TENDER EVALUATION

The evaluation of the Tender involves two stages scrutiny:

A. Technical Bid

B. Financial Bid

TECHNICAL BID

The applicant should submit the following documents online as

well as file a copy of the same with the department:

1. Earnest money of Rs. 75,000/- (Rupees Seventy Five Thousand

only) in the form of Demand Draft/ Bankers Cheque issued by a

Nationalized Bank in the name of District & Sessions Judge

(HQs), Delhi along with Scanned copy of EMD as mentioned above.

2. Certificate regarding non-depositing of EMD and registration

status etc., if exemption is claimed.

3. Acceptance of Terms and Conditions of NIT in the given format

as Annexure-A.

4. Photocopy of PAN Card.

5. Service Tax Registration Certificate.

6. The firm should be registered with Delhi Sales Tax Department

for Works Contract Tax.

7. Details of past performances showing satisfactorily executed

ARC projects during last three years. The applicant should have

preferably performed minimum three ARC contacts of minimum

installation 50 LAN Points.

8. Declaration in respect of Non-black listing of the firm.

9. The applicant must be having annual turnover more than Rs.

30,00,000 (Thirty Lacs) in Maintenance Service during the last

three financial years and in support of the same, annex the

copies of the balance sheets of the last three financial years

duly certified by the Chartered Accountant/Company

Secretary/Auditors.

10. Income Tax return for last three financial year’s alongwith

income Tax clearance certificate.

11. Sales Tax/VAT/Service ‘Tax Return’ for the latest assessment

year.

12. Sales Tax/VAT/Service Tax clearance certificate.

13. ISO quality certification, if any.

14. The applicant must be registered as Limited or Private Limited

firm under the Companies Act.

15. The applicant shall enclose details of infrastructure and

backup facility.

16. List of Hardware & Network Engineers on roll of the firm with

their qualification.

17. Rates quoted in the tender shall be in Indian Rupees only.

18. Purchase Orders/Work orders/Certificate of Customers

where network has been implemented during the past two

NOTE:

a. Copy of all the aforesaid documents along with EMD shall

be submitted to the department at Tis Hazari Court

Complex on or before 00/00/2014.

b. Only those firms who fulfill the aforesaid conditions as

mentioned at Sl. No. (1) to (17) shall be eligible for

consideration in the next stage.

c. On the website the applicant should submit these

documents as NSD (Non Sensitive Documents) from my space

column provided to the bidder.

Annexure-II TERMS AND CONDITIONS

1. The Tender submitted after the due date and time shall be

rejected. The quotation must be clearly legible, duly signed by

authorized signatories. Any erasure or alteration must appear

specifically in the quotation. Bidder may visit Office of

District & Sessions Judge (HQs), Delhi for inspecting existing

LAN setup, if required on prior permission of Nodal Officer

(Computer). No disputes regarding the form, nature or quality

of infrastructure and site shall be entertained after submission

of the Bid by the Bidder. 2. Scope of Work:

a. New installation and integration with existing LAN setup

includes but not limited to the following tentative work:

i. It will be duty of the Contractor to have the credential

of the Service Person/Technical Persons deputed for

installation of Local Area Network duly verified and

certified.

ii. The Contractor shall provide Network Certified Engineer

to ensure proper maintenance and management of manpower

and the active passing components deployed for

installation of Local Area Network.

iii. The Contractor shall install Local Area Network by laying

the cable CAT-6 or of other specification matching with

the Local Area Network cables already installed in the

Delhi District Courts.

iv. It shall be the responsibility of the Contractor to ensue

the connectivity of every node and wire (CAT-6 & Fire

optical wire both) with the Central Server installed at

Concerned Delhi District Courts.

v. The Contractor shall ensure that no damage is caused to

the Building/ Court premises and proper repairs and

finishing is to be done after installation of the network.

vi. Indoor UTP Cable Laying through PVC Pipe, Casing including

all materials b) Preparation of Actual Bill of Material based on Survey and

requirements of Office of District & Sessions Judge concerned.

