SUBJECT: Sexual Health and HIV/AIDS Prevention Enclosures: One Instruction Board Policy #6142.1 CATEGORY: Superintendent’s Item Reason for Board Consideration: Action Date: August 17, 2016 BACKGROUND: Education Code 51934 requires districts to provide HIV/AIDS prevention instruction to students in grades 7–12. Previously, districts were not required to provide comprehensive sexual health education. New legislation (AB 329) requires that the district provide both a comprehensive sexual health education and HIV prevention education to students in these same grade spans. Additionally, the new law clarifies parental consent, requiring that a “passive consent” or “opt out” process be used for both HIV prevention education and sexual health education. Districts are required to notify parents/guardians of the opportunity to request that their child not receive the instruction, but students will receive the instruction unless their parent/guardian submits a written request. The attached revision of Board Policy #6142.1 reflects changes in policy language due to changes in Education Code. Revisions are reflected in bold and lined out language. The revised policy satisfies the requirements set forth in the California Department of Education's Categorical Program Monitoring of the district's comprehensive sexual health and HIV/AIDS prevention instruction. This revised policy is supported by revised Administrative Regulations which provide sites further guidance necessary to implement the proposed Board Policy. INSTRUCTION BP 6142.1 Sexual Health and HIV/AIDS Prevention Instruction The Governing Board desires to provide a well-planned, integrated sequence of medically accurate and inclusive instruction on comprehensive sexual health and human immunodeficiency virus (HIV) prevention. recognizes that the purpose of The district's sexual health and HIV/AIDS prevention instruction is to educational program shall provide students with the knowledge and skills necessary to protect them from unintended pregnancy and sexually transmitted diseases infections and to have healthy, positive, and safe relationships and behaviors. The district’s educational program shall also promote the understanding of sexuality as a normal part of human development and to encourage students to develop and the development of healthy attitudes and behaviors concerning adolescent growth and development, body image, gender roles, sexual orientation, dating, relationships, marriage, and family. The Board therefore desires to provide a well-planned sequence of instruction on comprehensive sexual health and HIV/AIDS prevention. (Education Code 51934) The district’s curriculum shall support the purposes of the California Healthy Youth Act as specified in Education Code 51930-51939, be unbiased and inclusive of all students in the classroom, and be aligned with the state's content standards, based on medically accurate and factual information, and designed to teach students to make healthy choices and reduce high-risk behaviors. The district’s program shall comply with the requirements of law, Board policy, and administrative regulation and shall respect the rights of parents/guardians to supervise their children’s education on these subjects and to impart values regarding human sexuality to their children. The Superintendent or designee may appoint a coordinator and/or an advisory committee regarding the district’s comprehensive sexual health program. This advisory committee shall represent a divergence of viewpoints and may participate in planning, implementing and evaluating the district’s comprehensive sexual health education program. The Board shall consider the advisory committee’s recommendations when approving the district’s program. Parent/Guardian Consent Annually, parents/guardians shall be notified, in the manner specified in the accompanying administrative regulation A parent/guardian that they may request in writing that his/her their child be excused from participating in HIV/AIDS prevention or and comprehensive sexual health education. SUBJECT: Placement in Mathematics Courses Enclosure: Two Board Policy # 6152.1 CATEGORY: Superintendent’s Item Reason for Board Consideration: Action Date: August 17, 2016 BACKGROUND: Board Policy # 6152.1 Placement in Mathematics Courses delineates the District’s fair, objective, and transparent mathematics placement considerations and criteria as required pursuant to Education Code 51224.7, as added by SB 359 (Ch. 508, Statutes of 2015). The Policy states that students shall be enrolled in mathematics courses based on the placement protocols and that no student shall repeat a mathematics course which he/she has successfully completed based on these placement protocols. According to a report released in 2013 by the Lawyers' Committee for Civil Rights of San Francisco Bay Area, Held Back: Addressing Misplacement of 9th Grade Students in Bay Area School Math Classes, in many districts, high school freshmen who have successfully completed Algebra I in 8th grade are placed in 9th grade Algebra I class. In adding Education Code 51224.7, the legislature declared that placement in appropriate mathematics courses is critically important for a student in his/her middle and high school years, and that misplacement in the sequence of mathematics courses creates barriers for educational success, especially for students of color. Exhibit A, Mathematics Placement Protocols, provides guidance to administrators, counselors, and teachers for the use of multiple measures to place middle school students in mathematics courses as well as the placement in mathematics courses for students transitioning to high school. INSTRUCTION Placement in Mathematics Courses The Governing Board believes that a sound educational program must include the study of subjects that prepare students for admission to higher education and/or a fulfilling career. To the extent possible, district students shall be provided an opportunity to complete a sequence of mathematics courses recommended for admission into the University of California and California State University systems. The Superintendent or designee shall work with district teachers, counselors, and administrators and the representatives of feeder schools to develop consistent protocols for placing students in mathematics courses offered at district high schools. Such placement protocols shall systematically take into consideration multiple objective academic measures that may include, but are not limited to, interim and summative assessments, placement tests that are aligned to state-adopted content standards in mathematics, classroom assignment and grades, and report cards. Students shall be enrolled in mathematics courses based on the placement protocols. No student shall repeat a mathematics course which he/she has successfully completed based on the district's placement protocols. When a student does not qualify to be enrolled in a higher level mathematics course based on a consideration of the objective measures specified in the placement protocols, he/she may nevertheless be admitted to the course based on the recommendation of a teacher or counselor who has personal knowledge of the student's academic ability. The placement protocols shall specify a time within the first month of the school year when students shall be reevaluated to ensure that they are appropriately placed in mathematics courses and shall specify the criteria the district will use to make this determination. Any student found to be misplaced shall be promptly placed in the appropriate mathematics course. Within 10 school days of an initial placement decision or a placement decision upon reevaluation, a student and his/her parent/guardian who disagree with the placement of the student may appeal the decision to the Superintendent or designee. The Superintendent or designee shall decide whether or not to overrule the placement determination within 10 school days of receiving the appeal. The decision of the Superintendent or designee shall be final. (cf. 5123 - Promotion/Acceleration/Retention) District staff shall implement the placement protocols uniformly and without regard to students' race, sex, gender, nationality, ethnicity, socioeconomic background, or other subjective or discriminatory consideration in making placement decisions.

