Executive Summary

Ohio's various occupational licensing and regulatory boards monitor, license, and regulate selected occupations and professions. Many of the regulated professions provide services in technical and specialized fields such as nursing, medicine, and engineering, where the failure to meet minimum standards could be dangerous or costly. The boards, as defined by section 4743.01 of the Revised Code, are charged to ensure the health, safety, and welfare of the public by ensuring the professionals who practice in these fields meet certain standards.

Section 103.13 of the Revised Code requires the Legislative Service Commission (LSC) to prepare this report, entitled the Ohio Occupational Licensing and Regulatory Board Report, annually to evaluate the extent to which boards and commissions are financially self-supporting. This report provides a summary of the licensing and financial activities as well as the legislative changes affecting the boards, commissions, and agencies that regulate occupations and professions, as defined in section 4743.01 of the Revised Code, that took place during FY 2006 (July 1, 2005 through June 30, 2006). Individual boards provided information for this report.

Most of the occupational licensing and regulatory boards listed in this report deposit funds into the Occupational Licensing and Regulatory Fund (Fund 4K9), established by Am. Sub. H.B. 152 of the 120th General Assembly to serve as a repository for license fees and other assessments. Before that, appropriations for each licensing board were made from the GRF. This created some problems as some boards contributed more revenues than they expended and others had to be subsidized by the GRF since the revenues they generated were not sufficient to cover operating expenses. Pooling revenue in a single fund eliminated these problems. In fact, it is quite common now for the boards to develop a surplus in the fund to cover unforeseen economic hardships. Please note, however, that this report also covers licensing boards that operate through other funds, which, like Fund 4K9, are supported by license and other fee revenue.

The Department of Administrative Services' Central Service Agency (CSA) supports the administrative operations for most of the licensing boards. Approximately 26 of the agencies included in this report use various services and forms of assistance available to them through CSA, including budget development, budget entry, controlling board support, management consultation, procurement, fiscal processing, human resources, fixed asset management, and payroll. The consolidation of services available to the boards through CSA provides administrative efficiencies for these shared services.

The report includes data on 36 boards and commissions (some of which are under the

auspices of larger agencies) and five regulatory divisions responsible for licensure housed within cabinet agencies. The information in this report is divided into three main sections that are described below.

Section I: General Information – The first section begins with a description of the functions of each licensing or regulatory board or program, followed by a brief description of legislation that became effective in FY 2006 that affected one or more of the boards. There were five such bills that impacted eight of the licensing boards in one or more ways. This section also

contains a table of general information for these regulatory entities, such as staffing levels and primary renewal cycles. Although many boards experienced changes in staffing levels in FY 2006, these changes were minimal in most cases. Of the entities included in this report, twenty have primarily annual renewal cycles, nineteen have primarily biennial renewal cycles, and two have primarily triennial renewal cycles.

Section II: Active Licenses – The second section lists the total number of active licenses for each board for FY 2005 and FY 2006. The percent change in the total number of licenses between these fiscal years is also calculated. The majority of agencies reported an increase in the number of active licenses over the period. The timing of the renewal cycle does not appear to be a factor, as 12 of the 20 agencies using annual renewal cycles and 13 of 18 agencies (not including the Manufactured Homes Commission, which had not begun licensing activities at the end of FY 2006) using biennial renewal cycles reported active license increases. In total, 26 boards experienced increases in the number of active licenses and 13 experienced decreases. Only three boards experienced increases or decreases in licensing volume of more than 10%.

Section III: Revenues and Expenditures – The third section contains information on the revenues and expenditures for each board for FY 2005 and FY 2006. This information is organized according to renewal cycle for each board (e.g., annual and biennial). The table contains information on both Fund 4K9 revenues and expenditures and any non-Fund 4K9 revenues and expenditures. The table also shows FY 2006 encumbrances, the changes in both revenue and expenditures from FY 2005 to FY 2006, and the net gain or loss for the two fiscal years combined. Corresponding to the majority of boards that saw an increase in the number of active licenses, most boards with an annual renewal cycle reported increased revenue in their respective operating funds between FY 2005 and FY 2006. Of those annual renewal agencies that reported reduced revenue in operating funds from FY 2005 to FY 2006, no decrease was more than 2.5%. While most boards also reported increased spending from FY 2005 to FY 2006, 16 of 22 respective operating funds posted positive two-year net balances.

Note that the boards that renew licenses biennially receive the bulk of their fee revenues

in alternate years. Thus, making comparisons of revenue in consecutive fiscal years is problematic. However, a review of data presented in previous editions of the Ohio Occupational Licensing and Board Report reveals that most such boards experienced an increase in revenue between the two most recent “on-years,” which are the years when the boards and commissions receive the majority of their revenue. Thirteen boards with a biennial renewal cycle increased spending from FY 2005 to FY 2006 and six decreased spending during that period. Sixteen of 19 (approximately 84%) of biennially renewing boards posted positive two-year net balances.

