NEIGHBOURHOOD CHARACTER & SITE DESCRIPTION The property is in a TZ - schedule to the Township Zone and DD012 - Schedule 12 to the Design & Development Overlay.
Total site area is 1011.78m2
The site is a corner allotment bounded by no.26 Birregurra Road to the west, lot 2 /38 Beal Street to the south, and the road reserves of Molesworth and Beal Streets to the north & east respectively. The site is accessed via an existing driveway/gate from Molesworth Street.
The site is essentially flat, fall being approximately 200mm south to north. There is currently post & wire fencing on all boundaries except for the southern boundary. (refer: site context 261.0, site existing conditions 261.1 and site proposed 261.2)

To the south at Lot 2 /38 Beal Street is a single storey, weatherboard, render & colorbond steel clad residence. Setback from the southern boundary of lot 1 is 8.54m to the dwelling and 4.54m to the north-facing deck. Setback to Beal Street (east) is 6.00m and 12.48m to the western boundary. DESIGN PROPOSAL The design proposal for Lot 1/38 Beal Street is for the construction of a single storey dwelling. Preferred siting is to the south-west corner of the site to make the most of the northern aspect & to create a green buffer to the road.
A simple single skillion roof design with carport, the dwelling is essentially a rectangle dwelling with carport to the north - in-line with the property access off Molesworth Street. There are 3 bedrooms with a central, north-facing living area. A generous, partially covered deck is off this living area.
Construction is lightweight on stumps & bearers clad in a combination of cement sheet with colourbond corrugated steel & weatherboard highlights. (refer: site proposed 261.2, floor plan 261.3, elevations north & south 261.4 and elevations south & east 261.5)
LEVELS/HEIGHTS Landfall is essentially flat, falling approximately 200mm south to north. The floor is a single level elevated timber floor with a finished floor level of RL110.20. The overall highest point of the dwelling above natural ground level will be 4.75m (RLI13.95) at the north-west corner of the skillion eave/fascia. (refer: site proposed 261.2, floor plan 261.3, elevations north & south 261.4 and elevations south & east 261.5)

VARIATION A Variation to schedule 12 to the Design & Development Overlay is sought regarding setbacks. Table 1 to Schedule 12 Design Standards states that the rear setback minimum is to be lOm.
Consideration for a variation is sought on the basis that, as a corner site, the philosophy behind the 10m minimum rear setback overlay requirement is no longer relevant. There being no other adjoining dwelling/site to the north to conform with. The proposed siting also takes into account the northerly aspect the dwelling at lot 2 enjoys, which it has been designed for. (refer: site proposed 261.2, floor plan 261.3, elevations north & south 261.4 and elevations south & east 261.5)