c) Installation of IO/Crimping/Patch Panel/ Rack/ Switch and

System Integration

d) Laying and Termination of CAT6 UTP Cable. All cabling must be

“structured”

e) Network Documentation (on Paper and CD)

f) All the floppy-disc., CD’s, operational manuals, stationery and

similar accessories made available by Equipment vendor would

be handed over by the Contractor to the Office of District &

Sessions Judge (HQs), Delhi after installation work is over.

g) Labeling of Cables, I/Os, Jack Panel, Switches for new

connections h) Repair/Refurnishing work owing to damage caused due to cabling

or any other work related to this Project. There should not be

any hanging or uncovered wire.

i) Patch cord should be branded and factory crimped.

j) Equipment furnished shall be complete in every respect with all

mountings, fittings, fixtures and standard accessories

normally provided with such equipment's and/or needed for

erection, completion and safe operation of the equipment's as

required by applicable codes though they may not have been


specifically detailed in the tender document, unless included

in the list of exclusions. All similar standard

components/parts of similar standard equipment's provided,

shall be inter-changeable with one another. k) The Bidder shall be responsible for providing all materials,

equipment's, and services, specified or otherwise, which are

required to fulfill the intent of ensuring operability,

maintainability, and reliability of the complete equipment

covered under this specification within his quoted price. This

work shall be in compliance with all applicable standards,

statutory regulations and safety requirements in force of the

date of award of this contract. l) The bidder shall also be responsible for deputing qualified

personnel for installation, testing, commissioning and other

services under his scope of work as per this specification. All

required tools and tackles for completing the scope of work as

per the specification is also the responsibility of the bidder.

m) The installation of equipments shall be accepted only after

installation tests are over.

n) The bidder should ensure while installation of LAN, day-to-day

functioning of official work and existing network

setup/connectivity/internet connectivity should not get

disrupted. o) The bidder’s proposal shall include the list of tools (such as

crimping tool, Krone punch tool) and other accessories, which

are required for installation of the connection. No separate

charges for fixing/crimping/other connection charges would be

paid by Office of District & Sessions Judge (HQs).

p) The switches proposed by the bidders must be compatible to the

existing network.

q) The scope covers design/development of a suitable

architecture/layout of the proposed networking system,

preparation of bill of materials, pre-dispatch inspection /

testing, packing and forwarding, transportation, insurance and

carrying out further activities at sites viz. unloading,

storage, (space to be provided by the owner) further handling,

erection, testing and commissioning including successful

completion of acceptance tests and any other services

specified.

r) The office of District & Sessions Judge (HQs) reserves the right

for quantity variation due to increase/decrease in

requirements. The bidder shall also provide all required

equipment which may not be specifically stated herein but are

required to meet the intent of ensuring completeness,

maintainability and reliability of the total system covered

under this specification, including integration and

interoperability with the existing LAN.

s) In case, the quantity of laying cables or fixing wall mount

sockets etc. exceeds or is less than the quantity in bid price

schedule, the payment for the executed quantity shall be paid

on pro-rata basis, for the actual quantities consumed / for

which the installation is carried out through the Bidder on

Certification by Office of District & Sessions Judge (HQs).

t) Any other work required for making the network functional up

to the satisfaction of Office of District & Sessions Judge

(HQs). u) Scope of Work shall also include

• Powering on equipment after ensuring correctness of

terminations interfaces and power supply and making the

system ready for testing and commissioning.

• Testing of LAN Cables after laying, terminations and

ferruling at both the ends. All testing tools and


instruments shall be brought by the bidder and taken back

after the testing.

• Configuration of the equipment as per the requirements of

the office of District & Sessions Judge (HQs) including

Network segmentation and Network Monitoring though

network management software. • Site acceptance tests to establish satisfactory

performance of the equipment's as per specs.

• Assistance for familiarization and operation of the

installed system & services for 6 months after acceptance

of system.