The State Board of Examiners of Architects adopts, promulgates, and enforces the rules and statutes governing the profession of architecture in the state of Ohio. Athletic Commission, Ohio

The Ohio Athletic Commission regulates the welfare and safety of contestants in any public or private competition that involves the sports of boxing, kickboxing, karate, tough-man contests or tough-person contests, professional wrestling, or any other form of boxing or mixed martial arts within the state of Ohio. The Division of Industrial Compliance, within the Department of Commerce, provides building and construction plans review and inspections of plumbing, electrical and structural systems, elevators, boilers, bedding and upholstered products, as well as regulation of individuals in the building trades. The Division provides administrative support for three boards: Board of Building Standards (which develops the Ohio Building Code), Board of Building Appeals (which handles compliance adjudication), and the Construction Industry Licensing Board (which provides testing, certification, licensing, and continuing education services for skilled trades). The Division also provides support to the Ohio Ski Tramway Board and the Historical Boilers Licensing Board.

Landscape Architect Examiners, State Board of

The State Board of Landscape Architect Examiners adopts, promulgates, and enforces the rules and statutes governing the profession of landscape architecture in the state of Ohio. Manufactured Homes Commission, Ohio

The Ohio Manufactured Homes Commission protects the property, safety, and health of the public through the regulation of manufactured home installation throughout the state; the development of uniform installation standards which meet or exceed the federal standards for the installation of manufactured homes and through the licensing of manufactured homes installers; the certification of building departments and their personnel; and the certification of third party inspection agencies. In addition, the Commission provides a dispute resolution process, a continuing education program, and licensing and certification exams. The Commission approves methods and materials used in the installation of manufactured homes and conducts investigations regarding licensing and certification and performs inspections of manufactured home installations to ensure quality installation and as a part of investigation processes. The State Medical Board of Ohio protects and enhances the health and safety of the public by regulating the practice of Doctors of Medicine, Doctors of Osteopathic Medicine, Doctors of Podiatric Medicine, Limited Practitioners, Physician Assistants, Anesthesiologist Assistants, and Acupuncturists. Medical Transportation Board, Ohio

The Ohio Medical Transportation Board ensures appropriate care and safe transportation for the citizens of Ohio by inspecting, certifying, and licensing all private emergency (ambulance), nonemergency (ambulette), and air medical services and associated vehicles as defined in Chapter 4766. of the Revised Code. The mission of the Ohio Respiratory Care Board is to protect and serve the public by effectively and efficiently regulating the practice of respiratory care and home medical equipment facility licensure and registration through the licensing of qualified practitioners and facilities, the establishment of standards for respiratory care educational programs and facility inspection standards, and the enforcement of the laws and rules governing both practices.

The Division of Securities, within the Department of Commerce, licenses securities dealers, salespersons, investment advisers, investment adviser representatives, state retirement system investment officers, and the Chief Investment Officer of the Bureau of Workers' Compensation. Additionally, the Division registers and exempts securities offerings, regulates tender offers for subject companies in Ohio, and brings enforcement actions for violations of the Ohio Securities Act. Speech-Language Pathology and Audiology, State Board of

The State Board of Speech-Language Pathology and Audiology regulates the professions of speech-language pathology and audiology in accordance with the Revised Code. Veterinary Medical Licensing Board, Ohio

The Ohio Veterinary Medical Licensing Board licenses, regulates, and enforces the laws governing the practice of veterinary medicine in the state of Ohio. Specifically, the Board licenses veterinarians, registers veterinary technicians, qualifies candidates for examination, and disciplines veterinarians and veterinary technicians based on consumer complaints.

New Legislation Effective in FY 2006

Five bills affected eight boards and commissions during FY 2006. Summaries of legislation affecting the boards and commissions are presented alphabetically by board name. All the bills discussed below became effective between July 1, 2005 and June 30, 2006. Athletic Commission, Ohio

Am. Sub. H.B. 66, the main operating budget act for FYs 2006-2007, gave the Executive Director of the Ohio Athletic Commission more authority to implement changes in events without a Commission meeting having to be called. This limited the number of scheduled Commission meetings to one per month. Dental Board, Ohio State

Am. Sub. H.B. 143 required the registration with the Ohio State Dental Board of expanded function dental auxiliaries (EFDAs) beginning in May 2007. These are persons that can perform the same functions as a dental assistant, but can also place restorations and sealants when working under the supervision of a licensed dentist. The act required the biennial renewal of these registrations. Also, the act made other changes regarding dental x-ray machine operators and the make-up of the Ohio State Dental Board. Manufactured Homes Commission, Ohio

