Application Guidelines

Foreword

This booklet, “One-stop Service for Licensing of Food and Beverage Establishments - Guidelines for Applications”, has been published to give investors wishing to establish a food and beverage establishment in the Macao Special Administrative Region (MSAR) a clear and thorough understanding of the issues of concern and requirements relating to procedures for opening and licensing food and beverage (hereinafter referred to as F & B) establishments, thus avoiding wasted time due to insufficient documentation or disqualification of construction work, and to enable the investor to obtain a licence and commence business speedily. To accomplish the above-mentioned purposes, the One-stop Service focuses on the various phases of operating an F & B establishment, from the preparatory stage before opening, application for a licence, site construction and inspection, and licensing, through to the operating stage, including details of procedures for applying for a licence, services provided by relevant departments, issues relating to the selection of the site before opening, specifications of public safety, and sanitary conditions involved in decorating and installing facilities, criteria for documentation, authorities and responsibilities of relevant departments, criteria for inspection, penalties for violating relevant laws and regulations, etc. This booklet is divided into four sections: (1) Introduction to the One-stop Licensing Service for Food and Beverage Establishments, (2) Arrangements for Applying for Food and Beverage Establishment Licences, (3) Penalties for Violating Relevant Laws and Regulations and (4) Attachments. The content of this booklet is based on current laws regulating building structures, fire control, public safety and sanitary conditions. However, it does not cover in detail all the laws and regulations governing food and beverage establishments. Individuals wishing to obtain more detailed information about such regulations should refer to the relevant laws and regulations listed in Attachment 1. One-stop Licensing Service for Food and Beverage Establishments Introduction

1. Principles In order to meet the demands of social development and create better conditions for investors, and to encourage the development of food and beverage (F & B) establishments, the Chief Executive of the Macao SAR enacted Administrative Regulation No. 16/2003 on 7 July 2003. The amendments to categories 4 and 5 of Decree Law No. 16/96/M governing the licensing procedures of F & B establishments are thus officially approved, and the “One-stop Licensing Service for Food and Beverage Establishments” has come into effect. As the organisation offering the “one-stop service”, the IACM is responsible for dealing directly with all applications for obtaining licences, and assisting applicants with processing the required documents and drawings, as well as the procedures involving other relevant public authorities. This simplifies administrative procedures, speeds up the process of issuing licences, increases the transparency of public administration and enhances the quality of service, thus fulfilling the IACM service pledge - “For the People”.

2. Scope of Services

As the organisation offering the “one-stop service”, the IACM does not deal with every application for licences in all categories of F & B establishments; only those covered in Categories 4 and 5 specified in Decree Law No. 16/96/M, including: 1) Category 4 – F & B establishments that mainly provide beverages and simple

dishes, such as coffee shops, ice-cream parlours, tea rooms, etc.; 2) Category 5 – F & B establishments that offer catering services and facilities and

equipment that satisfy the basic requirements for catering services, but excluding the requirements for restaurants, such as congee and noodle shops and food establishment.

3. Features of Services

The One-stop Licensing Service aims to provide the followings: 1) Offer clear information and technical assistance – These include the relevant

information contained in this booklet, display unit and short video. Complex project issues will be resolved through technical meetings between applicants and technicians from relevant departments. These meetings will aim to enable applicants to understand the details of the application procedure and the detailed technical requirements.

2) Centralised procedures processed by one organisation – Once authorised by the

applicant, the IACM will provide assistance with all application procedures, including applications for relevant documents from other departments (such as property registration reports, certified copies of the permit of use for the property, drawings, project permits, provisional operation permits for electrical installations, etc.). The IACM will also keep applicants informed of the progress of their applications and actions to be taken to meet the application requirements, in order to save applicants time in dealing with various departments and enable them to have a clearer idea of the status of their application.

3) Reduced set-up costs by speeding up the licensing process – Provided the

applicant submits all the required documents on the designated date, the licence will be issued in not more than 60 working days from the date of the application, excluding the construction period. In addition, if the establishment’s operation will not pose any risk for the public safety, public health and the environmental protection, a provisional licence will be issued to enable the applicant to commence business as soon as possible, in order to minimise financial losses.

4) Increased flexibility of licensing procedures – If the licensing process is

terminated for any reason, it can be resumed within a specified time, provided that the conditions for reapplication are fulfilled.

4. Application Procedures

The One-stop Licensing Service is mainly divided into the pre-application stage and the application stage. Please refer to the flow chart for further information:

4.1 Pre-application Stage The IACM provides detailed information concerning the One-stop Service and relevant documents required by the following means, thus enabling the applicant to clearly understand the procedures and therefore obtain the F & B Licence swiftly:

1) If the investor wishes to have a better understanding of the licence application procedures, he or she may visit the One-stop Service Organisation - the IACM - in person to obtain information handouts and pamphlets. In addition, the applicant may also consult IACM staff about the legal requirements for opening F & B establishments, criteria for submitting documents and relevant technical issues, licensing procedures, licence fees and payment methods.

2) Once the applicant files an application, the IACM will provide him or her with an

application form (Form A) and assist with completing the form correctly. The applicant may also authorise the IACM to undertake all application procedures, including applying for relevant documents and drawings from other relevant departments (e.g. a property registration report, plan drawing, sectional drawing and elevation drawing of the building) which are used as references in designing the project. All drawings must be officially compiled by an architect, civil engineer or technician, electronic or mechanical engineer or technician, fire-prevention company, contractor or construction company registered at the Land, Public Works and Transport Bureau, and the signatures of the applicant and the technician must be attached. For relevant criteria, please refer to Articles 1.3 and 1.4 of Section Two of this booklet.

3) If the project involves more complex technical problems, the applicant can raise

these issues in writing with the IACM and request a technical meeting. If the application is accepted, the IACM will arrange a meeting. The applicant will be asked to present at the meeting, accompanied by a technician, and representatives from the relevant departments will give detailed technical suggestions at the meeting. A maximum of three technical meetings can be arranged for each applicant. The first meeting is free of charge, while the second and the third are chargeable according to Table 5 of this booklet.

4) Upon obtaining the F & B Licence, the IACM will assist the applicant in

processing other pre-opening procedures, such as registration for corporate tax and occupational tax with the Finance Services Bureau, notifying the Social Security Fund of the list of employees, and so on. The IACM may also provide assistance in completing relevant forms, such as those related to the above-mentioned procedures.

4.2 Application Stage

The application stage starts after the applicant submits the application. The procedures include:

1) Upon receiving the application, the IACM is to send, on the same day or the next

working day, copies of the application form (Form A) and attached documents to the Lands, Public Works and Transport Bureau, the Fire Services, the Health Bureau and/or Cultural Institute, the Labour and Employment Bureau, and the Inspection Commission of Combustible Products and Installations, for their examination and approval. If the electricity consumption of the establishment exceeds 13.2 KVA (3 X 30A), the applicant is required to apply for a provisional operating permit for the electrical installation, in order to apply for the installation of a suitable watt-hour meter by the CEM. If it is not necessary for the IACM to apply on his or her behalf for the provisional operation permit for electrical installation, the applicant must state this clearly in the declaration of authorisation or specify it in Form A; otherwise the IACM will apply on his or her behalf for a relevant permit from the Lands, Public Works and Transport Bureau. At that time, the applicant must submit Form A, together with relevant drawings and the memorandum of construction specifications. The valid period of the permit should be stated in the memorandum. Once it is approved, the applicant will be granted the permit within 10 working days from the date of application.

2) If the relevant departments determine that the information provided in Form A and its attachments is erroneous, the IACM is to inform the applicant within 7 working days after passing the application to the relevant departments for review. The applicant must then submit corrected or required information within the specified time; otherwise the application process will be temporarily terminated 30 days after the designated date. The IACM will then notify the applicant of the decision made. The applicant may resume the application, subject to additional charges, within 6 months of receiving the notification. In addition, the fee paid by the applicant will not be refunded in the event of the termination and withdrawal of the application. If the documents submitted meet the stated requirements, the IACM will deliver the applicant the “project permit” issued by the Lands, Public Works and Transport Bureau within 25 working days after passing the application to the relevant departments for examination, provided that relevant fees are paid in full. If the application is rejected, the IACM is to inform the applicant by the said date, so that he or she can make relevant corrections or improvements by the designated date.

Upon receiving the project permit, the applicant must submit to the IACM the application form for commencing construction work within 15 days and purchase a construction record book. This enables the IACM to notify the Lands, Public Works and Transport Bureau to assign an inspector to make arrangements with the technical engineers to sign the permission statement at the site. The applicant may start the decoration or renovation work before then, in accordance with the approved plans and the suggestions and conditions provided by the relevant departments.

3) During the decoration or renovation period, if the need to modify the approved

project plan arises, the applicant must notify the IACM. If the altered plan is believed to affect public safety and health, the environment, and/or cultural heritage, the IACM will consult relevant departments for their technical opinions before making decisions on approving the said modifications.

