1. BACKGROUND:

The Himalayan state of Uttarakhand presents a storehouse of bio-diversity, where flora and fauna vary extensively with climate diversity from one region to the other. Between the Himalaya in the north and the hills and the plateau in the south lies a vast Gangetic Plains which is one of the most diverse and largest homogenous alluvial plains in the world.

Ayurveda has prospered in the laps of Himalaya and as such herbs growing here find high place in the Ayurvedic texts. It is an accomplished fact besides medicinal plants, Himalaya are the home of many species of aromatic nature. Thousands of species of medicinal plants and about 320 species have been identified so far in terms of their medicinal value. Therefore, the state of Uttarakhand is declared as an “Herbal State” in 2003. More than 250 species of medicinal and aromatic plants are being commercially extracted and traded. However, the State could not harness the available species of medicinal plants optimally. Subsequently Uttarakhand government has established a Herbal Garden at Muni Ki Reti in 2004 as ‘Dr. Sushila Tiwari Herbal Garden, Muni ki Reti’ for the promotion of medicinal & aromatic plant’s cultivation, development and conservation. However, in the subsequent years due to scarcity of funds these facilities have eroded and lost their original shapes. Therefore, there is a dire need of revival (Restoration and Renovation) of this important Herbal Garden.

Shiwalik formations are one of the most important eco-regions due to their endemicity and past geological history. The era of Shiwalik ecosystem of rocks is called “Age of Mammals”. It is the filtering zone for migration of fauna and flora from highlands to lowlands and vice-versa. It is not only a gateway to the enhanced biodiversity but also to the green and white revolutions, industrialization and creation of livelihood opportunities. This herbal garden including proposed site for biodiversity park situated in foothills of Shiwalik ranges and forms a transition zone (rich in floral diversity), but it has got intense anthropological pressure due to heavy pilgrimage.

Therefore, challenges for endemic biodiversity conservation, ecological restoration, sustainable development, promotion of cultivation & marketing of medicinal plants and enhancement of livelihoods of the communities are huge

and need to be addressed, immediately. Strategic development and involvement of communities in the conservation of natural resources is the key solution for preservation of this fragile Himalayan eco systems and to reduce biotic pressure on the forests, at the same time we can uplift the economic well-being of the local communities.

Recognizing these facts Honorable Chief Minister of Uttarakhand state has announced (174/2017) to establish an Eco/Bio-diversity Park and to develop a theme (Maa Ganga) based park at Muni Ki Reti in 2017. Further, Hon’ble NGT has also emphasized need to develop Bio-diversity parks, Arboretum, Eco-restoration and to undertake landscaping in its original application No. 99/2018 (M.A. No. 257/2018 & M.A. No. 258/2018) and O.A. No. 431/2018 in open government lands along NH-58 & 94.

3. PROBLEMS AND OPPORTUNITIES: -

So, summarized below are the basic problems existent today and within it lie the opportunities –

i. Need to need to create a common platform where, producers (farmers) and buyers (Pharmaceuticals) & technocrats (herbal expo) can meet, exchange technology, share, sale and buy herbal products. Need to fulfill up the gap between herbal producers and manufacturers.

ii. Need for eco-restoration, biodiversity conservation, nature education and livelihood enhancement.

iii. Ensuring regular flow of funds either from government or by creating a mechanism through which generated funds are flowed back – A Society.

iv. Need to promote scientific and efficient cultivation of herbs and medicinal plants in order to meet the increasing market demand and thereby open up a source of livelihood for farmers and to enhance their income.

v. Educating masses, creating awareness, promoting responsible visits to the forests, teaching the importance of both terrestrial (forests) and aquatic (river Ganga) ecosystems for the well-being of human being thus, Creating the ambassadors of Nature shall be the integral part of forest management.

vi. Need of a government body i.e.; Forest Department to proactively take the onus for disseminating knowledge and creating awareness about the enchanting world of medicinal plants. Private players cannot be expected to fill this role, their motive is profit, not education. This presents the opportunity for the department to create a Centre Of Excellence and truly a world class attraction that can fulfill multiple needs of the society and environment.

vii. Untapped potential of the location (Rishikesh - the Yoga capital); every year around 05-06 lakhs of tourists (who stay in night) visit Muni ki reti and Rishikesh area. This apart is the additional benefit of 25-30 lakhs Chaardham pilgrims who cross the project site. Kumbh Mela and Kawad Yatra also provide additional opportunities that need to be tapped.

viii. The fact is that Dr. Sushila Tiwari Herbal Garden exists today as a forgotten initiative. It costs resource, time and money just because it exists and needs to be open. That is an ongoing loss which if left as is, will continue to occupy prime land space and continue to be a drain on the dept’s resources without fulfilling its objective.

Thus, it falls upon us to put in whatever it takes and make it a world-class facility and attraction (a must visit site).

4. AVAILABLE RESOURCES AND UNTAPPED POTENTIAL: –

We clearly understand the problems now so let’s look at what all do we already have in hand. What is our strength and things that we can actually leverage instead of starting from scratch. Listed below are just the most important points summarized.

i. Our biggest opportunity and the starting point of this project genesis itself is the existence of Dr. Sushila Tiwari Herbal Garden. And the strength is not just for it as a property but for the associated 15 years’ worth of priceless expertise and knowledge that is just waiting to be systematized, documented, leveraged and tapped into.

ii. The other resource that we have is the 40 Ha of forest land surrounding the Herbal Garden that we can use effectively.

iii. Muni Ki Reti/Rishikesh is known as Yoga Capital of the World. This herbal garden is very near to River Ganga and surrounded by NH- 58 and 94 from three sides, which is also a main route for Chardham Yatra. Every year lakhs and lakhs pilgrims visit this place.

iv. Therefore, taking into consideration herbal garden’s importance, location, availability of resources and dire need, it is quite necessary to restore this Herbal Garden again in a sustainable manner, so that it can serve its original purposes and simultaneously serve the purpose of “Center of Excellence” for medicinal plants in the state.

v. And finally, Rishikesh is an existing popular tourist hub of international and domestic visitors. We have the opportunity to offer to this existing stream of tourists a ‘must visit’ attraction in Rishikesh and the numbers can only rise from therein.

4.1 Present Infrastructure Available at Herbal Garden: -

i. Agri-accessories – Sanjeevani Nursery, Germ Plasm Area, Mist Chamber, Hardening Chamber, Distillation Plant, Bio-composting Unit, Tube well, a Bamboo Fiber processing unit.

ii. Manpower - Total Staff - 10 a. Regular Staff - 05 (01- Dy. Range Officer, Forester, 2- Forest

Guard); b. Daily Wagers – 05

iii. Experience - Narendranagar Forest Division has 15 years of experience working in medicinal and aromatic plants and has very experienced staff.

o At present two lakh saplings of 65 species are available. o Distillation unit for extraction of oil of lemon grass and Eucalyptus. o Total expenditure is 2.21 crores and total revenue earned is Rs. 32.95

lakhs, since 2002-03 (Annexure-1).

5. Market Trend (Survey): Rishikesh, Muni Ki Reti, Shivpuri and Raja ji NP etc. are the major destinations around project site. People visit these areas especially for pilgrimage, adventure, yoga/meditation/peace and nature tourism. In year 2018, more than 662118 tourists visited this area, according to the data of tourism department, Uttarakhand (Annexure-3). An average days spent in the vicinity is 3-5 days and around 10-15 thousand rupees were spent by each tourist, during his/her stay. Apart this more than 30 lakhs pilgrims (Chardham, Kawad and Hemkund sahib) also pass through this area, every year.

To assess the potential demand for nature based tourism, herbal product or service a combination of both type of market research strategies primary and secondary was used in in Rishikesh, Muni Ki Reti, Haridwar and Dehradun the month of June, 2019 03 (Annexure-2).

For Primary survey; A 20 point questionnaire was prepared; 04 teams were

organized for primary market survey and study. Questions like;- § Who are our potential customers and how many days they spend ? § Awareness of market demand by talking to different traders and healers

about volume and price, what consumers are purchasing etc.; § Exploring different marketing options depending on resource access and

transport, infrastructure, selling unprocessed or processed, directly or indirectly to customers, traders, traditional healers, regional wholesalers, etc.;

§ The reasons consumers will visit herbal garden and biodiversity park ? etc.

Secondary survey was conducted based on online research /publications of various types/interaction with department of tourism officials and their reports. Ministry of tourism, in 2006 GoI hired a firm namely ACNielsen ORG - MARG to carry out research and collection of tourism statistics for the State of Uttaranchal. The main aim of the proposed survey was to collect relevant tourist related statistics for understanding subtle trends related to visitors (both domestic as well as foreign ones) in the State.

§ There is a huge demand for Gardens, Natural areas, Herbal, Natural, Local and Organic products.

§ There is an acute shortage of tourist friendly infrastructure such as online ticketing, online information, maps, wide roads, walking/resting place, transport, government parks and gardens etc. in the area.

6. CONCEPT AND JUSTIFICATION: -

“Nature conservation, the development and wellbeing of people are inseparable goals”. The demand for medicinal plants is rising in the industrialized world, with people increasingly resorting to natural health remedies. According to the WHO, the global market for herbal products is estimated to be around US $ 05 trillion by 2050. As India's share is less than one percent in the $ 62 billion big herbal market, which is growing 7 to 12 % per annum. Hence, there is an urgent need to promote this sector.

Due to increasing population and increased interest in Ayurveda, Homoeopathy and Allopathy, forest resources are not able to meet the requirement of medicinal plants and herbs adequately. 90% of these plant species being used for medicinal purposes are being collected from the forest, with only a few being cultivated commercially. Hence, there is a need for organized cultivation of these herbal plants and In-situ/Ex-situ conservation of RET species.

There are many stakeholders with no linkages amongst them and their

activities of efforts, coordination and, there are serious gaps in balancing external and internal information due to absence of a monitoring system. These need to be addressed on six major variables as under: -

(i) Conservation (ii) Propagation / cultivation / nursery development and

ITKs, formulations, local uses, value addition, techniques etc. should be documented and this knowledge should be imparted to all other stakeholders through frequent trainings, workshops etc. for collection, extraction, processing, value addition and marketing of herbal produces.

Institutions, Market platforms, livelihood parks etc. shall be developed and promoted, so that producers/farmers can directly meet consumers/industries. Forward and Backward linkages shall be created, recognized, promoted and their sustenance should be insured.

Harvesting and post-harvesting practices required to be standardized so that the efficacy of the herbs may be maintained. In this endeavour, women participation in the hilly areas will be useful in view of herbal conservation and economic upliftment of the rural poor.

Inadequate knowledge and incomplete information on products, markets and prices on the part of collectors/producers. The supply chain of medicinal plants is quite large and primary producers are dependent on the middlemen and still they face difficulty in selling the product. There is acute shortage of well-planned marketing infrastructure for medicinal plants.

Difficulties in marketing; Lack of local markets for primary processed products; Lack of access to latest technological & market information and infrastructure. Therefore, Government shall provide a platform in the form of “Nature Haat” or bazaar for local communities, artisans, handicraft, healers, farmers and buyers etc. to come here not only for sell & buy their wares but also for learning skills.

Fostering in-situ conservation of the Himalayan biodiversity is the ultimate goal of the project. Presently, there is a dire need for ex-situ conservation of rare, endangered and threatened species of the Himalayan flora, especially of medicinal value. Involving communities is vital; because local communities are amongst the Earth’s most important stewards of natural resources and are critical to build a future where human needs are met in harmony with nature.

Having understood the need for biodiversity conservation, livelihood enhancement, eco-restoration of degraded forests, nature learning & educating, promoting responsible visits to the Himalayan natural treasures, teaching the importance of both terrestrial (forests) and aquatic (river Ganga) ecosystems for the well-being of human being thus, Creating the “Ambassadors of the Nature” shall be the integral part of forest management.

Analyzing the above facts, the present project proposal comprises following main components: -

A. Revival of existing Herbal Garden into a theme based herbal garden with appropriate Landscaping.

B. Providing a marketing platform for farmers and Pharmaceuticals, in the form of “Nature Herbal Haat”.

C. Development of “Shiwalik Biodiversity Park” with an objective of Promoting Nature Education and Creating “Ambassadors of the Nature”.

