D. SUMMARY OF TESTIMONY & DISCUSSION

Senator Barnes: Bill 193-30 introduced by Speaker Judith T. Won Pat, Telo Taitague, Tina Muna Barnes, A.B. Palacios Sr., An act to place the Merizo Pier Park under the jurisdiction of the Merizo Mayors Office. I invite the mayor of Merizo to come back. I understand that the director of parks and recreation is also here to present testimony but before we have them present their testimony, I want to invite the author of the legislation,

Speaker Won Pat to say some brief remarks and then we will seek presentation from those who are here.

Speaker Won Pat: Thank you very much madam chair. I went around and visited all the mayors last year and my intent at that time was to talk about ground maintenance at the schools and while I was there some of the mayors at relayed some of their concerns some request or assistance from the Guam Legislature. One of the things that came up was that mayors are very proud of their villages and what they have to offer. Even if they don't have the sufficient resources or funding to maintain they took upon themselves to take it out of their pocket and free volunteerism. One of the concerns in this bill that resulted is the Merizo mayor had actual done a lot of work with the pier. And because it's a tourist sight the pavilion at the park needs to be maintained, painted, he has gone to the extent of providing water service as well to the fishermen the individuals that swim there and all basically at the mayors cost. More importantly if there's going to be an event the mayor would have to go to parks and recreation to request this particular park and only be told that he would have to pay for the usage of the park like everybody else. To me that's a slap in the face when it's being maintained by the mayor and the people of Merizo. What this bill will do is place the administrative jurisdiction under the mayor of Merizo. Thank you madam chair.

Senator Dames: Buen Probecho Speaker Won Pat. I will go ahead and yield to the mayor ofMerizo.

Mayor Chargolaf: Thank you madam chair. I don't know if my predecessors have pride or what but even before I came into office in November, shortly after winning the election. I spent about seven hundred dollars out of pocket to run the water lines through the park. Where as, there is only one water line to serve the pavilions the fishermen on the pier and people swimming. So throughout the whole day you have everybody waiting on each other. I wanted to do this before the election but I didn't want people to think I was trying to get votes this way. So I waited until after the election. Like President Obama said, I want to hit the ground running. I didn't wait until after the inauguration, I just took it upon myself with a little effort we can make that park more users friendly. With the help of my employee's and volunteers we were able to run the waterline and we now have five areas for boaters and swimmers to rinse off. I had called the Deputy Director, Mr. Matanane "God rest his soul" and asked him what was his plan for the park because I see a lot of improvements to be made. Especially in regards to the pavilions which is a faulty design. I asked Mr.Matanane if he had any plans to renovate to make the pavilions serve its purpose to protect people not only from the rain but from the sun. His respond is there is no funding to renovate. Then I will need your blessing including the director to sanction. It's very simple just to put an awning and cover the holes that causing all the problems. And it's going to be user friendly. The way it is now, you have to stand outside the pavilion to avoid getting wet. I'm even willing to use the council money or out of pocket. After inauguration the president of Shell donated about 16 fifty five gallon drums to put all over the park. As a result of that the park is much cleaner. People are using them for receptacle where as before there were only two drums. As we were planning for the Guput Chamorro, with the help of everybody we were able to water

blast, paint all the pavilions, the curb inside the park, benches, latte stones and the chains linking them together. This was all paid for by out of pocket and mayoral funding. It's a beautiful park. I told the late Mr. Matanane that he and Mr. Duenas this park is very beautiful and you should go out and inspect the park and make it user friendly. When we were planning the Guput Chamorro, Mr. Duenas was kind enough to waive the user fees. But the week before the event, Mr. Duenas flew over island. Friday I received a call that I can pick up the permit but I have to pay $1,000 user fee. I called Mr. Quinata the acting director and told him what I was doing with the park. He said the $1,000 is to make sure the park is cleaned after the event. I explained to him I've been cleaning the park. Every Friday since I took office, my guys go down there and clean and double the containers to accommodate the weekend trash. Then on Monday they go down again clean the trash in the entire park. I believe the park is in my village and if the mayor is willing I think the director and the government should concede to that. I'm slowly molding the people to use the trash bins in order to keep the park clean. I even emphasize to the people to be responsible drinkers in order to prevent the park from being an alcohol free park. Park. Even the restroom was tom down and there is no place for the people to relieve themselves. They tore the old rest room down with no contingent plan to replace it for people to utilize. Mr. Duenas has seventy parks and I hope he doesn't mind loosing one park. Like I said before, I don't need the funding because I have five hard working guys. I would like to invite you guys and Mr. Duenas to join me when it's raining and windy at the park. And we will go inside the pavilion and see if it serves its purpose. I have this park at heart and I have plans for it. My father served the community and the council wanted me to name the park after him but I have other plans for everybody.

