The 11th Hour Gulch is so named because the walls are so tall it is said to only get one hour of sunlight per day. The 11th Hour Gulch is located in Spearfish Canyon near mile marker 20. It is about 20 feet wide and it is just right off of Highway 14A. This is just across the road from “kissing rocks”. Just a few hundred feet north of kissing rocks is a pullout. Park there, cross the road and walk back in the same direction as the kissing rocks. You’ll see the gulch before you get to the rocks.

Attorney General Notes

Crime in South Dakota is a compilation of the efforts of law enforcement statewide. This publication reflects the hard work and dedication that reporting agencies have put forth to accurately report crime in their jurisdictions. Statewide participation is essential because

effective law enforcement requires accurate crime statistics in order to identify trends in criminal activity. In 2011, the total participation rate was 95% with 118 agencies participating. We continue to strive for 100% participation each year to achieve the most accurate stats. The Crime Reporting Program is a voluntary program. Without local law enforcement assistance, the following crime data would not be available. Below is a quick glance at the publication’s contents.

SOUTH DAKOTA CRIME SUMMARY 2011

In 2011, 37,202 Group A Offenses were reported by local law enforcement agencies. Group B Offenses totaled 19,070 completed by 18,770 arrestees.

The majority of the crimes, 40% or 14,847, occurred at a Residence/Home. Highway/Road/Alley accounted for approximately 13% with 4,936 crimes. There were a total of 2,566 Burglaries reported. Forty-six percent of those were forced entry (1,182). More than $17 million worth of property loss was reported in 2011 ($17,847,011). The total stolen was $13,761,874 with 24.9% of that amount reported as recovered by law enforcement officials ($3,426,699). Trucks had the greatest percent of recovery with 97%. South Dakota law enforcement agencies reported 14,570 Group A arrests and 18,770 Group B arrests in 2011 for a total of 33,340 arrests. In 2011, juvenile arrests accounted for 19% of the total arrests (6,342). The number of reported arrests in 2011 for DUI was 5,775. This represents a decrease of one arrest from the total of 5,776 reported in 2010. Arrests for drug offenses increased 18%. In 2011, 3,908 total drug arrests were reported compared to 3,315 reported in 2010. Weapon Type “Personal Weapons” (hands, feet, or fists) were reported in 5,456 incidents. Firearms were reported in 331 incidents.

Introduction National Incident-Based Reporting System (NIBRS) is a cooperative effort among city, county, and State law enforcement agencies. The State Clearinghouse (Criminal Statistical Analysis Center) for NIBRS provides participating agencies with the necessary application required for crime reporting. Agencies can use our web-based software or if they have a private vendor and their own RMS (Records Management System), they may export their data and send it in to the Criminal Statistical Analysis Center (SAC) on a monthly basis. The SAC then imports any data sent in by agencies. All data received either through the State’s web-based system or imported is then submitted to the Federal Bureau of Investigation where national reports such as Crime in the United States are generated. Certain constraints should be noted in interpreting the collective data for the State. It must be noted that Indian Reservations are not included as they do not report crime statistics to the SAC. Comparing data year to year gives a good picture of crime trends; however, keep in mind when comparing these figures to previous years that there is a difference in the number of agencies reporting each year. Also, these figures cannot be compared to data released by the FBI, as the FBI uses estimations for non-reported data. The deadline for submitting 2011 crime statistics to the Federal Bureau of Investigation was March 13, 2012. This publication is the fourth time the crime book was published in NIBRS format. Starting in 2008, the SAC only accepted NIBRS data. NIBRS is an incident-based reporting system designed to collect data on each incident and arrest within that occurrence. The most significant difference between NIBRS and the traditional UCR system is the degree of detail in reporting. Unlike the summary UCR system that collects data on only eight Part I crimes, NIBRS collects 22 crime categories made up of 46 specific crimes called Group A offenses. In addition to the Group A offenses, there are 11 Group B offense categories for which only arrest data are collected. The Hierarchy Rule is not used in NIBRS. Therefore, if more than one crime was committed by the same person or group of persons and the time and space intervals separating them were insignificant, all of the crimes are reported as offenses in the same incident. The population figures included in this publication were obtained from the Federal Bureau of Investigation. The national UCR Program obtained the July 1, 2011, state population estimates and the 2010 state, city/town and county decennial population counts. The 2010/2011 rate of growth was calculated for the state and the resulting factor was applied uniformly to the 2010 city/town and county decennial data. The resident county population sum of 824,082 was used. The information included in this report was generated by a combination of these population figures and data collected through the National Incident-Based Reporting System from the participating agencies. The figures are based on statistics that were analyzed for a twelve month period beginning January 1, 2011 and ending December 31, 2011. However, a few agencies did not report for an entire twelve month period. The information in this publication will reflect this partial participation. The data included in this report can only be as accurate as the data provided by each reporting agency. The following agencies did not report 12 months of data:

Corsica PD - seven months of data submitted. They became covered by Douglas SO in August 2011.

Delmont PD - seven months of data submitted. They became covered by Douglas SO in August 2011.

Eureka PD - three months of data submitted. They became covered by McPherson SO in April 2011.

Offenses There are two groupings of offenses reported in NIBRS, Group “A” and Group “B” Offenses. Both incidents and arrests are reported for Group “A” offenses. Only arrests are reported for Group “B” offenses.

Group A Offenses

There are 22 Group A crime categories made up of 46 offenses. Both incidents and arrests are to be reported for Group A offenses. The following criteria were used to determine if a crime should be designated as a Group A offense:

1. The seriousness or significance of the offense. 2. The frequency or volume of its occurrence. 3. The prevalence of the offense nationwide. 4. The probability of the offense being brought to law enforcement’s attention. 5. The likelihood that law enforcement is the best channel for collecting data regarding the

offense. 6. The burden placed on law enforcement in collecting data on the offense. 7. The national statistical validity and usefulness of the collected data. 8. The national UCR Program’s responsibility to make crime data available not only to law

enforcement but to others having a legitimate interest in it.

The Group A offenses are listed below in UCR (Uniform Crime Reporting) number order for ease of reference rather than in the order of their importance. Each crime category title indicates whether the crime is a Crime Against Person, Crime Against Property, or Crime Against Society. The crimes are counted as follows: for a Crime Against person, one offense is counted for each victim; Crime Against Property, one offense for each distinct operation is counted (except Motor Vehicle Theft, where one offense is counted for each stolen vehicle); and for a Crime Against Society, count one offense for each violation.

Murder and Non-Negligent Manslaughter Supplemental Information There were 15 homicides reported with 15 arrests. Five or 33% of the murders were the result of domestic violence. One case was a murder/suicide and one case the offender was shot and killed by law enforcement. One case had two victims and three cases had two offenders. Of the 15 homicides reported, two were certified law enforcement officers killed in the line of duty and one was a correctional officer killed while on duty.

Bias Motivation (Hate Crime) The table on the following pages indicates whether or not the offense was motivated by bias and, if so, what kind. Because of the difficulty of ascertaining the offender’s subjective motivation, bias should be reported only if investigation reveals sufficient objective facts to lead a reasonable and prudent person to conclude that the offender’s actions were motivated, in whole or in part, by bias against race, religion, disability, ethnicity, or sexual orientation. Barnable attended the 144th Session of the 12 week Basic Law Enforcement Class held January 3, 2011 through March 25, 2011. The Coler-Williams Award is awarded to the top student in the class. The award is named after Jack R. Coler and Ronald A. Williams, the two FBI agents killed in the line of duty near Oglala in 1975.

In Loving Memory

Correctional Officer Ronald E. "RJ" Johnson South Dakota Department of Corrections, South Dakota End of Watch: Tuesday, April 12, 2011 Correctional Officer Ronald Johnson was killed by two inmates who were attempting to escape from the South Dakota State Penitentiary in Sioux Falls. The inmates attacked Officer Johnson, beat him with a metal pipe, and then wrapped his head in plastic wrap. One of the inmates then put on Officer Johnson's uniform. As the inmate wheeled out a large box with the other inmate inside another officer didn't recognize him as a fellow officer and confronted him.