D. “Conservation of the Maa Ganga River” – A Theme based Light & Sound show for public awareness.

7. PROJECT OBJECTIVES :–

Following are general objectives of the project:-

(i) Conservation of Ecological and Biological Eco-Systems of the region. (ii) Livelihood support to communities (Expo Mart/Herbal Haat) (iii) Testing, Processing, value addition, marketing and quality control (iv) Nature based eco-tourism as the driving force behind all designs and

The success of any project actually depends on clearly defined objectives. But more so on defining the objectives in a focused manner, bearing in mind strategy and execution. So based on the above opportunities and unique leverage points that we have, we can clearly segregate our strategy into 02

THE B2C SEGMENT or TOURISTS :-

The main objectives of the project for the B2C segment are – i. Establishment of Dr. Sushila Tiwari Herbal Garden as one of the main

attractions and must visit destination for all Rishikesh visitors and passing by tourists.

ii. Redevelop and design an educational theme based Herbal Garden walking tour for visitors based on Permaculture design principles.

iii. Set up a specialized Nature Haat sustainable natural marketing centre showcasing products from Garhwal cottage industries and SHGs promoting use of herbal and aromatic products.

iv. Create a unique world-class sound and light show showcasing the mythology of River Ganga, to promote its conservation.

v. Create an avenue to help visitors appreciate the forest and benefit from its healing powers.

THE B2B SEGMENT:-

It is comprising of farmers, buyers of herbal extractions, manufacturers, agents, processing units and such.

The main objectives of the project for the B2B segment are: –

i. Establishment of gene pool, propagation and Ex-situ conservation of RET species and development of a “Nature Learning Center” (NLC) for creating awareness among the various stakeholders.

ii. Establishment of a “Centre of Excellence” (CoE) of medicinal and aromatic plants of Sub-Tropical and Sub-Himalayan region to serve as a center of education, research, trade and development.

iii. Organising appropriate training programmes for all stakeholders especially farmers. The training would focus on viable farming methodologies and species based on industry demand; and also processing and packaging.

iv. Filling up the gap between producers/collectors and traders/buyers, value addition, package & practice od medicinal plant and marketing of herbal products by organizing an Expos, Marts, fairs/melas etc. at Muni Ki Reti (Rishikesh) for community based organizations CBOs and other stakeholders of Garhwal Himalaya.

v. Development of the large scale planting materials (approximate 05 lakhs seedlings per year) to meet out the growing demand of planting materials by different stakeholders for the purpose of new investigation and cultivation/plantation. This will also serve as the source nursery for the farmers for saplings and seeds.

vi. Transfer of developed information, technology and planting materials (elite one) to farmer for enhancement of their livelihood opportunities.

vii. Documentation, demonstration, research and evaluation of indigenous medicinal plants.

8. PROJECT MANAGEMENT PRINCIPLES : –

The entire project is based on Natural product utilization, Zero carbon footprint, future sustenance and Sustainable utilization of resources. Following are project principles:-

i. Sustainable design and build of infrastructure i.e. use of natural materials only primarily.

ii. Less use of Cement and RCC. iii. Carbon Neutral Activities: To achieve a zero carbon footprint, we

would generate and use renewable energy- solar and biogas (off grid energy systems).

iv. Water management – harvesting, treatment, segregation, usage as much as possible.

v. Assuring ongoing financial sustainability of project vi. Automate systems and digitalise for consistency, efficiency, quality

control and audit vii. Leverage expertise of existing team and networks internally – no

compromise with quality. (for this we need to hire experts and professionals– overall project consultant, permaculture designer, medicinal plant expert, natural building expert, audio-visual set up firm, marketing agency etc.)

b. Introduction and Justification: In our state migration of village population is the biggest problem. In hills where employment, human-wildlife conflict, less market knowledge and availability, unirrigated land, difficult terrain and lack of market facilities are the major problems but these hills are rich in medicinal plant resources. Therefore, change in land use pattern beyond agriculture, development of agro-technology, development of market facilities and cultivation of medicinal & aromatic plants can form one of the important components for the socio-economic development of native communities as an income generating resource.

Taking into consideration herbal garden’s importance, location, availability of resources, tourists influx and dire need, it is quite necessary to restore this existing Herbal Garden again in a thematic manner with proper landscaping, herbal trails, herbal kiosk and nature herbal haat etc. so that it can serve its original purpose. Therefore, it is imperative to upgrade existing herbal garden into a “Center of Excellence” for medicinal plants and also we need to promote herbal eco-tourism for the sustenance of garden.

h. Strategy –

Professional experts would be hired for planning and documentation. Project field works would be performed by forest staff. The germ plasm area of herbal garden will be used for production of seedlings of different medicinal & aromatic plants as well as in vegetative propagation of various species. The herbal garden will provide seeds and saplings of medicinal & aromatic plants to the farmers as per their demands. Technical information about cultivation of medicinal & aromatic plants will also be provided to the farmers.

The herbal garden will be open every day for public; demonstrations will be given about the plants and their medicinal benefits. For the people/cultivars interested in cultivating and selling the plants there will be detailed workshops organized. The people can attend these workshops to understand the cultivating, harvesting and processing techniques required for each plant, value addition and packaging etc. post the workshops, people can register to become suppliers of these herbs.

i. Scope – i. For establishing a herbal nature bazaar for sell and promotion of herbal

plant & products. ii. herbal based eco-tourism several programmes like – herbal walk,

aroma therapy, training course on medicinal plant etc. can be taken up in future.

iii. To promote research various universities can be invited. iv. There is always scope for Herbal products certification, packaging and

promotion. v. To have collaborations with SMPB, HDRI for medicinal plant

cultivation and for raw material, Bamboo board for bamboo artefacts and others.

9.1.2 NATURE HERBAL HAAT: -

As India's share is less than one percent in the $ 62 billion big herbal market, which is growing 7 to 12 % per annum. Hence, there is an urgent need to promote this sector.

Current Issues with medicinal plant sector: i. Inadequate knowledge and incomplete information on herbal products,

markets and unregulated prices on the part of collectors/producers. ii. Difficulties in marketing; Lack of local markets for primary processed

products; Lack of access to latest technological & market information and No market infrastructure is available.

iii. Inefficient processing techniques leading to low yields and poor quality products; Poor quality control procedures;

iv. Producers (farmers) operate in isolation and have little bargaining power for sales and prices

Present Need: i. The gaps between the producers/collectors and traders or buyers need to

be minimized as these are at present very wide and often inequitable. ii. Linkages should be developed in order to have better understanding about

the medicinal plants and other NTFPs business & between the businesses and the producers/collectors.

iii. Government shall provide a platform in the form of “Nature Haat” or bazaar for local communities, artisans, handicraft, healers, farmers and buyers etc. to come here and sell & buy their wares. It gives the feel of a traditional weekly village market (called a haat) and offers cultural

performances and Indian cuisine as well. iv. Thus, all-our efforts should be made to adopt a package of best practices

encompassing conservation, restoration, cultivation, quality control & standardization and research for improving its marketing performance efficiently.

Benefits of establishing a Nature Haat:

i. Improving product quality and making supply consistent, and being able to diversify through different processing methods;

ii. Overcoming large distances to the point of sell and achieving more cost-effective means of transport and marketing;

iii. Being able to access and acting upon market information and in doing so increase the ability of farmers to negotiate with other ‘actors’ in the supply chain;

iv. Improving levels of transparency between collectors, processors and traders to avoid the concentration of market power in a few hands.

v. This platform would provide an opportunity to collaborate with producers (farmers), collectors, processors, traders, etc., and pooling stocks to attract companies, firms and traders who prefer to buy bulk quantities; Sharing knowledge and experiences with other collectors or traders and, where necessary. Thus, helping in development of social assets and contacts with a variety of traders and healers, and help access more market opportunities.

Therefore, we are proposing a platform in the form Nature Haat, where buyers and sellers can meet and do trading. To promote this activity we would organize fairs, melas, haats, expos and marts.

a. Goal of Nature Haat: (i) To fill up the gaps between the producers/collectors and traders or

buyers. (ii) To provide an arena in people including sellers and buyers can meet,

perform trade, enjoy, collaborate, share, relax and promote best practices.

Organizing training, workshops, live shows, Ayurveda consultancies, fairs, expos, marts and hands on hobby activities like yoga, meditation, pottery, Puppetry, Juggling, gymming, Carpentry, drawing, painting, Jewellery-making, reading, hiking etc. Expo Mart will act as a channelizing force for the farmers and provide a reasonable platform for product diversification, marketing of produce, branding for local produces etc.

Marketing and promotion done by Marketing agency under Project Consultant. In order to insure backward linkages and regular supply of herbal raw material several stakeholder such as – Uttarakhand Bamboo board, SMPB, Herbal research and development institute, SHGs/Federations of Uttarakhand forest resources management project (UFRMP), Van Panchayats and other local communities etc. have already been involved and preliminary planning is in progress.

9.1.3 SHIWALIK BIODIVERSITY PARK (SBP):-

Muni Ki Reti (Rishikesh) is strategically located in the foothills of Shiwalik hills and specifically in the transition zone known as “Ecotone Belt”. More than three ecosystems (Shiwalik hills, Bhabhar Forests and Gangetic aquatic ecosystem) merge into each other resulting into fertile soil, optimum rainfall, favourable climate for floral growth and rich biodiversity.

Biologically rich and unique habitats are being destroyed, fragmented, and degraded due to increasing human population, resource exploitation and environmental pollution. Conservation of forest biodiversity is fundamental for sustaining forests, and supporting the livelihoods of people and their economic well-being. The ecosystem services that benefit the society are improving air quality, climate regulation, carbon sequestration, water purification, pollination, and prevention of erosion, besides provision for useful biomass. Innovative and effective responses are necessary to meet the challenges of forest biodiversity conservation for the well-being of the people.

“Biodiversity Park” is a nature reserve that harbours natural heritage of the area and have conservational, ecological, educational, recreational, cultural and aesthetic values, and enhance the quality of environment in urban centres. The underlying principle of Biodiversity Park is to recreate self-sustaining ecosystems with native flora and fauna characteristics of the area for enhancing the quality of urban environment.

Biodiversity Park – especially as it will be beneficial for the development of education, responsible tourism, ecology etc. and will bring visible benefits to the State – especially students, youth and amongst citizens to promote the cultural, ecological and educational aspects.

Major Functions of the Biodiversity Park: (i) To Serve as nature reserve for the conservation of threatened biodiversity. (ii) Serve as hub for education, cultural and conservation activities. (iii) Connect biodiversity to the city and people, thus promoting eco-tourism. (iv) Create livelihoods for local communities. (v) Serve as living lab for understanding the ecosystem processes and

functions. (vi) Buffer local weather and serve as sink for CO2 and urban pollutants. (vii) Serve as adaptation to climate change and Enhances the quality of

environment. (viii) Preserve the rare, endemic threatened plant and animal species of the area

and even ecosystem due to developmental activities. (ix) Serve as habitat for gene pools of RET species.

Rishikesh is well known for a sacred river, the Ganga. This is the place where Ganga meets plains. Ganga Basin is home to a wide variety of relic, rare and threatened species. The aquatic wildlife of the Ganga basin, is in peril due to reduction in water level, pollution and over exploitation of riverine resources, leading to habitat degradation. To address this issue a thematic Ganga awareness show facility will be developed.

9.1.5 Promoting Nature Education and Creating Ambassadors of the Nature:-

Our planet, Earth, is our most precious resource. It gives us everything we need to survive – and it’s an amazing place. It’s important that we do all we can to protect it so people and nature can thrive. The main objective of this initiative is to promote volunteerism for Nature conservation and to promote stewardship. Helping children develop a sense of pride and connectedness to their natural heritage by exposing them to the forests and wildlife areas. Students and people of all ages will participate in gardening and greening projects, revitalization of habitats and ecological restoration projects, composting, recycling and reduction of waste. Designed to connect participants of all ages with nature and inspire them to protect it, the program empowers each of its participants to take action to promote sustainable living in their communities at home, thus becoming Ambassadors of the Environment.

a. Goal:- Connecting people with nature and Promotion of Nature Conservation through awareness and education and Zero Carbon Footprint.

b. Activities:- Various activities like Shramdan for Cleaning, Weeding, Planting, Waste disposal, Bird watching, Helping in man-animal conflict and forest fire fighting, conservation awareness etc.

c. Strategy: Biodiversity park would be utilize as an open laboratory and a learning center. Green Clubs would be created in schools and colleges.