Senator Barnes: Thank you Mayor Chargualaf, Mr. Duenas you can proceed.

Mr. Duenas: Thank you Madam Chair, Speaker Won Pat, members of the committee. For the record my name is Joseph W. Duenas, I'm the Director of Parks & Recreation. Mayor Chargulaf is a great man. There is no doubt if we transfer the park under this mayor because he has done an outstanding job. I didn't prepare a written testimony for you today so I'm going to speak to you from my experience the last six years as director on and off. Had this bill come up back in 2003 I would be supporting it because we don't have the resources and the budget comes every year DPR is last in line that's just the fact of how it goes with the economic situation. The levels of services you're seeing is proportionate to the level of funding we are receiving. I would like to point out that as funding becomes available for example there's an appropriation to build a rest room last year the Merizo pier, the department acted on it so there's a restroom at Merizo pier today. An appropriation was given to this body last year to outsource the public restrooms. We acted on that, today we have clean restrooms. So what I'm saying is the root of the issue on maintenance at public parks. It's not because parks and recreation is managing it's because despite where you put the park or the restroom the root of the problem is funding. The problem is just going to transfer to that entity. An example is Piti Park, The mayor there is an excellent mayor he's my mayor, but the park has been closed for two years to the public. The park was transferred to the mayor but he hasn't had the funding to fix it. Under parks and recreation I think we would have kept the park open. Another example as to why I think the park should stay within the department is because

I think our government needs one consistent policy for all of the parks, so you can hold one body accountable, not nineteen different individuals and nineteen different personalities. The park might be important to Mayor Chargulaf and I know it is. But I can't guarantee that when I'm gone and he's gone it's going to be just important to the next mayor and that's what we found. One of the mayors earlier testified that parks and recreation has seven parks in his village. What he doesn't realize is parks and recs only has one left in his village because they have been transferred by peace meal by the legislature over the last ten or so years. So what I'm finding are the mayors who have the parks in their system the new mayors don't even realize that these parks are under their jurisdiction. Again Mayor Chargulaf is an outstand mayor and every time he has called me I have worked with him. A good example again is youth centers. Back in your days, many of you folks grew up in youth centers under the department of parks and recreation. Prior legislation transferred these youth centers to the mayors who should have a better understanding in their communities and the youth in their communities which makes good sense. But over time what we have found is there are only a few villages left with youth centers. So that is why I am being protective of the parks in my system because I do know beyond my time as director of the department, there's going to be funding for this department when the fiscal situation gets better and it's much easier for you folks, the governor and the community to hold one organization accountable rather then nineteen different elected organizations who all come in with different priorities and agendas. I'm just here to appeal to you that the park system especially the coastline parks, all of the villages should fall under the executive branch of government and maybe I'm supportive in seeing little community parks like playgrounds and what not go to the village mayors. Once example of partnership is the skate park. We outsourced the park, the restroom the grass cutting. Merizo pier we outsourced the grass cutting. The Dededo mayor up north even thought it's not her park per say she goes down there every day and helps us maintain it everyday because she takes ownership of it to. But it's a win win because the funding comes from us, the oversight come from us and the oversight comes from her. Again of course I'm going to try to protect the resources by my department. I really think its good government to have one policy of the park system, hold one individual accountable to that policy and pull them in here when things are not going right. My · concerns are what happen when Mayor Chargulaf leaves. Like he said his predecessor the park was not his priority and that's my concern for the long term. If I was worried about I I would say take the par~ I don't want to deal with it. But I don't think that's the best model for future government when times get better.