4) The applicant should complete the construction work before the permit expires,

and must apply for inspection upon completion of the work. The applicant should also submit the construction record book to the IACM before the permit expires; otherwise the IACM will temporarily terminate the application process and inform the applicant 30 days after the permit expires. When the application is terminated, the applicant may resume the application subject to additional charges within 6 months upon receiving the notification. In addition, the applicant is not entitled for any refund of fees due to the termination and withdrawal of the application. The IACM will fix a date for the site inspection and issue a bill of charges to the applicant within 3 working days of receiving the notification of completion of work. The site inspection will be carried out within 15 working days upon receiving the application, and the IACM must inform the applicant of the exact inspection date at least 5 working days before the date of inspection. The applicant may request a change of the inspection date due to acceptable reasons. The IACM is to set another date of inspection within 15 working days upon receiving such a request, and inform the applicant of the exact date of the new inspection at least 5 working days in advance.

5) On the day of the site inspection, the applicant (or his or her agent) must be present

at the site with the relevant technicians. If the Inspection Committee believes after the inspection that the construction work totally fulfils the requirements of the approved drawings and instructions of relevant departments and that all the facilities and installations of the establishment are in line with the lawful criteria, the IACM will grant the applicant an official F & B Licence within 8 working days from the date of inspection. Applicants who do not entrust the IACM to undertake the business registration procedure must submit the business registration form to the Finance Services Bureau before obtaining the official F & B Licence.

6) If the Inspection Committee believes that the construction work fails to meet the requirements, the applicant will not be granted the F & B Licence. If the improvement issues will not pose any risks to the public safety, public health and environmental protection, the applicant will be granted a provisional licence within 8 working days from the date of inspection, on condition that the applicant will implement measures to improve the situation and observe various restrictions and conditions stated in the provisional licence. The applicant must apply to the IACM to arrange a re-inspection 15 working days prior to the expiry date of the provisional licence. Each re-inspection is subject to additional charges.

7) If the construction work of the F & B establishment neither meets the requirements

nor possesses the conditions for obtaining a provisional licence after inspection, relevant improvements must be made according to the suggestions of the Inspection Committee. The applicant must notify the IACM to arrange a re-inspection 15 working days prior to the expiry date of the provisional licence and pay additional charges for each re-inspection.

If the re-inspection is approved, the IACM will grant the official F & B Licence within 8 working days from the date of re-inspection. Applicants who do not entrust the IACM to undertake the business registration procedure must submit the business registration form to the Finance Services Bureau before obtaining the official F & B Licence.

8) The establishment can be opened for business only after the official F & B Licence

Arrangements for Applying for Food and Beverage Establishments Licence 1. Preparatory Stage

Before opening an establishment for F & B services, the investor must understand and observe the relevant laws and regulations relating to the site, its surrounding environment and fire control requirements, as well as public health and safety. The investor should also ensure that the relevant technicians understand and carry out the design and construction project accordingly. Only by so doing can the investor obtain the F & B Licence within the shortest possible time. Below is a detailed outline of notes for attention. For enquiries about these, please contact the IACM - One-stop Service Organisation.

1.1 Selection of Premises

The investor must pay attention to the following instructions when selecting a site:

1.1.1 Basic Requirements for Sites of Food and Beverage Establishments 1) The premises must be a completed building or construction unit with a property

certificate clearly stating that the property is for commercial use, or with certificates from the Lands, Public Works and Transport Bureau clearly stating that the property may be used for a F & B establishment; if the site happens to be situated within the vicinity of the four classified cultural heritage preservation areas listed in Attachment 6 in Section Four, namely: classified memorial sites, buildings of architectural value, complexes and other classified sites, and the project involves internal decoration or construction work on the building, approval must be sought beforehand from the relevant departments through the IACM, provided that the project will not damage the structure, outlook and surrounding landscape of the classified buildings. When mapping out the designs of the F & B establishment, the principles of respecting and preserving cultural heritage and urban landscaping, as well as making full use of the potential value of the cultural heritage, should be upheld;

2) The premises must be legally constructed; 3) Approval must be sought from the property owner for legal renovation; 4) A power supply must be available; 5) A water supply and well-equipped drainage and sewage systems must be

available; 6) Sufficient emergency exits must be available; 7) The floor area must be large enough to set up five functional areas - the catering

area, sanitary facilities, kitchen, storage room or warehouse and refrigeration facilities (cold storage, freezer, and/or refrigerators) - and it must be consistent with the maximum accommodation capacity;

8) Adequate distance must be kept between the exhaust gas outlet and neighbouring buildings to allow cooking fumes to dissipate;

9) Adequate space and easy access must be available for installing air-pollution control equipment;

10) Sufficient concealed space (such as a machinery room) must be available to install noisy equipment, especially when such equipment will still be in use at night;

11) Proper space must be available to install high-volume grease interceptors; 12) Enough room and facilities must be available to store and transport waste; 13) Public health and safety requirements must be met; 14) The establishment must be sufficiently far away from any animal rearing area or

other place that may affect its hygienic conditions; 15) The clearance height of the establishment or the height from the floor to the

suspended ceiling must be at least 2.6 m. If an air-conditioning system is to be installed to maintain air circulation and freshness, an allowance of 5 cm is permitted; and

16) If a consecutive suspended ceiling is to be installed, the upper space of each partition must not be connected with those of the adjacent partitions.

1.1.2 Establishments that Will Not be Granted a Licence 1) Sites not zoned for commercial use (e.g. office buildings, factories, workshops,

etc.); 2) A unit of an industrial building (except the ground floor); 3) A unit on the second level of a basement or below; 4) Sites for residential use, including those for temporary residential purposes; or 5) Locations where the facilities or actual operations of the establishment may

cause inconvenience or harm to a third party.

1.2 Notice of the Number of Employees

The investor may legally employ a necessary number of workers to work at the establishment. There is no limit on the number of employees. However, if the number of employees exceeds 30, the investor must consult the relevant departments through the IACM and carry out a safety inspection of the establishment.

1.3 Specifications of Drawings and Documents Required

All the drawings must be officially compiled and designed by architects or civil engineers or technicians, electronic or mechanical engineers or technicians, a fire control company, a contractor or a construction company registered at the Lands Public Works and Transport Bureau, and they must be submitted with the signatures of the applicant and the technicians who will bear the responsibility for any alterations of the specific site. The drawings are intended to assist the relevant departments in analysing the layout, partitions and installations of the site, and ensure they are in line with the relevant regulations. The following are the classifications and specifications of the required drawings and documents.

For further information, please refer to articles 1.3 and 1.4 in Section Two and clauses 3 and 4 of Section Four of this booklet. 1.3.1 Drawings for Restructuring Projects

1) Location map in 1:1000. 2) Plan drawing, elevation drawing and sectional drawing in 1:100, including:

� Approved original drawings (attached to certified copies of construction drawings issued by the Land, Public Works and Transport Bureau)

� Modified drawings � Overlapping drawings (the modified sections should be in red and the

dismantled sections in yellow). The following information must be included in the above-mentioned drawings: 1) Areas for cooking, preparing and processing food; 2) Dining areas; 3) Layout of dining tables and other equipments (e.g. seats, refrigerators,

cashier counters, storage cabinets and stoves); 4) Washrooms; 5) All entrances and exits and internal passages; 6) All windows, air/smoke exhaust and ventilation outlets, exhaust pipes,

ventilation pipes and air-conditioning facilities; and 7) The clearance height of the site and the stairs, the functions and area of each

partition.

1.3.2 Drawings of Fire Control Facilities and Fire Control System Design

1) Plan drawing of fire control facilities in 1:100 clearly indicating the locations of all equipment installed (e.g. extinguishers, emergency exit signs, emergency lights, etc.).

2) If the establishment already has a fire control system installed, drawings of the design of the fire control system in 1:100 are required (the various diameters of pipes should be marked in different colours, according to the regulations).

The fire control facilities and the fire control system may both be shown in the same drawing.

1.3.3 Drawings of Water Supply System

1.3.4 Drawings of Drainage and Sewage System, Detailed Drawings of Grease

Interceptors and Structural Foundation Plans 1) Plan drawings of drainage and sewage system in 1:100 (attached to certified

copies of the drawings of the drainage and sewage systems of the building issued by the Lands, Public Works and Transport Bureau).

2) Detailed drawings of the grease interceptor: top view, plan and section. 3) The plan and sectional drawings of the foundation structure of the site in

1:100 (attached to certified copies issued by the Lands, Public Works and Transport Bureau).

4) The basement plan of the site in 1:100 (if the F & B establishment includes a basement, the certified copies of the underground plan issued by the Lands, Public Works and Transport Bureau should be attached).

The above-mentioned drawings should clearly indicate the following information:

1) The water supply, drainage and sewage systems, the sewage water collection capacity and connections of the grease interceptor.

2) The directions of flow of pipes, the inlet and outlet positions of the grease interceptor, and the sand-trap clearance height of the sewage system of the building.

1.3.5 Drawings of Structural Designs (required only when a restructuring project is implemented)

1) Plan drawing in 1:100; 2) Sectional drawing in 1:10 or 1:20.

1.3.6 Wiring Diagram of the Main Switchboard of the Electrical Installation

(required only when applying for a provisional operation permit for the electrical installation)

Plan drawing of the wiring of the main switchboard of the electrical installation – clearly showing wires connecting to the main switchboard and the capacity of each wire.

1.3.7 Completion of Application Forms and Specifications of Documents

1) Form A, provided by the IACM free of charge, must be completed in the proper

way together with accurate and complete information. 2) The declaration of authorisation, provided by the IACM free of charge, must be

completed with the relevant information, so that the IACM can undertake the application process as entrusted.

