The Department of Parks and Wildlife has reviewed this proposal and has the following advice. Conservation category wetland buffer The Department notes that the proposed industrial development adjoins the Richardson road reserve which is adjacent to Conservation category wetland (CCW) (UFI 14505). This wetland forms parts of Bush Forever site 350 and contains threatened ecological community (TEC) 3b Eucalyptus calophylla - Eucalyptus marginata woodlands on sandy clay soils of the southern Swan Coastal Plain. This TEC is ranked as vulnerable in Western Australia. Although still in excellent condition, the rail line TEC occurrence has probably been substantially influenced I impacted by the installation of the rail line adjacent, and the associated changes to drainage. The department notes that the structure plan is proposing to utilise both the Richardson road reserve and a 25 m buffer on the development to provide a total 50 m buffer. The department considers that the proposed buffer will probably be adequate, as long as the proponents are required to apply water sensitive urban design and to maintain the current drainage patterns of drainage of water into and out of the adjacent TECs. Figure 9 of the Local Water Management Strategy (Emerge, 2014) appears to show drainage infrastructure within the buffer of the CCW. The Decision process for stormwater management in WA (Department of Water, 2009) states that, "there shall be no new constructed stormwater infrastructure (e.g. no pipes or constructed channels) within conservation category wetlands and their buffers, or other wetlands of high conservation significance and their buffers." The Department recommends that all constructed drainage infrastructure is accommodated within the development area with an overland flow path to the wetland. Boundary interface The Shire acknowledges comments that the wetland buffer will be adequate, as long as the applicant applies water sensitive urban design principles and maintains the current patterns of drainage water into and out of the adjacent threatened ecological communities (TEC). It is also acknowledges the recommendation that all constructed drainage infrastructure is accommodated within the development area with an overflow path to the wetland. The Shire recommends that the LSP be modified accordingly. The Shire agrees that a trafficable interface should be provided between the future industrial sites and Bush Forever sites 350 and 361. Reference is made to your correspondence dated 5 December 2014 in respect of the above. The Department of Parks and Wildlife has reviewed this proposal and has the following advice.

Conservation category wetland buffer

The Department notes that the proposed industrial development adjoins the Richardson road reserve which is adjacent to Conservation category wetland (CCW) (UFI 14505). This wetland forms parts of Bush Forever site 350 and contains threatened ecological community (TEC) 3b Eucalyptus calophylla - Eucalyptus marginata woodlands on sandy clay soils of the southern Swan Coastal Plain. This TEC is ranked as vulnerable in Western Australia. Although still in excellent condition, the rail line TEC occurrence has probably been substantially influenced I impacted by the installation of the rail line adjacent, and the associated changes to drainage. The department notes that the structure plan is proposing to utilise both the Richardson road reserve and a 25 m buffer on the development to provide a total 50 m buffer. The department considers that the proposed buffer will probably be adequate, as long as the proponents are required to apply water sensitive urban design and to maintain the current drainage patterns of drainage of water into and out of the adjacent TECs.

The proposed structure plan report requires either a bitumen road or trafficable access track along the interfaces between the development and Bush Forever Sites 361 and 350 and the CCW buffer. However, the proposed structure plan only shows a hard road edge between the development and Bush Forever site no. 361 and a portion of the buffer to CCW UFI 14505. The Department recommends that the structure plan is amended to show the hardroad edge adjacent to the length of the CCW buffer. This interface road is for reasons of public safety, protection of bushland and fire safety for the development area. The Department recommends that the width of the road is adequate to accommodate all road, and drainage infrastructure, and still allow for a gently sloping batter (1 in 6).

Fire management

The Shire of Serpentine Jarrahdale or WAPC should ensure that adequate separation is provided between buildings and the adjoining bushland and that all fire protection requirements are provided for on the property itself and do not place impositions or reliance upon the management of adjoining bushland or the CCW and its buffer.

Matters of National Environmental Significance

The clearing that may occur as a result of this project may cause a loss of habitat for forest redtailed black cockatoo (Ca/yptorhynchus banksii naso) or Baudin's black cockatoo ( Calyptorhynchus baudinii, ), listed as vulnerable under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). Please be aware that the proponent may therefore have notification responsibilities under the EPBC Act. The proponent should contact the Federal Department of the Environment for further information on these responsibilities, (if required) prior to further planning stages.