Senator Barnes: Thank you. Senator Ada. Senator Taitague

Senator Taitague: Thank you. I'll make this short again. I'm one ofthe sponsors of this bill and one the questions I have is to you Mr. Duenas. How many parks are there in Merizo?

Mr. Duenas: We only have one park in Merizo left which is the Merizo Pier. They have the baseball field and sports facilities under their inventory.

Senator Taitague: Okay then but no parks other then the baseball field? Other then baseball and what else did you say. I'm sorry. Mr. Duenas: What other parks do you have?

Mayor Chargualaf: We have the baseball and two dilapidated children's park which I am about to resurrect it. I'm not about to leave it unsafe because of the extent of the damages to the equipment there.

Senator Taitague: So one baseball and two children's park?

Mayor Chargualaf: We have the park, the two children's park and the baseball field.

Senator Taitague: So other than that there's only one main park which is the Merizo Pier Park?

Mr. Duenas: One third of Coco's Island falls under our inventory.

Senator Taitague: I understand. My question is how much do you pay for maintenance in that park.

Mr. Duenas: We have outsourced it and I don't have the information with me right now. The south was outsourced so there should be regular grass cutting by the contractor. Twice weekly during dry season and three times weekly during rainy season.

Senator Taitague: Would it affect the contract at all if you were to give this to the mayor?

Mr. Duenas: If we were to transfer the park under the mayor what good management would do is direct our financing to other projects.

Senator Taitague: Who pays for the utilities with regards to lights?

Mr. Duenas: The Department of Parks and Recreation. And again when we have transferred parks in the past, we have transferred the utilities

Senator Taitague: Since you have 2010 budget already where we gave you additional monies to help you out, will you be able to maintain the utilities there with regards to the lighting. And still pass it on?

Mr. Duenas: BBMR doesn't think that's good management on our part. When I first came into the department back in 2003, because our budget was cut it went to all the youth centers. If it's under the mayor is should be taken over by the mayor.

Senator Taitague: Mr. Mayor would you be able to handle the utilities from your budget?

Mayor Chargualaf: The other mayors have gymnasium. I didn't even ask for additional funding to staff that youth center. I'm pretty sure we can accommodate even if I have to maneuver my own funds. With the Mayors Council I will try to find funds to cover it. r m not much for the funding. Like I said, I want to rename that park where it will touch more families. I would like to rename that park "The Sons of Maleso War Casualties" and "Meleso Veterans Park". These families will be encouraged to clean and adopt the park.

Senator Taitague: There's no doubt in my mind Mr. Mayor the love you have for your village and your father and the park itself. I definitely share your sentiments being from Inarajan and going to Merizo to play volleyball. I know the people of Merizo would take care of the park. Joe with these areas of concern it's easily remedied by turning it over. I doubt that this mayor will not be in there for twenty years like his father. If certain mayors cannot take that responsibility through legislation we can also give it back to Parks & Rec. In the south people really take pride.

Mayor Chargualaf: I had a discussion with Mr. Duenas you can deal with me now because I'm willing to clean it but my successor. It's the same thing if you reverse it. You can deal with me now but what about your successor, he's still going to charge me the deposits. Who has the park with best interest at heart?

Mr. Duenas: Again I have no doubt this mayor will do an excellent job at the Merizo park but again if you look at the history of the parks and youth centers, I think these were the intentions when we started transfer those out. If you drive around the island right now this mayor started the youth center again and its flourishing but if you look at the other areas. The intention started out with the existing mayors in office but over time what we have proven the youth centers have disappeared because maybe they weren't a priority for the existing mayor at the various villages. Yes I've seen it.

Senator Taitague: Thank you madam chair.

Senator Barnes: Thank you. Before we close Speaker Won Pat would you like to share any comments?

