(7/15/19) Motion by Kellbach, second by Herbst to approve the minutes of the previous meeting on 7/15/19. Motion carried 5-0. Consider approval or denial of various license applications Rasmussen stated there were denial recommendations for Public Transport Driver applications for Joshua Sly and Zachary Wilson. Joshua Sly was present to address the committee to appeal the denial. Rasmussen noted that Mr. Sly had already provided evidence of rehabilitation to the Police Chief and following review Chief Bliven decided to uphold his recommendation for denial. Joshua Sly stated he did not understand why he was denied further because the reason for denial was due to a 1998 burglary felony conviction. He explained he served his prison time; was released on parole; was granted administrative action to get off parole and probation early; and did not have violations the entire time while on parole. He stated five years later he received an OWI which was a municipal first offense, but has paid all fines and completed everything for that. He explained due to being a single parent of three and the struggle to make ends meet, he failed to pay $170 in fines which resulted in his license being revoked and he did get arrested for driving after revocation. This was the only criminal instance since his release on June 3, 2005, until July 20, 2015. He stated he picked up three misdemeanor cases after having spinal injections in his neck and had a meltdown while talking with police, all one incident. He pointed out the Judge was favorable because of the medication he had been given. He service a year of probation and has not since had a single police contact. Chief Bliven stated the felony burglary was the initial reason for the denial recommendation. The additional offenses beyond the initial incarceration and parole of operating without a license, resisting/obstructing and disorderly conduct were the reason for maintaining the denial. Rasmussen questioned if Mr. Sly had any additional documentation to submit to show proof of rehabilitation for these other violations for OWI, Operating after Revocation, Disorderly Conduct and Resisting/Obstructing. Sly stated he had submitted a letter of reference from Diane Seinhold who he has worked with the last two years. Alfonso questioned if he had the discharge from probation in 2015. Sly indicated he was not provided with any paperwork on that, but believed it was online. He commented he did not know how else to prove his rehabilitation. Zachary Wilson was present to appeal. Rasmussen stated evidence of rehabilitation was also submitted by Mr. Wilson, but following Chief Bliven’s review his recommendation stands pending the results of a drug test from the Wisconsin State Lab of Hygiene because the results submitted were not state validated results. Zachary Wilson explained on the day of May 10th he was stopped. He stated his license was valid, but he felt he was illegally searched and was taken in for a blood test for which the results could take anywhere from a few weeks to a few months. He indicated when he was released the next morning he went and took a drug test for the Salvation Army and passed a 12 panel test. He did not feel he should be denied as he still has not been convicted of anything. Rasmussen suggested the committee hold off on a decision on Mr. Wilson’s license until we have the validated results. Peckham questioned if they were testing for alcohol or for drugs. Bliven stated it was a State Patrol arrest and the report indicates the arrest for OWI was with a suspicion of drugs being in his system. He noted this particular testing can take up to six months for results. Peckham requested Mr. Wilson be pulled off the list for reconsideration at another date. Motion by Kellbach, second by Peckham to approve or deny licenses as recommended by staff, with the exception of Zachary Wilson to be considered at a future meeting. Motion carried 5-0.

Consider request for waiver of 9.04.025 Consumption or possession of intoxicants on streets - Wausau River District for Exhibitour, September 28, 2019 Rasmussen stated Exhibitour has been conducted without issue and we have previously approved a waiver for attendees to traverse the local sidewalks with the wine during the event. Motion by Peckham, second by Herbst to approve the waiver of 9.04.025 for Exhibitour 2019. Motion carried 5-0. Communications Kim Lemke addressed the committee regarding the significant drop in attendance at the Wisconsin Valley Fair. He indicated he has been a vendor at the fair for the past nine years and as a business person was concerned the fair would disappear. He stated since 1986 the beer gardens have become beer cages or beer areas. He remembered going to the fair as a child with his parents when they were allowed to walk the midway with their beer. He felt beer gardens separated the families with the kids on the midway separated from their parents. He was not implying that this would solve all the problems with fair attendance, but requested this issue be revisited. He suggested working with the Fair Board to have wrist banding for adults rather than a segregated beer garden. Rasmussen stated this item will be put on a future agenda for discussion and the Fair Board and vendors would be invited for input. HEARING: Mae Cantrell, owner, Raichu, Appeal of Prohibited Dangerous Animal Designation Rasmussen opened the hearing and all the witnesses for testimony were sworn in by the clerk: Humane Officer Bishop, Michelle Harris, Mae Cantrell, David Cantrell, and Carey Kania. Rasmussen verified receipt of hearing documents by Ms. Cantrell. Rasmussen explained the committee considered a dangerous animal designation pertaining to Raichu last fall and upheld the recommendation of the Police Department in November 2018. This designation has requirements that must be met in order for the animal it remain within the city. The Humane Officer allowed an extensive period of time to install the fencing and kennel because the designation was made in the winter. She questioned what steps Ms. Cantrell has taken to comply with the ordinance to date. Mae Cantrell acknowledged she was given ample amount of time and it was appreciated. She indicated she received several estimates from fence companies of which she had anticipated she would be able to get a loan. It took a lot longer than anticipated and she still did not have her home equity line of credit established to pay for the fencing. In the meantime she put up a chain link fence and now has a kennel, however, the city had her take it down because it was mixed materials and no permit was approved/issued. She stated she has been trying to get a permit, but was unable to get their plan approved. She felt the committee and Officer Bishop should recognize the electric fence as a barrier. She still disagreed that Raichu went through the electric fence last fall as claimed at the original hearing. Cantrell further stated she purchased the insurance, has a leather collar, and muzzles Raichu when out on a walk. Michelle Harris (Mae Contrell’s sister) stated she is willing to rehome Raichu to a property on the west side of Wausau where Harris was moving to. Rasmussen pointed she would have to comply with the same requirements if she took Raichu. She noted the hearing today is not to decide whether or not Raichu is dangerous, that designation was already made. The hearing today is to uphold or not the prohibited dangerous declaration which would require Raichu to either be rehomed outside of the city limits or euthanized within five days. The prohibited designation is based on the length of time the compliance has taken. Rasmussen questioned how many animals were in Mae Cantrell’s home. Cantrell indicated she owned two dogs, Lucy and Raichu. Rasmussen questioned if there were any other animals there temporarily. Cantrell stated a dog named Diesel came into the household a couple months ago and has been there longer than was anticipated. She stated she couldn’t apply for a pet fancier license because Raichu is designated dangerous. David Cantrell requested an extension of time until the end of September to meet all the requirements. Humane Officer Bishop stated she attempted several times to follow up with Mae on the fencing as well as microchipping. The vet clinic was not willing to insert the chip without Raichu being sedated due to its behavior issues. On February 20, 2019 Bishop received the microchip information and was told she would be contacted in spring by the Cantrell’s once the ground thawed regarding the fence. Bishop did not receive any call, left voice messages but did not receive any return calls. In May Bishop issued a letter with a June 15, 2019 deadline to comply. On July 30th the prohibited dangerous designation letter was delivered. Bishop also discovered the