Department of Mines and Petroleum

The Geological Survey of Western Australia (GSWA), on behalf of the Department of Mines and Petroleum (DMP), has assessed this proposal with respect to access to mineral and petroleum resources, geothermal energy, and basic raw materials.

This proposal is adjacent to known titanium-zircon resources. However, consistent with previous comments from DMP, as industrial zoning is a compatible land use DMP

Tourism Western Australia

Tourism WA has no comment to make on the proposal at this time.

Department of Aboriginal Affairs

DAA has reviewed the relevant information and can confirm that there are currently no known Aboriginal sites registered with the DAA within the area of proposed development. There is therefore no known information to suggest that approval under the Aboriginal Heritage Act (1972) is required.

DAA has released Cultural Heritage Due Diligence Guidelines (the Guidelines) to assist developers with planning and considering Aboriginal heritage during proposed works. It is recommended that any developer/land user be made aware of the Guidelines. A copy of the Guidelines can be found on the DAA website at:

It is suggested that developers/land users contact DAA on the above number should they have any further heritage concerns with the area subject to the LSP.

Telstra Corporation

Thank you for the above advice. At present, Telstra Corporation Limited has no objection. I have recorded it and look forward to further documentation as the development progresses.

A network extension will be required for any development within the area concerned. The owner/developer will have to submit an application before construction is due to start to NBN Co. (for greater than 100 lots or living units in a 3 year period) or Telstra (less than 100 lots or living units). Developers are now responsible for telecommunications infrastructure, i.e. conduits and pits. NBN and/or Telstra will provide the cable.

Department of Water Better Urban Water Management

Consistent with Better Urban Water Management (BUWM) (WAPC, 2008) and policy measures outlined in State Planning Policy 2.9, the proposed Local Structure Plan (LSP) should be supported by an approved Local Water Management Strategy (LWMS) prior to finalising and supporting the LSP.

The DoW has reviewed the Cardup Business Park Local Water Management Strategy - June 2014 (Emerge Associates, 2014) and amendments are required (see attached). It is recommended that the LSP should not be finalised in the absence of an approved LWMS. DoW is yet to receive an amended LWMS and the appendix to the LSP on your web site does not contain the strategy.

Peel Harvey Coastal Plain Catchment

The proponent is advised that the proposal is located within the Peel-Harvey catchment and the provisions of the Environmental Protection (Peel Inlet - Harvey Estuary) Policy 1992 and the Statement of Planning Policy No 2.1 - the Peel-Harvey Coastal Plain Catchment (SPP 2.1) shall apply.

Groundwater The subject area is located within the Serpentine Groundwater Area as proclaimed under the Rights in Water and Irrigation Act 1914. Any groundwater abstraction in this proclaimed area for purposes other than domestic and/or stock watering taken from the superficial aquifer, is subject to licensing by the Department of Water. The issuing of a 6: groundwater licence is not guaranteed but if issued will contain a number of conditions that are binding upon the licensee.

The Shire acknowledges the general advice provided by the DoW. The Shire agrees that amendments should be undertaken to the LWMS and that it should be finalised, prior to the LSP being determined by the WAPC.

DPaW Issues It appears that a portion of the study area is within the buffer area of Conservation Category Wetlands. For this reason, this proposal must be referred to the Land Use Planning section at the Department of Parks and Wildlife's Swan Region

State Heritage Office

I wish to advise that we have no comment as the proposal does not appear to impact upon any place of State cultural heritage significance.

Department of Environment Regulation

The Department of Environment Regulation's (DER) has reviewed the information submitted in regard to the proposed local structure plan of the Cardup Business Park, Cardup. The information was received by DER on 2 December 2014. DER understands that the proposed structure plan aims to provide a framework for the future subdivision and development of the Cardup Business Park. The Cardup Business Park is zoned as 'Industrial' and 'Rural' and is to be rezoned as 'Industrial - General'. DER does not currently hold any information relating to contamination within the Cardup Business Park. If, in the future, DER is requested to comment on the need for environmental conditions to be placed on the development of the site, DER will assess these requests on a case by case basis. Please note that this advice relates to potential contamination and acid sulphate soil issues only.

The comments are noted.

