1. Radio Equipment became so small that
securing space for marks is difficult.
2. Multiple radio equipment are installed
into a single housing, which make the
marking complicated, and the space is
limited for marking.
3. Changing frequencies and modulation
method of radio equipment already in the
market became easier thanks to software
technology advancement, but changing
the marking is difficult.

The marking shall be indicated must be the following mark, a symbol “R” and the Technical Regulations Conformity Certification
Number or Certificate of Construction Type Number.

1. The first three letters of the Technical Regulations Conformity Certification Number must be the category of a Registered
Certification Body or a Recognized Certification Body separately specified by the Minister of Internal Affairs and
Communications, and the forth letter or the forth and fifth letters must be as specified in the following table according to
the classification of Specified Radio Equipment as below chart. The other letters must be as specified by the Minister of
Internal Affairs and Communications.
2. The first three letters of the Certificate of Construction Type Number must be the category of a Registered Certification
Body or a Recognized Certification Body separately specified by the Minister of Internal Affairs and Communications,
and the forth letter must be “-(hyphen).” The fifth to tenth letters shall be a combination of Arabic numbers and alphabets
assigned by a Registered Certification Body or a Recognized Certification Body for each Certificate of Construction Type.
However, below cases shall be treated as specified.
1. When constructing a single Specified Radio Equipment with 2 or more radio equipment certified by separate
attestations of the construction design of specified radio equipment, the equipment may have 1 attestation
number of the construction design of specified radio equipment.
2. When acquired a new Certificate of Construction Type on an existing attested construction design, the attestation
number for the existing attestation may be the number for the new attestation except when there is no
construction is required to change the certification mark based on the new attestation. In this case, the Specified
Radio Equipment with the existing attestation number is considered that the new attestation mark has been
installed.

(Effective Date)
1 This Ordinance is effective upon announcement.
(Transactional Measures)
2 Marking set by Article 38.26(include Article 38.31.6), based on construction types that have
been certified before the enforcement of this ordinance, shall follow an existing format
regardless of amended Certification Rules Form 7.
3 Regardless of amended Certification Rules Form 7, registered certification bodies or
authorized certification bodies what fall under Article 38.2.2.1.1 or 2, may follow existing
format of Certificate of Construction Type Number until 6 months after the ordinance is
enforced.
4 registered certification bodies or authorized certification bodies what fall under Article
38.2.2.1.3 shall comply with Amended Certification Rules Form 7 from April 1, 2013. Before
this date, Certificate of Construction Type Numbers may follow existing format.

【Guidelines on Same Certification Number】
1 Background
MIC has collected opinion on “revision of certification system” from August 2, 2011 to August 31, 2011, and
disclosed the results to press on October 19 of the same year. Amendment of related Ordinances have been
announced based on the result on December 16, 2011, and became effective immediately.
2 Objective
The objective of this guideline is to provide a unified interpretation of an expression within the amended ordinance,
“As long as it does not require alteration work on certified radio equipment,” so that registered certification bodies,
certification grantees, would have common understanding of the amendment. It is especially to prevent from
grantees to properly perform the certification procedure, and to operate the certification system smoothly.
3 Scope
”Comprehensive Legal Structure of Communication and Broadcast” (August 2009, ICCJ Report) has raised a
number of issue with existing legislature on marking, which led to the recent amendment. The issues include the
following; A)it would be beneficial if certified equipment can be modified with new parts or devices without re-
affixing the mark after the equipment is in the market; B) the need for recertification to comply with new spurious
regulation; C) the need for recertification to reflect changes of domestic standards, whose change was made to
mirror international standards that are more advanced than domestic ones; D) the need for recertification when
multiple certified devices are integrated; E) the need for proper procedures of adding antennas, whose restriction
has been lifted with recent amendment. The common characteristic among these issues is that it is extremely
difficult or unreasonable to collect radio equipment to remove/renew marks. The amendment covers to solve these
urgent matter. The scope of this amendment shall be revised in a timely and flexible manner.

4 Guideline
The same certification number may be applied if below 4.1 and 4.2 are both fulfilled.
4-1 Requirements
Should applicants(Certification Grantees such as manufacturers) wish to acquire the same certification number
with an existing one, Form 7 Note5(2) of Rules on Technical Regulations Conformity Certification Etc. of Specific
Radio Equipment (Certification Rules) requires that application shall meet below requirements simultaneously.
Note that this amendment of Certification Rules ONLY covers the method of the construction type marking, which
is assigned by registered certification bodies; and that the certification process of the construction type between
registered certification bodies and applicants remain unchanged.

4 Guideline for Specific Matters
4-1 Adding Parts
All of following requirements shall be met.
(1)It does not alter the characteristics of radio.
(2)Functions of the added part is equivalent to or better than an existing one.
(3)There is no amendment to documentation of construction type.
(4)It does not require changes with schematic diagram except for model number of the part.
(5)It does not replace the main component of radio device if the radio device is consisted of the single component. For
example, it is not permitted to replace a chip of a single chip radio device.
4-2 Spurious Regulations
All of following requirements shall be met.
(1)It conform with Certification Rules Article 7 Annex 3 within Amendment to Radio Device Rules (August 9, 2005 MIC
Ordinance) .
(2)It complies with above (1) without changing the radio device.
4-3 Adding Modulation Method
All of following requirements shall be met.
(1) It conform with Certification Rules Article 49-28 within Amendment to Radio Device Rules (April 26, 2011 MIC
Ordinance) .
(2)The type of device allowed is Certification Rules Article 2-1-49, 51, 52-2, or 52-3, and shall be controlled by a master
station.
(3)It complies with above (1) technical standards by fulfilling one of the below;
①There is no change in hardware or software of the radio device.
②Adding modulation method by software update under the management of telecommunication businesses.

4-4 Transition to “Radio relay station for cellular radio communication” regardless of communication method
It is permits the use of same certification number in the following 2 cases; A) Transition to “Radio relay station for
cellular radio communication” regardless of communication method based on amended Certification Rules Article
2-1-10, from radio stations that relay each communication methods based on Amendment to Radio Law
Enforcement Regulations (October 25, 2011 MIC Ordinance; or B) adding frequency, type of radio wave etc. in
conformity with technical standards of radio devices set by amended Certification Rules Article 2-1-10.
4-5 Adding Antenna (including antenna system)
Specific radio devices covered here are for cellular radio communication use or low-power data communication
system etc. More specifically, it shall fall under one of the following legislature; Certification Rules Article 2.1.10,
2.1.11-11.28, 2.1.19-19.3.2, 2.1.19.5-11, 2.1.22-23.3, 2.1.49-56.
4-6 Adding Frequency
All of following requirements shall be met.
(1)Land mobile stations for cellular radio communications that fall under Certification rules Article 2.1.11,2.1.11.3,
2.1.11.4, 2.1.11.7, 2.1.11.8 or 2.1.11.9
(2)Adding frequency with software update to radio device with function to add the new frequency under the
management of telecommunication businesses.