General Points for the Action Plan: -

Ø A mosaic of water bodies and various types of gardens will be made. A Herbal Garden, Butterfly Park, Nature Interpretation Centre, Wild Flower Garden, a Nature Haat and an Orchidarium will be developed on the land available.

Ø The landscape should be made as undulating terrain with the ridges, having a difference of 1 to 3 metres between high point and low point. The landscape should be done in such a way that existing native trees should be preserved.

Ø A peripheral 5 to 8 m wide bamboo green shelter belt will be developed all along the boundary of the area.

Ø The embankment and roads on the east and west will be made greenways with walkways.

Ø A scented garden will also be a part the recreational garden. There are also greenways with walking paths.

10. IMPLEMENTATION OF THE ACTION PLAN: -

Narendranagar Forest Division, Forest Department, Uttarakhand will be the nodal agency to set up the Biodiversity park, Nature haat and upgradation of existing herbal garden. It has already been decided in a meeting chaired by Principal Secretary, Forest & Environment on 26th June, 2019, that in order to ensure sustenance of the project and the entities created therein, a society by the name “The Himalayan Eco-Restoration, Biodiversity Augmentation and Livelihood Enhancement Society (HERBALES)” will be formed. This society would have a General body, headed by Principal Secretary Forest and an Executive or a Management Committee in the Chairpersonship of PCCF/HoFF, Uttarakhand.

Divisional Forest Officer or ex-officio Director of the Park is designated for the implementation of the project as per the Action Plan proposed and with financial and administrative powers. The outsourced staff consisting of a project coordinator, a medicinal plant expert, 02-Field Biologist cum Technical Assistant and about 10 daily wage workers will be needed and will work at the site under administrative control of DFO/Director. The staff will be outsourced as the per norms. Sub-divisional Forest Officer (SDO), Narendranagar and incharge of herbal garden (Dy. Range Forest Officer) to monitor the progress and supervise the project, respectively. The existing infrastructure including germ plasm nursery will be utilized for multiplication and maintenance of saplings of medicinal plant, RET species, native trees and herbs.

12. BUSINESS MODEL:-

There are two models of revenue generation, which can be looked at to sustain the recurring costs of the Herbal Garden. The first will be to directly sell certain products like plant seedlings, seeds, NTFPs, Herbal products, distillation products, etc. to the visitors, pilgrims, cultivars, students visiting from colleges and schools, and the tourists/who come to visit Herbal Garden. In addition, we will also employ a certain part of the land for Herbal tourism, wherein various units described in strategy table above such as – Herbal Garden, Ganga Sound & Light Show, Walking Tours and Cycling Trails would be developed. From this we aim to generate some revenue, which will help us to recover (40-50%) the recurring costs. Eventually the goal is to recover 100% of the recurring operating costs by building on our successes further.

§ In order to attract a large number of visitors to the herbal garden, marketing needs to be done through a dedicated website of herbal garden, putting billboards outside the garden, pamphlets and advertising through social media like Facebook/Instagram etc. In the future we can also look to open a small café outside the garden, offering various Herbal Teas from the garden itself. This will attract a larger footfall of visitors, becoming a must visit spot for the travellers along the Chardham highways and can also generate a secondary source of income to help cover recurring costs.

§ In order to promote AYUSH services, tie-ups will be done with established centres of Yoga, Panchakarma, Naturopathy, Aromatherapy and Acupressure therapy. Referrals will be generated and be charged for through consultations and events organized at the Herbal Garden.

§ A Society will be established for the management of the herbal garden and all the income generated will be kept in the account of this society that will be ploughed back to meet the expenses of the herbal garden and its growth.

§ Herbal Garden Society ex-officio headed by Director or Divisional Forest Officer, Narendranagar would manage all the affairs of the park.

§ Sustenance of the herbal park will be insured though ploughing back all the revenue generated in that particular year.

§ All imported herbal medicinal products need to meet the requirements for safety, efficacy and quality control regulations. Quality Control of the herbal products will be insured, for this purpose support (technical know-how) from various NGOs would be taken.

§ Code of Conduct: To insure smooth implementation of the proposed project, some code of conducts for the stakeholders and sharing of responsibilities among members, will help to run this centre smoothly and avoiding mis-management.

§ Quality & Service assurance: We will try to ensure quality with our products. Quality maintenance and good services will definitely ensure our retention of customers and creating a brand. Apart from this we will

facilitate our customer with good quality of health and other services. § Let’s look at some of the key elements of our business model based on the

two categorisations we have done for our target audience who is going to benefit from this. Everything planned and proposed will be executed with a lot of detailing for a unique experience while being superior aesthetically and incorporating sustainability, be it natural constructions, water conservation and harvesting, waste management, solar systems and so on.

5. Water vending machines

Self-explanatory in terms of its need.

landscaped gardens and parks but they don’t have access to pristine forests and that has become a rare privilege inaccessible to most. --trails as described here would be a huge USP and most suitable for forest dept. because: - we conserve the forest area instead of cutting it down to build too much infrastructure - we give people an opportunity to get educated about forests, fall in love with it and hence work towards its conservation. --a cobbled/brick pathway of 4ft will run across the forest through its contours adding up to 3kms approx. and lined with aromatic herbs. --There will be inspiring quotes about nature throughout the path. The tree and bush species along the path will also be marked along with its benefits. --we will have a tree top machaan along the path, a pergola atop a small rise to sit and view the Ganga river, sitting points, a lotus pond (at the current dried animal water drinking zone), a hand drawn ropeway to cross a marsh. --visitors only allowed to follow the path and not to step beyond it. --this path will also work for educational guided tours conducted time to time by the dept. --two cycling tracks will also criss-cross through the peaks and contours and marshes of the delineated jungle. These will be unlined/unpaved dirt tracks with clear signages marking the turns. --level 1 cycling track will be for families/adults etc. and mostly on level ground. --Rishikesh sees a lot of tourists, especially international travellers, seeking out adventure cycling. Level 2 cycling track will be for the experienced cyclists and will leverage the natural contours of the land along with stretches of specially built ramps and obstructions. --few cycles will be available for rent on chargeable basis while visitors will also be allowed to bring their own cycles. --2 eco-friendly bio digester toilets along the trail/path, that do not create any sewage and the entire water is automatically treated by anaerobic bacteria

Narendranagar Forest Division has 15 years of experience on medicinal & aromatic plants conservation and management. After the establishment of Herbal Garden in 2003-04 around 210 medicinal species have been developed and conserved, at present we have around two lakhs saplings of 65 medicinal plant species.

15. MAJOR ACTIVITIES TO BE UNDER TAKEN: -

A. For Conservation of Ecological & Biological Diversity of the region – Restoration and Strengthening of existing herbal garden:-

(i) Survey of Muni Ki Reti and Rishikesh area; to find out the demand and needs.

(ii) Survey of existing forest medicinal plant resources and identifying medicinal plants to be grown with their appropriate periods of harvesting, with the help of a professional

(iii) Land preparation – including leveling, weed eradication, shrub cutting, fencing, creating footpaths, walkways and sourcing irrigation facilities

(iv) Procurement of basic planting material of high quality (v) Establishment of germ plasm area and high tech nurseries for

production of large scale planting stock –Poly houses, net houses, beds, nutrient supplies etc.

having one SHG/collector per selected Van Panchyat (iv) Preserving and packaging of the plants and their products as required (v) Establishing HERBAL/Nature Haat and Expo Mart – Herbal

Store/Kiosk/Stall, Identifying markets and networking for selling of the products – Firms, Aashrams, Ayurvedic doctors, tourists and individuals etc.

organic farming techniques, their processing and preservation, quality control, testing, packaging and marketing.

(x) Pricing the products after analysis of the competitor’s pricing. (xi) Identification of how to provide remuneration / profit sharing for the

collector and people cultivating the plants.

C. For Generating Awareness, Education and Documentation:-

(i) Promotion through Website. (ii) Establishment of a Nature Learning Center - Interpretation center,

Nature trails, educational paths (iii) Conducting Herbal Fairs, participating in various melas etc. (iv) Establishing a Herbarium of medicinal plants of this region. (v) Publishing booklets, leaflets, billboards, pamphlets, signage boards

etc. (vi) Spreading awareness in schools through pamphlets and organizing

school visits to ensure greater awareness and footfall.

D. For Generating Revenue, which will help, cover certain percentage of Recurring Costs –

(i) Generating Secondary Source of Income through Herbal-tourism wherein various units described in strategy table above such as – Herbal Garden ticketing, Ganga Sound & Light Show, Walking Tours and Cycling Trails would be developed. From this we aim to generate some revenue, which will help us to recover (40-50%) the recurring costs. Eventually the goal is to recover 100% of the recurring operating costs by building on our successes further.

(ii) Production of sapling, products like Aloe vera powder, jelly, lemon grass oil, herbal tea, herbal juice, raw material of various medicinal plants etc. to be sold.

(iii) Packaging and pricing of these products (iv) Advertising and publicity of the herbal garden through online and

digital marketing, pamphlets/ announcements to ensure larger population of visitors to the garden who will eventually buy the products.

(v) Creating of billboards and pamphlets to be distributed to increase awareness.

(vi) Selling of the sapling, products etc. to the visitors and pilgrims, surrounding Aashrams and industries.

(vii) Identifying markets to sell bulk orders to, identifying marketing and distribution techniques to sell the products

(viii) Hiring expert agency for making the website, managing social media and developing strategy and creatives constantly including videos.

16. OUTCOME/ BENEFITS FROM THE PROJECT :- (both tangible and intangible)

At the start of this project report we detailed the objectives and also classified it according to our beneficiaries/target groups. Then we went on detail out the strategy and all associated activities to achieve the objectives along with its USPs. And so now let’s summarise the overall outcomes that would emerge through a thorough implementation of this plan. We will also look at how to measure our own efficacy over these outcomes.

PHASES OF THE PROJECT:- A decision was taken during the meeting held at Secretariat on 15th October, 2019 in the chairpersonship of Chief Secretary, Uttarakhand that entire project would be executed in two phases namely; - Ist PHASE: - In first phase Development of “Shiwalik Biodiversity Park” will be executed in Muni Ki Reti. This project phase would consist of five major components (A) Herbal Garden for Conservation & Education, (B) A Thematic Herbal Garden for Herbal Tourism & Awareness, (C) Development of a Nature Herbal Haat, (D) Development of a Shiwalik Biodiversity Park, and (E) Establishment of a Sound and Light Show for Conservation of Maa Ganga. First phase works would be executed on 40 ha. of land and the overall objective is the Conservation, Development and Well being of People. This phase has to be completed with in two years of commencement.

IInd PHASE: - In Second phase “Wildlife & Jungle Safari” facilities would be developed on the land behind the Dalwala area. For this work separate permissions from the appropriate authorities such as CZA, MoEF, FCA, EC etc. will be taken before the commencement of the work. For this phase DPR will be made separately and this phase can only be taken up after the completion of first phase work.

INVITING EXPRESSION OF INTEREST (EOI) FOR CONSULTANCY SERVICES FOR THE PREPARATION OF COMPREHENSIVE DETAILED PROJECT REPORT (DPR) FOR THE ESTABLISHMENT OF A WORLD CLASS “SHIWALIK BIODIVERSITY PARK” AT MUNI KI RETI (NEAR RISHIKESH), TEHRI GARHWAL, UTTARAKHAND. Forest Department, Govt. of Uttarakhand hereby invites ‘Expression of Interest’ from eligible professional individual/firms/institutions/organizations/consortium for appointment of Consultant(s) preferably with global area of operations (Indian or foreign origin‐in India or abroad) and having extensive experience and expertise in the fields of Bio-Diversity Conservation and Eco-restoration, Eco-park & landscape development and large scale institutional/ public building for the preparation of a Detailed Project Report (DPR) that will include concept plans, layout plans, detailed designs (2D,3D) and detailed estimates of the Shivalik Biodiversity Park (includes thematic herbal garden, livelihood park, Ganga light & sound show, adventure, conservation, eco trails, eco trails and other related works) and providing assistance in subsequent stages of preparation and evaluation of tender documents for execution of approved works and in supervising their implementation at Muni Ki Reti (Rishikesh) and develop them as a State of the art facility for Biodiversity Conservation, Knowledge dissemination, Nature education, promotion of herbal products and eco-restoration.