Department of Transport The subject site for this proposed local structure plan abuts South Western Highway (SWH), Norman Road and Cardup Siding Road. SWH is a Primary Regional Road (PRR) in the MRS and a primary freight road in the Metropolitan Freight Network.

A number of accesses to SWH are proposed in the Plan which are not desirable. Only one access should be allowed to SWH and all other vehicle accesses would be via Cardup Siding Road and Norman Road.

DoT suggests to have MRWA comments on access and intersection upgrading proposal. It is also important to have PTA comments to this structure plan to see the implications of this development on the nearby rail crossings.

The Department of Transport (DoT) has no objection to the proposal subject to

MRWA and PTA agree with the proposed access and rail crossing arrangements; and

the proponent revise the traffic assessment report based on MRWA and PTA consultation.

Shire recommends that comments be sought from MRWA and PTA (and any changes required being made to the LSP documents) prior to the LSP being determined by the WAPC.

Water Corporation Wastewater services As indicated in the engineering services report for the Cardup Business Park (CBP) structure plan and previous advice, there is no wastewater infrastructure available in close proximity to the proposed CBP.

Wastewater collected in the Byford catchment area to the north of the CBP is currently pumped via pressure mains northwards to the Waterworks Main Wastewater Pump Station (WWPS) in Westfield where it is then pumped to the Woodman Point Wastewater Treatment Plant (WWTP). In the much longer term, once urbanisation in Byford and Mundijong is substantially advanced, the Corporation plans to redirect wastewater from the south-east corridor southwards to a future WWPS to be located at the western edge of the Mundijong urban area, which will pump the wastewater westwards via pressure mains to the future East Rockingham WWTP.

The developers' engineering consultants have previously discussed with the Corporation the option of installing a private WWPS (owned and managed by landowners) or a temporary WWPS (owned and managed by the WC) and associated conveyance infrastructure to pump wastewater from the CBP northwards into the Byford Sewer District. However, this option is presently not available because the capacity of wastewater infrastructure in the Byford Sewer District is limited. The available capacity in Byford is already taken up or reserved for servicing the ongoing residential development in Byford . The gravity sewers in Byford do not have the capacity to accept unplanned, out-of-catchment flows pumped flows from Cardup.

The Shire acknowledges Water Corporation’s advice regarding the future servicing of the Cardup, Mundijong and Whitby areas as they are further developed in the future. No action is required on this matter as it will be appropriately addressed in the long term as demand increases.

The Water Corporation has prepared a long term conceptual wastewater conveyance plan covering the entire south-east urban corridor, which provides for wastewater flows from the Cardup and surrounding areas area to be received at a future WWPS to be located approximately 2.5km to the west of Cardup adjacent to the future Tonkin Highway extension. This long-term planning is predicated on the full development of Byford and Mundijong as well as the urbanisation of the rural land between Byford and Mundijong. If/when this area is urbanised and the pump station is constructed, the option will be available to gravitate wastewater from the CBP to the WWPS.

Water As indicated in the engineering services report, the CBP is located on the fringe of the current Byford Water Zone network and there are capacity issues associated with extending water mains from Byford. The CBP is situated outside the planned Byford Gravity Water Scheme. Existing rural properties within the Cardup area do not have access to scheme water. An existing 200mm water reticulation main is located to the north of the CBP along Pinebrook Road. This main feeds a 150mm main on Cardup Siding Road that services the 'Byford on the Brook' residential subdivision to the west of the CBP. The 200mm main will not have the capacity to serve existing customers as well as the full development to the CBP. While the main could be extended to serve an initial stage of the CBP, the developer will ultimately need to duplicate or upgrade the water main in order to serve all lots within the CBP. The feasibility of extending additional water mains southwards off the Byford scheme and the need for other system upgrades such as duplication of storage tanks in Byford, has not been investigated.

In summary:

The CBP is unable to be serviced by the Water Corporation with wastewater services in the short (5-10 year) term. Servicing in the long term (20-30 year) may be possible subject to the urbanisation of the rural area between Byford and Mundijong and the availability of a WWPS to accept wastewater flows from the CBP.

In the short term (5 years) the ability of the developer to pump wastewater to

the Byford WWPS will be compromised by cost and the capacity of the existing Byford system, which have not been designed to take flows from the CBP.

Water supply mains will need to be extended to the CBP site at the developer's expense but total capacity may be limited by supply constraints in the Byford Gravity supply scheme.