The officer was attacked, but was assisted by other officers who witnessed the attack on surveillance cameras. Both inmates were subdued before being able to escape. One of the inmates who murdered Officer Johnson had been involved in several successful and attempted escapes before. Officer Johnson was transported to a local hospital where he succumbed to his injuries a short time later. Both inmates were charged with first degree murder, first degree murder-kidnapping, and assault. Both defendants were sentenced to death, both pled guilty. Officer Johnson had served with the South Dakota Department of Corrections for 23 years and was murdered on his 63rd birthday. He is survived by his wife, two children, and six grandchildren. Type of Property Loss Property data are collected to describe the type, value, and (for drugs and narcotics seized in drug cases) quantity of property involved in the incident. The types of offenses in the incident determine which type(s) of loss apply. The Types of Property Loss are:

Burned - includes damage caused in fighting the fire.

Counterfeited/Forged

Destroyed/Damaged/Vandalized

Seized - to impound property that was not previously stolen, i.e. drugs/narcotics,

drug/narcotic equipment.

Stolen/Etc. - includes bribed, defrauded, embezzled, extorted, ransomed, robbed, etc.

An agency reports property stolen in their jurisdiction. Likewise, the agency that reported the property stolen should also report the property recovered. The following table shows the Type of Property Loss per Property Description.

Victim Data

A victim can be linked up to ten of the most serious (as determined by the reporting agency) Group A offenses which were perpetrated against him/her during the incident. For example, there may be two victims of a robbery and one of those two victims was also raped. The first victim would be linked to “120 – Robbery”. The second victim would be linked to both “120 – Robbery” and “11A – Forcible Rape”. Therefore, there may be more than one offense reporting a victim’s age, gender, race, ethnicity, etc.

Type of Victim Only one Type of Victim should be reported for each victim. Type of Victim allowed entries are: Individual, Business, Financial Institution, Government, Religious Organization, Society/Public, Other or Unknown. For example, during a bank robbery, the offender pointed a gun at a teller and demanded and received money. The robber also pistol whipped a customer who stood in his way as he made his getaway from the bank. There were three victims: the bank (Type of Victim = Financial Institution), the teller (Type of Victim = Individual), and the pistol whipped customer (Type of Victim = Individual).

Students of the 2-day NIBRS Class held on September 28-29, 2011 received their training materials consisting of FBI manuals in leftover sand bags. Sand bags were to be filled with sand and used to build berms to protect houses/structures for those involved in the Missouri River Flood. Many people were affected by the 2011 flood.

Victim Resident Status

This table shows the resident status of “Individual” and “Law Enforcement Officer” victims. This data element is not required; therefore, “No Data” represents victims where the agency did not report resident status. A “Resident” is a person who maintains his/her permanent home for legal purposes in the locality (i.e., town, city community) where the crime took place. Federal, state, and county law enforcement agencies should base their determinations of residency on the town, city, or community where the crime occurred rather than their broader geographical jurisdictions. Offender Data

Offender data include characteristics (age, sex, and race) of each offender (up to 99 offenders) involved in a crime incident whether or not an arrest has been made. The object is to capture any information known to law enforcement concerning the offenders even though they may not have been identified. There are, of course, instances where no information about perpetrators is known. An offender’s age, gender, race, ethnicity, etc. may be reported under more than one offense. Offender information is recorded under each offense committed by that Offender.

Arrestee Data

Arrestee data are reported for all persons apprehended for the commission of Group A or Group B crimes, that is, all offenses except Justifiable Homicide (not a crime). It must be remembered that the object of this data set is to collect data on persons arrested, not on charges lodged. For example, a person may be arrested on several charges in connection with the same incident; in this situation, only one set of arrestee data would be reported, again, if the offenses involved were in connection with one incident. Likewise, one person may be arrested many times during a given time span for similar or different violations within a jurisdiction. Because of a separation of time between the arrests, a set of arrestee data is to be reported for each separate arrest. Again, more than one charge could be lodged during the individual arrests, but only one set of arrestee data would be reported for each crime incident. Data is recorded for each of the (up to 99) arrestees involved in each incident. Arrest data is recorded on all persons processed by arrest, citation, or summons for committing an offense within the reporting jurisdiction. Included:

1. Those persons arrested and released without a formal charge being placed against them. (An arrest has occurred when a law enforcement officer detains an adult with the intention of seeking charges against the person for a specific offense(s) and a record is made of the detention.)