Dangerous Animal license for Raichu was not issued because of unpaid fines owed to the city. She noted in November when Cantrell was allowed an extension of time to install the fence she was told any time Raichu was outside she was to be muzzled on a leather leash in the hands of a responsible adult. An officer provided video evidence to Bishop in July which shows Raichu outside in the yard without a leash or a muzzle. Bishop stated Raichu has been taken to the Humane Society as a seized animal. She noted the neighbors have complained there is another dog brought to the Cantrell’s frequently to be watched. There have been numerous complaints. CLOSED SESSION pursuant to Section 19.85(1)(a) of the Wisconsin Statutes for the purpose of considering the following: Deliberation concerning a case which was the subject of any judicial or quasi-judicial trial or hearing before the governmental body Motion by Peckham, second by Herbst to convene into Closed Session regarding the prohibited dangerous designation. Roll Call Vote: Ayes – Kellbach, Herbst, Peckham, McElhaney, and Rasmussen. Motion carried unanimously. RECONVENED into OPEN SESSION to announce results of deliberations on appeal of Prohibited Dangerous Animal Declaration. Rasmussen read the Findings of Fact and Conclusion of Law upholding the Prohibited Dangerous Animal declaration of the Chief of Police on July 29, 2019. She noted the pet owner has the right to further contest this determination through a review of this decision in Marathon County Circuit Court. Tavern Activities / Compliance Checks / Law Enforcement Activities Chief Bliven presented the Tavern Report for July 1, 2019 through July 31, 2019 (See attached). Chief Bliven informed the committee the department has had two pretty significant calls at Roc’s in the last couple weeks involving guns. There were no shots fired, but there were people brandishing guns; and in addition to those two incidents, a manager of Roc’s called him to ask for help in keeping a specific underage person out of the establishment. He indicated Lt. Mike Felder is going to be meeting with Tim Nawrocki and the manager next week to help them understand how to be in compliance and take better control of the establishment. Bliven stated he was also going to meet with them at the police department to set expectations. Rasmussen commented on the offense at Christine’s regarding obtaining alcohol that was not from a licensed wholesaler. The committee agreed by consensus to support the recommendation of an assessment of 50 demerit points to Christine’s. Adjourn Motion by Peckham, second by Herbst to adjourn the meeting. Motion carried unanimously. Meeting adjourned at 6:55 pm.

Re:      Rental Inspection Program and Rental Registration

Purpose:  Discuss with the Public Health and Safety Committee rental inspection program, including inspection district and rental registration.  Facts / Considerations:    

1. Background. – The city of Wausau adopted a rental licensing and inspection program in November 2013.  The city licensed all residential rental properties in 2014 and 2015 and performed inspections on over 1,000 residential rental buildings during that same time period.       Several legislative acts in 2015 and 2016 eventually eliminated city wide rental licensing and limited the ability to perform rental inspections.  More recently 2017 Wisconsin Act 317 limited broad rental inspection programs.  Assistant City Attorney Alfonso will have a separate memo discussing the statutory history of rental inspections.  

2. History.  – Over the last several years the common council has found that property maintenance and decent, safe, and sanitary living environments were a top concern for the city.  The housing code task force made several recommendations over the years to modify or add municipal code sections to address distressed properties.  Staff had found that most of the distress properties had several factors in common; age of the home and if the structure was a rental versus owner occupied.  In 2014 the city hired a second property inspector to help address blighted properties and implement the rental inspection program.  

3. Program needed. – The city property inspectors continue to find property maintenance violations throughout the city.  Since the rental inspection program stopped in April 2016, we have still found many interior and exterior issues for residential properties.  Staff has developed a property code violation map of the city showing the highest

location of violations.  As you can see many of the densest areas of violations are found in the core areas of the city.  These areas correspond with high percentages of rental properties (see rental map).  

4.  Program implementation – Staff proposes to create a single district to focus our efforts on interior housing conditions for tenants.  We propose an approximate 15 – 20 block area that over the course of several months’ city staff can work with landlords and tenants to inspect both the interior and exterior of residential rental properties.  By limiting the area we are hopeful to make a difference in the district while enabling staff to move on to another area.  We are limited by statute to inspections once every 5 years.  This will allow us to fulfill the rental inspection program duties with existing staff.

Comments on Proposed Draft of Residential Rental Inspection Ordinance and Re-creation of Residential Rental Contact Registration Ordinance

On November 26, 2013, the City passed a residential rental licensing ordinance. The

effect of the ordinance was to require all owners of rental dwelling units within the City to acquire an annual license in order to lease a residential unit. The rental license was to ensure the primary purpose of the ordinance: that rental property owners have rental units located within the City inspected every three years for compliance with the City housing code.

At the time it was being considered, the residential rental licensing ordinance was the subject of wide spread debate within the City’s landlord community. One debate was the effect of Wis. Stat. §66.0104 on the ordinance and its rental licensing and inspection program. Wis. Stat. §66.0104 was created by the state legislature through 2011 Wisconsin Act 108 on December 7, 2011, and as originally created, prohibited municipal governments from placing certain limitations or restrictions on landlords. The Wausau Area Apartment Association and three landlords filed a law suit against the City to test the validity of the ordinance. A similar law suit was filed against the City of La Crosse at the same time with respect to its rental licensing ordinance.

The ordinance survived judicial scrutiny through appellate court review although at its conclusion, the City was required to amend the manner in which it arranged for the rental inspections. Rather than having a landlord contact a tenant in order to arrange the time and date of the inspection, the City would contact the tenant directly.

At the time the City implemented its rental licensing program a few other communities had rental licensing programs as well, such as the cities of Milwaukee, Beloit and La Crosse. The City of OshKosh began initial consideration of implementing a program at that time as well. Likely as a result of a perceived local government trend concerning residential licensing programs, discussion continued at the state legislature as to whether Wis. Stat. §66.0104 should be amended to add additional provisions restricting municipalities’ right to regulate the rental of private dwelling units.

Additional legislation amending Wis. Stat. §66.0104 (2017 Wisconsin Act 317 [“Act 317”]) passed on April 16, 2018, the effect of which was to prohibit a municipality from having a rental licensing program. As a consequence of Act 317, the City placed a moratorium on its rental licensing program.

In response to lobbying efforts by the Wisconsin League of Municipalities and the expressed concerns of many local municipalities and other groups, Act 317 does permit a municipality to provide for a regularly scheduled inspection program of residential rental units. Act 317 places certain limits on those programs such as when a fee for an inspection may be charged, the frequency with which a unit may be inspected, and a minimum time period to be provided a landlord to correct a discovered violation. Significantly, a rental program is limited to a district in which a municipality has determined there is “evidence of blight, high rates of building code complaints or violations, deteriorating property values, or increases in single-family home conversions to rental units.” Wis. City staff would like to initiate a discussion within the Public Health & Safety Committee, given the considerable success the rental licensing program had on improving the quality of dwelling units within the City, as to whether it is appropriate to

implement a residential inspection program. The Inspections Department has provided a detailed and comprehensive analysis of housing code violations within the City which is provided as part of the packet presented to the Committee for its initial review and discussion.