3) The applicant’s identification documents should be as follow:

� If the applicant is a natural person (an individual), a copy of his or her personal ID is required;

� If the applicant is a legal entity (a company), a valid registration certificate issued by the Commerce and Movable Property Registry is required. If less than 15 days have elapsed since the registration date of the company, a copy of the letter of approval or a copy of the “Macao SAR Government Bulletin” containing the letter of approval is required; and

� If the applicant has entrusted an agent to handle the application procedure, a copy of the personal ID of the agent and a letter of authorisation from the applicant is required in order to safeguard the interests of the applicant.

4) On behalf of the applicant, the IACM must apply for the following documents to be attached to Form A from the relevant departments (these are subject to certain charges detailed in Table 5): � Valid documents relating to the use of the establishment issued by the Lands,

Public Works and Transport Bureau: - Certified copy of the drawing of the drainage and sewage systems of the

building; - Certified copy of the plan and sectional drawings of the foundation

structure; - Certified copy of the drawing of the construction plan; - Certified copy of the drawing of the basement (required only when the F

& B establishment includes a basement); and - Copies of other verified documents.

� Valid documents relating to the use of the establishment issued by the Property Registry: - A written report of the property registration.

5) The following documents must be submitted together with the drawing of the

restructuring project, and the relevant requirements must be fulfilled: � Specifications of the restructuring project which outline the content of the

project, including modified partitions and their functions, plans of modifications of the water supply and drainage systems, installation of fire control equipment and other facilities, and the construction materials used.

� Declarations of responsibility are required and must be signed respectively by the project planner, project director and project engineer, who must either be technicians or contractors/construction companies registered with the Lands, Public Works and Transport Bureau. Samples of declarations of responsibility are provided in Section Four of this booklet.

� Originals or certified copies of project insurance policies must be submitted for the issuance of the project licence. The project insurance policies must clearly state the name of the applicant or the contractor or construction company responsible for the project, as well as its location, description, and duration.

� The applicant and designer must sign the above-mentioned documents.

6) A memorandum of the electrical installation project must be provided together

with a wiring diagram of the main switchboard of the electrical installation. The valid period of the provisional operation permit for electrical installation will depend on the applicant’s request, which must be clearly stated in the memorandum. Only establishments whose electricity consumption will exceed 13.2 KVA (3 X 30 A) are needed to apply for a provisional operation permit for electrical installations.

7) The menus of F & B establishments must list the varieties of food and beverages and their corresponding prices.

8) If the establishment has installed a fire control system, relevant proposals and the valid maintenance certificate must be submitted together with drawings of the fire control system for declarations of responsibilities. The relevant proposals must include full details about the project plan and various installations in the F & B establishment.

9) If the establishment is to undergo structural changes, explanatory notes about the relevant design, calculations and Declaration of Responsibility by the project planner must be submitted together with the drawing of structural design.

1.4 Requirements for Relevant Projects and Facilities

The standards of the structure, fire control facilities, public health and safety of F & B establishments are regulated by the Macao SAR Government. The required specifications are based on current laws and regulations, and these can be referred to in Attachment 1 of Section Four of this booklet. Briefly, these are as follows.

1.4.1 Construction Design 1) The minimum live load of the establishment’s structure should be 4.0 kN/m2. If

the establishment is to undergo structural changes, structural plans must be provided by civil engineers or technicians registered at the Lands, Public Works and Transport Bureau, to prove that the building structure will be safe for use.

2) Where establishments can accommodate more than 50 persons but less than 100, at least two exit doors must be installed. The width of an individual exit must be not less than 85 cm, while the total width of the exit doors must be not less than 180 cm. If a double-leaf door is installed at the exit, the width of each door must be not less than 60 cm.

3) If the establishment can accommodate 50 persons or less, the width of the exit should not be less than 90 cm.

4) The exit door/s must open (open outward refers to how the door is opened, not an action) outwards and these must not obstruct pedestrian pavements or public roads.

5) If there is no choice of exits for evacuating the establishment, the maximum

distance to the emergency exit should be not more than 30 m. If there is a choice of exits for evacuation, the maximum distance to the aforesaid should be not more than 45 m.

6) Protruding objects on the outer wall, such as decorations, smoke extraction pipes or air conditioners, should be within 50 cm and 70 cm respectively from the attached wall. The above-mentioned protrusions should be at least 2.7 m. and 3.5 m, respectively above the pedestrian pavement. For establishments in NAPE, any protruding object should be not more than 10 cm from the attached wall.

7) The width of stairs inside the establishment should be no less than 1.0 m. and must not be of a spiral shape. The above-mentioned condition can be exempted if the stairs lead only to a storage room or an unoccupied area.

8) The depth of each tread of the stairs should be no less than 23 cm, and each riser height should be not more than 18 cm.

9) The clearance height of the stairs for public use should be no less than 2.2 m. 10) The clearance height of the kitchen should be no less than 2.6 m. Kitchens located

in the upper part or lower part of an attic that was already in use when the building was constructed should have a clearance height of not less than 2.2 m.

11) The clearance height of passages, and sanitary facilities should be no less than 2.2 m., except for installations on the upper or lower part of an attic that was already in use when the building was constructed.

12) Any zones of the establishment can be used only for storage purposes if their clearance height is less than 2.0 m. Only if the clearance height is 2.6 m or above can they be opened to the public or customers.

13) All functional areas of the establishment should be delineated and independent, in order to avoid confusion affecting food and environmental hygiene.

14) Decorations, such as suspended ceilings, which are difficult or impossible to inspect and clean, should not be installed in the kitchen and storage rooms.

15) The kitchen should be separated from other areas with a brick wall and a floor with 60-minute fire-resistance capability (CRF 60), together with a solid wooden door at least 4.5 cm thick and equipped with an automatic door-closing function and with a 30-minute fire-resistance capability (CRF 30).

16) The serving hatch area (the opening in the wall for delivering dishes) between the kitchen and dining area should not be bigger than 0.2 m² and have a 30-minute fire-resistance capability (CRF 30), and a manual or automatic fire damper should also be installed between the two zones (as required by the Fire Services).

17) The air-extraction/smoke-extraction/ventilation pipes of the establishment should be constructed and installed with non-flammable materials, and they should not impede the operation of the automatic fire extinguishing system.

18) If the pipes need to pass through partitions or units of different functions, they must be made of materials with a 60-minute fire resistance capability (CRF 60) (as required by the Fire Services).

19) If the air-extraction/ventilation pipes need to pass through partitions or units of different functions, they must be made of materials with a 60-minute fire resistance capability (CRF 60)

20) If the establishment’s kitchen is used only for cooking congee and soup noodles using 20 litres of kerosene, diesel or electricity, the above-mentioned requirements in points 15-16 are exempted (as required by the Fire Services).

1.4.2 Construction Materials 1.4.2.1 The Ceiling 1) If the partition walls, ceiling and decorations are made of flammable materials,

they should be fully protected by recognised fire-resistance products (F.R.P.) to raise their fire-resistance capability and reduce their flammability.

2) The ceilings of all partitions (e.g. kitchens, storage, washrooms, dining areas, passages or any other partitions) must be covered with strong, non-flammable and anti-corrosive materials that are easy to clean and sterilise. Decorative installations that are difficult or impossible to inspect and clean, such as suspended ceilings, are not recommended for sanitary reasons. To ensure facilities in places other than the kitchen and the storage room comply with guaranteed hygienic standards, the relevant facilities must be stated clearly in the application form for licensing. District health inspectors will give advice according to individual situations.

1.4.2.2 The Floor 1) The materials used for laying the floor of the establishment must be flat, non-

slippery, durable, water-resistant, non-flammable, anti-corrosive and easy to clean and sterilise.

2) If the floor is to be carpeted, a sample piece of the carpet must be sent to the Fire Services for testing; or it should be properly treated with the necessary fire-resistance measures by being coated with a fire-resistant substance supplied by a qualified fire control company, who will submit a valid certificate concerning the product being used (as required by the Fire Services).

1.4.2.3 The Walls and Stairs

1) The establishment’s additional partition walls must be made of non-flammable

materials; or else the materials must be treated with a fire-resistant substance supplied by a qualified fire control company, who will submit a valid certificate of the product in use. They should not impede the operation of the fire control system or block access to emergency exits (as required by the Fire Services).

2) All the establishment’s internal walls must be covered with flat, strong, non-flammable, anti-corrosive materials that are easy to clean and sterilise.

3) The walls of the kitchen, washrooms and passages leading to them must be covered with strong, water-resistant, non-corrosive, non-slippery and easily cleaned materials (such as tiles and marble) from the floor to the ceiling. The boundaries between walls and floors or other walls should be arc-shaped.

4) Stairs leading to the attic or basement of the establishment should be made of Grade M0 (non-flammable) fire-resistant materials. If the attic is only used for storage or accommodating people, this requirement may be waived.

1.4.3 Fire control System 1) The design and installation of the fire control system must be carried out by

one of the followings: a registered civil, electronic or mechanical engineer or project technician, or a registered fire control company, and in accordance with instructions stipulated in the “Safety Regulations for Fire Prevention”; the said facilities must be inspected and tested by personnel from the Fire Services before being put into use.

2) If a fire control system (a fixed automatic extinguishing system, automatic fire-detection system, fire hose, etc.) is already installed, it must be maintained by a qualified personnel to ensure the specified output pressure and water flow.