2. Juveniles taken into custody or arrested but merely warned and released without being charged.

In Loving Memory

Officer James Ryan McCandless, was killed on Tuesday, August 2, 2011. Officer McCandless was shot on August 2nd along with Officer Nick Armstrong and Officer Tim Doyle. The officers had stopped four subjects on an alcohol violation. During the stop, 22 yr. old Daniel Tiger, pulled out a gun and fired multiple shots, wounding all three officers. Return fire by McCandless and Doyle also struck and wounded Tiger. Suspect Daniel Tiger died the next day. Officer Nick Armstrong died from his wounds on August 6th. Officer Doyle was seriously wounded, but recovered and returned to duty. Officer McCandless is survived by his parents and fiancée. He had been an officer for 6 years. Officer Armstrong had served with the Rapid City Police Department for two years and was assigned to the Street Crimes Unit. He had previously served two years with the Spearfish Police Department. Offenses by Contributor Supplemental Information Crime in South Dakota is an annual publication based upon National Incident-Based Reporting System (NIBRS) statistics. NIBRS is the basis for collecting data on selected crimes by participating agencies throughout South Dakota. Prior to 1990, this data collection effort was handled directly by the FBI with approximately thirty-two agencies reporting in 1989. There are 22 Group “A” crime categories made up of 46 Group “A” offenses. The crime categories are listed below in alphabetical order for ease of reference rather than in the order of their importance. There are 11 Group “B” crime categories. They encompass all of the crimes that are not Group “A” offenses. ______________________

Group A Offense Definitions Arson (200) – To unlawfully and intentionally damage or attempt to damage any real or personal property by fire or incendiary device. Assault Offenses (13A - 13C) – An unlawful attack by one person upon another.

Aggravated Assault – An unlawful attack by one person upon another wherein the offender uses a weapon or displays it in a threatening manner, or the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration, or loss of consciousness. Note: Aggravated Assault also includes assault with disease (as in cases when the offender is aware that he/she is infected with a deadly disease and deliberately attempts to inflict the disease by biting, spitting, etc.). Simple Assault – An unlawful physical attack by one person upon another where neither the offender displays a weapon, nor the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration, or loss of consciousness. Intimidation – To unlawfully place another person in reasonable fear of bodily harm through the use of threatening words and/or other conduct but without displaying a weapon or subjecting the victim to actual physical attack. Note: This offense includes stalking.

Bribery (510) – The offering, giving, receiving, or soliciting of anything of value (i.e. a bribe, gratuity, or kickback) to sway the judgment or action of a person in a position of trust or influence. Note: If the bribery involves changing the outcome of a sporting contest or event, it should be reported under Gambling Offenses as Sports Tampering, not Bribery. Burglary/Breaking and Entering (220) – The unlawful entry into a building or other structure with the intent to commit a felony or theft. Counterfeiting/Forgery (250) – The altering, copying, or imitation of something, without authority or right, with the intent to deceive or defraud by passing the copy or thing altered or imitated as that which is original or genuine or the selling, buying, or possession of an altered, copied, or imitated thing with the intent to deceive or defraud.


Destruction/Damage/Vandalism of Property (290) – To willfully or maliciously destroy, damage, deface, or otherwise injure real or personal property without the consent of the owner or the person having custody or control of it. Drug/Narcotic Offenses (35A - 35B) – The violation of laws prohibiting the production, distribution, and/or use of certain controlled substances and the equipment or devices utilized in their preparation and/or use.

Drug/Narcotic Violations (35A) - The unlawful cultivation, manufacture, distribution, sale, purchase, use, possession, transportation or importation of any controlled drug or narcotic substance. Drug Equipment Violations (35B) – The unlawful manufacture, sale, purchase, possession, or transportation of equipment or devices utilized in preparing and/or using drugs or narcotics.

Embezzlement (270) – The unlawful misappropriation by an offender to his/her own use or purpose of money, property, or some other thing of value entrusted to his/her care, custody or control. Extortion/Blackmail (210) – To unlawfully obtain money, property, or any other thing of value, either tangible or intangible, through the use or threat of force, misuse of authority, threat of criminal prosecution, threat of destruction of reputation or social standing, or through other coercive means. Fraud Offenses (26A - 26E) – The intentional perversion of the truth for the purpose of inducing another person or other entity in reliance upon it to part with something of value or to surrender a legal right.