A draft of a residential inspection program ordinance is included that provides a framework for an inspection program. Under this draft, the City would regularly inspect rental units within an area to be designated by the Common Council by resolution. After the initial inspection, and any re-inspection if necessary, subsequent inspection would only occur within the parameters established by Wis. Stat. §66.0104. The inspection would be arranged for by the City directly with the tenant. If a tenant objected to the inspection it would either not occur or the City would determine whether it should proceed to obtain a special inspection warrant pursuant to Wis. Stat. §66.0119.

The proposed ordinance also repeals the rental licensing program, which in any case was passed by the Common Council with a sunset provision of January 1, 2020.

The Common Council of the City of Wausau do ordain as follows:

Section 1. That Section 16.04.030 Residential Rental Contact Registration is hereby repealed and recreated to read as follows:

16.04.030 Residential Rental Contact Registration. (a) The owner of a residential rental dwelling unit located in the City shall register with

the City of Wausau Division of Inspection and Zoning (“Department”), on forms provided by the Department, rental contact information for residential rental dwelling units.

(b) The owner shall provide information on the form which will enable the Department to

contact the owner, or at the option of the owner, an agent of the owner, including the street address of the residential rental dwelling unit to be registered and the owner’s or agent’s legal name and telephone number. The owner may voluntarily provide an email address for the owner or the agent of the owner.

(c) The owner of a residential dwelling unit shall update the residential contact

information on file with the Department within thirty (30) days of any changes in the information set forth in subsection (b) to ensure that it includes the correct and current contact information at all times.

(d) Within thirty (30) days of the sale, conveyance or other transfer of the ownership of

the residential rental dwelling unit, the new owner shall submit to the Department such information as complies with the requirements of this section.

(e) A one-time registration fee of ten dollars ($10.00) shall be paid by the owner for the

initial registration of a rental dwelling unit or a building containing multiple dwelling units. A one-time registration fee shall be paid for the change of ownership or management of a rental dwelling unit or a building containing multiple dwelling units, or the change of contact information for the residential dwelling unit or building containing multiple dwelling units.

(f) Residential rental dwelling unit means any independently rented living space whose

term of lease is 30 days or greater. It does not include rest homes, convalescent homes, nursing homes, hospitals, assisted living centers, community based residential facilities, adult homes and other facilities licensed or certified by the Wisconsin Department of Health Services, or properties owned or operated by the City of Wausau or its Community Development Authority.

Section 2. That Section 16.04.039 Residential Rental Licensing, is hereby repealed. Section 3. That Section 16.04.039 Residential Rental Inspection is hereby created as follows:

16.04.039 Residential rental inspection. (a) Findings. The Common Council finds that a significant percentage of housing code and fire code violations occur at residential rental dwelling units located within the City and that the conditions which exist at these units adversely affect the individuals residing in such units, the neighborhoods in which they are located and the residents living nearby. As a reasonable and necessary means of realizing the purposes and objectives of this Title 16, Housing Code, as well as to prevent blighted conditions in city neighborhoods and to protect the health, safety and welfare of the public the Common Council has determined that it is necessary to establish a program of regularly scheduled inspections within designated districts which demonstrate evidence of blight, high rates of building code complaints or violations, deteriorating property values, or increases in single-family home conversions to rental units. (b) Definitions. The following definitions shall apply in the interpretation and enforcement of this section.

(1) “Habitability violation” shall have the same meaning as in Wis. Stat. §66.0104(1)(ah).

(2) “Department” means the City of Wausau Division of Inspection and Zoning. (3) “Designated neighborhood stabilization and enhancement district” means that area defined in accordance with Wis. Stat. §66.0104 and adopted by resolution by the Common Council. (4) “Dwelling” means a building which includes one or more distinct living units. It does not include rest homes, convalescent homes, nursing homes, hospitals, assisted living centers, hotels, motels, or properties owned or operated by the City of Wausau or its Community Development Authority. (5) “Unit” means any independently rented living space whose term of lease is 30 days or greater.

(c) Regularly scheduled inspections. The City hereby establishes a program of regularly scheduled inspections of all residential rental dwelling units located within a designated neighborhood stabilization and enhancement district.

(d) Inspection. Inspections shall only be conducted:

(1) In an occupied dwelling unit with consent from an adult tenant or adult designee present at the time of the inspection; (2) In a vacant dwelling unit with consent from the owner or owner’s agent who is present at the time of the inspection; or (3) Upon obtaining a special inspection warrant pursuant to Wis. Stat. §66.0119.

(e) Abatement. Code violations identified during the residential rental dwelling unit inspection shall be abated within the time ordered by the Department to prevent re-inspections and associated re-inspection fees. The time to abate or cure a habitability violation will be not less than thirty (30) days; however, where the habitability violation exposes a tenant to imminent danger, the City may require an abatement or cure period of less than thirty (days). (f) Inspection fee. The Department will charge a fee for the residential rental unit inspection or re-inspection as approved by the Common Council and set forth in the City of Wausau Fees and Licenses Schedule pursuant to section 3.40.010(a) of this Code. Such fee will not exceed those permitted pursuant to Wis. Stat. §66.0104(e). Unpaid inspection fees will be collected as a special charge as provided in Wis. Stat. §66.0627 and entered on the tax roll if unpaid, or may be collected in any other manner allowed by law. The enactment of this ordinance shall constitute notice to property owners of such charge. (g) Inspection upon request or complaint. All properties in the City, including residential rental dwelling units, shall remain subject to inspection requests. None of the inspection provisions in this section shall prohibit, condition, or otherwise limit any inspection conducted pursuant to this code or other applicable law. The Department will inspect residential rental dwelling units based on tenant or citizen requests or complaints. (h) Notice of inspection. (1) The Department shall serve written notice of the date and time of any inspection to be conducted under this section by mailing such notice by first class mail at least 21 calendar days prior to the date of the inspection. The Department shall mail the notice to the occupants of each residential dwelling unit, the owner, and the authorized contact person to the addresses provided on the residential rental contact registration as provided in section 16.04.030 of this Code. In the case of multiple owners of the same property, notice to any one of the owners or the authorized contact person shall comply with the notice requirement under this section. (2) Should the tenant, owner, authorized contact person of the owner of the residential rental dwelling unit , or other person in control of the dwelling unit

refuse admittance to the Department for purposes of the inspection or any re- inspection the Department may proceed to obtain a special inspection warrant pursuant to Wis. Stat. §66.0119.

(i) Severability. If any provision or portion of this section is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this section shall not be affected thereby.

Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 5. This ordinance shall be in full force and effect from and after its date of publication.

