What is a Type III School Bus ?

• A "type III vehicle" is restricted to passenger vehicles and buses having a maximum manufacturer's rated seating capacity of ten or fewer people, including the driver, and a gross vehicle weight rating of 10,000 pounds or less. The vehicle may not be more than twelve years old.

• (2) For vehicles manufactured on and after September 1, 2011, designated seating position means a seat location that has a seating surface width, as described in §571.10(c) of this part, of at least 330 mm (13 inches). The number of designated seating positions at a seat location is determined according to the procedure set forth in §571.10(b) of this part. However, for trucks and multipurpose passenger vehicles with a gross vehicle weight rating greater than 10,000 lbs, police vehicles as defined in S7 of FMVSS No. 208, firefighting vehicles, ambulances, and motor homes, a seating location that is labeled in accordance with S4.4 of FMVSS No. 207 will not be considered a designated seating position. For the sole purpose of determining the classification of any vehicle sold or introduced into interstate commerce for purposes that include carrying students to and from school or related events, any location in such a vehicle intended for securement of an occupied wheelchair during vehicle operation is regarded as four designated seating positions.

The operator's employer has adopted and implemented a policy that provides for annual training and certification of the operator in:(1) safe operation of a type III vehicle;(2) understanding student behavior, including issues relating to students with disabilities;(3) encouraging orderly conduct of students on the bus and handling incidents of misconduct appropriately;(4) knowing and understanding relevant laws, rules of the road, and local school bus safety policies;

• No school bus shall be driven unless the driver or other designated person has inspected the vehicle to ensure that, at a minimum, the following parts and accessories are in good working order: service brakes, including trailer brake connections; parking (hand) brakes; steering mechanism; lighting devices and reflectors; tires; fluid levels; horn; windshield wiper or wipers; rear-vision and crossover mirrors, including their proper adjustment; eight-lamp system; and stop arm.

• A copy of the current daily pretrip inspection report must be carried in the bus.

Emergency Equipment Type III Vehicle

Ensure that if you use any safety equipment you replace it or notify a supervisor to have it replaced.

If emergency equipment is not located in the driver area a label shall be located in the driver compartment indicating the location of the emergency equipment.

A person who sustains a conviction of a moving offense in violation of chapter 169 within three years of the first of three other moving offenses is precluded from operating a Type III school bus for one year from the date of the last conviction.

Physical Examination of Driver

• Type III school bus drivers hired solely to operate a Type III school bus must submit to a physical examination as required by section 171.321, subdivision 2b (e).

• If you are required to submit to a physical exam, you must carry physical examination card with you while operating a Type III school bus as this will be the only proof of your physical qualification.

physical control of any class of school bus or Head Start bus within this state when there is physical evidence present in the person's body of the consumption of any alcohol…

Zero Tolerance Alcohol169A.31 Alcohol – Related School Bus - Driving

Subd. 2.Gross misdemeanor alcohol-related school bus driving.

A person who violates subdivision 1 is guilty of gross misdemeanor alcohol-related school bus or Head Start bus driving if:

(1) the violation occurs while a child under the age of 16 is in the vehicle, if the child is more than 36 months younger than the violator; or

(2) the violation occurs within ten years of a qualified prior impaired driving incident.

So what does this mean to you as a Type III school bus driver?

• The loss of eligibility to operate a Type III school bus for five (5) years.

Cellular Phone UseMS 169.443 sub 9

Personal cellular phone call prohibited(b) A school bus driver may not operate a school bus while communicating over, or otherwise operating, a cellular phone for personal reasons, whether handheld or hands free, when the vehicle is in motion or a part of traffic.

Texting While Driving(MS 169.475)

Subd. 2.Prohibition on use.No person may operate a motor vehicle while using a wireless communications device to compose, read, or send an electronic message, when the vehicle is in motion or a part of traffic.

School Bus SeatbeltsMS 169.447 subd. 2

School buses and Head Start buses must be equippedwith driver seat belts and seat belt assemblies of the type described in section 169.685, subdivision 3. School bus drivers and Head Start bus drivers must use these seat belts. A properly adjusted and fastened seat belt, including both the shoulder and lap belt when the vehicle is so equipped, shall be worn by the driver.

Booster Seat RequirementsMS 169.685 sub. 5(a)

Every motor vehicle operator, when transporting a child who is both under the age eight and shorter than four feet nine inches on the streets and highways of this state in a motor vehicle equipped with factory-installed seat belts, shall equip and install for use in the motor vehicle, according to the manufacturer's instructions, a child passenger restraint system meeting federal motor vehicle safety standards.

School Bus Post Crash InspectionsMS 169.4511

A peace officer responding to an accident involving a school bus or Head Start bus must immediately notify the State Patrol if the accident results in;

- a fatality;- bodily injury to a person who, as a result of the injury,

immediately receives medical treatment away from the scene of the accident; or

- one or more motor vehicles incurring disabling damage as a result of the accident, requiring the motor vehicles to be transported away from the scene by tow truck or other motor vehicle.

To keep it simple Type III buses are the non-yellow vehicles used to transport students. You can check out the link bellow for a full definition and example pictures. https://dps.mn.gov/divisions/msp/forms-reports/Documents/SBTypesPhotos.pdf According to state statute these vehicles are defined as a bus and therefor would be allowed to use the HOV lane regardless of the number of occupants. If someone gives you the excuse that they are driving a Type III vehicle an easy way to confirm this would be to check for an annual inspection sticker located in the lower driver’s side portion of the windshield. There would be a hole punched indicating that it has been inspected as a school bus. If the sticker is not there, then it is not a bus!