3) If a fire control system is not installed, the following installation instructions must be followed: � If an F & B establishment forms part of a building: If the total area

exceeds 400 m² or the total volume of space exceeds 1,400 m³, a fixed automatic fire-extinguishing sprinkler system must be installed. If the total area is more than 200 m² and less than or equal to 400 m², or the total volume of space is more than 700 m³ and less than or equal to 1,400 m³, an automatic fire-detection system must be installed (as required by the Fire Services).

� If an F & B establishment is an independent building: If the total area exceeds 2,000 m² or the total volume of space exceeds 7,000 m³, a fixed automatic fire-extinguishing sprinkler system must be installed. If the total area is more than 800 m² less and less than or equal to 2,000 m², or the total volume is more than 2,800 m³ but less than or equal to 7,000 m³, an automatic fire-detection system must be installed (as required by the Fire Services).

4) A constantly illuminated safety sign (with a green background and white patterns or characters, or with a white background and green patterns or characters) and emergency lighting must be placed on a permanent basis above all exits (evacuation passages) of the F & B establishment. The directions should be clear and easy to understand, and guide people to exits without misdirecting them (as required by the Fire Services).

5) The required number of fire extinguishers must be installed in the F & B establishment. Each establishment should be equipped with at least two fire extinguishers, so that the nearest fire extinguisher is less than 15 m. from any given spot (as required by the Fire Services).

6) An alarm system must be installed in the F & B establishment for the purpose of alerting the public in different locations within the establishment if there is a fire. If the establishment is already equipped with a fire-hose system (and fire alarm), it shall be exempted from this requirement (as required by the Fire Services).

1.4.4 Electrical installations 1) Electrical systems installed in the F & B establishment should be of low-fire

risk and unlikely to spread a fire. 2) All food and beverage preparation equipment in the beverage bar of the F & B

establishment should be powered by electricity, and it should be operated in accordance with the safety instructions.

3) The electricity meter should be installed in an insulated metal box and be kept clean at all times.

4) Appropriate sections of the electrical system should be installed with efficient and automatic on/off switches or additional installations, such as, a circuit breaker, fuse, automatic short-circuit protection switch, etc.

5) All electrical appliances must be properly earthed. 6) All electrical installations (inclusive of cables, wires, plugs and plug sockets)

must be kept in good and tidy condition. 7) Electrical appliances with a voltage of 220V or more must not be used in damp

places; waterproof sockets with proper covers should be used in such locations.

1.4.5 Machinery 1) Dangerous machine parts must be properly covered to safeguard users. 2) Operating and safety instructions must be clearly visible. 3) All machinery must be regularly inspected and maintained.

1.4.6 Dish-serving Elevators and Fish Tanks/Ponds for Keeping Fresh and Live Seafood for Sale

1.4.6.1 Dish-serving Elevators 1) Dish-serving elevators (Dumb-waiter) installed between the kitchen and other

parts of the F & B establishment will greatly increase the possibility of the spread of fire. The openings of their elevator shaft must be covered with proper structures to prevent the spread of fire, and the spread of smoke in case of fire.

2) A safety control with an interlocking design must be installed. 3) A safety signal system must be installed to enable communication between all

floors. 4) Dish-serving elevators must be regularly inspected and maintained. 5) Dish-serving elevators must be made of water-resistant metal and must be easy

to clean. All partition boards must be easy to clean and dismantle. 6) The safety operating instructions of the dish serving elevators must be clearly

visible. 7) If the F & B establishment has only one elevator installed, it must be used

solely for transportation of food and/or clean utensils; or it can be divided into two parts, with the upper part for food and clean utensils and the lower part for food waste or dirty utensils.

8) If the F & B establishment has more than one elevator installed, each elevator must be clearly marked with its specific function; for example, labels such as “food and clean utensils only” or “dirty utensils only” placed in a visible spot on the elevator.

1.4.6.2 Fish Tanks/Ponds for Keeping Fresh and Live Seafood for Sale 1) Fish tanks and ponds must be installed and fixed inside the establishment and be

easy to clean and maintain, so as to avoid creating public health problems outside the establishment.

2) The bottom and surface area of the fish tanks and ponds must be made of flat and smooth, strong, water-resistant and anti-corrosive materials that are easy to clean and sterilise.

3) Fish tanks and ponds must be connected to the public water supply network (i.e. tap water).

4) Sufficient clean and dry space must be left between the fish tank or pond and neighbouring areas used for storing cleaning and maintenance equipment, such as accessories for the fish tank or pond filtering system, brushes solely used for cleaning fish the tank or pond, high-pressure water taps and cleaning gloves. Such areas or spaces should be provided inside the establishment, and should not be linked with the outside environment of the establishment.

5) The mouth of the tank must face the shop, to prevent the drainage of sewage into the public street. (IACM requirement).

6) If the requirement stated in the above Clause 5 cannot be fulfilled, and the mouth of the fish tank or pond must face the street, sufficient space must be kept between the tank and public street, and an open drainage system must be installed for disposing of sewage. (IACM requirement).

1.4.7 Fuel System 1) The storage room of the F & B establishment must not contain high-risk

products (e.g. LPG, kerosene, diesel, etc.), and no activity that may easily cause a fire may be carried out there (as required by the Fire Services).

2) All flammable objects, such as LPG and kerosene, must be stored and protected properly in non-flammable and ventilated partitions (as required by the Fire Services).

3) If the kitchen is constructed with strong fire-resistant walls and doors, LPG and liquefied fuel (kerosene or diesel) may be used there. Under no circumstances should the quantity of LPG in the kitchen exceed 22 kg (two 11-kg containers, whether full or empty), and these fuel containers and the stove must be completely separated. The quantity of liquefied fuel (kerosene or diesel) should not exceed 22 litres (4 gallons) and its container should be placed in an enclosed pit.

4) The kitchen of any establishment that is located in a basement is forbidden to use LPG fuel.

5) If the F & B establishment adopts a centralised fuel supply system, the following instructions must be observed: � The design of the storage for LPG cylinders must meet the requirements of

the “Safety Regulations for Fire Prevention” of Decree Law No. 24/95/M of 9 June 1995, and the Macao SAR Administrative Regulation No. 28/2002 of 16 December 2002 – Safety Regulations for the Storage of Liquefied Petroleum Gas (LPG) with a Maximum Capacity of 200m3 per Container.

� The design of storage for diesel must meet the requirements of the “Safety Regulations for Fire Prevention” approved by Decree Law No. 24/95/M of 9 June 1995, and “Regulations for Storage and the Supply System for Category III Liquefied Fuel in Buildings” promulgated by the Inspection Commission of Combustible Products and Installations on 8 October 1992.

6) The switch of the fuel supply system must be marked clearly. 7) The LPG cylinder must be placed vertically and in a stable position. 8) All parts of the LPG cylinder (nozzle, valve and pressure reducer) must be kept

clean and in good condition. 9) The LPG cylinder and its nozzle must be appropriately labelled. 10) The fuel supply system, LPG cylinders and their parts must be inspected on a

daily basis.

1.4.8 Management of Chemicals for Cleaning and Sterilisation.

To clean and sterilise the establishment, an appropriate quantity of relevant chemicals may be stored there, but attention is drawn to the followings:

1) Cleaning and sterilising chemicals must be stored at a safe distance from flammable items, high temperatures or damp places.

2) Cleaning and sterilising chemical containers must be covered with close-fitting caps and properly stored to avoid contact with anyone other than working staff.

3) Cleaning and sterilising chemical containers must be properly labelled. 4) Cleaning and sterilising chemicals must be used in an open and well-ventilated

area. 5) Personal protective devices, such as masks and gloves, must be worn when

handling cleaning and sterilising chemicals. 6) Eating and drinking, fire lighting or smoking are not allowed in places where

cleaning and sterilising chemicals are stored.

1.4.9 Sanitary Conditions

1.4.9.1 The Working Environment 1) The working environment must be kept clean at all times; 2) No objects are to block passages in the working environment; 3) Materials and objects must be tidily piled to a limited height; 4) Water or oil should not be allowed to accumulate on the floor; 5) The floor must be flat; 6) A first aid box and relevant medicines must be available; and

7) For sanitary reasons, personal belongings, such as clothes, socks, baggage, umbrellas and personal-care items must not be kept in the kitchen or food storage room. Sufficient lockers should be provided in appropriate places for the staff to use.

1.4.9.2 The Kitchen 1) The kitchen must be well lit and equipped with a direct or manual ventilation

system. 2) The floor of the kitchen must be made of hard, water-resistant, non-corrosive,

non-slippery materials that are easy to clean, and it must be installed with effective drainage systems.

3) A good air-extraction system must be installed in the kitchen. 4) No decorations, such as decorative walls or suspended walls, which are difficult

or impossible to inspect, clean and sterilise should be installed in the kitchen, storage room, washrooms, dining area, beverage area, waiting room or on the walls of passages leading to such areas.

5) The kitchen of the establishment serving only congee and noodles can be separated by an aluminium frame and glass.

6) Staff dealing with food must keep their hands clean at all times. The kitchen must be equipped with washbasins (with a suggested allocation of at least one washbasin for every 20 staff); these should be located at the entrance or other suitable places in the kitchen and equipped with siphon-curve water outlets connected to a public sewage system. In addition, liquid soap, disposable tissues or a hand drier should also be available.