(cf. 0410 - Nondiscrimination in District Programs and Activities) The Superintendent or designee shall ensure that all teachers, counselors, and other district staff responsible for determining students' placement in mathematics courses receive training on the placement protocols. (cf. 4131 - Staff Development) Prior to the beginning of each school year, the Superintendent or designee shall communicate the district's commitment to providing students with the opportunity to complete mathematics courses recommended for college admission, including approved placement protocols and the appeal process, to parents/guardians, students, teachers, school counselors, and administrators. This policy and the district's mathematics placement protocols shall be posted on the district's web site. Middle School Math Course Placement Recommendations

Spring 2016 These guidelines serve as a recommendation for student placement in middle school math classes. Decisions regarding student placement require the consideration of various other factors including interim and summative assessments, classroom assessments, assignments, and grades. When grades are used to determine course placement, the semester grade is used as a predictor for the final grade. After the final grades are issued, student placement should be re-examined, and the final grade should be used for course determination. In the diagram below, the arrows indicate the achievement grades suggested for placement into each course. Each arrow is numbered and described below. 1. Students in Math 6 with any grade in the course should be placed into Math 7.

Why shouldn’t a high achieving student in Math 6 take Math 7 ACC the following year? The Math 6 course addresses all of the 6th grade California Standards. The Math 6 Accelerated course addresses all of the 6th grade standards and about one-half of the 7th grade standards. The 7th grade standards addressed in Math 6 ACC are not taught in Math 7 Accelerated. A student cannot take Math 6 in the 6th grade and then Math 7 ACC in the 7th grade because the students would not learn the omitted 7th grade content.

2. Students in Math 6 ACC with a D or F should be placed into Math 7. 3. Students in Math 6 ACC with an A, B, or C should be placed into Math 7 ACC.

Why should a student struggling in Math 6 ACC take Math 7 the following year? The accelerated course sequence of Math 6 ACC and Math 7 ACC compacts the 6th, 7th and 8th grade standards into a two-year course sequence. In these fast-paced courses, students are required to master the content with fluency, depth of understanding, and the ability to apply the mathematics to never-before-seen problems. The non-accelerated sequence also

requires students to master the content with fluency, depth of understanding and problem solving skills, but provides more time for students to develop their understanding of each unit of study. The Math 7 course will prepare students for Math 8, a course which is as rigorous and demanding as the previous Algebra course taught in 8th grade in LBUSD.

Why are only “A” and “B” students from Math 7 recommended for Algebra 1? The Math 8 course is as rigorous and demanding as the previous Algebra course taught in 8th grade. The new Algebra 1 course addresses content previously taught in the second semester of Algebra and several higher level topics, such as exponential functions, arithmetic and geometric sequences, and piecewise functions. Students who have learned the 8th grade standards prior to entering Algebra 1 are likely to be more successful than students having learned only the 7th grade standards. However, according to the authors of the Common Core State Standards, “students who master the K-7 material will be able to take Algebra 1 in 8th grade” (http://www.corestandards.org/about-the-standards/myths-vs-facts/).