False Pretenses/Swindle/Confidence Games (26A) – The intentional misrepresentation of existing fact or condition or the use of some other deceptive scheme or device to obtain money, goods or other things of value. Credit Card/Automatic Teller Machine Fraud (26B) - The unlawful use of a credit (or debit) card or automatic teller machine for fraudulent purposes.

Impersonation (26C) – Falsely representing one’s identity or position and acting in the character or position thus unlawfully assumed to deceive others and thereby gain a profit or advantage, enjoy some right or privilege, or subject another person or entity to an expense, charge, or liability that would not have otherwise been incurred. Welfare Fraud (26D) – The use of deceitful statements, practices, or devices to unlawfully obtain welfare benefits.

Wire Fraud (26E) – The use of an electronic or electronic communications facility to intentionally transmit a false and/or deceptive message in furtherance of a fraudulent activity.

Gambling Offenses (39A - 39D) – To unlawfully bet or wager money or something else of value; assist, promote, or operate a game of chance for money or some other stake; possess or transmit wagering information; manufacture, sell, purchase, possess, or transport gambling equipment, devices, or goods; or tamper with the outcome of a sporting event or contest to gain a gambling advantage.


Betting Wagering (39A) – To unlawfully stake money or something else of value on the happening of an uncertain event or on the ascertainment of a fact in dispute. Operating/Promoting/Assisting Gambling (39B) – To unlawfully operate, promote, or assist in the operation of a game of chance, lottery, or other gambling activity. Note: This offense includes bookmaking, numbers running, transmitting wagering information, etc.

Gambling Equipment Violations (39C) – To unlawfully manufacture, sell, buy, possess, or transport equipment, devices, and/or goods used for gambling purposes. Sports Tampering (39D) – To unlawfully alter, meddle in, or otherwise interfere with a sporting contest or event for the purpose of gaining a gambling advantage. Note: this offense includes engaging in bribery for gambling purposes. For example, if a jockey was bribed to lose a horse race, it would be reported as Sports Tampering not Bribery.

Homicide Offenses (09A - 09C) – The killing of one human being by another.

Murder and Non-Negligent Manslaughter (09A) – The willful (non-negligent) killing of one human being by another. Note: Assault to Murder and Attempted Murder are to be reported as Aggravated Assault.

Negligent Manslaughter (09B) – The killing of another person through negligence. Note: This offense does not include Vehicular Manslaughter which is reportable as 09A Murder and Non-Negligent Manslaughter if not accidental or 90Z All Other Offenses if accidental.

Justifiable Homicide (09C) – The killing of a perpetrator of a serious criminal offense by a peace officer in the line of duty, or the killing, during the commission of a serious criminal offense, of the perpetrator by a private individual. Note: Justifiable Homicide often occurs in conjunction with other offenses. The crime that was being committed when the justifiable homicide took place must be reported as a separate incident. Therefore, justifiable homicide cases involve two incidents rather than one.

Kidnapping/Abduction (100) – The unlawful seizure, transportation, and/or detention of a person against his/her will or of a minor without the consent of his/her custodial parent(s) or legal guardian. Note: Kidnapping/Abduction includes hostage-taking. Larceny Theft Offenses (23A - 23H) – The unlawful taking, carrying, leading, or riding away of property from the possession or constructive possession of another person.

Pocket-Picking (23A) – The theft of articles from another person’s physical possession by stealth where the victim usually does not become immediately aware of the theft.


Purse-snatching (23B) – The grabbing or snatching of a purse, handbag, etc., from the physical possession of another person. Note: If more force was used than actually necessary to wrench the purse from the grasp of the person, then a strong-arm Robbery occurred rather than Purse-snatching. Shoplifting (23C) – The theft by someone other than an employee of the victim of goods or merchandise exposed for sale. Theft From Building (23D) – A theft from within a building which is either open to the general public or to which the offender has legal access. Theft From Coin-Operated Machine or Device (23E) – A theft from a machine or device that is operated or activated by the use of coins. Theft From Motor Vehicle (23F) (Except Theft of Motor Vehicle Parts or Accessories) – The theft of articles from a motor vehicle, locked or unlocked.

Theft of Motor Vehicle Parts or Accessories ( 23G) – The theft of any part or accessory affixed or exterior of a motor vehicle in a manner which would make the item an attachment of the vehicle or necessary for its operation. All Other Larceny (23H) – All thefts that do not fit any of the definitions of the specific subcategories of Larceny/Theft listed above.