Speaker Won Pat: Thank you very much. Its funny when we first introduced this legislation how are thoughts was at the time and then you hear both sides of the story, and both of you have compelling arguments. Maybe what I need to do is look at how many parks are in each village. Maybe you can share that information with me. Which ones are under the mayors? Maybe some of the mayors may want to turn them back to parks and recs. What I want to do before we do the mark up is sit down with you and some of the mayors and the council to take a look at this in a broader perspective and maybe it should stay in the executive branch but it could be memorandum of understanding. In this case when mayors are taking care of these villages they have the jurisdiction in some sense when to use it, how to use it, maintain it but yes the property in terms of title still stays in the hands of the executive branch. Both of you are right because it depends on who comes in different mayors and different directors and whatever their priorities are. And I've seen that where facilities have gone on the way side if it's not a priority. I don't want

that to happen and the mayor here as long as he continues to be a mayor he will continue to maintain. And what happens when your not here and when we are not here could be a different story again altogether. Definitely during the mark up is sit down with you and the mayors. In advance solicit from all the mayors all their parks within their villages and how's that working. Because I know eventually it's going to be a financial burden on the mayors if they are unable to sustain the facilities. I know with gyms and the utilities it's far more expensive and the burden is far greater then others. Madam chair I would like to work with you and your committee the mayors and the director.

Senator Barnes: Thank you Speaker Won Pat. I do know that Mayor Chargulafwould like to respond to your comments.

Mayor Chargualaf: Speaker I don't know if you have a copy of the resolution supported by all the mayors.

Senator Barnes: Yes I have and I was going to share that. And note it for the record resolution 9-10 from the Mayors Council of Guam as introduced by E.T. Chargulaf, Mayor C.S. Tayama, R.B. Blas, and the rest of the mayors and vice mayors from the island of Guam and it was signed in support of on the 16th day of September 2009. Signed by President Carol S. Tayama and Secretary Louis C. Rivera. In closing both of you as I shared with your sentiments with the Speaker both of you have shared compelling presentations in reference to your protection of putting the protocols in place where you have jurisdiction of and Mayor the pride. The best place to put this is in your heart the park is very admirable. I've know you half my life as we have worked very closely together. And I know when you are committed you give not just your 100% but 200 plus percent. I've always said if there is anybody I would like to have on my team it would be you because as we have worked events together in the past we always became winners and I have no reservation stating to the public that if I hadn't heard your presentation by a long shot I would have gone with Mayor Chargulaf because I know where his dedication and commitment is. Losing was not in our vocabulary, we were always winners. I almost felt presentation for his vision and plans I almost as oversight chair felt compel to give him that opportunity but also as oversight chair for parks and recreation I understand and applaud your stand and appreciate you are committed as the director of parks and recs. With that being said, I'm going to work real closely with my colleagues on the mark up with all involved. I truly believe maybe some compromise with a memorandum of understanding or something that can be a win win for both sides. We definitely will work towards that because I think both of you have great intentions and good protocols in place to protect what you both believe what is right for your agency and for your village. Yes I will yield to the speaker.

Speaker Won Pat: I just want to ask one question to the director. When was the restroom at Alupang Beach Park removed?

Mr. Duenas: I'm happy to report not during my time Speaker, it happened when I was at Public Works. The reason they were removed is because they were in violation of the National Flood Program and Guam was on a high risk status there. Public Works had to

demonstrate that facility had to be removed for us to get off of that status. What I was told from Larry Perez we are no longer on high risk status with the National Flood Program.

Speaker Won Pat: So you can't go back and replace it? Or will that continue to be a violation?

Mr. Duenas: If we fixed it within the building guidelines of the flood zone. It should be elevated and what not.

Speaker Won Pat: Are there any plans in the future to look at that.

Mr. Duenas: If we get funding we certainly will do it.

Speaker Won Pat: There's no water flowing out oflpao Beach on the Hilton side at the pavilions.

Mr. Duenas: I'm sorry I didn't know that.

Senator Barnes: I'm going to allow that. Madam Speaker I made it a rule of engagement to stick to the subject but I understand the criticalness of you having to work closely with the director of parks and recs. With that being said, I do know its 1 : 15 in the afternoon. Mayor I would like to thank you for being here all morning and all day. Mr. Duenas, Mr. Sablan the Executive Director of Mayors Council of Guam. III. Findings and Recommendations

The Committee on Municipal Affairs, Aviation, Housing and Recreation fmds that the Merizo Mayor, staff and volunteers are very much interested and its in their heart to make the sacrifices of maintaining the Merizo Pier Park with no additional budget from the Government even to the extend of finding the financial resources to pay for utilizes within their means and through the community. Since Mayor Chargulaf was elected into office, he and his team and maintained the park by cleaning it every Friday and Monday, providing sixteen 55 gallon containers donated by Shell Guam and educating the community to keep the park clean and not to be abusing it in order to prevent it from becoming a alcohol free park. They have also done improvements to the park such as painting, additional water lines and minor repairs to the pavilions.