The EOI/RFP document is available on the website of Forest Department, Uttarakhand and can be downloaded from the site www.forest.uk.gov.in or can be purchased of Rs. 2000/- + GST from the DFO, Narendranagar office. Details for technical qualification and TOR are elaborated in the EOI document. The Consultant will be selected in accordance with the procedures of Uttarakhand Procurement Rules, 2017. They should submit relevant documents to demonstrate/evidence that they are eligible and have the necessary capability to execute the contract, if awarded.

fees, TA,DA, expenses associated with any demonstrations or presentations which may be required by the UKFD or any other costs incurred in connection with or relating to its Proposal. 1. Introduction to the Project 1.1 Background

1.1.1 The Himalayan state of Uttarakhand presents a storehouse of bio-diversity, where flora and fauna vary extensively with climate diversity from one region to the other. Between the Himalaya in the north and the hills and the plateau in the south lies a vast Gangetic Plains which is one of the most diverse and largest homogenous alluvial plains in the world.

1.1.2 Ayurveda has prospered in the laps of Himalaya and as such herbs growing here find high place in the Ayurvedic texts. It is an accomplished fact besides medicinal plants, Himalaya are the home of many species of aromatic nature. Thousands of species of medicinal plants and about 320 species have been identified so far in terms of their medicinal value. Therefore, the state of Uttarakhand has been declared as an “Herbal State” in 2003.

1.1.3 Shiwalik formations are one of the most important eco-regions due to their endemicity and past geological history. The challenges for endemic biodiversity conservation, ecological restoration, sustainable development, promotion of cultivation & marketing of medicinal plants and enhancement of livelihoods of the communities are huge and need to be addressed, immediately.

1.1.4 Untapped potential of the location (Muni Ki Reti/Rishikesh - the Yoga capital of World); every year around 05-06 lakhs of tourists (who stay in night) visit Muni ki reti and Rishikesh area. This apart is the additional benefit of 25-30 lakhs Chaardham pilgrims who cross the project site. Kumbh Mela and Kawad Yatra also provide additional opportunities that need to be tapped.

1.1.5 Recognizing these facts Honorable Chief Minister of Uttarakhand state has announced (174/2017) to establish an Eco/Bio-diversity Park at Muni Ki Reti in 2017, a detailed concept plan for the same has been approved by the Chief Secretary vide letter no. 2030/X-2-2019-01(05)2017, dated 21st October, 2019. Further, Hon’ble NGT has also emphasized need to develop Bio-diversity parks, Arboretum, Eco-restoration and to undertake landscaping in its original application No. 99/2018 (M.A. No. 257/2018 & M.A. No. 258/2018) and O.A. No. 431/2018 in open government lands along NH-58 & 94.

1.1.6 In line with the aforementioned objective, DFO Narendranagar Forest Division, Forest Department, Government of Uttarakhand (hereinafter referred to as ‘UKFD’) invites Proposals from eligible professional consulting agencies (hereinafter referred to as ‘Applicants’) to provide Consultancy Services for preparation of a Comprehensive Detailed Project Report (DPR) that will include concept and layout plans, detailed designs (2D,3D) and detailed estimates/BoQ of the Shivalik Biodiversity Park (including thematic herbal garden, Nature herbal haat or livelihood park, Ganga light & sound show, biodiversity park, adventure & eco trails) and providing assistance in subsequent stages of preparation and evaluation of tender documents for execution of approved works and in supervising their implementation at Muni Ki Reti (Rishikesh) and develop them as a World class State of the art facility for Biodiversity Conservation, Knowledge dissemination, Nature education, promotion of herbal products and eco-restoration.

1.1.7 The applicants will provide the services in accordance with the Terms of Reference of

this EOI or Request for Proposal. The scope of work can be expanded/reduced as required with consequent increase or decrease in number of resources as per the rates discovered through this EOI.

1.2 Request for Proposal

The UKFD invites Proposals for engaging professional consulting agency for providing Consultancy Services for preparation of a Comprehensive Detailed Project Report (DPR)” for development of ‘Shiwalik Biodiversity Park’ in accordance with the procedure set out herein. The details on the scope of services are provided in the Terms of Reference (TOR) of this EOI/RFP.

1.3 Due diligence by Applicants

Applicants are encouraged to inform themselves fully about the assignment and the local conditions before submitting the Proposals. Written queries through email ([email protected]) can be sent to the DFO Narendranagar, UKFD by date and time specified in this EOI.

1.4 Validity of the Proposals The Proposal shall be valid for a period of 90 days from the Bid Due Date (the “BDD”). In exceptional circumstances, prior to the expiry of the original proposal validity period, the UKFD may request applicants to extend the period of validity for a specified additional period. The request for the extension shall be made in writing. However, applicants will not be permitted to modify their Proposals submitted already.

1.5 Consultancy period

The Applicant will be required to provide services for the project period. The UKFD may choose to extend the services beyond the specified time on mutual agreement with successful Applicant.

1.6 Brief Description of Selection Process

The UKFD has adopted a two-stage selection process (collectively the “Selection Process”) in evaluating the Proposals comprising technical and financial Proposals. In the first stage, a technical evaluation will be carried out as specified in this EOI. Based on this technical evaluation, a list of short-listed applicants shall be prepared. In the second stage, a financial evaluation will be carried out as specified in this EOI/RFP. The Financial Proposal of the eligible and technically qualified Proposals will only be opened for consideration under QCBS evaluation. Proposals will finally be ranked according to their combined technical and financial scores as specified in Section 11.6 of RFP (Quality and Cost Based System (QCBS) of evaluation in the ratio of 80:20 (80% technical and 20% financial)). The first ranked Applicant shall be selected (the “Selected Applicant”) while the second ranked Applicant will be kept in reserve. The Proposal evaluation process and eligibility criteria is detailed in this EOI.

1.7 Currency for payment

All payments to the Applicant shall be made in INR in accordance with the provisions of this EOI/RFP.

2. Instructions to Applicants

2.1 Scope of the Proposal

2.1.1 Detailed description of the objectives, scope of services, deliverables and other requirements relating to this Consultancy are specified in this EOI/RFP. In case an applicant firm possesses the requisite experience and capabilities required for undertaking the Consultancy, it may participate in the Selection Process either individually (the "Sole Firm") or as lead member of a consortium of firms (the "Lead Member") in response to this invitation. The manner in which the Proposal is required to be submitted, the manner it is evaluated and accepted is explained in this EOI.

2.1.2 Applicants are advised that the selection of Consultant shall be on the basis of an evaluation by the UKFD through the Selection Process specified in this EOI. Applicants shall be deemed to have understood and agreed that no explanation or justification for any aspect of the Selection Process will be given and that the UKFD’s decisions are final and binding without any right of appeal whatsoever.

2.1.3 The Applicant shall submit its Proposals in the form and manner specified in this Section of the EOI/RFP. The Technical bid shall be submitted in the forms at Appendix-I and the Financial bid shall be submitted in the form at Appendix-II. Upon selection, the Applicant shall be required to enter into an agreement with the Authority in the form specified at Schedule-2.

2.2 Key Personnel:

The Consultancy Team shall consist of the following key personnel (the “Key Personnel”) who shall discharge their respective responsibilities as specified below:

CONSULTANCY FIRM ELIGIBILITY:

i. The bidder must be registered in India within the meaning of Companies Act 2013. The Bidding firm or consortium must be in the business of providing architectural services with complete site service elements, landscape design, environmental consultancy and sustainable development practices, preferably with experience in public building design and execution, institutional buildings, sustainable development advisory or consultancy projects, forest regeneration and documentation or similar works in India for last 3 years as on December 31, 2019.

ii. Experience of having satisfactorily completed works similar to the bid as enlisted in table ‘Detailed Technical Evaluation’.

iii. The bidder should not have been blacklisted by any Govt. bodies / PSB / PSU during the last three years.

iv. The bidder should have average annual financial turnover of not less than 100 lakh rupees (excluding all taxes) during the immediate last three consecutive financial years.

v. The bidder should have sufficient number of Technical and Administrative employees for the proper execution of the contract. The bidder should submit a list of employees who would be involved in this work.

vi. The bidder should submit list of all completed works with completion certificates from the clients in the last 5 years and list of all works in hand.

vii. All eligibility requirements mentioned above should be complied by the Bidders as applicable and relevant support documents should be submitted for the fulfillment of eligibility criteria failing which the bid may be summarily rejected. Any decision in this regard shall be final, conclusive and binding on the Bidder.

viii. In case of Consortium bidding, no more than three consortium members shall be allowed, including Lead Bidder.

ix. Each consortium member shall sign an MOU with the Lead bidder specifying their agreement to the deliverables sought by UKFD in this project and their role.

x. Firm should/may have past experience with government projects.

The new State of Uttarakhand has envisioned itself to be a globally hub of AYUSH and embarked on the journey to become the conservation role model of the country to emerge as the leading global conservation investment destination. In line with its vision, Government of Uttarakhand has accorded top priority to sustainable growth and accordingly identified eco-tourism sector as growth engine. To further sharpen and retain its existing competitive advantage and to identify new growth and investment opportunities, initiatives, projects/programs to enhance employment to its broad human base etc., UKFD is in process of selection of consultancy services for preparation of a comprehensive detailed project report (DPR)” for development of ‘Shiwalik Biodiversity Park’ at Muni Ki Reti, Tehri Garhwal, Uttarakhand.

4.1.1 Site Location

Note: The consultant shall be guided in its assignment by the IFA, 1927, FC Act 1980 other regulations, relevant rules, and provisions of law.

The consultant shall be responsible for preparing the technical and system related schedules of the “Contract Agreement” and for bringing out any special feature or requirement of the project referred to in the Contract Agreement, as the case may be. The details and particulars to be specified in the Schedules shall be duly addressed and incorporated therein.

The consultant shall, to the extent possible, rely on the existing data and which it may verify, supplement and analyze, as necessary, during the course of consultancy. The reports, information and material to be provided by the Authority are as follows:

(i) Concept Note, (ii) Base map of Project Area, (iii) Maps showing details of existing facilities.

The data/ details furnished by the Authority are for guidance only and therefore the Applicants are advised to visit the site for making their own assessment regarding site conditions and restrains.

The consultant shall also participate in the Pre-bid meeting with the bidders of the Project and assist the Authority in clarifying the technical aspects from bid of documents.

4.1.4 Objective of the Project:

The overall objective of the project is biodiversity conservation, herbal products promotion (Testing, Processing, value addition, marketing and quality control), livelihood enhancement (Livelihood support to communities (Expo Mart/Herbal Haat), eco-restoration of degraded forests, nature learning & educating, promoting responsible visits to the Himalayan natural treasures, teaching the importance of both terrestrial (forests) and aquatic (river Ganga) ecosystems for the well-being of human being, thus Creating the “Ambassadors of the Nature” and Securing the future of RET medicinal pant species.

4.1.5 Project Principles:

The entire project is based on Natural product utilization, Zero carbon footprint, future sustenance and Sustainable utilization of resources. Following are project principles:-

i. Sustainable design and build of infrastructure i.e. use of pre fab and natural materials, primarily.

ii. Less use of Cement and RCC. iii. Carbon Neutral Activities: To achieve a zero-carbon footprint, we would generate

and use renewable energy- solar and biogas (off grid energy systems). iv. Water management – harvesting, treatment, segregation, usage as much as possible. v. Assuring ongoing financial sustainability of project

vi. Automate systems and digitalize for consistency, efficiency, quality control and audit. vii. Leverage expertise of existing team and networks internally – no compromise with

quality. (for this we need to hire experts and professionals– overall project consultant, landscape designer, medicinal plant expert, natural building expert, audio-visual set up firm, marketing agency etc.)

viii. Project would be run by a society (for sustenance).