• Onsite warranty for all Installation and Hardware

delivered for minimum one year and extended as per OEM

guarantee/warranty offered. 3. All necessary permissions and approvals (including statuary,

regulatory permissions, approvals etc) required for carrying

out the contract work shall be the responsibility of the bidder. 4. Measurements: For payment purposes the measurement of cables

would be carried out from end to end (measured from the I/O up

to the Patch Panel). 5. Bid Pricing: Prices stated in the Bid-Offers submitted by

Contractors are in accordance with Terms & Conditions in the bidding document. The Bidders further understand that the

quantities and scope of work as specified in this Tender may vary

at the time of Award of Purchase Order as per the discretion and

requirements of Office of District & Sessions Judge (HQs),

Delhi. 6. Payment terms:

a. No advance payment will be made in any circumstance. The payment will be released quarterly after deducting penalty,

if any and on satisfactory completion of assigned work and

on completion of the codal formalities. b. The tenderer/vender will submit the bills for that work to

the concerned Court complex, as per finalized/agreed rates

of Annual Rate Contract and the payment for the same will be

made by the concerned Committee/authority of the Court

Complex. c. If the report received from the any of the Court Complex that

work/services rendered by the successful bidder/vendor are

not-satisfactory then penalty will be imposed, as per the

agreed terms and conditions or as decided by the concerned

Committee and such penalty amount will be deducted from the

outstanding bills. d. The payment will be made after proper deduction of TDS and

other applicable taxes, as per prevailing rule/rates. e. Any payment made in excess will have to be refunded by the

successful bidder/vendor to the department immediately as and

when asked for. f. No escalation of prices shall be permitted on any ground.

Enhancement or decreases of taxes, duties or prices of

components, etc., will not affect the agreed rates during the

entire period; no difference shall be paid or claimed as a

result of the above. g. The Office of District & Sessions Judge (HQs) Delhi or the

Office of District Judge of any District/Court Complex shall

not pay any extra charges. h. The successful bidder/vendor will not have any legal right

to proceed against Department in the event of late payment

due to unforeseen reason/s. 7. Taxes/Duties/Etc.: All applicable taxes should be clearly and

separately mentioned in the commercial bid. 8. Penalty: Failure to supply or commission all or some equipments

on or before the stipulated date/period will entail a penalty


of Rs. 1,000/- per day subject to maximum of total value of the

assigned work and the concerned office will be at liberty to get

the work completed from the other agency and the amount occurred

thereon will be recovered from the outstanding bills or from the

Performance Guarantee or by directing to deposit the same in cash

with the Office of Concerned District Judge.

10. Bank Guarantee: The successful bidder has to submit a

Performance Bank Guarantee (PBG) for Rs. 75,000/- valid up to

the period of expiry of the contract along with the Acceptance

Letter.

11. Earnest Money a. Parties are required to deposit the Earnest Money in the

sum of Rs. 75,000/- (Rs Seventy Five thousand only) in the

form of Demand Draft only in favour of ld. District &

Sessions Judge (HQs), Delhi, No other mode of payment is

acceptable.

b. The EMD shall be refundable to un-successful parties on

written request.

c. No interest shall be payable on Earnest Money by Office

of District & Sessions Judge (HQs), Delhi.

d. The Earnest Money of one quotation case shall not be

off-sated transferred / adjustable towards any other

quotation. 12. WARRANTY:

a. Onsite warranty for all Hardware delivered and installed for

minimum for one year and extended as per OEM Guarantee/

Warrantee period.

b. The equipment must be warranted against all manufacturing /

installation defects for at least a period of 12 months

(Please indicate Guarantee/ Warrantee period offered by you

on the product in your quote) from the date of successful

installation and acceptance.

c. In case, a part thereof or the whole equipment is found

defective the same will have to be rectified/replaced on free

of charge basis without lapse of time. In case the equipments

are not repaired/replaced within the “Service” Time quoted

the Bank Guarantee will be invoked without assigning any

reason. 13. Service Assured

1. The contractor shall complete the Local Area Network within

one month from the receipt of work order failing which a

penalty of Rs. 500/- per day will be imposed.

2. The installation work shall be undertaken only by the

contractor’s authorized persons to maintain the security of

the Delhi District Courts. The vender shall provide the list

of technical persons in advance with their credentials to the

Delhi District Courts.

3. The Tender will be open in the Room No.232, Second floor, Tis

Hazari Courts, Delhi. One representative of the bidder may

remain present. Tender will be finalized after considering

the proposals.

4. All tenderers or any of the tenderer may be called for further

negotiations before considering his/their proposal.