RESOLUTION

WHEREAS, the Common Council of the City of Wausau approved a Residential Rental Licensing Ordinance on November 26, 2013; and

WHEREAS, the State Legislature passed 2017 Wisconsin Act 317 (“Act 317”) on April 16,

2018, amending Wis. Stat. §66.0104, the effect of which prohibited a municipality from having a rental licensing program; and

WHEREAS, the City suspended enforcement of its rental licensing program in order to study

the new State law and its effects on inspection programs; and WHEREAS, Act 317 permits a municipality to establish regularly scheduled inspection

programs of residential rental units in districts in which a municipality has determined there is “evidence of blight, high rates of building code complaints or violations, deteriorating property values, or increases in single-family home conversions to rental units; and

WHEREAS, in conjunction with consideration of this Resolution, your Public Health & Safety

Committee, at its September 16, 2019, meeting recommends the Common Council approve an ordinance creating a regularly scheduled residential rental inspection program proposed as W.M.C. §16.04.039 Residential rental inspection; and

WHEREAS, the City Division of Inspection and Zoning (“Division”) has studied the numbers and locations of rental properties throughout the City, the frequency and location of code violations reported from January 1, 2016 through August 13, 2018, and the numbers and locations of rental properties inspected by the City from 2014 thorough 2016 under its previous rental licensing program; and WHEREAS, such review has demonstrated the utility and need for establishing a neighborhood stabilization and enhancement district as set forth in Exhibit 1 (“District”) attached hereto within the City for the purposes of remediating the effects of blight, high rates of building code complaints or violations, deteriorating property values, or increases in single-family home conversions to rental units, and WHEREAS, 2010 Census Bureau, General Housing Characteristics data provides that the District is comprised of 75 % rental units compared to the City –wide average of 42% rental units; and WHEREAS, data provided by the City Assessor’s Office to the Division demonstrates that the average age of housing stock in the District is one hundred and nine years compared to the City-wide average of sixty-five years of age as set forth in Exhibit 2; and WHEREAS, the Divisions has determined the frequency and location of housing code complaints and violations are disbursed throughout the City as is set forth in Exhibit 3 provided by the Division; and WHEREAS, rental properties in the neighborhoods commonly known as “East Towne” and “Longfellow” have been inspected within the past five years under the City’s previous rental licensing program as set forth in Exhibit 4; and WHEREAS, your Public Health & Safety Committee, at its September 16, 2019, meeting, recommends that the City adopt the District set forth in Exhibit 1 as a Neighborhood Stabilization and Enhancement District for purposes of the City’s residential rental inspection program, W.M.C. §16.04.039 and remediating the effects of blight, high rates of building code complaints or violations, deteriorating property values, or increases in single-family home conversions to rental units in said District.

NOW THEREFORE BE IT RESOLVED by the Common Council of the City of Wausau that the District set forth in Exhibit 1 attached hereto is hereby designated as a Neighborhood Stabilization and Enhancement District for purposes of the City’s residential rental inspection program, W.M.C. §16.04.039.

Re: Title 18 – Wausau Electrical Code (Repeal and Recreate)

Purpose: To obtain your approval for the repeal and recreation of Title 18 of the Wausau

Municipal Code. The basis of the current electrical code is 1978 and several new legislative acts

have limited or eliminated local control.

Facts / Considerations:

1. 2015 Wisconsin Act 55 requires statewide uniform enforcement of SPS 316, the

Wisconsin State Electrical Code. No local amendments are allowed.

2. Act 55 required DSPS to develop a program that requires each municipality to either

enforce the electrical code or opt out and have the state enforce the electrical code.

3. In 2019 DSPS developed a program for registered inspection agencies to apply for and be

granted control of enforcing electrical permits and inspections.

4. We wish to continue local control of electrical permits and inspections.

5. In order to be approved as a registered inspection agency, Wausau needs to update our

electrical code to fully adopt SPS 316.

6. Wausau has an existing electrical code that is out dated. The title includes chapters for

board of electrical examiners and licenses. Neither of these chapters are necessary under

the statewide code.

7. The proposed Title 18 Electrical Standards will clear up non-compliant sections of the

ordinance. It also provides clear direction for when permits are required, when

inspections are required, when a homeowner can do electrical installations, and penalties

for violating the ordinance.

18.01.010 Purpose. The purpose of this title is to safeguard life and property by regulating the

proper installation, maintenance and use of electricity and utilization devices by providing for the review

and licensing of persons, firms and corporations undertaking electrical work, by issuing permits for

electrical work, by the inspection of the existing and newly installed wiring, equipment and devices, and

fixing a penalty for violation thereof.

18.01.020 State code and regulations adopted. (a) The provisions of the Wisconsin State

Electrical Code and all regulations and rules adopted thereunder, including any future amendments,

revisions, modifications, or successors thereto, are incorporated herein by reference as part of this title as

if fully set forth herein. Where the requirements of state law adopted herein and the provisions of this

title conflict, the stricter requirements shall govern. Electrical wiring and equipment, properly installed

in accordance with the then-existing electrical code, shall be considered in compliance with this title

unless it poses a safety threat to property or life.

(b) Without limiting the provisions of subsection (a), the following portions of the Wisconsin

Administrative Codes, including any future amendments, revisions, modifications or successors thereto,

are incorporated herein by reference as part of this title as if fully set forth herein:

(1) Wisconsin Administrative Code, Department of Safety and Professional Services

18.01.030 Records. There shall be kept in the division of inspection and zoning, a complete

record of all applications and permits, regularly numbered in the order of their issue, and also a record of

all inspections made and other official work performed under the provisions of this chapter, so arranged

as to afford prompt information concerning electrical installations.

18.01.040 Right of entry. (a) Authority to enter premises. In the discharge of his/her duties and

whenever necessary to make an inspection to enforce any provision of this title, or whenever the

electrical inspector or authorized representative has reasonable cause to believe that there exists in any

building or upon any premises any condition which makes such building or premises unsafe, the

electrical inspector or authorized representative may enter such building or premises at all reasonable

times to inspect the same, require the production of any permit or license required hereunder or to

perform any duty imposed upon by this chapter, provided that if such building or premises be occupied,

he/she shall first present proper credentials and request entry; and if such building or premises be

unoccupied he/she shall first make a reasonable effort to locate the owner or other persons having charge

or control of the building or premises and request entry.

(b) Enforcement. If consent to entry to the personal or real properties which are not public

buildings, or to portions of public buildings which are not open to the public, for inspection purposes has

been denied, or if the owner or other person in charge or control cannot be located, the electrical

inspector shall obtain a special inspection warrant pursuant to section 66.0119, Wisconsin Statutes. No

person shall interfere with the electrical inspector or his/her authorized agent while in the performance

of his/her duties, and any person interfering shall be in violation of this chapter and subject to a penalty

as provided by section 18.09.010 of this title.

