Because he is blessed with greater intelligence than his fa- ther, he is enrolled in an Advanced Placement Government course. I am admiedly excited about this because I might actually be able to offer him at least some level of guidance and knowledge on topics of civics and the law. So, that’s the good part. My angst arises from the fact that my children have arrived at an age where they will be, for the first time in their lives, truly aware of the operation of our government and the behavior of our elected leaders. My son will be eligible to vote in the next presidential elec- tion. Politics has always been a messy business, but I am genuinely concerned about the deplorable state of political discourse and the possible trickle-down effect on young people today. Commentators sometime refer to what is happening as the “new normal.” I submit that there is nothing normal about it and, if it is, it should not be. Before you stop reading and toss aside this newsleer, let me be clear: this is not a political piece. I suspect that, regardless of where you fall on the political spectrum, you have been exceedingly disap- pointed by what seems to be a steady stream of personal aacks and an alarming lack of courtesy. We seem to be collectively losing our ability to respectfully debate issues about which reasonable people can disagree. While the internet has transformed our lives, oſten for the beer, it has also created an environment in which polite disagreement is in- creasingly abandoned. In its place, outrage is the order of the day. If you don’t believe me, venture into the comments section of near- ly any article on the web. The level of animosity is nothing short of shocking -- and it is, for the most part, anonymous. Greenberg, Administrative JudgeFAMILY DIVISION MAGISTRATEI am pleased to announce that the Judges of the Circuit Court have selected Ms. Bibi Berry as our new Family Di-vision Magistrate. Ms. Berry will fill the position vacated by the appointment of Judge James A. Bonifant. Ms. Berry is a Principal in the firm of Paley Rothman where she devotes her practice to Family Law and litigation. Magistrate Berry will begin effective October 11, 2017. She will be assigned to Hearing Room 2K and her office will be in Room 2900 on the 2nd floor of the South Tower.

LAW LIBRARY RENOVATIONSThe Circuit Court Law Library renovations continue. During this time, the Library will re-

main open with limited access to some areas. We will keep you apprised of the ongoing status of the renovations and we ap-preciate your patience while we improve this resource.

REQUEST FOR ASSIGNMENT TO BUSINESS AND TECHNOLOGY (B&T) OR ADVANCED SCIENCE AND TECHNOLOGY ADJUDICATION RESOURCE (ASTAR) TRACKSPlease be advised, in addition to the Civil Case Information Report required by MD Rule 2-111 and MD Rule 16-302, any party requesting assignment to a Business and Technolo-gy (B&T) or Advanced Science and Technology Adjudication Resource (ASTAR) Track shall submit a one (1) page state-ment setting forth each of the seven (7) factors the court may consider, pursuant to MD Rule 16-308 (c). Failure to file the statement or failure to address each of the seven (7) factors will result in a denial of the request

for B&T or ASTAR assignment. The case will then be assigned to a standard track, pursuant to the courts Civil Differentiated Case Management Plan, as set forth in MD Rule 16-302. CIRCUIT COURT WEBSITEThe Circuit Court launched its new website on Septem-ber 5, 2017. The new website is more user friendly and is now responsive on mobile devic-es. Attorneys have their own

set of pages that are easily reached from the Home Page https://tinyurl.com/yccuprzj or the dark blue bar located on the top of each page. These pages include quick links to the Court Schedule/Daily Docket, Case Search, the Judicial Center Bar Card/Security Pass applica-tion, transcripts, forms, and the telephone directory. The Court streamlined the content to make it more understandable. Visitors have much less text to read through, can view a list of frequently asked questions, or when necessary, easily find ways reach a live person by tele-

text messages have replaced phone calls.

Media outlets purposefully seek out extreme opinions and rev-el in the inevitable arguments that result. Few consumers of the news seem interested in being exposed to any ideas or arguments that are inconsistent with their own beliefs. Rather than permitting their opinions to be challenged, many consume news simply to obtain confirma-tion that their beliefs are cor-rect. Those on the “other side” are simply wrong; their opinions unworthy of respect.

A recent example is the debate regarding Confederate memori-als and how the Civil War and Reconstruction will be stud-ied and remembered by future generations. Like many other issues in the headlines, it has often been framed by the most extreme opinions. I submit that eradicating symbols of oppres-sion while, at the same time, preserving a fair and accurate recitation of our complicated history requires a more nuanced debate than we seem to be capa-ble of participating in at the mo-ment.

