DEPARTMENT OF EDUCATION FOR TITLE II, PART A

Approve Memorandum of Understanding (MOU) with the California Department of Education as required by Section 2141 (c) of the Elementary & Secondary Education Act/No Child Left Behind. The MOU asserts that the District shall 1) develop and utilize professional development strategies and activities to ensure that 100% of teachers become highly qualified; and 2) prohibit the use of funds under Title I, Part A to fund any paraprofessional who does not satisfy the requirements of Section 1119 (c), which includes two years of postsecondary education, an associate's degree or higher, or, for an applicant with a high school diploma, the demonstration of necessary skills on a formal state or local academic assessment, unless the District can demonstrate significant student enrollment increase or there is an increased need for translators or assistance with parental involvement activities. Board of Education LONG BEACH UNIFIED SCHOOL DISTRICT

______________________________________________________________________________ SUBJECT: Charter Petition from Direct Instruction Entrepreneurial Academy ______________________________________________________________________________ CATEGORY: NEW BUSINESS Reason for Board Consideration: Action Date: December 2, 2014 ______________________________________________________________________________ CONSIDER ADOPTION OF RESOLUTION DENYING DIRECT INSTRUCTION ENTREPRENEURIAL ACADEMY CHARTER PETITION Background: Sections 47600 through 47616.7 of the California Education Code provide for the establishment of charter schools and further provide that petitions for charter schools are to demonstrate certain specific elements in order to be approved. The governing board of the Long Beach Unified School District (LBUSD) received a proposal for establishment of a charter school for Direct Instruction Vital for Achievement at its regularly scheduled Board Meeting on October 7, 2014. In accordance with Education Code 47605, a public hearing was conducted on November 4, 2014 for the purpose of considering the level of support for the charter petition by teachers employed by the district, other employees of the district, parents, and community members. Pursuant to Education Code section 47605(b), the governing board of a school district shall not deny a petition for the establishment of a charter school unless it is not satisfied that granting the charter is consistent with sound educational practice and it makes written factual findings, specific to the particular petition, setting forth specific facts to support the findings. District staff has been carefully and thoroughly reviewing the charter proposal. The proposal has been assessed against the standards and requirements, as set forth in the Education Code, in order to develop final recommendations. District staff has noted a number of issues and concerns. Several of the most significant of the concerns noted are included as proposed findings in Resolution No.120214-B. The specific factual findings in the recommended Resolution are within the following statutory findings for denial of the Charter:

A. The petitioners are demonstrably unlikely to successfully implement the program set forth in the Petition. [Education Code Section 47605(b)(2)]

B. The Petition does not contain reasonably comprehensive descriptions of all of the elements required by law. [Education Code section 47605(b)(5)]

Recommendation: The Superintendent of the Long Beach Unified School District recommends that the Board of Education adopt Resolution 120214-B, which denies the Direct Instruction Entrepreneurial Academy charter petition, based on findings enumerated in said Resolution. SUBJECT: Adoption of Initial Reopener Bargaining Proposals from the Long Beach Unified School District to the California School Employees Association (CSEA), Long Beach Chapter 2, Units A and B Enclosures: None _____________________________________________________________________ CATEGORY: New Business Reason for Board Consideration: Action Date: December 2, 2014 BACKGROUND; On November 18, 2014, the District’s Initial Reopener Bargaining Proposals for collective bargaining were presented by the Long Beach Unified School District for Collective Bargaining Agreements to the California School Employees Association, Chapter 2, for both Units A and B. In compliance with Government Code, Section 3547, the public hearings on these proposals are scheduled for the regular meeting of the Board of Education on December 2, 2014. The initial announcement of the public hearings was provided during the regular scheduled Board of Education meeting which was held on November 18, 2014. Copies of these proposals have been available for public study in the main office of all elementary, middle, and high schools, the lobby of the administration building, and the office of the Assistant Secretary to the Board of Education. RECOMMENDATION; The Superintendent of Schools recommends approval of the District's Initial Reopener Bargaining Proposals for collective bargaining which were presented by the Long Beach Unified School District on November 18, 2014 for Collective Bargaining Agreements to the California School Employees Association, Chapter 2, for both Units A and B. AUTHORIZING CHIEF BUSINESS & FINANCIAL OFFICER TO COMPENSATE BOARD MEMBER FELTON WILLIAMS FOR

ABSENCE AT BOARD MEETING Whereas, Felton Williams is a member of the Board of Education of the Long Beach Unified School District; and, Whereas, Felton Williams was unable to attend the special Board meeting of November 17 and November 18, 2014, due to illness as referenced in Education Code Section 35120,

Now, Therefore Be It Resolved, that the Chief Business and Financial Officer is authorized to provide for compensation from District funds in an amount equal to his compensation had he attended the special Board of Education meeting scheduled for November 17 and November 18, 2014.