The grade 8 standards will transition students effectively into a full Algebra 1 course.

How is the new Algebra 1 course more rigorous than the previous Algebra course? The new Algebra 1 course addresses content previously taught in the second semester of Algebra and several higher level topics, such as exponential functions, arithmetic and geometric sequences, and piecewise functions. The course is more rigorous and demanding than the previous Algebra course taught in the 8th grade. Students who successfully complete Math 7 Accelerated, which includes the linear equation and function work from the 8th grade standards, should be well prepared for this course.

A RESOLUTION OF THE GOVERNING BOARD OF EDUCATION OF THE LONG BEACH UNIFIED SCHOOL DISTRICT SUPERSEDING RESOLUTION NO. 081815-A AND

ESTABLISHING A RESOLUTION IN SUPPORT OF APPLICATIONS FOR ELIGIBILITY DETERMINATION, FUNDING APPLICATIONS, HIGH PERFORMANCE INCENTIVE GRANT

FUNDING REQUESTS AND AUTHORIZATION TO SIGN APPLICATIONS AND ASSOCIATED DOCUMENTS

WHEREAS, the Long Beach Unified School District currently files and intends to continue

to file applications for funding under the School Facility Program as provided in Chapter 12.5, Part 10, Division 1, commencing with Section 17070.10, et seq., of the Education Code; and

WHEREAS, the Long Beach Unified School District has filed and intends to continue to file applications under other State facility programs; and

WHEREAS, a condition of processing the various applications under the above mentioned programs, including applications with the Division of State Architect and the California Department of Education, is a resolution in support of those applications from the Long Beach Unified School District Board of Education and signatures of the Long Beach Unified School District Administration; and

WHEREAS, the Long Beach Unified School District intends to request additional grants for high performance incentive funding under the School Facility Program, when applicable; and

WHEREAS, a condition of requesting high performance incentive grant funding is a resolution in support of the high performance incentive grant funding request and intent to incorporate high performance features in future facilities projects from the Long Beach Unified School District Board of Education; and

WHEREAS, the Long Beach Unified School District wishes to submit applications for eligibility determination and funding for programs including, but not limited to, modernization, new construction, career technical education, joint use, charter school, and/or overcrowding relief grant;

NOW, THEREFORE, BE IT RESOLVED that the Board of Education of the Long Beach Unified School District does hereby resolve, determine, and order as follows:

A. Resolution No. 081815-A establishing support of applications for eligibility determination, funding applications, high performance incentive grant funding requests and authorization to sign applications and associated documents is superseded by Resolution No. 081716-A.

B. The Long Beach Unified School Board of Education is in support of necessary applications under the School Facility Program, including applications to the California Department of Education.

C. The Long Beach Unified School Board of Education is in support of requesting additional

grants for high performance incentive funding when applicable.

D. The Long Beach Unified School Board of Education intends to incorporate high performance features in future facilities projects.

with the applications for funding, including forms for the California Department of Education:

The Governing Board for the Long Beach Unified School District (“District”) submits this initial proposal to the Teacher Association of Long Beach (“TALB”) for the 2016-2017 negotiations. The Board proposes to maintain the provisions of the current certificated collective bargaining agreement except as modified below: ARTICLE V: DAYS AND HOURS OF EMPLOYMENT A.7. Clarify activities that can be performed as part of adjunct duties. A.14. Add new language requiring the use of a district-selected online grading and

communication program. B. 6. Add new language to address less than effective performance. ARTICLE VI: COMPENSATION A.1. Discuss salaries in light of the current District budget and state revenues. B. Review contract language for health and welfare benefits.

New: Add language to address schedule of pay for employees who are assigned to sites on

non-traditional or standard year-round school calendars. New: Enter into a memorandum of understanding to implement the recommendation of

moving from payroll on a quadriweekly (QW) basis to payroll on a monthly basis. ARTICLE X: CLASS SIZE AND STAFFING RATIOS A. Discuss optional approaches for secondary classes that focus on caseloads. F. Review language for the special education day class average for the District. New: Add language regarding caseloads for itinerant staff.

ARTICLE XII: EVALUATION PROCEDURE G.5. Clarify language of requesting another manager for formal observation conducted

jointly. H. Consider revisions to the evaluation forms for non-classroom based unit members, an