18.01.050 Liability. This chapter shall not be construed to relieve from or lessen the

responsibility or liability of any person, firm, corporation or other organization supplying electricity to

or selling, renting, leasing, owning, using, operating, controlling, installing, altering, repairing,

removing, replacing, disturbing, connecting, disconnecting or maintaining any electrical equipment for

damages to persons or property caused by any defect therein or therefrom; nor shall the city be held as

assuming any such responsibility or liability by reason of the issuance, revocation, suspension, voiding

or refusal to issue any license, permit or certificate, or the inspection or reinspection authorized by this

title, or by reason of the approval or disapproval of any electrical equipment, sales, rentals, drawings,

plans, specifications, materials, samples, test reports, literature, information or schedules authorized in

this title. Nor shall the city be held liable for any damages resulting from the enforcement of this title.

Chapter 18.03

ELECTRICAL SECTION AND ELECTRICAL INSPECTOR

18.03.010 Electrical section created; designation of enforcing officer. There is hereby created

within the division of inspection and zoning, an electrical section. The electrical section shall be under

the supervision of the electrical inspector. The electrical inspector will possess the general authority and

control of all matters pertaining to electrical inspections and may enforce all state laws adopted by this

title and city ordinances relating thereto.

18.03.020 Qualifications of electrical inspector. The electrical inspector shall possess a master

electrician license issued by the department of safety and professional services and be a state certified

commercial electrical inspector.

18.03.030 Authority of electrical inspector. The electrical inspector shall have full power to pass

upon any question arising under the provisions of this chapter, subject to the conditions contained in this

title, and shall have the power and authority at all reasonable times, for any proper purpose, to enter

upon any public or private premises and make inspection thereof and to require the production of the

permit for electrical work or the required license therefor. In case of violation of this title or any other

ordinance of the city, the electrical inspector may post a stop order upon the premises after which no

further work shall be performed upon the structure until the premises are brought in compliance. Any

person interfering with the electrical inspector while in the performance of his/her duties may be subject

to a forfeiture as provided in section 18.09.010 of this title.

18.05.010 Electrical permit. (a) Permit required. No building, structure or premises shall be

wired for electric lights, meters, heating units, signs, refrigeration or other electrical wiring nor shall any

electrical equipment be installed nor shall any alteration or change be made in any wiring system, nor

shall electric current be supplied to any new electrical system, before notifying the electrical inspector

and securing a permit and/or authority to proceed with the work.

(b) Permit not required. No permits shall be required for the connection of electrical

equipment having a rating of not greater than 120 volts or 20 amps and having an attachment cord and

cap for connection to a permanently installed receptacle, except that a permit shall be required for the

installation of a new fire alarm system or the replacement of an existing fire alarm system. No person,

firm, corporation, or other organization shall alter or install a fire alarm system without first having

procured a license, as provided in this chapter. A fire alarm system is one where the electrical wiring is

connected to a listed (per Wisconsin Administrative Code, Department of Safety and Professional

Services SPS 316.11, Electrical) fire alarm control panel.

(c) To obtain a permit. A contractor licensed to perform the service for which the permit is

sought, or such person who is otherwise permitted pursuant to Chapter 101, Wisconsin Statutes to

perform the applied-for service, shall first file with the electrical inspector an application for an

electrical permit. The application shall state the name of the owner of the property, the address of the

premises where the work is proposed, a description of all work proposed and other information as the

electrical inspector may request. The required fees as prescribed by this chapter shall accompany the

application.

(d) Temporary work. On applying for a permit for temporary work, a specified period of

time for which such wiring is to remain in service shall be stated. Service shall be disconnected at the

end of this period and not again be connected without written permission from the electrical inspector.

For buildings where conduit wiring is required, special permits for temporary work may be granted by

the electrical inspector for the installation of exposed wiring of lights and power for building operations,

display, decorative lighting, etc., for use for a limited period, subject to discontinuance and complete

removal at expiration, and to condemnation and revocation within such period.

(e) Emergency work. Permits are required for emergency work in accordance with

Wisconsin Administrative Code, Department of Safety and Professional Services SPS 316.012(1)(b).

(f) Emergency. The determination as to the existence of an emergency shall be made by the

electrical inspector.

18.05.020 Electrical permit voided. The electrical permit shall have lapsed and be void unless

electrical work is commenced within 180 days of the date of issuing of the permit or, if work authorized

by the permit is suspended at any time after the work is commenced, for a period of 180 days. Before

such work can be recommenced, a new permit shall be first obtained. A written request from the permit

holder, prior to termination, may extend the electrical permit up to an additional 120 days. A permit that

has lapsed and become void shall not relieve the permit holder of completion of the electrical work to a

safe condition.

18.05.030 Electrical permit revoked. The electrical inspector may revoke a permit or approval

issued under the provisions of this chapter in case of false statements or misrepresentation as to a

material fact in the application or plans on which a permit or approval was based. A permit that has

been revoked shall not relieve the permit holder of completion of the work to a safe condition. Permits

expire in accordance with Wisconsin Administrative Code, Department of Safety and Professional

Services SPS 316.012(3)(b).

18.05.040 Electrical permit refused. No permit shall be issued to any electrical contractor who is

in arrears on the payment of any of the fees or special assessments or who has failed to comply with any

outstanding lawful order of the electrical inspector.

18.05.050 Approval of other permit. The approval or conditional approval of a building,

plumbing or HVAC permit shall not be considered as approval of the electrical plans, electrical

specifications, electrical equipment, or of an electrical permit.

18.05.060 Working without permit; penalty. (a) Penalty. When obtaining an electrical permit

after the work has commenced, the total fee shall be doubled with a minimum fee in accordance with the

fee schedule.

(b) Compliance. The payment of such double fee shall not relieve the permit holder from

fully complying with all the regulations of this chapter or from any other penalties prescribed by this

chapter.

18.05.070 Fee schedule. Fee schedule. Fees charged under this chapter shall be as specified in

section 3.40.010(a).

18.05.080 Refund of fees. A request may be made in writing by the permit holder for a refund of

permit fees, if the request is made within 120 days of the issuance of the permit.

18.05.090 Payment and use of fees. All permit fees shall become property of the city will be

delivered to the customer service office and credited to the general fund.

Chapter 18.07

INSPECTIONS

18.07.010 Inspections.

18.07.020 Homeowner’s privilege.

18.07.010 Inspections. (a) When required and notification. Upon completion of electrical

wiring required to be inspected as hereafter stated or before any electrical wiring is to be hidden from

view, the electrical contractor installing the electrical wiring shall notify the electrical inspector that the

installation is ready for inspection. The request for inspection shall include the permit number and

location of work to be inspected.

(b) Inspection of work. The electrical inspector shall perform the requested inspection

within two business days, exclusive of Saturdays, Sundays and holidays, after receiving notification

from the contractor or a homeowner authorized to perform work pursuant to section 18.07.020 that the

work is ready for inspection. If after two business days an inspection has not been made, the contractor

or homeowner authorized to perform work pursuant to section 18.07.020 shall inform the electrical

inspector of his/her intention to proceed with the work.