5. The office of District & Sessions Judge (HQs), Delhi shall

have absolute right to select/reject any tender for

installation of Local Area Network basic rate, quality and

services proposed in the tender.

6. The vender is required to submit brochure(s) of the Hardware

proposed to be installed.

7. The Office of District & Sessions Judge (HQs), Delhi has the

right of accepting or rejecting any of all tenders without

specifying any reasons thereof. District & Sessions Judge


(HQs), Delhi obligation to accept the lowest tender.

8. There is no obligation on the part of the District & Sessions

Judge (HQs), Delhi to inform the unsuccessful tenderer qua

the outcome of the tender process and reasons for the

rejection of the tender.

9. The successful vender/contractor shall forthwith

engage/depute qualified Service Person/Operators to install

the Local Area Network in the Delhi Courts to the desired

extent.

10. In case of pecuniary loss suffered by any of the

users/beneficiaries of the Delhi District Courts attribute

the Contractor, District & Sessions Judge (HQs), Delhi will

have the right to forfeit the Security Deposit and in case

of security deposit falls short to match the pecuniary loss

being insufficient, such balance will be recovered from the

payments due to the Contractor.

11. Rates offered in the Tender will not be enhanced after

acceptance of the Tender. No upward revision will be allowed

under any circumstances whatsoever.

12. Under no circumstances, shall the Contractor appoint any

sub-contractor or sub-lease the contract. If it is found that

the contractor has violated these conditions, the contract

will be terminated forthwith without any notice, by the

authority that has approved the award of the contract.

13. The successful Tenderer will be required to furnish security

deposit of Rs.75,000/- (Rupees Seventy Five Thousand Only)

within 10 (ten) days from the date of issue of letter of

acceptance. The security deposit shall be in the form of FDR

through any nationalized bank in favour of District & Sessions

Judge (HQs), Delhi or unconditional Bank Guarantee of any

Nationalized Bank to the equal amount. The security deposit

will be refundable only after completion of the tenure of the

contract. The security deposit will be forfeited, if during

the period of contract, the services of the contractor found

to be unsatisfactory in any respect.

14. Any work order can be terminated by the issuing office

without assigning any reason, if the work of the contractor

is found unsatisfactory from the report of district & Session

Judge.

15. The decision of the department will be final and binding

on the contractor and the department reserves the right to

accept or reject any bid in whole or in part without assigning

any reasons thereof.

16. The bill in triplicate for the executed work on the basis

of approved rates will have to be submitted with the concerned

office.

17. No advance payment shall be made for the job.

16. The contractor shall submit a report on successful

completion of assigned work which shall be verified by the

concerned office and only after the bill related to the said

work will be considered.

17. The job carried out shall be to the satisfaction of the Office

of District & Sessions Judge (HQs) Delhi or the Office of

District Judge of any District/Court Complex after getting

satisfaction from the Concerned Office In-charge (Computers)

of Courts complex.

18. The Office of District & Sessions Judge (HQs) Delhi,

reserves the right to blacklist the agency for a suitable

period or from further participation in any of the jobs to

be done for Delhi District Court and such decision shall be

final and binding on the Contractor.

19. Premature withdrawal of the contract by the Contractor shall


make them liable for forfeiture of the earnest money.

20.Office of District & Sessions Judge (HQs) Delhi reserves the

right to review the performance whenever so desires, and also

to terminate the work order at any point of time during the

installation in case the performance and the service rendered

by the Vender is found to be unsatisfactory.

21. Office of District & Sessions Judge (HQs) Delhi reserves the

right to vary, amend or alter any terms and conditions of the

Tender Document at the time of placement of work Order.