Motor Vehicle Theft (240) – The theft of a motor vehicle. Note: A motor vehicle is a self-propelled vehicle that runs on the surface of land and not on rails and that fits one of the following property descriptions: Automobiles - sedans, coupes, station wagons, convertibles, taxicabs, or other similar motor vehicles that serve the primary purpose of transporting people. Buses - motor vehicles that are specifically designed (but not necessarily used) to transport groups of people on a commercial basis. Recreational Vehicles - motor vehicles that are specifically designed (but not necessarily used) to transport people and also provide them temporary lodging for recreational purposes. Trucks - motor vehicles that are specifically designed (but not necessarily used) to transport cargo. Other Motor Vehicles - any other motor vehicles, e.g., motorcycles, motor scooters, trail bikes, mopeds, snowmobiles, or golf carts. Pornography/Obscene Material (370) - The violation of laws or ordinances prohibiting the manufacture, publishing, sale, purchase, or possession of sexually explicit material, e.g., literature or photographs.


Prostitution Offenses (40A - 40B) - To unlawfully engage in or promote sexual activities for profit.

Prostitution (40A) - To unlawfully engage in sexual relations for profit. Note: This offense involves prostitution by both males and females. Assisting or Promoting Prostitution (40B) - To solicit customers or transport persons for prostitution purposes; to own, manage, or operate a dwelling or other establishment for the purpose of providing a place where prostitution is performed; or to otherwise assist or promote prostitution.

Robbery (120) - The taking or attempting to take anything of value under confrontational circumstances from the control, custody, or care of another person by force or threat of force or violence and/or by putting the victim in fear of immediate harm. Sex Offenses, Forcible (11A - 11D) - Any sexual act directed against another person, forcibly and/or against that person’s will or not forcibly or against the person’s will in instances where the victim is incapable of giving consent.

Forcible Rape (11A) - The carnal knowledge of a person, forcibly and/or against that person’s will or not forcibly or against the person’s will in instances where the victim is incapable of giving consent because of his/her temporary or permanent mental or physical incapacity. Forcible Sodomy (11B) - Oral or anal sexual intercourse with another person, forcibly and/or against that person’s will or not forcibly or against the person’s will in instances where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental or physical incapacity. Sexual Assault With An Object (11C) - To use an object or instrument to unlawfully penetrate, however slightly, the genital or anal opening of the body of another person, forcibly and/or against that person’s will or not forcibly or against the person’s will in instances where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental or physical incapacity. Note: An object or instrument is anything used by the offender other than the offender’s genitalia. Examples include but are not limited to a finger, bottle, handgun or stick. Forcible Fondling (11D) - The touching of the private body parts of another person for the purpose of sexual gratification, forcibly and/or against that person’s will or not forcibly or against the person’s will in instances where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental or physical incapacity.

Sex Offenses, Non-Forcible (36A-36B) - Unlawful, non-forcible sexual intercourse.

Incest (36A) - Non-forcible sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law. Statutory Rape (36B) - Non-Forcible sexual intercourse with a person who is under the statutory age of consent.


Stolen Property Offenses (280) - Receiving, buying, selling, possessing, concealing, or transporting any property with the knowledge that it has been unlawfully taken, as by Burglary, Embezzlement, Fraud, Larceny, Robbery, etc. Weapon Law Violations (520) - The violation of laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession, concealment, or use of firearms, cutting instruments, explosives, incendiary devices, or other deadly weapons.