7) Shelves, tables, cabinets, working tables and any other food-preparation areas should be made of smooth, strong, water-resistant, anti-corrosive materials that are easy to clean and consistent with the maximum capacity of the establishment.

8) The floor of the kitchen must be covered with non-slippery materials. Stepping boards made of wood or other materials are not recommended.

9) It is suggested that F & B establishments should have a tableware storage room for storing tablecloths, glasses, dishes, knives and forks and utensils sufficient to serve the maximum capacity of customers. If conditions for this are not appropriate, a special sideboard made of waterproof materials, which is ventilated and easy to clean, should be provided for this purpose, and the sideboard must always be kept closed, to ensure it remains free of pests and dust.

10) The kitchen must have a designated place in which to store daily utensils and tools. Proper knife shelves should be installed, and the knife blades must be kept covered (it is suggested that for every square metre in the kitchen, an area of at least 0.02 m3 should be reserved for cupboards to store bowls and dishes).

11) Depending on their characteristics and maximum accommodation, all F & B establishments must designate an area for storing food, beverages, and glassware.

1.4.9.3 Cold Storage 1) To keep food and beverages in good condition, all F & B establishments must

have a refrigeration facility with an automatic temperature control and alarm system, in accordance with their characteristics and maximum accommodation.

2) The cold storage must be equipped with proper lighting. 3) The floor of the cold storage must be kept clean, without the risk of water

logging. 4) Workers entering the cold storage must wear cold-resistant clothes and gloves

to keep warm.

1.4.9.4 Heating Utensils 1) Containers for high-temperature food preparation must be properly located. 2) A separation board must be installed beside the stove. 3) The handles of pots must not protrude beyond the boundary of the stove or be

placed above the burning chamber. 4) Microwave and baking ovens must be operated according to their

manufacturers’ safety instructions. 5) All kitchen staff must wear heat-resistant gloves.

1.4.9.5 Sanitary Installations 1) All equipments in toilet must always be kept clean and in good condition. 2) Toilets must be equipped with fresh-water taps, and must be properly designed

to avoid any risks. 3) Doors must be fitted with self-closing hinges. 4) Toilets must not be connected directly to areas used for cooking, storage,

preservation and/or food preparation, and they should be properly planned to avoid directly facing dining areas.

5) Toilets must always be provided with liquid soap, disposable tissues or electric hand driers, and each cubicle must always be equipped with sufficient toilet paper. It is suggested that lighting and fixed mirrors be provided in the toilets for the use of customers.

6) The number of toilets installed must be in line with the establishment’s accommodation capacity, as specified in Table 2.

7) Except for light-refreshment premises, toilets for males and females must be separate.

8) Light-refreshment establishments are advised to reserve a toilet for staff use only, in which there are one urinal and one washbasin for every 40 male employees or every 30 female employees.

9) If an F & B establishment is located inside a commercial building or mall, it is allowed not to install sanitary facilities, providing the commercial building or mall’s sanitary facilities fulfil the requirements listed in Table 2 and are located on the same floor of the establishment and reserved for customers and staff of the establishment. If the above situation applies to the establishment, a toilet-allocation certificate (or declaration) and a layout plan of the toilets issued by the relevant management company must be submitted to the licensing authority together with the licence application, for the reference of the District Health Inspector.

The above-mentioned sanitary facilities in toilets of similar establishments must be labelled properly in visible places to state whether the toilets are for customers or staff only.

10) For unisex sanitary facilities, more cubicles and partitions must be installed, and the partitions must be separated by walls from the floor up to the ceiling.

1.4.9.6 Garbage Disposal

1) Since garbage is produced by business operation, the owner of the establishment is responsible for hiring a cleaning service company, or designating his or her staff to send garbage to the Taipa incineration plant for disposal. The owner should discuss collection times with the cleaning service company, to avoid leaving garbage containers in the street, where they will affect the environment and block the way of pedestrians.

2) The F & B establishment must reserve sufficient space for garbage containers (pedal garbage containers may be used).

3) Garbage containers used in the establishment must have covers and their numbers and capacity must be in consistent with the establishment’s accommodation capacity and flow of customers.

1.4.9.7 Lighting 1) The establishment must be well lit with fluorescent lamps. 2) Fluorescent lamps must be replaced immediately they are found not to be

functioning. 3) Fluorescent lamps must be covered with lampshades if they are installed in a

damp or high-temperature area.

1.4.9.8 Ventilation Systems 1) All establishments should ideally have natural ventilation, but ventilation

facilities or installations may be used to improve environmental conditions.

2) When natural ventilation is insufficient or impossible, the establishment must install an effective ventilation system to keep the air fresh. The inlet for fresh air and outlet for waste air should be located at a height of at least 2.5 m from the ground outside the premises.

3) The ventilation system must have a capacity of 17 m3 per person per hour, and independent ventilation inlets and outlets should be installed at various spots in each partition of the establishment.

4) The air extractor must be equipped with a safety cover (a fan cover). 5) The fresh air inlet and waste air outlet must not be placed too close to one

another, so as to avoid any backflow of waste air. 6) All air pipes must be properly covered to prevent access of mice. 7) The outlet of the ventilation system must not be located in an area where it

may cause disturbance or inconvenience to the public. 8) An exclusive extractor fan must be installed above the stove. 9) All extractor installations must be kept clean and in good condition.

1.4.9.9 Grease Interceptors

Specifications of Grease Interceptors The type of grease interceptor used is dictated by the fat or oil content of the food sold in the F & B establishment. However, if no food is processed on the premises and only beverages and snacks which do not produce a large amount of fat are sold in the establishment, a grease interceptor need not be installed.

According to Categories 4 and 5 specified in Decree Law No.16/96/M, the grease interceptors installed in F & B establishments are classified mainly into Types A and B:

� If the establishment mainly serves beverages and also food that produces

less grease, such as noodles and sandwiches (excluding rice, roast or barbequed products), a Type A grease interceptor must be installed. Type A grease interceptors are divided into eight grades, according to the number of seats. For example, if the number of seats in the establishment is not more than 10, a grease interceptor with internal dimensions of 100 cm long, 60 cm wide and 60 cm deep, a total depth of 90 cm, a top of 30 cm high and a minimum capacity of 300 L and an outlet pipe with a diameter of 10 cm must be installed (for detailed specifications, please refer to Table 3).

� If the establishment mainly serves food, including food that produces large amounts of grease, such as rice, roasted or barbequed products, a Type B grease interceptor must be installed. Type B grease interceptors are divided into nine grades, according to the number of seats. If the number of seats in the establishment is not more than 10, for instance, a grease interceptor with internal dimensions of 120 cm long, 60 cm wide and 60 cm deep, a total

Installation Methods for Grease Interceptors A grease interceptor is a grit chamber with filtration, precipitation and cooling functions. For convenience of cleaning and inspection, the grease interceptor must have a strong cover that is easy to open. Principally, there are two installation methods:

1) Underground-type: installed under the ground. 2) Surface-type: installed on the surface of the ground. In normal cases, the underground type of grease interceptor is preferred. If it is impossible to install the underground type grease interceptor, because of the existence of a basement or underground car park or because the structure of the building may be affected, then a surface type of grease interceptor can be installed, subject to prior approval by the IACM. Locations for Grease Interceptor Installations

1) The grease interceptor must be installed in an area where it is easy to clean and

inspect. Except under special circumstances, it must not be installed in public areas of the building or public streets, to avoid affecting property owners or the public.

2) The grease interceptor must be installed in the washing area, and kept away from food preparation and storage areas. Notes for attention:

1) Sufficient space must be reserved for installation of an appropriate quantity of grease interceptors with an appropriate capacity.

2) Grease and waste water collected from the kitchen, including waste water from the water trough, sinks, stoves and ground ditch, must be directed into the grease interceptor for filtration, precipitation and cooling before being discharged into the building’s public drainage system.

3) The connection between the grease interceptor and the building’s drainage system must not obstruct the original water drainage system, thus affecting users of the system.

4) If the required capacity of the grease interceptor is so great that it cannot be installed within the establishment, the establishment may, with the IACM’s permission, install a number of grease interceptors of smaller capacity. However, the total capacity of the smaller grease interceptors must exceed the original required capacity. In addition, the capacity of each smaller grease interceptor must satisfy the required specifications for grease interceptor type A.

5) When the height of the grease interceptor is equal to or higher than 0.9 m., installing a surface-type grease interceptor under the sink will affect the normal use of the sink. In this case, in addition to installing the grease interceptor on the structural ground level (not the surface of the decorative floor), the floor of the working area must also be raised to ensure the safety of workers using the sink.

6) Special cases will be treated individually, according to the IACM’s advice.

1.4.9.10 Cooking Fume Filtration and Odour-dispelling Systems

1) The kitchen and other areas that function as food-preparation and cooking areas must be installed with proper filtration and odour-dispelling systems. The operation of such installations must not cause any inconvenience or damage to third parties.

2) The outlet of a smoke extractor must not be blocked and should be located in a ventilated area far from other residences.

3) An effective and efficient cooking fume filtration system should be installed. If the cooking process produces greasy cooking fumes, a high-efficiency filtration system, such as an electrostatic fume filter, should be installed.

4) The cooking fume filtration system selected must match the capacity of the smoke extractor, to ensure that the extraction capacity of the system is lower than that of the manufacturer’s specifications, in order to guarantee effective filtering results.