Based on historical facts Mr. Duenas has encouraged the legislature to have only one agency maintain the parks which is the Executive Branch because not all elected official has the same desire and priorities of interest as Mayor Chargulaf to beautify and maintain his park. In previous years parks and youth centers has been turned over to certain village mayors and now, these parks and centers are no longer being maintained. If the parks are

kept under the executive branch it would be easier to pin point problems and direct them to the one person in charge. As the economic trend gets better, more funding would be provided though annual budget appropriations.

It is the consensus of the legislature after hearing both sides that more study is done on what parks falls under the inventory of Parks and Recreation and which parks falls under the inventory of the individual mayors and the status of these parks and recreational facilities. The legislature would like to meet and work with the Director of Parks and Recreation and each of the village mayors before the mark up and perhaps resolve some of the issues through memorandum of understandings if not through legislation.

AN ACT TO PLACE THE MERZO PIER PARK UNDER THE ADMISITRATIVE JURISDICTION OF THE MERIZO MAYOR'S OFFICE

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. Legislative Findings and Intent: The Merizo Mayor

3 has requested to have administrative jurisdiction of the Merizo Pier

4 and would like to have sole control of the property. Since assuming

5 office, the Mayor has painted the pavilions and has been up keeping

6 the Merizo Pier Park by disposing of trash. The Mayor has also

7 provided water service to all the pavilions including the installation

8 of shower heads for use by individuals who fish and swim in the

9 area. The cost of the additional maintenance and services provided

10 at the Merizo Pier has been absorbed by the Merizo Mayor with no

11 intention of any request for additional funds.

12 Section 2. Transfer of Property. It is the intent of I Liheslaturan

13 Guahan to transfer the Merizo Pier Park from the administrative

14 jurisdiction of the Department of Parks and Recreation to the

2 transfer of said property shall become effective no later than one

3 hundred twenty (120) days from the enactment of this Act.

4 Section 3. A new Item (20) is hereby added to §40113 of Title

5 5 of the Guam Code to read as follows:

6 "(20) The Mayor of Merizo is responsible for the Merizo Pier

7 Park."

1 BE IT RESOLVED BY KONSEHELON MAHOT GUAHAN:

2 WHEREAS, the Office of Mayor of Malesso has taken responsibility for the

3 upkeep of the Merizo Pier Park for the past year by disposing of its trash, repainting

4 the pavilions, providing water service to all pavilions, inclusive of installing shower

5 heads for the use of all who come to the pier for recreation, fishing , and boating; and

6 WHEREAS, the Office of the Mayor of Malesso has provided maintenance and

7 upkeep services through the its own appropriated funds; and

8 WHEREAS, it is the Office of the Mayor of Malesso that can expediently,

9 efficiently, and effectively provide the care and maintenance of the Merizo Pier Park

10 due to its proximity; and

11 WHEREAS, it is the Office of the Mayor of Malesso and its residents that have a

12 vested interest in keeping the Merizo Pier Park in its best form and shape; and

13 WHEREAS, the Merizo Pier Park is an integral part of the culture and history of

14 the people of Malesso; and

15 WHEREAS, it is the Mayor of Malesso that can best coordinate, promote, and

16 effectuate programs, events, and festivities at the Merizo Pier Park; and

17 WHEREAS, the placement of jurisdiction of the Merizo Pier Park under the

18 control of the Mayor of Malesso will not result in any additional expense to the

19 Department of Parks and Recreation; and

20 WHEREAS, the placement of jurisdiction of the Merizo Pier Park under the

21 control of the Mayor of. Malesso will result in giving back to Malesso a park that has

22 always been theirs to enjoy and share with all the people of Guam and our tourists; now