(c) Inspection types. Inspections required to be performed shall be of the following types for

the purpose of determining if the work complies with this chapter:

(1) Temporary service,

(2) Service,

(3) A rough-in inspection before concealment of electrical wiring or raceway piping,

(4) Above ceiling,

(5) Final inspection for releasing the installation for its intended use, and

(6) Reinspections, as necessary, to confirm compliance and satisfactory completion

of the electrical work.

(d) Access. The electrical contractor shall provide access for any inspection which is

not readily accessible for an inspection such as, but not limited to, roof tops, tunnels, etc.

(e) Certificate of inspection. For connection of a new or relocated electrical service to any

building, structure or premises, the electrical inspector will issue a certificate of inspection to the electric

company furnishing electrical power and the power company shall not energize said service until

receiving approval from the electrical inspector.

(f) Final inspection. The electrical contractor or homeowner authorized to perform work

pursuant to section 18.07.020 shall promptly call for a final inspection when work is completed and

before the electrical installation is used for its intended purpose. The electrical contractor or homeowner

authorized to perform work pursuant to section 18.07.020 shall ensure the electrical installation is

safeguarded until approved by the electrical inspector.

18.07.020 Homeowner’s privilege. (a) A property owner may personally install electrical wiring

in his/her own single-family dwelling owned by and occupied by him/her as a permanent residence,

provided that said owner shall:

(1) Apply for and secure a permit in accordance with this title.

(2) Pay the required fees.

(3) Do the work himself/herself in accordance with this title.

(4) Apply for inspection.

(5) Receive the approval of the electrical inspector.

(b) The homeowner's privilege does not apply to the following:

(1) New electrical services, or service upgrades.

(2) In-ground swimming pools, spas, or hot tubs.

(3) New construction prior to the issuance of an occupancy permit.

Chapter 18.09

PENALTIES

Sections:

18.09.010 Violations and penalties.

18.09.010 Violations and penalties. (a) Violation. It shall be unlawful for any person, firm,

corporation, or other organization to erect, construct, install, alter, repair, move, demolish, convert,

equip, use, occupy or maintain any building, structure or premises in the city contrary to or in violation

of any provision of this title or to cause, permit or support the same to be done.

(b) Other violations. It shall be unlawful for any person, firm, corporation, or other

organization to violate any other provision of this title.

(b) Penalties. Except as otherwise provided herein, any person who violates any provision of

this title, shall, for each violation, forfeit not less than one hundred dollars nor more than three hundred

dollars. Each day such violation continues shall constitute a separate offense.

(c) Injunctive action and abatement. In addition to the penalties provided in subsection b,

appropriate legal or equitable action may be commenced to obtain compliance or enjoin any person,

firm, corporation, or other organization from violating any of the sections of this chapter.

The Officer detained the male and contacted the Department of Corrections (Madison). They declined to place a hold on the male for the rules violation. The Officer released the male and there was no further action taken.

(1) Event #19106764, 08/11/19 at 9:34 AM: I met with bar management and staff at their request to have a discussion of everyone’s expectations. In my opinion, it was a good meeting, and proactive on their part.

Domino Bar, 740 Washington Street

(1) Event #19103209, 08/04/19 at 1:21 AM: A woman called to report an alleged sexual assault. When talking to Officers, she stated a white male followed her into the bathroom of the bar, into the stall she was occupying. He didn’t touch her in any way, but “came onto her.” When she told him to back off, he did. Officers also spoke with the bartender, who described the woman as having been flirtatious with the male in question, and also varied the description of the male suspect. Officers were going to check with the manager to view video for follow up. The manager reviewed the video and the complaint was not corroborated.

(2) Event #19104897, 08/07/19 at 2:53 PM: A caller who refused to be identified reported seeing a male jump into a car in the parking lot and start attacking a female over a phone. The vehicle left prior to Officers’ arrival. Officers spoke with the bartender, who was unaware of any problems in the parking lot. Officers did not receive enough information to conduct any further follow up.

(1) Case #19007624, 08/10/19 at 11:44 PM: A CSO was conducting downtown patrol when he observed a male walk out of the bar with an open bottle of Budweiser beer. When the male saw the CSO, he threw the bottle in the trash. The male was cited for liquor on the street (Municipal Citation #N1366094). Twenty-Five (25) Demerit Points are recommended for Leaving With Open Container.

Glass Hat Bar, 1203 N 3rd Street

(1) Case #19008179, 08/25/19 at 12:52 AM: A bartender called in to report that a male had broken the front door of the bar. Officers responded and located and arrested the male. The bartender and some patrons stated that the suspect caused a disturbance and ultimately broke the glass in the front door. The male was arrested for Disorderly Conduct and Criminal Damage to Property.

Hiawatha Restaurant & Lounge, 713 Grant Street

(1) Case #19007670, 08/12/19 at 7:23 PM: A bar employee called to report that he suspected a male patron had stolen his personal belongings from a backpack and left the business without paying for food and drinks. An Officer took the complaint and investigated the incident, eventually arresting a suspect for Theft and Fraud on an Innkeeper.

(2) Case #19008419, 08/31/19 at 9:21 PM: An Officer observed a male walking into the business that may have had a warrant. After confirming the existence of the warrant (traffic offense failure to appear), Officers made contact with the male in the bar and arrested him.

Malarkey’s. 412 N. 3rd Street

(1) Case #19007325, 08/03/19 at 1:53 AM: An Officer was patrolling the downtown area via squad car when he observed a male sitting on one of the planters for the 400 block. The male was holding a 16oz. can of Miller Lite beer in his hand. When approached by the Officer, the male admitted that it was “booze.” The male further admitted that he had left Malarkey’s with the can of beer. The male was issued a citation for Liquor on the Street (Municipal Citation #4T80ZFXHNJ). It is recommended that the bar receive twenty-five (25) Demerit Points for Leaving With Open Container.

(2) Case #19007359, 08/04/19 at 1:37 AM: The bouncer called to report that there was a male patron that would not leave the bar. On arrival, Officers made contact with the bouncer who advised the male was stealing other patrons’ drinks and touching female patrons inappropriately. When he asked the male to leave, the male poked him in the chest, pushed him and tried punching him. The male denied being involved in any type of altercation or wrong doing. He was arrested for Disorderly Conduct.

(3) Case #19007552, 08/09/19 at 1:10 AM: CSO stopped a woman that had a 16oz. can

of Budweiser on the sidewalk. The woman was issued a written warning by the CSO (Traffic Warning #W8507) for Liquor on the Street. The bartender told the CSO that he was “pretty busy,” so he wasn’t able to monitor the door. It was noted that there were four patrons in the bar at the time. I recommend twenty-five (25) Demerit Points be assessed for Leaving with Open Container.