14. Structured cabling

The bidder/contractor is required to install and commission the

structured LAN cabling involving CAT-6 Cabling, surface mount

I/Os, Jack Panels, PVC Conduit/Casing/Capping with accessories

any other required component such as labels, furrieries etc,

and all associated civil work in accordance with the following

guidelines.

a. Carrying out of the required survey prior to

installation work is the responsibility of

successful bidder, if deemed necessary. The

contractor/supplier may be asked to submit to conduct

survey and to submit report before award of any order

for supply and installation.

b. The LAN Cabling job should be carried out under the supervision of certified Engineers.

c. All the wiring should be concealed inside the

conduit/casing and no cable (except Patch Cords)

should be visible to the naked eye.

d. The cabling shall be properly labeled and ferruled so as to facilitate easy identification and

maintenance, the lubing and ferruling shall be

documented.

e. All civil work like cutting, Chasing, drilling, etc. shall be finished to insure smooth leveled surfaced

matching the existing aesthetic of the office to the

extent possible.

f. All waste material shall properly dispose of from this department in an environment friendly manner and

complaint to applicable civil/Municipals guideline.

g. The certify test result has to be submitted to this office in hard copy.

h. The LAN cabling component and the systems (Cables, I/Os, Patch cord & Jack panel) shall EEE 802.3

standard, conform to the TIA/EIA 568 standard and UL,

listed.

i. The PVC conduit/Casing/Capping/all accessories and other required components including labels,

ferrules, and any other propose component shall be

ISI certified.

j. The bidder shall provide the details (Technical Specification, Dimension, Boucher, make, Photo

Catalogue) and conformance to standard mention in the

tender.

k. The registration of LAN switch by the manufacturing


Company is the mandatory and is the responsibility

of the contractor/supplier.

15. Settlements of Dispute

a. In the event of any question, disputes or difference rising

between the parties relating to the interpretation and

application of the provisions of this tender term, such

disputes or differences shall be resolved amicably by mutual

consents.

b. On failure of mutual consents, matter of dispute will be

referred for arbitration to the Sole Arbitrator, who shall

be a Judicial Officer of Delhi Higher Judicial Service and

appointed by the District & Sessions Judge (HQs).

c. The decision of appointed Arbitrator shall be final and

binding upon both the parties (department and successful

bidder/vendor).

d. The arbitration proceedings shall be governed by Arbitration

and conciliation Act, 1996. The venue of arbitration shall

be at Jurisdiction of Delhi.

e. In case of any dispute Delhi courts alone will have the

Jurisdiction. 16. Rights

The Office of District & Sessions Judge (HQs), Delhi has

reserves the right to reject lowest quotation or all the

quotations or accept any quotation or part thereof without

assigning any reason. This Tender Document is subject to change

determined by the needs of the Office of District & Sessions

Judge (HQs) or Delhi District Courts.

17. Evaluation of Bid:

a. Initially the technical bid would be opened.

b. Financial bids of only technically qualified firms would be

opened on the date and time to be informed to the technical

qualified bidders.

c. The L1 bidder will be arrived at on the basis of the grand

total.

d. The Office of District & Sessions Judge (HQs) may use

quantity, unit rate, and tax to recalculate the Sub

Total/Grand Total. 18. The Officer In-charge of Computer Branch of respective Court

Complex shall be the In-charge for the desired work and his

decisions shall be final and binding regarding any matters

related to the terms of this tender /contract.

19. The location where the equipments are to be installed shall be

identified by the Officer In-charge of Computer Branch of

respective Court Complex and communicated through the

work/supply order.

20. The quality of the material being installed should be as per the

approved tender specifications and to the satisfaction of the

Officer In-charge of Computer Branch of respective Court Complex

and if the approved item (s) is/are not available for any reason

or if the quality of such items/equipments found not

satisfactory, the decision of the with regard to substituted

items/ equipment (including variation in rates, if any) shall

be final and binding on the contractor.

21. The award of work shall not be assigned, transferred or

sub-delegated to other Contractors except with the written

approval of Office of District & Sessions Judge (HQs), Delhi.

However this clause shall not apply to purchase of equipments

and material for the performance of the work. 22. The Contractor/ Vendor shall indemnify Office of District &

Sessions Judge (HQs), Delhi against all the losses, destruction

or damages to any property or injury caused or death of any person


caused by the negligent act or omission of the Contractor / their

Employees agent or sub-contractors.

The comprehensive Annual Rate Contract (ARC) of Local Area

Network (LAN) items/periphery shall be carried out at all the

District Courts Complexes i.e Tis Hazari, Patiala House,

Karkardooma, Rohini, Dwarka, Saket or wherever the LAN Nodes &

Switches have been installed or so directed.
