NOW THE~fORE, under an.El, by virtue of the powers in me vested, I do hereby p~oclaim, .~eclare and make known as follows:- '

1. In thi-s Pmclarnation the !_S~pression 'the principal law' means the Imperial Mining Ordi,r1afjce for German South West Africa of the eighth. day of Au_ .. ,ust, 1905, as amended by Proclamations of the Administra~ ·t No. 24 of 1919, No. 12 of 1920, No. 59 of 1920, No. 29 9 1921 and No. 11 of 1923.

2. (1) Section one of t!le. principal law is hereby amended by . fhe addftion to item. . (2) of paragraph A thereof of th•e words "(diamonds, rubi~§1 emeralds and! sapphires)" and by tbe addition to item (2} pf paragraph B thereof of the words "and fluorspar". ·

ZO IS HET, dat ik, onder en krachtens de macht mij verleend, hierbij proklameer, verklaar en bekend maak, als volgt:-

1. In deze Proklamatie betekent de uitcirukking "De hoofdwet" de Keizer1ike Mijn Ordonnantie van Duits Zuid· west Afrika van de achtste dag ·van· Augustus 1905, zoals ge· wijzigd door P11oklamafies van de Administrateur No. 24 van 1919, No. 12 van 1920, No. 59 van 1920, No. 29 va,n 1921, en No. 11 van 1923.

2: (1) Artikel e en van de hoofdwet wordt hierbij gewijzigd door h-et toevoegen daaraan van de woor

(3) F110m and after the 15th day of August, 1925, every owner of a prospecti-ng daim or grantee of a mining area shall have the same right ro search for and win fluorspar occurring on or tn the prospecting claim or mining area pegged by or granted to him as ]1e has to search for and, win ofher bas,e minerals occurring on or i:n such prospecHng darm o r m'ining area, whether such prospecting claim or mining area shall have been pegged or granted prior to or on or after the 15fn day of August, 1925; provided• tha t the right to se_arch for and win fluorspar referred to in th1s sub-sechon shall be subject to any rights to tluorspar acquired by an owner of land ·or cessiionary of th~ rights -to fluorspar of such owner under the pr-ovisi·ons of sub-section (2) of this section.

(4) If any owner of land or cessi-011ary of · the rights of suc'h, owner to fluorspar shall, under the provisrons of sub-secHon (2) of this secti,on, peg fluorspar on any g~ound oovered by a prospecting daim or mini-ng area, all fluorspar won on such vound sha:11 be surrendered to him on request against paym.ent of the costs of winning and· working.

3. Secti-on t en of th-e principal law is hereby deleted and t'he foHowing new secti,on ten is hereby substituted' therefor:-

"10 (1) It s'hall not be lawful for any person to search for and peg the minerals menHoned in· section -one hereof in their natural state except npon a prospecting licence issued subject to fhe provisions of ihe Ordinance by the Min~ng A'Ut'h:ority or by the Magistrate •of the district in which such person desi-res to p:,ospect. Every sue~ .licence shall specify the magisteria[ district ,or part therco.f i-ii'- which prospecting is permitted tha:tll'eumler,

(2) For every such licence issued by the Mining Authority there s'hafl be payabfe a fee at th:e rate of_ two. shiUi•ngs and sixpence for each month or part of a month of th-e peri,od thereof if it he issu,ed' ~n. respect of o ne magisterial distri.:11: and five s'hi-Ilings for each month or part of' a month of f~e period thereof if it. be issued in respect of- two or more magisterial districis. For. every such licence issued, b.y a Magistrate fh,ere shall be payable a fee at the rate of two s'hitlings and sixpence for each month or part of ·a month of fhe period thereof. · ·

-· · (3} · No sucb_ licence shaH be granted untH the applicant therefor has . given security to the satisfaction of tbe Mining Authority or ·or the Magistrate as the case may be for the restoration to a safe condition of any property rendered dangerous or unsafe through such. prospecting. Tbe applicant shall be bound so to restore any property s·o rendered: danger-ous or unsafe by him."

4. Section t w e n t y - four of the principal law is hereby amended by t'he d:efetion of the first two paragraphs thereof and the snbstituh.on therefoi· of the following new para-~~- .

"A pr.ospecti-n~ claim shall be pegged by erecting a plainly recogmsable beacon in a co;nspi-cuous place as ·near as possihl-e to tbe centre of the prospecti!ng claim, to w'hi-ch must be securely affixed' a board ,or metal plate, at least six h1ches square, on which appears legihly written in durable writing:- ·

.(1). The name of the prospector;

(2) l'ru: nature of the p11ospecting daim (precious minerals pr-0:specHng claim o r base minerafs pro-specting dafm) ;

(3) The date and hour of the erectio11 of the beacon;

(4) A serial number distinguishing the claim from any other claims pegged '>y the s.arne prospector m the same district.