No reasonable person would suggest that we should not call out prejudice, insensitivi-ty or discrimination when we see it. But, by the same token, we should be careful not to characterize every incident of prejudice as racism. Instead, I suggest that we make a sincere effort to distinguish between prejudice and racism. While racism is, obviously, indefensible and a product of hate, prejudice is frequently the product of ig-norance. Where there is igno-rance, there is the possibility of education and enlightenment. But when the merely ignorant are reflexively labeled as racists, there is little incentive for them to listen, learn and, hopefully, change.

So what is my point? I believe that we, as attorneys, play a critical role in fostering commu-nication and framing civil and productive debate. More often than not, we meet and interact with our clients during the most stressful and vulnerable times of their lives. They instinctive-ly look to us for how to view and interact with opposing at-torneys and parties. When we denigrate opposing counsel, cli-ents view that as tacit approval

(Continued from page 1) for them to do likewise. When clients observe discourteous be-havior between attorneys, they form a belief that this is just the way our system of justice works.

Perhaps even more destruc-tive is the notion that displays of courtesy and civility are for the weak. Many years ago, I had the opportunity to sit in on part of the “D.C. Sniper” trial when it was tried in our circuit court. At one point during the proceedings, the defendant, Mr. Muhammad, became argumen-tative with Judge James L. Ryan who presided over the proceed-ings. I will never forget Judge Ryan’s rebuke: “Please do not mistake my courtesy as weak-ness.” None of us should view the courtesy of opposing coun-sel as weakness or convey that mis-perception to our clients.

In addition to embracing civil-ity, we need to encourage our clients to listen. I frequently tell clients that the opposing party’s perception is the client’s reali-ty. That perception may not be accurate or fair but it must be dealt with. When we take the time to view a dispute from the perspective of the opposing par-ty, we can be more creative in resolving those disagreements.

But first, we need to encourage our clients to actually listen.

We, as attorneys, are the stew-ards of our adversarial system of justice. As such, we are in the unique position of being able to demonstrate the effectiveness of civility and true communica-tion. Plus, it makes the practice of law more enjoyable. It is in-credibly gratifying to reach the conclusion of a difficult trial and be able to exchange handshakes and a kind word with opposing counsel. Clients should have the opportunity to see us interact in this way and to hear judges com-pliment the professionalism of the attorneys at the conclusion of a case.

Many years ago, I was invited to participate in the drafting of the BAMC’s Code of Civility. If you are interested in reading it, you can find it in the first few pages of your Lawyer Directory. But you shouldn’t have to. The conduct that we display just has to conform to the wisdom we learned at the knees of our par-ents: “If you have nothing nice to say, don’t say it at all” and the Golden Rule:  “Do unto others as you would have them do unto you.” Words we should all live (and practice law) by.

Many lawyers wait until the last minute to prepare for trials, return phone calls, draft motions, take on difficult clients or employees, or respond to difficult correspondence.

We then either run to the next case we work on last minute or if we don’t, we go back to putting things off on a future case. The result is that we are more stressed and so is our staff. It begs the question of what our own part is in the stress of our practice.

When we continue to go from deadline to deadline and crunch time to crunch time, we may ultimately give up op-portunities to develop business, solve practice problems, meet a growth goal or take a short vacation. Worse than that, it can affect our health and well-being.

Good leadership (of yourself and your firm) would have us plan to take these difficult tasks on now so that they are not harder later. We might actually be energized if we take on one difficult thing each day.

I spend a lot of time coaching my clients in planning to do tasks and case actions when they can and not waiting until the last minute. It starts with planning 2, 3 or 4 months at a time in advance and includes planning out the work for each trial or event way before it’s due. Trials are always stressful but can planning make them no more stressful than necessary?

Another Successful Softball SeasonPaul Schwinn The Bar Association of Mont-gomery County's softball league recently concluded a successful 2017 season.  This year’s league consisted of teams including the Law Clerks, Shulman Rog-ers, Lerch, Early & Brewer, Pa-

ley Rothman, the office of the County Attorney, Offit Kurman, Planet Depos, “Res Ipsa,” and McCarthy Wilson.  The teams collectively played more than 50 games.  Lerch, Early & Brewer and Paley Rothman, who field a combined team called the “Pa-ley Ale Brewers” led the league in wins this season, reminis-cent of their undefeated stretch from 2014-2016. 

Every team participated in a three-round playoff tourna-ment spanning from July 24th – 31st.  The heart-pounding cham-pionship game came down to the final at-bat, as the Paley Ale Brewers walked-off Offit Kur-man to take home the trophy.

Congratulations to Paley Ale Brewers and all participants! Thank you to our hard working captains on organizing a success-ful thirteen weeks of softball.