(4) Case #19007590, 08/09/19 at 10:41 PM: Officers received an anonymous complaint that there were underage people in the bar. Officer responded to investigate the complaint and located three underage people on the premises. The three underage people were sitting at a table with two people who were of legal drinking age. The three underage people did not have drinks in front of them, but had been drinking. They stated they had been drinking elsewhere, prior to coming into the bar. They stated they were not carded as they entered the bar. When questioned, the bouncer said he had checked two of the underage people’s identifications, and asserted that they must have fake identifications. The two people the bouncer claimed to have checked were not found to have any identification on their person. The three underage people were cited for Underage Drinking. Since they did not appear to have been served alcoholic beverages at the bar, no citations were issued to the bar for serving the underage persons. They were not issued citations, however I recommend that they be issued twenty-five (25) Demerit Points for Underage Person on Premise.

(5) Case #19007819, 08/17/19 at 12:56 AM: A male was stopped by a CSO on the street/sidewalk after being seen with a clear plastic cup with a mixed drink in it. The male was issued a written warning (Traffic Warning #W8510), and it was determined by the CSO that the male had left Malarkey’s with the drink. I recommend twenty-five (25) Demerit Points be assessed to Malarkey’s for this violation.

(6) Case #19007823, 08/17/19 at 2:04 AM: A male was stopped by a CSO on Jefferson Street with what appeared to be a 16oz. can of Miller Lite in his hand. He was issued a citation (Municipal Citation #N1366096) for Liquor on the Street, as he had been warned earlier in the evening by an Officer outside Malarkey’s an hour prior. I recommend twenty-five (25) Demerit Points be assessed for Leaving with Open Container.

(7) Case #19007824, 08/17/19 at 2:12 AM: A male was stopped by an Officer while standing outside Malarkey’s with a red solo cup. He initially tried hiding it from the Officer, then admitted that it was what was left of a mixed drink. He was issued a citation (#N1388313) for Liquor on Street. The bouncer had stopped working at approximately 1:30 AM, and no employees were at the door. The male was indignant upon receiving the citation. I recommend twenty-five (25) Demerit Points be assessed for Leaving with Open Container.

Cabaret Bar, 204 E. Rib Mountain Drive (1) Event #19114331, 08/26/19 at 11:46 PM: The bartender called regarding a

suspicious male patron. The bartender thought the male may be messing with the entertainment machines, and thought he might be waiting for everyone else to leave. She requested that an Officer conduct extra patrol when she was going to close. An Officer responded later in the evening, and observed as she closed. The Officer saw the male in question, and the bartender closed and left without issue. The Officer identified the male afterwards for safety’s sake.

Den Mar, 601 W. Thomas Street

(1) Event #19113483, 08/24/19 at 11:37 PM: A patron called to report that there was a violation of a restraining order. The petitioner called when the respondent showed up at the bar. The respondent claimed she was not aware that the petitioner had been there, and she willingly left.

Jim’s Corner Pub, 1244 S. 9th Avenue

(1) Event #19106907, 08/11/19 at 4:46 PM: A person who refused to be identified called to report an extremely intoxicated person that may have been preparing to drive from the bar. Officers responded and made contact with the male in question behind the bar (not in his car). He was warned of the consequences of driving in the condition he was in, and said he would be getting a cab ride home.

Roc’s Place, 810 S. 3rd Avenue

(1) Event #19102679, 08/03/19 at 1:46 AM: A bartender called regarding an underage person they were trying to remove from the bar. An Officer responded and located the female. She was escorted off the premises. No action taken against the bar since they had called. The underage female was given a warning by the Officer. She said she was brought there by her step-father. The bartender indicated they did not want her on the premises, regardless of whether she was with parent or not.

(2) Event #19106675, 08/11/19 at 1:49 AM: A person that refused to be identified called to report that there was an underage person in the bar. Officers responded and located the same underage woman from 08/03/19. She had not been drinking and was escorted off the property with another warning.

(3) Case #19007743, 08/15/19 at 1:46 AM: Officers responded to the bar in reference to a threat with a gun, called in by a bartender. While Officers were responding, the male left the bar and walked towards M&R Station. He attempted to leave the area in a vehicle, but crashed, and was eventually apprehended. Information obtained by Officers indicated that the male had gotten into an altercation in Roc’s Place, and returned with a handgun. The handgun was allegedly taken from the male in Roc’s, but it was never discovered where the gun went and it was not located. The male denied ever having a gun. The male was arrested for Disorderly Conduct, Resisting an Officer, Probation Hold, OWI and Hit and Run.

(4) Case #19007826, 08/17/19 at 2:03 AM: A bartender called to report that there was a large verbal argument between several male patrons outside the bar. They all left when the bartender announced she was calling the Police. Further investigation led to the discovery of information that the bouncer thought he had broken up the original argument, however the involved people returned, and several of them were armed with handguns, one of which was equipped with a laser sight. A bartender recounted seeing a red dot move across her body. No one was able to identify any of the people involved at the time by anything more than nicknames. One male that later identified as being “involved” was later questioned, but denied being involved. Since there was no recordings available, no further investigation was possible. An informational report was completed.

(5) Case #19007867, 08/18/19 at 1:59 AM: Officers were approaching the bar to conduct an extra patrol. As the Officer was pulling up, he observed what appeared to be a fight just breaking up on the sidewalk outside the bar. Contact was made with the victim, who stated he was outside on the sidewalk when he was punched by the ex-boyfriend of his current girlfriend. The male suspect left as Officers arrived. The victim initially denied to pursue charges, but later changed his mind. The suspect was located on a later date and arrested for battery. On a sidebar, the woman involved between the two males was arrested at the time of the incident for Misdemeanor Bail Jumping (violation of no-drink bond condition).

(6) No Event #; 08/26/19 at 7:00 PM: I responded to the bar, at their request to have a meeting about everyone’s expectations. The owner was concerned due to the previous week’s serious nature of calls. He wanted to be sure he was doing what he could to improve the situation. We went over several suggestions they could enact that would help. Top on the list were to have a video system that records the interior and exterior areas that patrons frequent, to have enough staff to monitor both doors and the exterior areas for underage persons and disturbances, and to take a stand against allowing previous trouble-makers on the premises.

(7) Event #19116346, 08/31/19 at 12:07 AM: A bartender called requesting assistance in removing an intoxicated male from the bar. On arrival, Officers recognized the intoxicated male and assisted him in leaving. The male had come in a short time prior to the call and had not been served due to his intoxication. The male is known to Law Enforcement to be regularly intoxicated and homeless.

M & R Station, 818 S. 3rd Avenue

(1) Case #19007605, 08/10/19 at 12:58 PM: A bartender called to request a welfare check on a male that was on the back end of the property that the bar was on. Officers responded and located a male loitering near the woods. He refused to leave, and when Officers were attempting to escort him from the property, he resisted them. The male was arrested for Disorderly Conduct, Resisting an Officer and cited for Trespass.

(2) Event #19109002, 08/16/19 at 1:37 AM: The owner called to report that there were three people walking down the road threatening people. When asked what he wanted to be done, he simply told the Officers to “do their job.” The male suspect was not located.

