Certificate issued by the ~anufacturcr should be provided to the purchaser together with the copy of the approval certificate issued by the Society. The manufacturer should take responsibility for the product being in compliance with the convention, statutory regulation, the Society rules and the standard accepted by the Society.

After type approval, if there are changes to the design, materials used or manufacturing method of the product and important components and such changes affect major characteristics and properties of the product, or property indexes of the product are changed and exceed the scope of approval, related drawings and documents arc to be examined and approved by the concerned survey office. Where deemed necessary by the survey office, the surveyor to the Society will go to witness relevant tests and conduct inspection and the results should be able to demonstrate compliance with the approval conditions. 2.T,~~••w~~@~M~~~~. *~~~AJ~- B- ~•m~•w•~~~a~. @~~•~u~m~* ~ :Jt-1~*tHtt<lt . The quality management system of the factory shall be ensure effective operation, and shall be the same as the situation of approval. Within the validity of the approval certificate, the surveyor to the Society may pay unannounced audit to the manufacturing procPss of the product in order to confirm whether it is in compliance with the drawings and documents approved by the Society. If belong to the situation of the product has type approval mode B certificate, and marine product certificate/equivalent document is not necessary, those who have obtained the rertificate should be subject to periodical audit every year. The date of periodical audit shall be each anniversary date which corresponds Lo the date of expiry of the relevant certificate and the periodical audit shall be done within a time span of three months before and after the annual surveillance date.