Group B Offense Definitions Bad Checks (90A) – Knowingly and intentionally writing and/or negotiating checks drawn against insufficient or nonexistent funds. Curfew/Loitering/Vagrancy Violations (90B) - The violation of a court order, regulation, ordinance, or law requiring the withdrawal of persons from the streets or other specified areas; prohibiting persons from remaining in an area or place in an idle or aimless manner; or prohibiting persons from going from place to place without visible means of support. Note: This offense includes Begging and Vagabondage. Persons prosecuted on charges of being a Suspicious Character, Suspicious Person, etc., are also to be included. Disorderly Conduct (90C) - Any behavior that tends to disturb the public peace or decorum, scandalize the community, or shock the public sense of morality. Driving Under The Influence (90D) - Driving or operating a motor vehicle or common carrier while mentally or physically impaired as the result of consuming an alcoholic beverage or using a drug or narcotic. Drunkenness (90E) - To drink alcoholic beverages to the extent that one’s mental faculties and physical coordination are substantially impaired. Note: This offense includes Drunk and Disorderly, Common Drunkard, Habitual Drunkard, and Intoxication. Family Offenses, Non-Violent (90F) - Unlawful, non-violent acts by a family member (or legal guardian) that threaten the physical, mental, or economic well-being or morals of another family member and that are not classifiable as other offenses, such as Assault, Incest, Statutory Rape, etc. Note: This offense includes Abandonment, Desertion, Neglect, Non-Support, Non-Violent Abuse, and Non-Violent Cruelty to other family members. It also includes the non-payment of court-ordered alimony, as long as it is not considered to be Contempt of Court within the reporting jurisdiction. Do not include victims of these offenses who are taken into custody for their own protection.


Glossary ADULT: A person 18 years of age or older. ARREST: The act of taking into custody by authority of law, to charge him or her with a criminal offense or to initiate juvenile proceedings. CLEARANCE: An offense is cleared, or solved for crime reporting purposes, when at least one person is arrested, charged with commission of the offense and turned over to the court for prosecution. Provision is also made for clearance in certain "exceptional" situations. CLEARANCE RATE (TOTAL): The number of clearances divided by the total number of offenses, expressed as a percent. The formula is: Number of Clearances X 100 Number of Offenses Offenses are reported as they become known to law enforcement agencies. Clearances are scored as they are made. Therefore, it is possible for the clearance rate to exceed 100 percent for a time period. Both clearances by arrest and exceptional clearances are included. CRIME INDEX: Classification of seven offenses used as an indicator of crime. Crime Index offenses are murder and non-negligent manslaughter, forcible rape, robbery, aggravated assault, burglary, larceny, motor vehicle theft, and arson. CRIME RATE: The number of known offenses per 100,000 population. The formula is: Number of Offenses X 100,000 Population

Crime rates per population unit are employed to remove the effect of differing sizes of law enforcement service areas, permitting the examination of reported crime on an equalized population basis. "Per 100,000 population" is generally utilized to preclude the rates for infrequently occurring offenses from being expressed as very small numbers. EXCEPTIONAL CLEARANCE: When the law enforcement agency has enough information to make an arrest, but cannot locate the offender to do so, then, the complaint is considered solved or cleared by exceptional circumstance, rather than by arrest. For example, a crime may be cleared by exceptional circumstance when an offender has died, moved out of state, or when extradition has been refused. JUVENILE: A person 17 years of age or younger. JUVENILE ARREST: For purposes of Uniform Crime Reporting, a juvenile should be counted as "arrested" when the circumstances are such that if he or she were an adult, an arrest would be tallied. When a law enforcement officer places a juvenile in custody for a specific offense, including status offenses, an "arrest" is scored. Law enforcement contacts with juveniles where no offense has been committed are not scored as arrests. Juveniles taken into custody for their own protection, such as in neglect cases, are not scored as being arrested if they have not committed an offense. UCR uses the term "arrest" for both adults and juveniles to describe apprehension.


JUVENILE CRIME: The only measure of juvenile crime available through Uniform Crime Reporting is the number of juvenile arrests (number, rate, and percentage of total arrests). PROPERTY CRIMES: Sub classification of the Crime Index which encompasses burglary, larceny, motor vehicle theft, and arson. STATUTORY RAPE: The carnal knowledge or the attempted carnal knowledge of a female with no force used and the female victim is under the legal age of consent. UNFOUNDED COMPLAINTS: A complaint which is determined through investigation to be false or baseless. If the investigation shows that no offense occurred nor was attempted, the reported offense can be deleted for NIBRS reporting purposes. The findings of a coroner, court, jury, or prosecutor do not unfound offenses or attempts which law enforcement investigations establish to be legitimate. VICTIM: A victim, in this publication, is an individual person who has had a violent crime committed against him or her. Victims, here, are described by age, sex, and race. VIOLENT CRIMES: Sub classification of the Crime Index which encompasses murder and non-negligent manslaughter, forcible rape, robbery, and aggravated assault.