Miller & Canby before going on to form Clarke, Crawford & Bonifant, which later merged to form another illustrious lo-cal firm, Debelius, Clifford, De-belius, Crawford & Bonifant. During his over thirty years in private practice, Judge Boni-fant focused on family law, em-inent domain, real estate, and misdemeanor crime, among others. In 2013, the Judges of the Circuit Court for Mont-gomery County appointed him as a Family Magistrate. Judge Bonifant has been a Judge on the Circuit Court bench since July 6, 2017, and is currently in the Family Law rotation.

JUSTICE REINVESTMENT ACTEffective October 1, 2017, the Justice Reinvestment Act signed into law by Governor Hogan last year will begin impacting criminal cases in Montgomery County. The leg-islative goal of the Act was to reduce the number of incarcer-ated individuals in Maryland, and re-route the funds that would otherwise have been spent on their incarceration to more rehabilitative-minded programs among other things. Some of the practical impacts will include the reduction of criminal penalties, the reduc-tion of sanctions for violations of probation, and earlier parole consideration in certain cases. We await the full impact these legislative changes may have on the handling of criminal cases in the County.

COURTHOUSE RENOVATIONSRockville City continues ren-

ovations outside of the Mary-land Avenue entrance to the Circuit Court. Litigants and at-torneys are encouraged to use the Monroe Street or Terrace Level entrances over the next several months while construc-tion is ongoing.

The ramp that connects the North and South towers on the second floor of the Cir-cuit Court has been under construction, but was sched-uled to re-open approximately mid-September.

Law Library renovations are expected to continue through November. Conference rooms are being made available on the second floor and may still be reserved through the Law Library.

CIRCUIT COURT WEBSITEAfter 9 months of design, development and launch, the new and improved Cir-cuit Court website went live just after Labor Day. MATTERS OF INTEREST IN CRIMINAL AND TRAFFIC CASESOur District Court is still awaiting the appointment of three new judges, and no interviews by the governor had been scheduled as of the date we met. The three newer judges appointed to the court [Judges Gelber, Koch and Sa-bett] have less than one year’s experience and are scheduled to attend training in Novem-ber 2017. There is a limita-tion on the number of “Vis-iting Judges” assigned each month. The Court continues to struggle with greater case-loads while understaffed and one product of this problem is that some courtrooms will have to be closed periodically. Check the website for current scheduling information each month.

Mental Health Court: In less than one year into its opera-tion, MHC is already forced to put new people in a waiting list. There are 47 participants in the District Court program and 10 in Circuit Court. The professional mental health staff was to be serving only a total of 50 persons. Attorneys are reminded there is a strict application process to get into MHC, and that the State's At-torney's Office has veto power

Opening Drug Case Evidence: In August Judge Mitchell signed an administrative order that requires her prior person-al approval and an appropriate order before sealed evidence containers can be opened in the courtroom on a given case. This is because of the possibil-ity of danger to court person-nel, attorneys and others that could be exposed to toxic mate-rials that might be airborne. If there is a legitimate reason to open such containers, prepare a written motion and an appro-priate order.

Emergency contact phone numbers: Attorneys are ex-pected to be on time and in the courtroom to check in with the Assistant State's Attorneys and court room clerks before each court day commences. Attorneys should not use the telephone in or before court to check in. If an attorney is ex-pecting to be late, the following numbers should be used to no-tify the District Court.

DETERMINATION OF INDIGENCY – CHANGE OF LAW EFFECTIVE 10-1-17 Criminal Procedure, Section 16-210 has been amended to require District Court Commis-sioners to make a determina-tion whether an individual is eligible for representation by the Public Defender in certain circumstances. Until then, staff of the Public Defender’s Office were required to review finan-cial information and eligibility criteria.

Around October 1, 2017, there will be a new form called “Com-missioner Application for Rep-resentation by Office of Public Defender” (DC-099), but Judge Mitchell informed us that last minute amendments on the form will make it unavailable until then.

One reason for this change is that persons being held for bond reviews are being re-quired to provide eligibility information before release on bond. This law expands it, and makes available to potential indigent persons a 24 hour lo-cation, that is, a Commission-er’s office, where he or she can apply.