5) Since the electrostatic fume filter must be cleaned and maintained frequently to guarantee its designed efficiency, the filter must be installed in a place that is easy to clean and maintain. If the filter is not equipped with an automatic cleaning function, it must be cleaned weekly and maintained regularly.

6) In selecting a cooking fume filtration system, consideration should be given to choosing recognised and reputable brands.

1.4.9.11 Sewage Systems

The waste water of the establishment must be discharged directly into the public sewage system via the grease interceptor, and all the equipments for discharge waste water (e.g. sinks, water troughs and washbasins) must be properly equipped with siphon curve water outlets. Sewage pipes must be concealed all the way to the grease interceptor after passing the odour-dispelling process.

1.4.9.12 Drainage Systems

The floor of the kitchen, tableware room, and sanitary facilities should be gently slanting, so that the flow of water inclines towards the drainage system inlet.

1.4.9.13 Water Supply Systems

All F & B establishments must be connected to the public fresh water supply system.

1.4.9.14 Noise Control

1) Renovation works for the establishment must not be carried out on Sundays and public holidays, or between 8:00 pm and 8:00 am of the following day on weekdays.

2) Noise from the ventilation system, air conditioning system and other installations (stoves, sinks, etc.) must not exceed 10 dB (A) in comparison with background noise, as measured from the units of any persons who are disturbed by it.

3) If necessary, noise control devices must be installed to reduce the noise level, such as acoustic linings, acoustic baffle covers, acoustic silencers or acoustic louvers.

4) Soundproof facilities should be installed to minimise noise. 5) Noisy machinery and work must be isolated. 6) Since the air conditioning and ventilation systems produce noise, when

installing facilities that produce noise and vibration, such as cooling towers, compressors and motors, attention should be paid to avoid installing them near residences, schools or hospitals.

7) When air conditioning and ventilation systems are installed, they should not be directly fixed onto the building, because vibration generated by the operation of these installations will spread out and generate noise, thus causing disturbance to other people. Proper shockproof materials such as shockproof springs or rubber spacers must therefore be applied to parts that are connected to the building.

8) If the noise level exceeds 10 dB (A) in comparison with background noise, as measured from the units of persons being disturbed, a silencer must be installed on the air extraction system, as required by Article 6 of Decree Law No. 54/94/M on noise control regulation.

9) If the cooling tower of the air conditioner needs to be installed adjacent to residences, an acoustic baffle cover must be installed to reduce noise.

1.4.9.15 Water Dripping from Air-Conditioners

The water discharge pipes of air-conditioners must be connected to the drainage system of the building, to avoid water dripping and disturbing others.

1.4.9.16 Measures to Prevent the Propagation of Mosquitoes and Bugs

1) All partitions must be properly barriered to avoid the spread and propagation of the causes and methods of transmission of infectious diseases (such as mice and cockroaches) and to prevent them from entering via windows, doors, pipes or floors, or openings in walls and ceilings.

2) Effective electrical pest killers must be installed in the kitchen, other food preparation and cooking areas and the dining area, the number of which must be consistent with the accommodation capacity of their target zone.

3) Water logging within the establishment must be avoided. Measures must be taken to prevent mosquitoes propagating in water in vases and other decorative containers, by using appropriate materials such as filling them up with marble stones to keep the water surface out of contact.

2. Application Stage 2.1 Application Procedures for Obtaining the Food and Beverage

Establishment Licence

All documents and drawings submitted for the application of an F & B Licence are used as the basis for approving and granting the Licence, the provisional operation permit for electrical installations and the construction permit. Upon receiving these permits, the applicant may apply for an appropriate electricity meter from the electricity company, and legally start construction or renovation works for the F & B establishment. For specifications for these documents, specimens of standard drawings and relevant fees, please refer to Article 1.3 of Section Two, Parts 3 and 4 of Section Four and Table 5 of this booklet.

2.1.1 Initial Application

A natural person (an individual) or a legal entity (a company) or an agent entrusted by the applicant may file an application by submitting the following documents:

1) A Completed Form A; 2) The identity certificate of the applicant, and/or a certified copy of the letter of

authorisation; 3) The restructuring plan consisting of the following documents, drawings and

relevant specifications: � Memorandum of the project specifications; � Location map in 1:1000;

� A plan drawing, elevation drawing and sectional drawing in 1:100, including:

- Approved original drawings (attached to certified copies of construction drawings issued by the Lands, Public Works and Transport Bureau)

- Modified drawings - Overlapping drawings

� A plan drawing of the fire control facilities in 1:100. If the establishment already has a fire control system installed, the drawings of the fire control system and relevant specifications of the project plus a valid maintenance certificate must be submitted;

� A plan drawing of the water supply, drainage and sewage system in 1:100 (attached to certified copies of the drawings of the drainage and sewage systems of the building issued by the Lands, Public Works and Transport Bureau);

� A detailed drawing of the grease interceptor in 1:100; � A plan and sectional drawings of the foundation structure of the building in

1:100 (attached to certified copies issued by the Lands, Public Works and Transport Bureau);

� A plan drawing of the basement in 1:100 (if the F & B establishment includes a basement, the certified copies of the drawings issued by the Lands, Public Works and Transport Bureau must be attached);

� A drawing of the wiring diagram of the main electrical switchboard of the electrical installation in 1:100 and a memorandum stating the project’s specifications (required only when applying for a provisional operation permit for electrical installations);

� Tax turnover receipt of the person (if an individual) or legal entity (if a company);

� Proof of residential address, such as a phone bill, electricity bill or water bill; � Menus with related prices; � Photo of the establishment’s facade; � Letter of authorisation to entrust the IACM to undertake relevant application

procedures; � Declaration of responsibility for the project planner (architect or civil

engineer or civil engineering technician); � Declaration of responsibility for the project director (civil engineer or civil

engineering technician); � Declaration of responsibility for the project engineer (contractor or

construction company); � Written report of the property’s registration; � Original or certified copies of insurance policies for the project; and � The valid addresses and telephone contact numbers of the applicant, the

project director and project engineer stated in the application form or in the declarations of responsibility.

Notes for attention: � Upon submission of application Form A and attached documents, the

application process will be initiated, and staff of the IACM will, on behalf of the applicant, apply for relevant documents from relevant departments and undertake application procedures according to the content of the letter of authorisation.

� During the application process, staff of the IACM may request further information from the applicant or inform him or her about the collection of relevant documents by telephone, fax, mail, e-mail, etc.

� Purpose of applying for a provisional operation permit for electrical

installations: If the electricity consumption of the establishment exceeds 13.2 KVA (3 X 30A), the applicant is required to apply for a provisional operation permit for electrical installation, in order to allow for the installation of a suitable watt-hour meter by the CEM. Thus, the applicant must submit relevant documents, including a wiring diagram of the main electrical switchboard of the electrical installation and a memorandum of project specifications together with Form A. The required validity period of the permit should also be stated in the memorandum. The IACM will apply for the permit from the Lands, Public Works and Transport Bureau on behalf of the applicant. If the submitted documents are sufficient and meet all the requirements, the permit will be issued within 10 working days from the application date, and the applicant will be notified to collect the permit from the IACM’s One-stop Service Organisation free of charge. The applicant may also apply for an extension of the valid term of the permit free of charge (Please refer to Article 5.2 of Section Four of this booklet).

� The purpose of applying for a construction permit: Generally, during the application process for an F & B establishment licence, the applicant will be required to apply for a construction permit first, and then follow the recommendations and conditions provided by the relevant departments before starting renovation or restructuring works. If simple works are carried out in the F & B establishment, for instance, repairs that do not involve restructuring partition walls or altering the layout of the establishment, the submission of drawings will be waived, provided that the description of the construction works are stated in the memorandum of project specifications, and relevant information is correctly completed in Form A. If all requirements are met, the Lands, Public Works and Transport Bureau will issue a sealed copy of the memorandum to act as a construction

permit. Upon being notified, the applicant can collect and pay for the permit at the IACM. The maximum valid term for an initial construction permit is eight months. If the applicant foresees the construction works cannot be completed on time, an extension of a maximum of four months may be granted. An application for renewal can be submitted after the construction permit expires; however the time gap between the issue date of the initial construction permit and the application date of the renewal construction permit must not exceed one year. The application for extension and renewal of the construction permit must be accompanied by valid insurance policies for the project. A valid construction permit will be issued within 10 working days upon application (Please refer to Article 5.1 of Section Four of this booklet).

2.1.2 Transfer of Licence Holder

1) A completed Application Form A of the One-stop Licensing Service for F

& B Establishments (including the notarised signature of the licence holder).

2) The original and a copy of the identity certification of the new licence holder.

3) Proof of the residential address of the new licence holder (such as an electricity or water bill).

4) A certified and valid contract for the transfer of licence. 5) The latest menus with relevant prices (signed by the new licence holder). 6) The original F & B Licence. 7) A completed declaration (provided by the IACM) that there has been no

alteration within the specified area, facilities and environment of the establishment (signed by the new licence holder).

8) Produce the valid Business Operation Tax Voucher issued by the Finance Services Bureau (Form M/1).