(3) Case #19007863, 08/18/19 at 12:21 AM: Officers were in the area conducting extra patrol when advised that an underage person was on the premises. Officers walked over to the bar and observed the female in the premises, walking out the back door. Contact was made with the female in the smoking area behind the bar. It was found to be the same underage female that had been given two prior warnings for being on the premises at Roc’s Place. She was cited for being Underage on Premises. Both the female and the owner claimed the female walked in unexpectedly from the rear of the bar and went right into the bathroom, before he was able to stop her. He acknowledged that she has been removed from the bar in the past. When it was suggested that he had some door security, he stated he didn’t need it.

Whiskey River Bar & Grill, 5512 Stewart Avenue

(1) Case #19008397, 08/31/19 at 7:22 AM: A bar employee called to report a fight. The bartender’s boyfriend came to the bar near the end of the evening (Friday night), and was belligerent and threatening to the bartender and a male friend of hers. They locked him out of the bar, and remained inside, after closing time. They believed the boyfriend had remained outside, waiting to have a confrontation with the male friend. In the morning, another bar employee arrived, and unlocked the bar, letting the boyfriend in. He has slept in a car in the parking lot until that time. A fight between the boyfriend and the bartender’s male friend ensued. The boyfriend left the scene while Officers had just arrived. He was not located, however is being referred for charges of Battery, Disorderly Conduct and Bail Jumping. The Committee may wish to consider twenty-five (25) Demerit Points be assessed for being on the premises after closing hours, as the bartender was quite intoxicated at the time of the call, indicating that she had been drinking throughout the night, or (less likely) extremely intoxicated while still open the previous night. The bartender could also have contacted Police if she was concerned for her safety or the safety of her male friend when they were supposed to leave after closing.

101 Pub, 101 N. 3rd Avenue

(1) Event #19114319, 08/26/19 at 11:04 PM: A person who refused to be identified called to report that there was a male at the bar that had a “no-drink” bond or probation condition. He was causing a verbal disturbance. Officers responded and were unable to locate the male. No further action was taken.

Aftershock Bar and Grill, 1418 Lenard Street (1) Event #19105104, 08/07/19 at 9:56 PM: A named citizen observed a highly

intoxicated woman stumble to her car, and was concerned she was going to drive away. An Officer responded and located the woman. She was in the vehicle, however the keys were not in the ignition. She was waiting for a sober ride to come get her. The ride arrived while the Officer was there, and she was released.

(2) Event #19106693, 08/11/19 at 3:12 AM: A named citizen, who is a Lyft driver, called to report having been called to pick up a ride at the tavern. On arrival, the ride was waved off, as the male caller decided to get a ride with a female. The female, however, according to the Lyft driver was highly intoxicated and “could barely walk.” An Officer responded, however he was not able to locate the described vehicle for the female driver.

(3) Event #19106959, 08/11/19 at 7:11 PM: A named citizen called to report that there was a highly intoxicated male staggering around in the parking lot, and was concerned that the male was going to drive. An Officer responded and made contact with the intoxicated male, who was back in the bar. The male assured the Officer that he would be getting a safe ride home. The Officer also spoke with the bartender, and mentioned that there has been a neighborhood concern expressed regarding over-serving, highly intoxicated people, urination in public outside the bar, and people leaving the bar driving while intoxicated. The bartender said he would advise the owner of the concerns as well.

(4) No Event: A citizen contacted the Police Department, voicing the concerns mentioned above. As a result, Officers have been conducting a total of eight documented extra patrols, and likely more that have not been documented. Those that are documented note that there have only been a few cars in the parking lot, and no activity outside the bar. Patrols will continue.

The Chatterbox Bar, 102 S. 2nd Avenue

(1) Event #19110053, 08/18/19 at 8:12 AM: A citizen called the Police to assist with a civil matter in which the caller wanted to repossess a vehicle from a male that was intoxicated at the bar. He wanted the Officer to make sure the incident went peaceably. The Officer responded and the two men talked the issue out. No problems were encountered.

(2) Event #19116723, 08/31/19 at 10:29 PM: Officers responded to the bar for a report of an elderly woman that was possibly having a stroke. Officers arrived and assisted the medical personnel with what amounted to a medical issue only.

The Labor Temple, 318 S. 3rd Avenue (1) Case #19007850, 08/17/19 at 7:29 PM: Officers conducted a standard bar check.

The discovered that the bartender tending bar in the lower level did not have a valid bartender’s (operator’s) license. The licensed bartender was in the upper level, tending bar there. As the licensed bartender was not able to directly observe the unlicensed bartender, the unlicensed bartender and the agent received citations for No Licensed Bartender. It is recommended that fifty (50) Demerit Points be assessed to the Labor Temple for No Licensed Bartender.

Showtime Gentlemen’s Club, 1709 Merrill Avenue

(1) Event #19103568, 08/04/19 at 11:28 PM: A bar employee called to report suspicious activity. A male patron that was in the bar had written some things on a drink napkin that was observed by the bartender. The notes were about guns, and “how many steps from the door.” This concerned the bartender, who notified the bouncer, who then called the Police. An Officer responded and made contact with the patron. He was a Police Officer from out of the area, who was in town for scheduled training that he was going to be teaching. He was writing notes down regarding the lessons he was going to be teaching the following day (Active Shooter training). The male was about to drive from the bar, but was stopped by our Officer, who felt the male had likely had drunk too much to safely drive. The male walked from the bar at the time. Our Officer checked the area again later and found the vehicle the male was going to drive was gone.

(2) Case #19008180, 08/25/19 at 12:09 AM: A named citizen called to report that there was a dancer working there that was not supposed to be in a bar, according to her probation rules. Officers responded and made contact with the dancer, and with after-hours Probation/Parole. Probation/Parole authorized a hold to be placed on the woman, so she was arrested and taken to Jail without incident.

Newch’s Eatery, 1810 Merrill Avenue (former Chapter 2)

(1) Case #19008345, 08/29/19 at 6:11 PM: Officers responded to a report of a silent hold-up keychain fob alarm. There was no phone number listed for the site, although the owner’s name was located with a phone number. There were no notes indicating the outcome of the call, however since a case number was obtained, I believe a false alarm report was likely completed.

ALCOHOL BEVERAGE DEMERIT POINTS ASSESSED Labor Temple is recommended to be assessed fifty (50) Demerit Points for No Licensed

Bartender. Malarkey’s is recommended to be assessed with a total of one hundred fifty (150) Demerit Points for Underage on Premise, and several violations of Leaving with Liquor. Jalapeno’s is recommended to be assessed twenty-five (25) Demerit Point for Leaving with Liquor. Whiskey River Bar and Grill may be assessed twenty-five (25) Demerit Points if the Committee thinks it is appropriate for Open After Hours.

Whiskey River Bar and Grill had 25 Demerit Points drop off for time. They stand ar twenty-five currently. Den Mar dropped to zero (0) Demerit Points due to time without a violation.