4.1.6 Implementation of the Action Plan:

Narendranagar Forest Division, Forest Department, Uttarakhand will be the nodal agency to set up the Biodiversity park, Nature haat and upgradation of existing herbal garden. It has already been decided in a meeting chaired by Chief Secretary, Uttarakhand on 15th October, 2019, that in order to ensure sustenance of the project and the entities created therein, a society by the name “The Himalayan Eco-Restoration, Biodiversity Augmentation and Livelihood Enhancement Society (HERBALES)” will be formed. This society would have a General body, headed by Principal Secretary Forest and an Executive or a Management Committee in the Chairpersonship of PCCF/HoFF, Uttarakhand. Director of the Biodiversity park would be the Member Secretary.

5 Scope of Services or Work

5.1 The consultant would require to work as an integral team with the Authority for designing and providing consultancy services for the ‘Biodiversity Park’ at Muni Ki Reti, Tehri, Uttarakhand and assisting the Authority in implementing the project. The activities under the scope of work of consultant shall broadly include but not limited to the following:

a. The consultant shall provide descriptive evaluation of the project site and should list all the tasks necessary to complete the master planning of the site, assemble and analyze data regarding all of the existing conditions (topography, geology, soils, hydrology), ecological integrity, historic, cultural, or environmental resources within the park, changing demographics (open spaces, circulation and integration of all areas), tourist and business impact. The data shall be utilized to develop the landscape layout, detailed designs, policies, actions and an implementation plan with construction documents and construction administration phase.

b. Identify the natural/passive vs. programmed recreational space and create a green network plan that proposes opportunities to improve access and usage of parks and greater connectivity with the neighborhoods through public art installations, enriching park aesthetics, and incorporating ‘green’ design principles.

c. Prepare the DPR/master plan /landscape layout (hard and soft landscape areas) with detailed designs. layouts and shall provide services in respect of the following:

i. Site appraisal and suitability. ii. Site planning.

iii. Landform and grading. iv. Surface drainage design and water management. v. Irrigation facility design.

vi. Open space design – hard and soft areas. vii. Planting design.

viii. Landscape structures and features. ix. Garden Furniture location and design. x. Green/natural design Infrastructure design

xi. Illumination design. xii. Graphic design and signage.

xiii. Co-ordination of external services. xiv. All other components/aspects of DPR.

d. Develop an action and implementation plan with maintenance strategy (for 20 years) in an integrated manner to make it socially, economically and ecologically self- sustainable. It shall cover the following:

i. Optimal utilization of FAR for the facilities ii. Funding and revenue generation models- listing out all private and

public remunerative activities (to be approved by the Authority) iii. Short term and long-term priorities iv. Cost Estimates for the project v. Phasing of the development with time lines vi. Operation and lifecycle costs of the park facilities. Which may include

cost estimates needed to support the proposed plan and the possible public and private funding sources and proposed alternative managerial and operational structure(s).

e. The consultant will do traffic and parking studies on the proposed facilities to justify parking lot sizes, entrance road and traffic control plans related to entrance roads and external connections

f. The DPR proposal shall be of high quality better than as prescribed in Comprehensive concept note. The park needs to be of universally accessible design.

g. The consultant will associate with the experts/specialists for landscape development, architecture, forestry, environment, horticulture, sustainable energy efficient solutions including specialist services of solar, hydro-geologist, ecologist, lighting designer, natural building expert, waste & water management exhibit designer, graphic designer or any other specialist consultant etc.

h. The Consultant shall make Presentations before various committees and advice on all matters relating to the development of Park. The suggestions / observations shall be incorporated in the design before finalization of the drawings / documents. There can be some changes/modifications in the drawings before and during course of construction. No extra payments shall be made on accounts of such changes.

i. All specifications shall be prepared in consultation and approval of the Authority.

j. Preparation of BOQ with details of measurements, assist the Authority in bid evaluation& selection of the Contractor, assessment of progress of work with PERT/CPM charts.

k. The scope of the comprehensive landscape plan preparation includes close coordination with the project team of the Authority. Coordination may include, but not be limited to, participation in coordination meetings, developing conceptual park plans.

l. The consultant will assist the Authority in making all engineering/forestry/horticultural decisions required for the successful and timely implementation of the Project.

m. The consultant will ensure adherence to relevant Master Plan, CVC guidelines, FC, environment and other regulatory requirements & seek approval/ endorsement of proposals from all statutory Authorities, if required for the Project.

n. In case of any bottleneck in execution of the project arising out of any reason whatsoever, the consultant will undertake such an activity so that the project does not get delayed or stuck up. It is, therefore, desirable that the consultant may thoroughly study the scope of work before participation.

o. The consultant shall make provisions in the tender documents for Third party quality assurance.

p. The team leader of the consultant shall be a sufficiently senior and competent person having relevant experience and of impeccable integrity. The consultant shall submit the tentative organization chart for managing the consultancy assignments so that appropriate decisions are taken quickly. However, the actual number of technical personnel to be deployed and the deployment schedule shall be prepared by the consultant and mutually agreed upon after award of work. This schedule shall be prepared in a manner that all the functions required to be performed by the consultant as per the scope of their work are performed completely and efficiently.

Team leader and other key personnel’s assisting team leader shall not be changed during the implementation of the project except with concurrence of the Authority. The decision of the Authority, however, shall be final in this regard.

q. Deliverables: Design / drawings will be the property of UKFD and consultant shall provide 5 (five) sets of certified copies of drawings and soft copies of all the drawings / documents at each stage and as demanded by DFO Narendranagar. The drawings and documents shall be provided in both CAD and PDF versions for coordination.

r. It is clarified that the scope of the Consultant covers all the aspects required for finalization of DPR of the project including landscaping, civil, electrical & mechanical works, services etc. as per the design intent and nothing extra shall be payable on any account.

5.1 Consultant Role in Various Stages of the Project

The consultant shall be responsible for complete and comprehensive site planning, landscape development, planting design, green building, services (MEP, drainage, water management etc.) and detailing etc. and all the activities of the projects in consultation with the Authority.

The consultant would be required to perform broadly the following activities at different stages of the project:

5.1.1 Stage 1: Comprehensive Concept Stage

i. Develop the Comprehensive concept or vision for the project and develop an action plan with recommendations based on review and inputs on the Technical presentation by the consultant.

ii. Carrying out site analysis and furnish a site appraisal report with regard to the potential of the site vis-à-vis activities. The existing built up structures/ underground utility services may be relocated / refurbished as per the design intent.

iii. Assessment of irrigation, drainage, water harvesting, electrical, energy efficient systems to make the parks self-sustainable.

iv. Outlining the remunerative component in terms of activities (educational/ecological/commercial/public utilities etc.) with built up areas. Key Deliverables:

a. Final Concept presentation consisting of concept layout, planting concept, circulation and zoning drawings indicating zoning criteria, pedestrian, vehicular, service and emergency vehicle movement and any additional criteria that has impact on the landscape

b. Provide perspective views (3D), sections and elevations, to demonstrate the landscape design intent.

c. Provide a rough cost estimate for the development cost of the project including the operation & maintenance costs

d. The costs benefit analysis based on the proposed remunerative component.

5.1.2 Stage 2: Schematic Design or Draft Preliminary Project Report (DPPR)

i. This stage is to further review and modify the conceptual design incorporating required changes and prepare the preliminary drawings, sketches, etc. for the Authority’s approval.

ii. The scheme shall reflect the conservation and landscape features their relationship with architectural forms, planting strategy and the concepts on sustainable ‘green’.

iii. Demonstrating the optimum utilization of remunerative / commercial component with a management action plan.

Key deliverables:

a. Master Landscape plan, enlarged plans of key areas, 3D views, sections establish the proposed landscape character of the site along with the existing levels.

b. Schematic plans for surface drainage design, water features, irrigation, illumination design & other services

c. Design of the proposed energy efficient systems along with its sustainability model.

d. Prepare project management plan with PERT Chart.

5.1.3 Stage 3: Preliminary Project Report (PPR):

i. This stage is to develop detailed design proposals which include technical drawings for hard and soft landscape areas which include formation levels, grading plans, surface and surface drainage intent, detailed design of water features, lighting strategy, planting plans including all necessary suggestions made by the competent authority.

ii. Preparation of structural design & drawings and MEP (Mechanical, Electrical & Plumbing) details & drawings and further detailing of operation and maintenance plan of the park. Key deliverables:

a. Detailed plans, sections and elevations to define critical interfaces. Plans should indicate grade levels, soil loading and formation levels

b. Details of key landscape areas. c. Co-ordinate detailed services including surface drainage, irrigation. d. Graphic signage, street furniture & other landscape components with details e. Illumination design (plans & details) f. Landscape planting plans and schedules. g. All Infrastructure Design (Eco-friendly or Green) h. Engineering design of water features and specialized water features if any i. Waterproofing where required j. Detail of Waste Management model and energy efficient system k. Landscape specifications document. (Word format) l. BOQ of the total project including hard & soft landscape areas, landscape

elements, services & other infrastructural facilities required (Excel format) m. Finalization of the project management plan with PERT chart. n. Submission of final drawings, final designs, maps, grading plans, landscape &

civil Infrastructural work setting out plans, detailed landscape plans with construction details, sections & elevations, landscape planting plans and schedules, lighting layouts and lighting selection of fixtures or any other detail as required for execution.

o. Submission of all the services drawings- irrigation and electrical drawings, drainage plans or any other details required thereof.

5.1.4 Stage 4: Detailed DPR or Final Stage:

i. Detailed DPR for each component shall cover all the aspects of business, from analyzing the market, confirming availability of various necessarily know how, infrastructures, logistic, storage etc. along with forecasting of the financial requirements.

ii. Prepare final drawings, material specifications for hard and soft landscape components, schedule of quantities and tender documents including code of

practice covering aspects like mode of measurement, method of payments, quality control procedures on materials & works and other conditions of contract.

iii. For soft areas the Consultant shall provide detailed planting plans, measured bill of quantities and detailed specifications for plant material.

iv. To prepare project report chapter wise containing all required aspects for Development Commissioning & Operation of the World class Shiwalik Biodiversity Park.

v. Exploring and proposing multiple viable financial options for running the ‘Shiwalik Biodiversity Park’ as a successful business model.

vi. After required available data is furnished, section wise detailed appraisal will be carried out for:

A. Revival of existing Herbal Garden into a theme based herbal garden with appropriate Landscaping.

B. Providing a marketing platform for farmers and Pharmaceuticals, in the form of “Nature Herbal Haat”.

C. Development of “Shiwalik Biodiversity Park” with an objective of Promoting Nature Education and Creating “Ambassadors of the Nature”.

D. “Conservation of the Maa Ganga River” – A Theme based Light & Sound show for public awareness.

vii. Rendering timely advice for implementation of the project and inputs for effective cost/quality/time benefit for the project. Key deliverables:

i. All required aspects for Development Commissioning & Operation of the World class Shiwalik Biodiversity Park.

ii. A complete set of drawings and designs which shall include detailed plans, elevations and sections and all details as mentioned in the detailed design stage.

iii. To attend site meetings & coordination meetings with all agencies whenever called by the Authority for timely completion of the project.

iv. Provide quick clarifications to designs or details that have been provided vide drawings or immediate solutions to the clarifications sought by the Contractor and render appropriate advice and carry out site related modification in the design.

v. Component wise detailed appraisal will be carried out. vi. Viable financial options for running the ‘Shiwalik Biodiversity Park’ as a successful

business model. vii. The consultant shall assist the Authority in preparing the bid document for the

Contractor and details required for inviting the bid.

6. Project Information

6.1 Project Cost:

The Consultant shall prepare cost estimates of each site including site planning, landscaping works ( soft and hard landscaped areas), facility design , building works, entrance plazas, green covers, parking areas, public utilities, common infrastructure facilities, street furniture, graphic signage, lighting fixtures, etc. with a break-up of costs for each component separately.

6.2 Deliverables: The Consultant shall deliver the deliverables (the “Deliverables”) during the course of this Consultancy. The Deliverables shall be so drafted that they could be given to the

prospective Contractors for guidance in preparation of their Proposals. Five hard copies and two soft copies in pen drive/DVDs of all the final DPR reports, layouts, maps, drawings, etc. shall be submitted to the Authority. For draft documents /plans only two hard copies and one soft copy shall be submitted to the Authority. The size of drawings shall be A- 3 and A-0 (as per requirement). The Authority shall provide comments on the draft of each of the Deliverables at each stage within five (05) days prior to its finalization by the Consultant.