(3) Vanaf en na de 15de dag van Augustus 1925 za1 enige eig-enaar van een p:-ospekteerkleim, of enige cessionaris van een mijnstreek, hetzelfde ~echt hebben om naar vloeisnaat te zocken en dezelve te o ntginnen, waar voorkomend· op of in de prcspekkerkleim of mijnstreek, welke d oor hem afgepend ·ol aan hem gegeven fa, evena!s hij ·heeft om naar a-ndere onedele minernlen te zoeken en die te -ontginneil , welke 'Oorkomen in zodanige prospekteerkleim of mijnstreek, hetzij

rodanige pr-ospektee,klcim of mijnstreek v{H)r, op, of na de 15de dag van Augustus 1925 afgepend of gegcvcn werd; mits, dat hct recht om naar vloeispaat te zo·eken en de-zeh'e te -ontginnen, \\·aamaar vervv"ezen is in dit sub-artikel, onder-worpen is aan enige rechten tot vloeispaat, welke verkregen werden door een landeigenaar of cessionaris. van de rechten tot \'lo2ispaat van zodanige eigenaar, onder de bepalingen van sub-artikel (2) van dit Artikel.

(4) Indien enige landeigenaar of cessionaris van de rech.ten van zodanige ·cigenaar tot vloeispaat, onder de bepa-lingen van sub-artikel (2) van dit A;iikel, vfoeispaat afpent op en(g . gro-ml, dat ingeslot::n is in een prospekteerkl:eiim of mijnstree:k, dan moet al de op zodan-ig grom1 ontgonncn \'Ioeispaat ·op ver~oek aan ftem overgegeven warden, tegen betaling van de kosten \'an het ontginnen.

3. Artikel t i en van de hoofd~vet wordt hierbij weg-gelaten, en wordt vervangen door hct volgend nieuwc Ar-tiket t i e n : -

" 10, (1 ) H et ts onwettig voor cnige persoon om de mineralen gcnoemd in Artikel e en hiervan in hun natuurlike staat te zoeken en af te pennen, beha\ve onder een pros, pekteerlkentie, uitgereikt o nder de voorzieningen van de Ordonnantie van de· Mijnauroriteit, of door de Magistraat van het distrikt ,-vaarin zodanige persoon w;;:nst te pr-ospektcren. Eike zodanige licentie moet het magistraatsd-istrikt of dee:! er van aangeven, waarin daaronde·r het prospekteren toc-gelaten is.

(2) Voor elke zodanige licenlie uitgereikt door ae Mijll-autoriteit moet een foo i van twee shillings en zes pence betaald worden voor elke maand ·of decl van een maand v'an het tiJdperk e.- van, indien de li:centie· ten opzichte van een magistraatsdi-sfrikt uitgerdkt is, en vijf shillings voor elke maand o f dee] van een maand van, het tijd·perk er van, indien de liccnHe t-en opzichte van twee of mee-r magistraatsdistrikten uitgereikt is. Vo-or elke zodanige licentie uitgereikt door een Magistraat moet een fooi ,,an twee shiilin!;S en zes pence betaald word-en voo,· e!ke maand o! deel van een maand van bet tijdperk e,- van.

(3) Geen zodanige Hcentie zal uitgereikt worden totdat de applikant er voor tot voldoening van de Mijnautoriteit of de Magistraat, zoals hct geval zijn mag; waarborg gegeven heeft voor het herstellen van enig eigendom, dat door zodanig prospekteren gevaarlik of onveilig gemaakt is, tot een veilige toestand. De applikant is verplicht enig eigendo-m, dat door

·hem· gevaarlik of onveilig gemaakt werd, aldus te herstelfen.

4. Artikel v-i ,er - en • t w in ti g van de hoo·fdwet wordt hierbij gewijzigd door het weglaten van de eerste twee para-grafen daarvan, ,en het vervangen daarvan door de volgende ni-euwe paragrafen:-

"Een prospekteerkieim · nioet afgepend worden door het oprkhten van ·een gemakkcHk erkenbare baken in een zlchtbare plek, zo nabij het middelpunt van de pros-pekteerkfeim als inogelik, en daaraan moet een houten bord of metalen plaat van minstens zes duj:m in het vierkant gevesti-gd word-en, waarop in leesbare en vaste sch rift mo.et staan :-

(1) De na:am van de prospektor. (2) De aard van de ~Hospekteerkicim (edele mine-

ralen prospekteerkle1m o-f onedele mineral-en pros~ pekteerkieim).

(3) De datum ·en het uur van het opdchten van de baken.

(4) Een vioignummer, dat de kleim onderscheidt van. en.ige andere kleims,

6. Section twenty - s e ve n of the . principal law is 'herebv amended by the deleUon of. the second paragraph 'thereof and tile substitution therefor' of the following new . paragraph:-

"The fee shall be paid to the Mining Authority or to such other -o.fficer \3,s .the Administrator may appoint. The first payme11t shaII be for a peri-od of six monfus and shall fall due on the day on whi-ch the pegging of the prospecti,ng claim is notified (section 28), and sub-·scquent payments shall fall due on the first day . of ,every calendar month. If any fee due in respect of , any month after the expiration of the first s~x months :s'hall not be paid on the· day on which it falls due; a penalty of one-fourth- of such fee shall become payable; and if suc'h fee; together with any penalty that may have become payable, shall not be paid' _within · one calendar month after the day on which it falls due, t'he pmspecting claim shall cease io be closed·.''