2.1.3 Change of Name of the Establishment

3. Construction Stage

Upon receiving the construction permit, the applicant must purchase a construction record book. This enables the IACM to notify the Lands, Public Works and Transport Bureau to assign an inspector to make arrangements with the technical engineers to sign the permission statement at the site. The applicant may start the decoration or renovation work before then, in accordance with the approved plans, as well as the suggestions and conditions provided by relevant departments. The commencement date of construction is the date that the official notification from the IACM is received.

If the following conditions occur during the construction period, the applicant, project director and contractors must act in accordance with relevant regulations:

� If the project includes installation of reinforced concrete, the project director

must inform the IACM or the Lands, Public Works and Transport Bureau directly, and acquire the approval letter before starting the works.

� During the construction period, any alterations to the project plan or changes in design must be reported to the IACM together with the proposed alteration plan, including drawings and specifications of the modified plan. The IACM will assist with delivering the relevant documents to relevant departments for further approval. The restructuring work must not be carried out prior to approval by the relevant departments.

� If the alteration does not involve the fire control system or the structure of the building, or if it will not impair public safety, the applicant may make decisions concerning relevant alterations to the project, provided the project complies with the conditions stated in Article 1.4 of Section Two of this booklet, and other applicable regulations.

� Upon completion of construction works, the project director and contractors must submit declarations of responsibility stating whether the project has been completed in accordance with the approved plan and all applicable regulations.

4. Examination and Inspection Stage

4.1 Content and Criteria of Inspection Set by the Inspection Committee Upon completion of the project, the applicant must inform the IACM in order to arrange for a completion inspection, and at the same time submit the construction record book. The Inspection Committee will carry out the inspection within 15 working days of receiving the request. The inspection includes standard measures of public safety, public health, environmental protection and urban planning, as well as the appropriateness of the name of the establishment and the feasibility of issuing a provisional licence. The applicant or his or her entrusted agent must be present at the inspection, together with the

relevant technicians. The procedure of the inspection is as follows, (for other relevant criteria, please refer to Article 1.4 of Section Two of this booklet).

4.1.1 Safety Issues Related to the Construction and Structure of the Building

1) Inspection of whether the implemented project is in line with the approved drawings and suggestions about construction and structural safety.

2) Inspection of whether the annexes comply with relevant regulations concerning structural safety, fire control and public safety.

4.1.2 Safety Issues Related to Fire Control

1) Inspection of whether the fire control system and facilities comply with the approved drawings, and whether instructions concerning fire control have been implemented.

2) On-the-spot observations and testing of the fire control system to ensure that no other installations impede its normal operation.

3) Inspection of the number of emergency exit signs and the normal operation of the emergency lighting system.

4) Inspection of whether the fire extinguishers meet the Fire Services’ specifications, that the number of extinguishers is adequate, that the capacity of the extinguishers satisfies relevant regulations, and that they are located in the right areas.

5) Inspection of the fire-resistance capability of the kitchen, and whether advice about the safety of the fuel supply system and fire control has been implemented.

6) Inspection to ensure that the partitions are made of non-flammable materials and that they will not block emergency exits or impede the operation of the fire control system.

7) Inspection of whether suspended ceilings impede the operation of the fire control system, and whether they are made of flammable materials.

8) Inspection to ensure the widths of exits are consistent with the approved drawings.

4.1.3 Safety Issues Concerning Fuel

If the LPG consumption of the establishment exceeds 22 kg, or if the consumption of diesel or kerosene exceeds 20 litres, the Inspection Committee will, at the request of the relevant departments, inspect whether the storage and distribution network for fuel are consistent with the approved plan and conform with the instructions on the safety of the fuel supply system.

4.1.4 Safety Issues Concerning Sanitation

1) On-the-spot inspection of whether the project is consistent with the approved drawings.

2) Inspection of whether sanitation requirements have been fulfilled and also whether all plans are consistent with the standards of the relevant regulations.

4.1.5 Issues Related to Environmental Protection With regard to the specifications of grease interceptors and the smoke extraction system, an on-the-spot inspection will be carried out to ensure that the installations match the approved drawings.

4.1.6 Issues Related to Cultural Heritage Preservation

1) Inspection of whether instructions on cultural heritage preservation have been complied with.

2) Inspection of the accuracy of actual works of the project, and to determine whether they are consistent with the approved plan.

4.1.7 Safety Issues Related to the Workplace

If the F & B establishment employs more than 30 employees, the Labour and Employment Bureau will join the Inspection Committee to inspect whether the facilities/equipment within the establishment meet the safety requirements for work places.

4.2 Necessary Rectifications and Arrangements for Re-inspection of Projects

That Fail to Gain Approval

If the Inspection Committee finds during the on-the-spot inspection that the construction or restructuring, fire control system, fire control facilities, sanitary installations, sewage system, drainage system, installations of grease interceptors, fuel supply system, measures on cultural heritage preservation, safety operation standards or the public health standards of the F & B establishment are inconsistent with the approved drawings or plans, or relevant regulations, or instructions from the relevant departments, the project will not be approved.

In general, if the establishment’s facilities and installations and the approved plan are altered to a small extent, or they do not affect the safety of the building structure, restructuring of emergency passages, fire control system and the public safety, the Inspection Committee will offer practical advice and suggestions about rectifications.

If the situation is considered relatively complicated, the IACM will convey the professional advice of the Inspection Committee to the applicant within 5 working days after the inspection. Upon receiving such notification, the applicant must make improvements or rectifications within a specified time.

The applicant must execute the suggestions and instructions of the Inspection Committee. Upon completion of works, the applicant should notify the IACM so that a re-inspection may be conducted, or else submit modified drawings.

If a re-inspection is required due to the applicant’s fault, i.e. if the applicant fails to carry out renovation works required by relevant regulations or in accordance with the instructions given by the relevant departments, the applicant will be charged for each re-inspection. For the details of fees, please refer to Table 5.

4.3 Granting of Provisional Licence

When an on-the-spot inspection is carried out by the Inspection Committee and the project fails to gain approval due to reasons other than its impact on public safety, public health or the environment, subject to the Inspection Committee’s recommendation and approval by the One-stop Service Organisation, the applicant will be granted a provisional licence within 8 working days from the inspection date (please refer to Article 5.3 of Section Four of this booklet). The applicant must make relevant improvements and observe the terms and conditions specified in the provisional licence before the commencement of business. In addition, the applicant must notify the IACM about arrangements for re-inspection 15 days prior to the expiry date of the provisional licence.

The provisional licence is subject to certain charges and its period of validity may extend for between 2 and 6 months. It is transferable within this period.

4.4 The Official Food and Beverage Licence

If, during the initial inspection or re-inspection of the F & B establishment, the Inspection Committee concludes that the project fully complies with the approved drawings, and suggestions by relevant departments and the Inspection Committee itself have been implemented, and all the facilities and installations within the establishment comply with relevant regulations, the applicant may, subject to examination and approval by the IACM, obtain the official F & B Licence within 8 working days from the inspection date. Applicants who do not entrust the IACM to undertake business registration procedures must submit their business registration form to the Finance Services Bureau before obtaining the F & B Licence. (Please refer to Article 5.4 of Section Four of this booklet)

The official F & B Licence and initial inspection are subject to fees and the F & B Licence is valid for one year, during which the applicant is allowed to transfer and renew it. For relevant fees, please refer to Table 5.

4.5 Situations in Which Applications are Rejected

In general, there are two situations in which the IACM may reject outright an application for the F & B Licence:

1) When it is considered that there are no feasible ways, even through

rectifications, of improving a situation that may affect public safety, public health, fire control and the environment, and thus the project may directly or indirectly prejudice the public’s wellbeing in the future.

2) When the F & B establishment’s facilities fail to meet the requirements of

relevant departments and fail to pass the inspection carried out by the Inspection Committee, or when the professional advice and instructions made by the Inspection Committee are not implemented.

Penalties for Violating Relevant Laws and Regulations

1. Operating a Food and Beverage Establishment Without a Licence

In accordance with the regulations of Decree Law No. 16/96/M and Administrative Regulation No. 16/2003, F & B establishments are allowed to open for business only after obtaining stipulated permission.

Anyone who operates an F & B establishment without a licence is subject to the relevant regulations of the above-mentioned Decree Law and Regulation, and may incur a fine of MOP10,000 or MOP20,000, and their establishment must be closed immediately; otherwise the owner may be subject to criminal liability. In addition, if other violations related to the structure of the building, fire control, and environmental and food sanitation are involved, the case will be referred to other relevant authorities.

2. Violations of “The General Regulations for Urban Construction”

1) As specified in clause 61 of Decree Law No. 79/85/M, technicians, contractors or construction companies are subject to suspension of their qualification for between 6 months and 2 years in the event of the following situations:

� Construction work is not properly supervised or carried out by the appointed project director or project engineer who has declared his/her responsibility, and as a result the building collapses or the work is placed in jeopardy;

� Documents containing false or malicious information are submitted to the Lands, Public Works and Transport Bureau with the intention to obtain approval.

2) If, during the stage of planning, directing or construction, the project planner or person in charge is found to have violated the technical regulations specified in clause 62 of Decree Law No. 79/85/M, the Director of the Lands, Public Works and Transport Bureau may order the suspension of his or her qualifications for a period of between 180 days and 2 years, depending on the seriousness of the violation; and during this period, the project planner or person in charge may not submit new plans, offer supervision services or implement any projects.