6.3 Meetings:

The authority may review with the Consultant, any or all of the documents and advice forming part of the Consultancy, in meetings and conferences which will be held in the Authority’s office. Further, the Consultant will be required to attend meetings and conferences with pre-qualified Bidders or the Selected Bidder. No expense towards attending such meetings during the period of Consultancy, including travel costs shall be reimbursed.

6.4 Number of Proposals

No Applicant or its Associate shall submit more than one Application for the Consultancy. An Applicant applying individually or as an Associate shall not be entitled to submit another application.

6.5 Cost of Proposal

The Applicants shall be responsible for all of the costs associated with the preparation of their Proposals and their participation in the Selection Process including subsequent negotiation, visits to the UKFD etc. UKFD will not be responsible or in any way liable for such costs, regardless of the conduct or outcome of the Selection Process.

6.6 Visit to the Site and UKFD and verification of information

Applicants are encouraged to submit their respective Proposals after visiting the Site of project under Divisional Forest Officer, Narendranagar office, UKFD, Government of Uttarakhand and ascertaining for themselves the availability of any relevant documents and other data, Applicable Laws and regulations or any other matter considered relevant for the preparation of the Proposals.

6.7 Acknowledgement by Applicant

It shall be deemed that by submitting the Proposals, the Applicant has:

i. made a complete and careful examination of the EOI/RFP; ii. received all relevant information requested from the UKFD; iii. accepted the risk of inadequacy, error or mistake in the information provided in

the RFP or furnished by or on behalf of the UKFD as per Clause 11, iv. satisfied itself about all matters, things and information, including matters referred

to in Clause 11 herein above, necessary and required for submitting an informed Application and performance of all of its obligations thereunder;

v. acknowledged that it does not have a Conflict of Interest; and vi. agreed to be bound by the undertaking provided by it under and in terms hereof. UKFD shall not be liable for any omission, mistake or error in respect of any of the above or on account of any matter or thing arising out of or concerning or relating to EOI/RFP or the Selection Process, including any error or mistake therein or in any information or data given in this RFP.

6.8 Right to reject any or all Proposals

Notwithstanding anything contained in this EOI/RFP, the UKFD reserves the right to accept or reject any Proposal and to annul the Selection Process and reject all Proposals, at any time without any liability or any obligation for such acceptance, rejection or annulment, and without assigning any reasons therefor.

6.9 Contents of the RFP

This RFP comprises the Disclaimer set forth hereinabove, the contents as listed below and will additionally include any Addendum / Amendment issued: A. Request for Proposal

6.10 Clarifications

Applicants requiring any clarification on the EOI may send their queries in writing (E-mail: [email protected] ) before as mentioned in the key dates in the beginning of the RFP. The UKFD shall endeavour to respond to all queries before 3 days of the submission date. Replies to all such queries shall be posted on the Official Website without identifying the source of queries. UKFD reserves the right not to respond to any queries or provide any clarifications, in its sole discretion, and nothing in this Clause 4.8 shall be construed as an obligation to respond to any question or to provide any clarification.

6.11 Pre-Proposal Meeting

Pre-Bid Meeting shall be conducted as per the schedule provided in this RFP or EOI.

6.12 Amendment of RFP At any time prior to the deadline for submission of Proposal, the UKFD may, for any reason, whether at its own initiative or in response to clarifications requested by an Applicant, modify the EOI/RFP document by the issuance of Addendum/ Amendment and posting it on departmental website.

6.13 Language

Proposals with all accompanying documents (the “Documents”) and all communications in relation to or concerning the Selection Process shall be in English language and strictly on the forms provided in this RFP. No supporting document or printed literature shall be submitted with the Proposal unless specifically asked for and in case any of these Documents is in another language, it must be accompanied by an

accurate translation of all the relevant passages in English, in which case, for all purposes of interpretation of the Proposal, the translation in English shall prevail.

6.14 Documents Comprising the Bid: The bid prepared by the bidder shall comprise the following documents:

i. Tender Fee and EMD (Physical submission only) ii. Technical Bid (technical bid duly filled with supporting documents as per tender

requirement). iii. Financial Bid Document

6.15 Earnest Money Deposit (EMD):

i. An Earnest Money Deposit (EMD) in the form of a CDR/FDR/DD, from a scheduled Indian Bank in favor of Divisional Forest Officer, Narendranagar Forest Division, Muni Ki Reti, Tehri Garhwal, Uttarakhand payable at Narendranagar, for the sum of Rs. 1,00,000/- (Rupees one Lakhs Only) shall be required to be submitted by each Applicant. Original CDR/FDR/DD along with other tender documents must reach to Divisional Forest Officer, Narendranagar Forest Division, Muni Ki Reti, Tehri Garhwal, Uttarakhand before last date of submission.

ii. UKFD will not be liable to pay any interest on Earnest Money Deposit. Earnest

Money or Bid security of Pre- Qualified but unsuccessful Applicants shall be returned, without any interest, post issuance of the work order to the Selected Applicant or if the selection process is cancelled by Client. The selected Applicants’ Earnest Money shall be returned, without any interest, after 2 months of issuance of the work order.

iii. UKFD will be entitled to forfeit and appropriate the Earnest Money Deposit as

mutually agreed loss and damage payable to UKFD in regard to the RFP without prejudice to UKFD’s any other right or remedy under the following conditions:

a) If an Applicant engages in a corrupt practice, fraudulent practice, coercive practice, undesirable practice or restrictive practice as envisaged under this RFP;

b) If any Applicant withdraws its Proposal during the period of its validity as specified in this RFP and as extended by the Applicant from time to time,

c) In the case of the Selected Applicant, if the Selected Applicant fails to accept the work order within the specified time limit, or

d) If the Applicant commits any breach of terms of this RFP or is found to have made a false representation to Client.

6.16 Format and signing of Proposal i. The Applicant shall provide all the information sought under this EoI/RFP. UKFD

would evaluate only those proposals that are received in the specified forms and complete in all respects.

ii. Applicants should note the last date, as specified, for submission of Proposals. Except as specifically provided in this RFP, no supplementary material will be entertained, and that evaluation will be carried out only on the basis of Documents received by the closing time. Applicants will ordinarily not be asked to provide additional material information or documents subsequent to the date of submission, and unsolicited material if submitted will be summarily rejected.

7. Technical Proposal 7.1.1 Applicants shall submit the technical proposal in the formats at Appendix-I (the “Technical Proposal”).

7.1.2 While submitting the Technical Proposal, the Applicant shall, in particular, ensure that:

i. The Applicants shall submit the Proposal with all pages numbered serially and by giving an index of submissions. Each page of the submission shall be initialed by the Authorized Representative of the Applicant as per the terms of this EOI/RFP.

ii. all forms are in the prescribed formats and signed by the prescribed signatories; iii. CVs of all Key Personnel have been included; iv. key Personnel have been proposed in line with Conditions of Eligibility for key

personnel v. No alternative proposal for any Key Personnel is being made and only one CV for

each position has been furnished; vi. the CVs have been recently signed and dated, by the respective Personnel and

countersigned by the authorized representative of Applicant; vii. the CVs shall contain an undertaking from the respective Key Personnel about his/her

availability for the duration specified in the RFP; viii. Key Personnel proposed have good working knowledge of English language; ix. Key Personnel would be available for the period indicated in the TOR; x. Tender application form Fee: Rs. 2000/- + GST if purchased directly and If the tender

document downloaded from the website then, a Demand Draft of Rs. 2000/- + GST in favor of Divisional Forest Officer, Narendranagar Forest Division, Muni Ki Reti, Tehri Garhwal, Uttarakhand to be submitted along with tender documents.

7.1.3 Failure to comply with the requirements spelt out in this Clause 7.1.2 shall make the Proposal liable to be rejected.

7.1.4 If an individual Key Personnel makes a false averment regarding his qualification, experience or other particulars, he shall be liable to be debarred for any future assignment for a period of 3 (three) years. The award of this Consultancy to the Applicant will also be liable to cancellation in such an event.

7.1.5 The Technical Proposal shall not include any financial information relating to the Financial Proposal.

7.1.6 The proposed team shall include experts and specialists (the “Key Personnel”) in their respective areas of expertise such that the Consultant should be able to complete the Consultancy within the specified time schedule. The CV of each Key Personnel should be submitted in the format in Appendix-I.

7.1.7 UKFD reserves the right to verify all statements, information and documents, submitted by the Applicant in response to the EOI/RFP. Any such verification or the lack of such verification by UKFD to undertake such verification shall not relieve the Applicant of its obligations or liabilities here under nor will it affect any rights of UKFD there under.

7.1.8 In case it is found during the evaluation or at any time before issuance of LOA or after its issuance, that one or more of the eligibility conditions have not been met by the Applicant or the Applicant has made material misrepresentation or has given any materially incorrect or false information, the Applicant shall be disqualified forthwith

if not yet appointed as the Consultant by issue of the LOA and if the Selected Applicant has already been issued the LOA, the same shall, notwithstanding anything to the contrary contained therein or in this EOI/RFP, be liable to be terminated, by a communication in writing by UKFD without UKFD being liable in any manner whatsoever to the Selected Applicant or Consultant, as the case maybe.

8. Financial Proposal

8.1.1 Applicants shall submit the financial proposal in the format at Appendix-II (the “Financial Proposal”) clearly indicating the cost of the Consultancy in both figures and words, in Indian Rupees, and signed by the Applicant’s authorized representative. In the event of any difference between figures and words, the amount indicated in words shall prevail.

8.1.2 While submitting the Financial Proposal, the Applicant shall ensure the following:

i. All the costs associated with the assignment shall be included in the Financial Proposal. These shall normally cover remuneration for all the Personnel, accommodation, air fare, equipment, printing of documents, etc. The total amount indicated in the Financial Proposal shall be without any condition attached or subject to any assumption, and shall be final and binding. In case any assumption or condition is indicated in the Financial Proposal, it shall be considered non-responsive and liable to be rejected.

ii. The Financial Proposal shall take into account all expenses and tax liabilities, including GST. Further, all payments shall be subject to deduction of taxes at source as per Applicable Laws.

iii. Costs (including breakdown of costs) shall be expressed in INR.

9.1 Submission of Proposal

i. Technical Proposal and Financial Proposal shall be written in indelible ink and signed by the Authorized Representative of the Applicant.

ii. All pages of the Technical Proposal and Financial Proposal must be numbered and initialed by the person signing the Proposal.

iii. The completed Proposal must be submitted.

iv. The Proposal shall be made in the Forms specified in this EOI/RFP. Any attachment to such Forms must be provided on separate sheets of paper and only information that is directly relevant should be provided. This may include photocopies of the relevant pages of printed documents. No separate documents like printed annual statements, firm profiles, copy of contracts etc. will be entertained.

v. The rates quoted shall be firm throughout the period of performance of the assignment. 9.2 Proposal/Bid Due Date

i. Proposals should be submitted as specified at Clause 1.11 the address provided in Clause 1.9 in the manner and form as detailed in this EOI/RFP. A receipt thereof should be obtained from the person specified therein.

ii. The UKFD may, in its sole discretion, extend the last date of tender submission by issuing an Addendum in accordance with Clause 6.12 uniformly for all Applicants.

9.3 Late Proposals Proposals received by UKFD after the specified date shall not be eligible for consideration and shall be summarily rejected.

9.4 Modification/ substitution/ withdrawal of Proposals The Applicant may modify, substitute, or withdraw its Proposal after submission, provided that written notice of the modification, substitution, or withdrawal is received by UKFD prior to last date of submission. No Proposal shall be modified, substituted, or withdrawn by the Applicant on or after the last date of tender submission. Any alteration / modification in the Proposal or additional information or material supplied subsequent to the BDD, unless the same has been expressly sought for by UKFD, shall be disregarded.

9.5 Evaluation of Proposals

9.5.1 UKFD shall open the Proposals on the date, time and place specified in Clause 1.11 (schedule of bid process) and in the presence of the Applicants who choose to attend. The “Technical Proposal” shall be opened first to assess the compliance to Pre-qualification condition, followed by technical evaluation and presentation. The “Financial Proposal” shall be opened of those agencies who qualify in technical evaluation.

