Repeal Section 19, Mississippi Constitu­tion of 1890, which reads as follows:

Section 19. Human life shall not be im­periled by the practice of dueling; and any citiizen of this state who shall hereafter fight a duel, or assist in the same as second, or send, accept, or knowingly carry a chal­lenge therefor, whether such an act be done in the state, or out of it, or who shall go out of the state to fight a due l, or to assist in the same as second, or to send, aC(.'Cpt, or carry a challenge, shall be disqualified from holding any office under this Constitution, and shall be disfranchised. Amend Section 106, Mississippi Constitu­tion of 1890, to read as follows:

Section 106. There shall be a state li­brarian, to be chosen by the Legislature, on joint vote of the two (2) houses, to serve four ( 4) years, whose duties and compensa­tion shall be prescribed by law. BE IT FURTHER RESOLVED, That the

Secretary of State is hereby directed to give public notice of an election in the manner and for the time provided by Section 273, Mis­sissippi Constitution of 1890, and an election is hereby called and fixed to be held on the first Tuesday after the first Monday io November, 1978. for the purpose of sub­mitting this and other amendments to the Mississippi Constihltion to qualified electors of this state for approval or rejection, said election to be conducted and held as provided hy law for statewide general election.'i.

No person shall, for any in­dictable offense, be proceeded against crimi­nally by information, except in cases arising in the land or naval forces, or the miUtary when in actual service, or by leave of the court for misdemeanor in office or where a defendant represented by counsel by sworn statement waives indictment; but the Legis­lature, in cases n()t punishable by death or by imprisonment in the penitentiary. may dispense with the inquest of the v,rand jury, and may authorize prosecutions before jus­tice court judges, or such other inferior court or courts as may be established, and the proceedings in such cases shall be regulated by law. Chapter No. 429, Laws of I978. The ballot shaU contain the names of all candidates who have been put in nomination not less than sixty ( 60) days previous to the date of the election, by the primary election of any poli­tical party. This Section also provides for the nlacing on the bal1ot the names of candidates by petition, etc.

The names of the candidates shall be listed under the name of the political party each candidate represents.