What is Ligamentous Damage?The spine is held together by muscles, tendons and ligaments. They give the spine its flexibility and stability. When there is damage to a muscle, it is called a "strain". When there is damage to a ligament, it is called a "sprain". While the majority of muscle injuries are transient (4-6 weeks), ALL ligament injuries are permanent. ("once stretched, always stretched") They do not heal the same way that muscles do, and that is why some patients heal in 4-6 weeks (muscle damage) while others suffer for months and even years (ligament damage). That is why it is crucial to visualize and document these ligament injuries. Without this documentation, it is very difficult (if not impossible) to prove that your clients are injured and insurance adjusters will often make "low ball" settlement offers, especially if there is minimal property damage.The Importance of an Early Diagnosis:Auto insurance claims adjusters are notoriously skeptical of "soft tissue" injuries where there is no demonstrable evidence of injury. If ligament damage can be documented at the onset of treatment, carriers set aside higher "reserves" for the BI claim, as they know this is a much more serious injury than a simple "muscle strain" and will likely settle for a higher dollar amount. With a simple "strain" diagnosis, they are skeptical of all treatment beyond 6 weeks, but with a ligament "sprain" diagnosis, there is no arbitrary treatment cutoff.Ligament Injuries Settle for Higher Dollar Values:When it comes time to settle a case, almost all carriers utilize a computerized program known as "Colossus" to generate ranges in settlement offers. This is the tragic story of Amanda B.In January of 2014, Amanda was involved in a rear end collision that severely injured her neck and back. Those in attendance gathered in the new Steve Jobs Theatre and millions watched online. The September 12th announce-ment included first looks at iOS 11 and eight new pieces of Apple hardware, including three new iPhone iterations; the new Apple Watch; TV; and its new, Home device. Osten-sibly celebrating the 10th year anniversary of the original

iPhone, the live stream event will likely serve to further ce-ment Apple’s global dominance in the new world order.

REAL LIFE SIGNIFICANCE Bet on it! The three new (ex-pected) iPhones, the 8, 8+ and the so called iPhone X have been reported to significantly improve the iPhone en-v i r o n m e n t . Apple will reportedly be moving its new mobile phone to an entirely new screen tech-nology, OLED. Black coloring appears far darker and col-

ors are far more vibrant with OLED but the real difference to my thinking is the greatly im-proved outdoor full sun view-ing experience. If the newly an-ticipated iPhone screen display lives up to its claims, this fea-ture alone will elevate the new

iPhone to one more Apple “must have” for gazillions of us. But far more than merely a new screen, the reality is that Apple’s Sep-tember 12th an-

nouncement unleashed a vast array of very real, very signifi-cant technology development.

Do we need it? Do any of the newly launched Apple prod-ucts amount to something so new, so groundbreaking, we have to have it? Hard to say un-til the new product launch, but I’m gonna make a laymen-law-yer prediction and a promise. I believe the answer to the ulti-mate buy or wait question is a resounding buy and as a result, you will find me online at 11:59 p.m. on the night of the first opportunity to buy the new Apple iPhone! Your donation will assist the Foundation in carrying out its stated purposes of education, charitable and community proj-ects. In addition, the continued mission of the Foundation to assist low income individuals and families who need civil legal services with volunteer attorneys and community re-sources can be more attainable. When people earn little income and need assistance, it doesn’t make a difference to them what others in Maryland are earning. With our small staff in place, we continue to help as many people in need as possible. This is where you can make a differ-

ence. The Montgomery County Bar Foundation Pro Bono Pro-gram continues to seek volun-teers – whether experienced or newly barred attorneys – to join our panel. There are many county residents that are in great need of pro bono services. In Fiscal Year 2017, 2538 clients contacted the Pro Bono Pro-gram, seeking assistance for their legal issues; of those 1696 community residents were ad-vised at our legal clinics.

There are two ways for county residents to receive FREE LE-GAL SERVICES in civil cases – at a legal advice clinic or through the client intake line for refer-ral to an attorney volunteer for direct representation. The legal advice clinics operate in five lo-cations across the county and provide residents the opportu-nity to walk-in and meet with an attorney volunteer without scheduling an appointment. El-igible clients present their legal problems to an attorney and re-ceive free immediate legal advice and/or referral to a non-profit or government social service agen-cy that may be helpful. The cli-ent intake line operates out of

the main office where the staff screens calls from potential cli-ents. Cases referred to attorney volunteers include family law, debt collection, bankruptcy, lim-ited employment, simple name changes, limited immigration, wills and power of attorney.

The Pro Bono Program partic-ipates in the Judicare Project. Contested custody and complex family law cases are referred at a reduced fee to experienced family law attorneys. Attorneys can seek reimbursement of $80 per hour with a cap of 20 hours per case. The Pro Bono Pro-gram requires that the attorney must accept a pro bono case for each case accepted under the Judicare Project.

Our Family Law Training Ses-sions known as the Rita Rosen-krantz Family Law Training are currently available via webcast to attorneys for free in exchange for agreeing to accept a family law case.