9.5.2 Proposals for which a notice of withdrawal has been submitted in accordance with Clause shall not be opened.

9.5.3 Prior to evaluation of Proposals, UKFD will determine whether each Proposal is responsive to the requirements of the EOI/RFP. A Proposal shall be considered responsive only if: i. The applicants meet the pre-qualification criteria ii. the Technical Proposal is received in the forms specified at Appendix-I and is

accompanied by the Earnest Money Deposit; iii. it is received by the last date including any extension thereof pursuant to Clause

9.2; iv. it is signed, sealed, bound together in hard cover and marked as stipulated in Clause

9.1; v. it contains all the information (complete in all respects) as requested in the

EOI/RFP; vi. it does not contain any condition or qualification; vii. it is not non-responsive in terms hereof; and viii. it strictly does not contain any financial information that may affect the evaluation

of financial proposal

9.5.4 UKFD reserves the right to reject any Proposal which is non-responsive and no request for alteration, modification, substitution or withdrawal shall be entertained by UKFD in respect of such Proposals.

9.5.5 As part of the evaluation, the Pre-Qualification Proposals submitted should fulfill the pre- Qualification Criteria. In case an Applicant does not fulfill the pre-Qualification Criteria, the Proposal of such an Applicant will not be evaluated further.

9.5.6 UKFD shall subsequently examine and evaluate Proposals in accordance with the

Selection Process specified at Clause 1.6.

9.5.7 After the technical evaluation, UKFD shall prepare a list of qualified Applicants in terms of Clause 11.1 for opening of their Financial Proposals. The opening of Financial Proposals shall be done in presence of respective representatives of prequalified Applicants who choose to be present. UKFD will not entertain any query or clarification from Applicants who fail to qualify at any stage of the Selection Process. The financial evaluation and final ranking of the Proposals shall be carried out in terms of Clauses 11.6 and 11.7 and overall disclaimers provided at the start of the EOI.

9.5.8 Applicants are advised that Selection shall be entirely at the discretion of UKFD. Applicants shall be deemed to have understood and agreed that UKFD shall not be required to provide any explanation or justification in respect of any aspect of the Selection Process or Selection.

9.5.9 Any information contained in the Proposal shall not in any way be construed as binding on UKFD, its agents, successors or assigns, but shall be binding against the Applicant if the Consultancy is subsequently awarded to it.

9.6 Confidentiality Information relating to the examination, clarification, evaluation, and recommendation

for the selection of Applicants shall not be disclosed to any person who is not officially concerned with the process or is not a retained professional adviser advising UKFD in relation to matters arising out of, or concerning the Selection Process. UKFD shall treat all information, submitted as part of the Proposal, in confidence and shall require all those who have access to such material to treat the same in confidence. UKFD may not divulge any such information unless it is directed to do so by any statutory entity that has the power under law to require its disclosure or to enforce or assert any right or privilege of the statutory entity and/or UKFD or as may be required by law or in connection with any legal process.

9.7 Clarifications 9.7.1 To facilitate evaluation of Proposals, UKFD may, at its sole discretion, seek

clarifications from any Applicant regarding its Proposal. Such clarification(s) shall be provided within the time specified by UKFD for this purpose. Any request for clarification(s) and all clarification(s) in response thereto shall be in writing.

9.7.2 If an Applicant does not provide clarifications sought under Clause 9.7.1 above within the specified time, its Proposal shall be liable to be rejected. In case the Proposal is not rejected, UKFD may proceed to evaluate the Proposal by construing the particulars requiring clarification to the best of its understanding, and the Applicant shall be barred from subsequently questioning such interpretation of UKFD.

APPOINTMENT OF CONSULTANT

9.8 Negotiations The Selected Applicant may, if necessary, be invited for negotiations. The negotiations

shall generally not be for reducing the price of the Proposal, but will be for re-confirming the obligations of the Consultant under this EOI/RFP. Issues such as deployment of Key Personnel, understanding of the EOI/RFP and methodology shall be discussed during negotiations. In case the Selected Applicant fails to reconfirm its

commitment, UKFD reserves the right to designate the next ranked Applicant as the Selected Applicant and invite it for negotiations.

9.9 Indemnity The applicant / consultancy firm shall, subject to the provisions of the Agreement,

indemnity the UKFD, for an amount not exceeding value of the Agreement, for any direct loss or damage that is caused due to any deficiency in Services.

9.10 Award of Consultancy Generally, after selection, a Letter of Award (the “LOA”) shall be issued, in duplicate,

by UKFD to the Selected Applicant and the Selected Applicant shall, within 7 (seven) days of the receipt of the LOA, sign and return the duplicate copy of the LOA in acknowledgement thereof. In the event the duplicate copy of the LOA duly signed by the Selected Applicant is not received by the stipulated date, UKFD may, unless it consents to extension of time for submission thereof, cancel the LOA and the next highest-ranking Applicant may be considered.

9.11 Execution of Agreement After acknowledgement of the LOA as aforesaid by the Selected Applicant, it shall

execute the Agreement within the Time Schedule as prescribed. The Selected Applicant shall not be entitled to seek any deviation in the Agreement.

9.12 Commencement of the Consultancy Generally, the Consultant shall commence the Consultancy within one week from the

date of issuance of LOA, or such other date as may be mutually agreed. If the Consultant fails to commence the assignment as specified herein, UKFD may invite the second ranked Applicant for negotiations. In such an event, the LOA may be cancelled/terminated.

9.13 Proprietary data 9.13.1 Subject to the provisions of Clause 9.6, all documents and other information provided

by UKFD or submitted by an Applicant to UKFD shall remain or become the property of UKFD. Applicants and the Consultant, as the case may be, are to treat all information as strictly confidential. UKFD will not return any Proposal or any information related thereto. All information collected, analyzed, designed, developed, processed or in whatever manner provided by the Consultant to UKFD in relation to the Consultancy shall be the property of UKFD.

9.13.2 All Knowledge/Data which come to their notice as part of engagement shall not be used outside without permission of the UKFD.

9.13.3 The Correspondence both Physical and Electronic shall be in the name of the DFO Narendranagar, UKFD.

9.13.4 Dedicated official Mail ID ([email protected]) will be provided by the UKFD which shall alone be used for all correspondence associated with the engagement.

10.1 Performance Bank Guarantee Successful applicant shall be required to submit a performance bank guarantee of 10

(ten) percent of contract value towards performance security. It shall be retained for the duration of the engagement and it is to be appropriated against breach of this

Agreement or for recovery of liquidated damages as specified in Clause 10.2 The balance remaining out of the Performance Security shall be returned to the Consultant at the end of 3 (three) months after the expiry of this Agreement

10.1.1 The Consultant may, in lieu of retention of the amounts as referred to in Clause 10.1 above, furnish a Bank Guarantee substantially in the form specified at Annex of this Agreement.

10.2 Liquidated Damages

10.2.1 Liquidated Damages for error/variation/delay In case any error or variation is detected in the reports submitted by the Consultant and such error or variation is the result of negligence or lack of due diligence on the part of the Consultant, the consequential damages thereof shall be quantified by the Authority in a reasonable manner and recovered from the Consultant by way of deemed liquidated damages, subject to a maximum of 50% (fifty per cent) of the Agreement Value.

10.2.2 Liquidated Damages for delay In case of delay in completion of Services, liquidated damages not exceeding an amount equal to 0.1% (zero point one per cent) of the Agreement Value per day, subject to a maximum of 10% (ten per cent) of the Agreement Value will be imposed and shall be recovered by appropriation from the Performance Security or otherwise. However, in case of delay due to reasons beyond the control of the Consultant, suitable extension of time, as may be allowed by UKFD.

10.2.3 Encashment and appropriation of Performance Security

The Authority shall have the right to invoke and appropriate the proceeds of the Performance Security, in whole or in part, without notice to the Consultant in the event of breach of this Agreement or for recovery of liquidated damages specified in this Clause 10.2.

10.3 Penalty for deficiency in Services

In addition to the liquidated damages not amounting to penalty, as specified in Clause 10.2, warning may be issued to the Consultant for minor deficiencies on its part. In the case of significant deficiencies in Services causing adverse effect on the Project or on the reputation of the Authority, other penal action including debarring for a specified period may also be initiated as per policy of the Authority.

10.4 Fairness and Good Faith

10.4.1 Good Faith The Parties undertake to act in good faith with respect to each other’s rights under this Agreement and to adopt all reasonable measures to ensure the realization of the objectives of this Agreement.

10.4.2 Operation of the Agreement The Parties recognize that it is impractical in this Agreement to provide for every contingency which may arise during the life of the Agreement, and the Parties hereby agree that it is their intention that this Agreement shall operate fairly as between them, and without detriment to the interest of either of them, and that, if during the term of

this Agreement either Party believes that this Agreement is operating unfairly, the Parties will use their best efforts to agree on such action as may be necessary to remove the cause or causes of such unfairness, but failure to agree on any action pursuant to this Clause shall not give rise to a dispute subject to arbitration in accordance with Clause 10.5 hereof.

10.5 Dispute resolution

10.5.1 Any dispute, difference or controversy of whatever nature howsoever arising under or out of or in relation to this Agreement (including its interpretation) between the Parties, and so notified in writing by either Party to the other Party (the “Dispute”) shall, in the first instance, be attempted to be resolved amicably.

10.5.2 The Parties agree to use their best efforts for resolving all Disputes arising under or in respect of this Agreement promptly, equitably and in good faith, and further agree to provide each other with reasonable access during normal business hours to all non- privileged records, information and data pertaining to any Dispute.

10.5.3 Jurisdiction for the unresolved disputes, if any will be the hon. court of Narendranagar or Tehri or Hon. HC of Uttarakhand.

11 Criteria for Evaluation of Proposals:

11.1 Evaluation of Technical Bid/Proposals and Short-listing of Applicants

11.1.1 The Authority would scrutinize all RFP’s received up to the stipulated date and time for the receipts of RFP’s and evaluate these on the basis of the eligibility criteria laid down in this document. The Authority reserves the right to independently verify the genuineness of the documents submitted by the parties.

11.1.2 During verification if any submitted document is not found to be genuine or misleading in any way, the concerned party would be disqualified. The UKFD reserves the right to restrict the list of shortlisted parties as deemed suitable by it and the right to decide on the short-listing criteria.

11.1.3 Technical Proposals of only those applicants who fulfill the pre-qualification criteria without any condition shall be evaluated.

11.1.4 Presentations of the selected Applicants to the Jury panel as formulated by the approval of the Competent Authority. The selected Applicants would be intimated and assigned a date and time for making a power point presentation before the committee. The Applicants shall make the presentation with emphasis on their past experience in the field, technical manpower, conceptual plans for the proposed ‘The Shiwalik Biodiversity Park’ at Muni Ki Reti, Tehri Garhwal, Uttarakhand layout plans, 3D sketches etc. along with the financial strategy, Approach & Methodology with proposed value addition, its operative and management model, tentative project costs involved, any other choice of bidder under scope of works etc. Parties making the presentation would need to submit five colored hard copies of their power point presentations. The Committee may also ask parties to provide clarifications on the documents submitted by them with the RFP.

11.1.5 Only those Applicants whose Technical Proposals with a minimum aggregate technical score (including presentation) of 70 (seventy) marks out of 100 (one hundred) with a minimum of 60% in each sub category shall qualify for further consideration, and shall be ranked from highest to the lowest on the basis of their

11.1.6 The Technical and financial bids will have a 80:20 weightage of marks respectively in the evaluation criteria. The Quality cum Cost Based System (QCBS) shall be followed to evaluate the bids.

11.1.7 Technical Weightage (ST): The marks scored by the bidder in technical evaluation shall be calculated to 70 points as below:

11.1.8 The Applicants ranked as aforesaid, shall be prequalified and short-listed for financial evaluation in the second stage. A substantially responsive bid shall be one that meets the requirements of the bidding document in totality. The technical bid not meeting the minimum requirements as per the tender documents shall be rejected and their financial proposals will be returned unopened.

11.2 The scoring criteria to be used for technical evaluation will be as follows: Sl. No.

11.3 Eligible Assignments

For the purposes of determining of eligibility and for evaluating the proposals under this RFP, the eligible assignments (the “Eligible Assignments”) shall mean ‘Shiwalik Biodiversity Park development, Landscape Design and Development works’ which includes designing and execution of thematic & educational herbal garden, herbal haat, nature education through biodiversity park, Recreational facilities, Ganga light & sound show, River & Water Fronts Development along with Public Infrastructure.