Following a formal opinion of the Ohio Attorney General, the Ohio Manufactured Homes Commission could not adopt rules because U.S. Department of Housing and Urban Development model standards had not been promulgated, which Ohio statute required as a minimum standard. Am. Sub. H.B. 530 amended the Commission's statute, allowing the Commission to adopt rules regarding the licensing of installers, the certification of inspectors, and the standards for the installation of manufactured homes and dispute resolution to bring them into substantial equivalency with the U.S. Department of Housing and Urban Development standard within 180 days after the Department has adopted a standard. Medical Board of Ohio, State

Sub. S.B. 154 significantly impacted the regulation and practice of physician assistants in Ohio. The legislation increased educational requirements for physician assistant licensure; expanded the scope of practice for physician assistants, required the State Medical Board of Ohio to create and adopt new administrative rules and forms, and added two pharmacy members to the Physician Assistant Policy Committee. Under the law, a physician assistant's supervising physician and type of practice setting determines the services a physician assistant may provide.

Am. Sub. H.B. 530 included provisions requiring physicians who perform abortions to complete and submit to the Ohio Department of Health an individual abortion report for each abortion performed. Under law, the State Medical Board of Ohio is required to include a notice of this reporting obligation with the license renewal materials distributed to physicians. The law

further authorizes the State Medical Board of Ohio to take disciplinary action against physicians who fail to comply with the reporting requirements. The abortion reporting provisions of the law went into effect on March 30, 2006. Medical Transportation Board, Ohio

Am. Sub. S.B. 87 exempted senior centers and other senior transportation providers from the ambulette licensure law, as long as the senior center or senior transportation provider meets the requirements of the Department of Aging and the requirements under the state’s Medical Transportation Law. In addition, the bill exempted certain vehicles operated by public transit systems. In this case, the Department of Transportation, rather than the Department of Aging, is responsible for enforcing the requirements of the Medical Transportation Law. The exemptions do not apply to providers of ambulette services reimbursed under the state Medicaid plan. Transit systems are required to pay a $100 licensure fee and $50 for each transit vehicle. Occupational Therapy, Physical Therapy, and Athletic Trainers Board

Prior to this change, the Occupational Therapy section consisted of five occupational therapists. Under the change, an occupational therapy assistant replaced one occupational therapist. The new composition of the Occupational Therapy section is now four occupational therapists and one occupational therapy assistant.

Revenues and Expenditures

The tables in this section are organized according to each agency's renewal cycle. The agencies included in this report predominantly renew licenses on an annual or biennial basis. The exceptions are the Accountancy Board and the Division of Emergency Medical Services, which renew on a triennial basis. Also in the tables is a column that lists the amount each board or commission encumbered in FY 2006. An encumbrance is a charge against an agency's appropriation for a particular fiscal year, but is to be disbursed in the next fiscal year. Including encumbered funds provides a more complete picture of an agency's expenditures charged to the fiscal year. Most commonly this applies to end-of-year Central Service Agency charges, personal service contracts, and some equipment purchases. Agencies with a Triennial Renewal Cycle

Division of Emergency Medical Services

The Division of Emergency Medical Services is the administrative arm of the Emergency Medical Services Board under the Department of Public Safety. The license types that the Division of Emergency Medical Services oversees carry no license fees and therefore, generate no revenue. The EMS Division is funded primarily from traffic fine revenue in the Seat Belt Fund (Fund 83M). The disbursements and encumbrances accrued by the Division of Emergency Medical Services for FY 2006 totaled $2,294,964.

Accountancy Board of Ohio

In addition to Fund 4K9, the Accountancy Board of Ohio operates the CPA Education Assistance Fund (Fund 4J8). As with most boards, the Accountancy Board's license revenues and the Board's operational expenditures are collected and disbursed from Fund 4K9. Moneys from Fund 4J8 come from fees paid by licensees and are used for the Board's scholarship program, created through legislation in FY 1993. That legislation increased the basic education requirements an individual must meet to become licensed as a Certified Public Accountant. The Board encumbered $22,383 in FY 2006.

14 Expenditures for Fund 4K9 and Revenues for Fund 4J8 include transfers of $156,680 in FY 2004, $224,735 in FY 2005, and $146,140 in FY 2006 from Fund 4K9 to Fund 4J8. If the transfers are not included as an expense in Fund 4K9, the Accountancy Board of Ohio operated with a surplus of $189,532 in FY 2004, $351,535 in FY 2005, and $357,881 in FY 2006.

Agencies with a Biennial Renewal Cycle

Many of the boards renew their licenses on a biennial cycle. Because of this, each board receives the bulk of its licensing revenue every other year. A board may run a deficit in its "off" year that will be eliminated during its renewal year. The two-year renewal cycle must be analyzed to determine if a board is financially self-sufficient.