3) Clause 64 of Decree Law No. 79/85/M stipulates that if the following situations

occur, the project director and contractor or construction company may be fined between MOP1,000 and MOP10,000:

� Commencement of a project prior to obtaining a construction permit from the

Lands, Public Works and Transport Bureau, notwithstanding the signing of a declaration of responsibility.

� The absence of a construction permit, or failure to follow the approved plan, regulations specified in the issued permit, or other applicable regulations.

� Failure to observe the instructions contained in any lawful notification.

� Being absent from the construction site, without proven reasons, at the times and on the dates required by the Lands, Public Works and Transport Bureau.

� Failure to display a project signboard in a prominent location of the site or to provide a certified copy of the project plan, construction permit, inspection record, declaration of responsibility and construction record book; or failure to keep properly maintained or well-managed other relevant documents or documents as specified by the Lands, Public Works and Transport Bureau at the construction site for inspection by the inspector.

� Use of poor-quality construction materials, or adoption of flawed construction methods.

� Failure to report any change of address within 8 working days. � The departure of the technician in charge from Macao without giving any

notice during the construction period.

4) Clause 65 of Decree Law No. 79/85/M stipulates that any work implemented without a construction permit is liable to a fine of MOP1,000 to MOP20,000.

The contractor or construction company is liable to pay this fine. If the identity of the contractor or construction company is unknown, the project owner shall pay the fine.

3. Violations of the Safety Regulations for Fire Control

1) Any violation of the Safety Regulations for Fire Prevention approved by Decree Law No. 24/95/M, or the commencement of a construction project without a construction permit and failure to follow the approved plan will be liable to a fine of between MOP4,000 and MOP50,000.

2) If a violation results in any accident or puts the building and/or other people in jeopardy, the maximum fine will be increased fivefold.

3) The licensing entity and the Lands, Public Works and Transport Bureau are authorised, within the limits of their authorisation, to execute penalties in accordance with the Safety Regulations for Fire Prevention approved by Decree Law No.24/95/M.

4. Violations of the Safety Regulations for Sanitary Conditions

In accordance with the regulation of article 1 of clause 80 of Decree Law No. 16/96/M, the following illegal acts will result in a fine of between MOP15,000 and MOP35,000: 1) Food is not properly stored or preserved, and/or its recommended date for

consumption has expired. 2) Smoking, eating, spitting or coughing in food preparation and cooking areas. 3) Preparing or cooking food without wearing appropriate uniforms, or instances

where the food comes into direct contact with the floor. 4) Use of water that is not supplied by the public water supply system. 5) Washbasins, sinks and toilets are not equipped with siphon curve water outlets. 6) Piling of residue and garbage. 7) The absence of garbage container or the use of garbage containers without covers. 8) Porcelain ware and/or utensils are stored in places with poor sanitary conditions.

9) Personal belongings are placed in the food preparation or storage areas. 10) Facilities, installations and utensils are not properly maintained and cleaned. 11) Use of utensils that are easily oxidised. 12) Use of damaged porcelain ware and/or glassware. 13) Insufficient ventilation, air extraction and lighting. 14) Poor functioning of the smoke extraction and odour-filtration systems. 15) Allowing the propagation of pests and insects. 16) Failure to provide disposable tissues, hand driers and other necessary personal

sanitary articles in washrooms. 17) Use of an ineffective water tank.

5. Violations of Labour Provisions 1) The employer of the F & B establishment must follow the Laws and Regulations

on Employment Relations approved by Decree Law No. 24/89/M. 2) If accidents or professional illness occurs within the establishment, the Labour and

Employment Bureau will carry out an investigation according to the Laws and Regulations on Compensation for Injury Caused by Work Accidents and Occupational Illnesses, as approved by Decree Law No. 40/95/M, and execute relevant punitive measures accordingly.

6. Violations of Relic Preservation Provisions

1) If the unauthorised project is carried out in areas specified in attachments III and IV of Decree Law No. 83/92/M, the applicant will be penalised according to the provisions of the Penalties on Violating Administrative and Technical Regulations approved by clause 58 of Decree Law No. 79/85/M.

2) If the unauthorised project is carried out in areas specified in attachment II of Decree Law No. 83/92/M, besides being penalised according to the provisions of the Penalties on Violating Administrative and Technical Regulations approved by clause 58 of Decree Law No. 79/85/M, the applicant will also be liable to a fine of MOP10,000 to MOP100,000 executed by the President of the Cultural Institute according to article 3 of clause 58 of Decree Law No. 79/85/M, as well as possible civil or criminal charges.

3) If the unauthorised project is carried out in areas specified in attachment I of Decree Law No. 83/92/M, besides being penalised according to the provisions of the Penalties on Violating Administrative and Technical Regulations approved by clause 58 of Decree Law No. 79/85/M, the applicant will be subject to an additional penalty determined by the Chief Executive of the Macao SAR.

4) The above-mentioned projects specifically refer to overall or partial expansion, maintenance, reinforcement, construction, dismantling, renovation, restructuring or restoration of a building.

5) In addition, if the unauthorised project has been carried out, the original building’s structure and landscape must be fully restored according to the time frame and methods specified by the Cultural Institute and the Lands, Public Works and Transport Bureau.

2. One-stop Service Organisation and Relevant Departments

2.1 One-stop Service Organisation Civic & Municipal Affairs Bureau

Besides acting as the One-stop Service Organisation in terms of supervising and assisting with the application procedures for obtaining a licence for an F & B establishment, the IACM is also the entity that examines and issues licences. Before the F & B establishment commences business, an Inspection Committee must inspect its project plan and ensure its premises comply with public health and safety, environmental protection and urban planning requirements. Once it has been confirmed that these requirements have been fulfilled and that relevant regulations have been complied with, the IACM will examine and issue the licence to the applicant. Afterwards, it will carry out further inspections of the operations of the F & B establishment after it opens for business. A representative of the Administration Committee of the IACM chairs the Inspection Committee. Its other members are representatives from the Lands, Public Works and Transport Bureau; Fire Services; and Health Bureau. In certain circumstances required by law, representatives from the Cultural Institute, the Labour and Employment Bureau and the Combustibles Safety Commission will also be included in the Committee’s membership.

2.2 Relevant departments Throughout the licensing process, opinions on the project must be sought from departments with specific areas of authority, such as the Lands, Public Works and Transport Bureau; Fire Services, Health Bureau, and Combustibles Safety Commission. Such opinions relate to the application for the F & B establishment licence, public safety and health, environmental protection, and urban planning. If the F & B establishment is located within a cultural heritage preservation area (please refer to “Selection of premises” in Section Two), the Cultural Institute must be consulted about the exterior environment, the external appearance, interior restructuring and renovation of the building. If an F & B establishment will employ more than 30 employees, the Labour and Employment Bureau must also be consulted. To provide investors a better understanding of the roles of relevant departments, their responsibilities and jurisdictions relating to the licensing of F & B establishments are summarised below.

Lands, Public Works and Transport Bureau Responsibilities – To examine and approve construction plans submitted (including interior decoration, restructuring and maintenance plans, etc.), issue construction permits, and to ensure such approved plans are complied with relevant laws and regulations; to issue provisional operation permits for electricity installations, with regard to the specified electricity consumption of the establishment. Jurisdiction – Monitoring of the structural safety of the F & B establishment and urban planning issues. Fire Services Responsibilities – To advise on fire prevention in F & B establishments. Jurisdiction – Inspection, testing and monitoring of fire control systems and fire-prevention facilities in F & B establishments. Health Bureau Responsibilities – To advise on the appropriateness of the public heath and sanitary facilities of F & B establishments. Jurisdiction – Provision of guidance, supervision and education on environmental hygiene and food hygiene in the F & B establishment, through the District Health Working Group. Cultural Institute Responsibilities –To advise on the appropriateness of setting up F & B establishments in cultural heritage preservation areas, including monuments, buildings, complexes and other sites with architectural or artistic value, as specified in Attachments I, II, III, IV of Decree Law No. 83/92/M (please refer to Attachment 6 in Section Four), and on the outdoor landscaping, external appearance and interior restructuring and renovation of the building. Jurisdiction – Monitoring of F & B establishments established in cultural heritage preservation areas, including monuments, buildings, complexes and other sites with architectural or artistic value, and approval of any interior alterations made to architectural relics other than monuments.

Labour and Employment Bureau Responsibilities –To advise on the safety of the working environment and sanitary conditions in F & B establishments with more than 30 employees. Jurisdiction – Implementation of investigation and supervision of F & B establishments, to ensure the workplace safety and health of employees. Combustibles Safety Commission Responsibilities –To give relevant advice on the installation and safety of combustible product facilities upon request of the authorised entities, if the F & B establishment has the following features that make it subjects to mandatory supervision: i. The storage and transmission network for LPG exceeds 53 dm3 (in

accordance with the Administrative Regulation No. 28/2002 and 30/2002) ii. The power consumption of each item of heating equipment and the total

power dissipation of the kitchen exceed 35 kW and 50 kW, respectively (in accordance with the Administrative Regulation No. 26/2002).

iii. The storage of kerosene exceeds 0.1m3 (in accordance with Decree Law No. 19/89/M).

iv. The storage of oil residue exceeds 0.2m3 (in accordance with Decree Law No. 19/89/M).

Jurisdiction – Monitoring of the above-mentioned F & B establishments concerning their observation of the relevant regulations, and notification of any violation of those regulations to relevant disciplinary entities.