11.4 Technical and Financial eligibility

i. Experience of having satisfactorily completed works similar to the bid as enlisted in table ‘Detailed Technical Evaluation’.

ii. Firm has to comply all the conditions as mentioned in clause 3 of the EOI.

11.5 Short-listing of Applicants

Of the Applicants ranked as aforesaid, not more than 5 (five) shall be prequalified and short-listed for financial evaluation in the second stage. However, if the number of such pre-qualified Applicants is less than two, the Authority may, in its sole discretion, pre-qualify the Applicant(s) whose technical score is less than 60 (sixty) points even if such Applicant(s) do (es) not qualify in terms of Clause 11.1.5; provided that in such an event, the total number of pre-qualified and short-listed Applicants shall not exceed two.

11.6 Evaluation of Financial Bid

11.6.1 In the second stage, the financial evaluation will be carried out as per this Clause 11.6. Each Financial Proposal will be assigned a financial score (SF). The selection will be on QCBS basis with technical proposal carrying a weightage of 80% and the financial proposal carrying a weightage of 20%. The winner shall be the bidder scoring highest

marks combining the technical and financial scores. 11.6.2 The Authority will determine whether the Financial Proposals are complete, unqualified

and unconditional. The cost indicated in the Financial Proposal shall be deemed as final and reflecting the total cost of services. Omissions, if any, in costing any item shall not entitle the firm to be compensated and the liability to fulfil its obligations as per the TOR within the total quoted price shall be that of the Consultant. The ‘Lowest Financial Proposal’ (FM) will be given a financial score (SF) of 100 points (that is 20 marks).

The Technical and financial bids will have an 80:20 weightage of marks respectively in the evaluation criteria. The Quality cum Cost Based System (QCBS) shall be followed to evaluate the bids.

The financial scores of other Proposals will be computed as follows:

(F = amount of Financial Proposal under consideration) 11.7 Combined and Final Evaluation

Proposals will finally be ranked according to their combined, technical (ST) and financial (SF) scores as follows:

S = ST x Tw + SF x Fw Where, S is the combined score, and Tw and Fw are weights assigned to Technical Proposal and Financial Proposal, which shall be 0.80 and 0.20 respectively.

11.7.1 The Selected Applicant shall be the first ranked Applicant (having the highest combined score). The second ranked Applicant shall be kept in reserve and may be invited for negotiations in case the first ranked Applicant withdraws, or fails to comply with the requirements specified in Clauses 9.8, 9.11 and 9.12, as the case may be.

11.7.2 UKFD reserves the right to modify the evaluation process / relax any criteria of

eligibility for the selection of consultants laid down in the EOI/RFP document, if felt necessary, without assigning any reason, whatsoever, and without any requirement of intimating the bidders of any such change.

12. Fraud and Corrupt Practices

12.1 The Applicants and their respective officers, employees, agents and advisers shall observe the highest standard of ethics during the Selection Process. Notwithstanding anything to the contrary contained in this RFP, UKFD shall reject a Proposal without being liable in any manner whatsoever to the Applicant, if it determines that the Applicant has, directly or indirectly or through an agent, engaged in corrupt practice, fraudulent practice, coercive practice, undesirable practice or restrictive practice (collectively the “Prohibited Practices”) in the Selection Process.

12.2 Without prejudice to the rights of UKFD under Clause 12.1 hereinabove and the rights

and remedies which UKFD may have under the LOA, if an Applicant or Consultant, as the case may be, is found by UKFD to have directly or indirectly or through an agent, engaged or indulged in any corrupt practice, fraudulent practice, coercive practice, undesirable practice or restrictive practice during the Selection Process, or after the issue of the LOA, such Applicant or Consultant shall not be eligible to participate in any tender or RFP issued by UKFD during a period of 3 (three) years from the date such Applicant or Consultant, as the case may be, is found by UKFD to have directly

or through an agent, engaged or indulged in any corrupt practice, fraudulent practice, coercive practice, undesirable practice or restrictive practice, as the case may be.

13. Miscellaneous

13.1 The Selection Process shall be governed by, and construed in accordance with, the laws of India and the Courts at Dehradun shall have exclusive jurisdiction over all disputes arising under, pursuant to and/or in connection with the Selection Process.

13.2 UKFD, in its sole discretion and without incurring any obligation or liability, reserves

the right, at any time, to: i. suspend and/or cancel the Selection Process and/or amend and/or supplement the

Selection Process or modify the dates or other terms and conditions relating thereto; ii. consult with any Applicant in order to receive clarification or further information iii. retain any information and /or evidence submitted to UKFD by on behalf of and /or

in relation to any Applicant; and /or independently verify, disqualify, reject and/or accept any and all submissions or other information and/or evidence submitted by or on behalf of any Applicant.

13.2 It shall be deemed that by submitting the Proposal, the Applicant agrees and releases UKFD, its employees, agents and advisers, irrevocably, unconditionally, fully and finally from any and all liability for claims, losses, damages, costs, expenses or liabilities in any way related to or arising from the exercise of any rights and/or performance of any obligations hereunder, pursuant hereto and/or in connection herewith and waives any and all rights and/or claims it may have in this respect, whether actual or contingent, whether present or future.

13.4 All documents and other information supplied by UKFD or submitted by an Applicant shall remain or become, as the case may be, the property of UKFD. UKFD will not return any submissions made hereunder. Applicants are required to treat all such documents and information as strictly confidential.

13.5 UKFD reserves the right to make inquiries with any of the clients listed by the Applicants in their previous experience record.

The UKFD may prescribe the template for submission of such progress reports from time to time as felt necessary by the UKFD.

All key Personnel shall necessarily furnish weekly work out-turn report to the UKFD, which will be reviewed by the DFO Narendranagar FD.

14. Availability of Consultancy Team The consultancy team shall be available in the office of DFO Narendranagar Forest Division, UKFD, Muni Ki Reti, Tehri on all the working days of Govt. of Uttarakhand, and on public holidays also as and when necessary as felt necessary by the UKFD. This is necessary since the agency needs to support the UKFD continuously throughout the consultancy period.

15. CONSULTANCY TEAM

The Consultant shall form a multi-disciplinary team (the “Consultancy Team”) for undertaking this assignment. The following Key Personnel whose experience and responsibilities are briefly described here in would be considered for evaluation of the Technical Proposal. Other expertise such as that required for green building solutions, lighting experts etc. for the Project shall be included in the Team either through the Key Personnel specified below or through other Professional Personnel, as necessary.

The Consultant shall establish a Project Office at a suitable location in or near Rishikesh where the Authority’s office or the Project is situated, for efficient and coordinated performance of its Services. All the Key Personnel shall be deployed at this office during the consultancy period forming part of the Agreement. The authorized officials of the Authority may visit the Consultant’s Project Office any time during office hours for inspection and interaction with the Consultant’s Personnel. It is not expected of the Consultant to carry out the operations from the Head/Home Office.

15.1 Reporting

i. The Consultant will work closely with the Authority. The Authority has established a Working Group (the “WG”) to enable conduct of this assignment. A designated Project Director of the Authority will be responsible for the overall coordination and project development. He will play a coordinating role in dissemination of the Consultant’s outputs, facilitating discussions, and ensuring required reactions and responses to the Consultant.

ii. The Consultant will make presentations on the Concepts and a Schematic stage for discussion with the WG at a meeting till the plan is finalized to the satisfaction of the Authority. The Consultant is required to prepare and submit a monthly report and describes, inter alia, general progress to date; data and reports obtained and reviewed, conclusions to date, if any; concerns about availability of, or access to, data, analyses, reports; questions regarding the TOR or any other matters regarding work scope and related issues; and so on. The Consultants’ work on the TOR tasks should continue while the report is under consideration and is being discussed.

iii. Regular communication with the WG and the Project Officer is required in addition to all key communications. This may take the form of telephone/ teleconferencing, emails, faxes, and occasional meetings.

iv. The Deliverables will be submitted as per schedule provided in this EOI/RFP.

15.2 Fees and Payment Terms

i. In financial EOI/RFP bid the intending bidders should clearly specify the total amount of fees (in Indian Rs.) payable by the Authority to the consultant, inclusive of all levies and taxes as per the latest taxes and rules applicable for the entire work as detailed in this document, inclusive of fees payable by the Consultant to any other sub- consultants and associates.

ii. The amount of fees for the consultant for the DPR as mentioned in the scope of work shall be paid in the stages as mentioned in schedule of payment.

15.3 Schedule of Payment

i. The fees for services of consultant shall be payable on lump sum basis.

ii. The fee for consultant for the above project shall remain unchanged for the present scope of work even if the total cost of the project increases/decreases subsequently subject to provisions under Clause 13 of Schedule I- Terms of Reference, for Additions and Alterations. Consultant’s Scope of Services is detailed in Clause 5 above (Schedule I).

iii. UKFD shall pay consultant the fee (as defined in chapter) for the professional services rendered by them for the entire project as per scope of work defined in the document. The quoted fee should be inclusive of all taxes and the costs towards the whole project and no hidden costs/exclusions should be appended.

iv. The consultant shall be paid professional fee in the following stages consistent with the work done plus other charges and reimbursable expenses as agreed upon.

Retainer On appointment/ Signing of Agreement/ Acceptance of offer.

Note: 1. The payment against the above stages can be released on pro rata basis periodically to

be decided by UKFD based on the actual work done against the total work stipulated in the stage.

2. In case the project is dropped due to any reason, then the fees payable till that stage only after deducting the full prize money shall be paid and nothing extra will be paid and no claim in this regard shall be entertained.

3. In case of any doubt or ambiguity, UKFD shall have the right to get it checked from

any third-party expert.

15.4.1 Additions and Alterations: 15.4.1 The Authority shall have the right to ask in writing changes, additions, modifications

or deletions in the design and drawing of any part of the work and to request in writing auditioned work in connection herewith and the Consultant shall comply with such request. That if the Authority deviates substantially from the original scheme which involves for its proper execution, extra services, expenses and extra labor on the part of the Consultant for making changes and additions to the drawings, specifications or other documents due to rendering major part or the whole of their work in fructuous, the Consultant may then be compensated for such extra services and expenses on quantum merit basis at percentage applicable under their agreement and to be determined mutually unless such changes, alterations are due to the Consultants own commission and / or discrepancies including changes required at the time of approval at various Forums and due to changes required by the Consultants of all internal, external utilities and services. The decision of the Authority shall be final on whether the deviations and additions are substantial and require any compensation to be paid to the Consultant. However, for any modification or alteration which does not affect the entire design, planning, etc., no amount will be payable.

15.4.2 Consultant shall not make any material deviation, alteration, addition to or omission from the work shown and described in the contract document except without first obtaining the written consent of the Employer.

16. TIME OF COMPLETION OF THE PROJECT The consultant shall be associated with the project till the completion. However, the consultant shall adhere to the time schedule as given below:

3. This statement is made for the express purpose of appointment as the Consultant for the aforesaid Consultancy.

AGREEMENT

Shiwalik Biodiversity Park, Muni Ki Reti, Tehri Garhwal, Uttarakhand.

This AGREEMENT (hereinafter called the “Agreement”) is made on the day of the month of 20…, between, on the one hand, the [Vice Chairman DDA India acting through ……………………….] (hereinafter called the “Authority” which expression shall include their respective successors and permitted assigns, unless the context otherwise requires) and, on the other hand, …………………………………. (herein after called the “Consultant” which expression shall include their respective successors and permitted assigns). WHEREAS The Authority vide its Request for Proposal for Preparation of Landscape development (hereinafter called the “Consultancy”) for the ‘Shiwalik Biodiversity Park, Muni Ki Reti, Tehri Garhwal, Uttarakhand (hereinafter called the “Project”); The Consultant submitted its proposals for the aforesaid work, whereby the Consultant represented to the Authority that it had the required professional skills, and in the said proposals the Consultant also agreed to provide the Services to the Authority on the terms and conditions as set forth in the RFP and this Agreement; and The Authority, on acceptance of the aforesaid proposals of the Consultant, awarded the Consultancy to the Consultant vide its Letter of Award dated .................. (the “LOA”); and in pursuance of the LOA, the parties have agreed to enter into this Agreement.