Peel Harvey Catchment Council

The Peel-Harvey Catchment Council (PHCC) is interested in all new development and structure planning in the catchment, including all of the Shire of Serpentine-Jarrahdale, which has the potential to significantly improve or degrade the natural resources of the Peel-Harvey Catchment. This includes the conservation of biodiversity through the protection of natural areas, and the improvement of water quality entering local drains, creeks and rivers.

As you may be aware, the Serpentine River catchment continues to contribute twice the amount of nutrients to the Peel-Harvey Estuary than required to support a healthy ecosystem. The extent of clearing proposals on the Coastal Plain Catchment also suggests that there is a significant nett loss of native vegetation in the catchment each year.

The PHCC is concerned about the proposal for a number of reasons, but most significantly the proposal’s likely impact on Bush Forever Site 361 and biodiversity. Bush Forever Site 361 is of regional significance for its bushland and biodiversity values and the Site should be protected for conservation in perpetuity.

The PHCC’s position is that the protection of Bush Forever Site 361 for Conservation should be negotiated through the finalisation of the Cardup Business Park Local Structure Plan. BF Site 361 is part of a clear land precinct bounded by South West Highway, Norman Road, the south-west rail reserve and Cardup Siding Road. To omit the Bush Forever Site from the structure planning exercise is contrary to the Bush Forever approach and poses a significant further threat to the bushland.

Most significantly, the omission of BF Site 361 from the structure plan reduces any real opportunity that the protection of bushland can be reasonably negotiated as part of a larger development-conservation outcome. The most realistic opportunity for

protection of BF Site 361 is a negotiated planning outcome over a larger development area. Also, by omitting BF Site 361 from the proposal, opportunities to develop parts of Lots 21 and 60 will be constrained in the future and will likely result in a sub-optimal development design.

The PHCC’s position is supported through the State Government’s Bush Forever Policy and State Planning Policy 2.8 Bushland Policy for the Perth Metropolitan Region (especially Clause 5.1.2.2. BFA – Urban, industrial or resource development).

It is acknowledged that the land has been rezoned from Rural to Industrial since the Bush Forever policy was introduced (Government of Western Australia, 2000). This is in itself, of concern, and further complicates the conservation of Bush Forever Site 361.

Given the above, the PHCC calls on the local government and Department of Planning to suspend the processing of the proposed structure plan until the protection of BF Site 361 has been resolved and the outcome made publicly available.

In terms of the proposal’s other impacts on the environment and natural resources, the PHCC makes the following brief comments:

1. Lot development should not proceed until lots can be connected to reticulated sewerage. The use of Alternative Treatment Units (ATUs) is not acceptable. Discussions with Environmental Health Officers in the catchment, including Serpentine-Jarrahdale Shire, has confirmed that these systems do not perform to their stated standards over the long-term. They are definitely not acceptable for new light industrial units and businesses.

2. The structure plan should not be progressed to final consideration until the final Local Water Management Strategy has been approved.

3. The designation of ‘Drainage Purposes’ on the draft Structure Plan map should be amended to reflect that some of these areas are also wetland buffers and shall not be simply for ‘Drainage Purposes’. This has implications for management and protection of biodiversity.

The Shire disagrees that development should not be allowed until reticulated sewer is available. The Shire is satisfied that ATU systems will be able to service individual sites and minimum standards will be enforced through issue of Planning Approvals.

The Shire agrees that the LWMS should be finalised prior to the LSP being determined by the WAPC.

The Shire disagrees with the recommendation to amend designated ‘Drainage’ areas to reflect wetland buffers. While the Shire acknowledges the importance of wetland buffers, it

Once again, the Shire has sent out a Proposal for comment with inadequate information! Honestly, how hard can it be to get right?

The Draft of the proposal, which was rejected until amendments were made, was posted on your website...all 970 pages.

My concern is this, although bore water is going to be sampled every three months for 2 years, there is no mention of who will compensate the Cardup residents if the water becomes contaminated, and hence un-potable. Will the Shire, or those responsible for the contamination provide water tanks and pay for the water to fill them?

If the use of bore water in the Business Park lowers the water table to a point where our pumps run dry, who will pay the cost to have new bores sunk?

Individual Development Applications will be required to demonstrate that all impacts are retained on-site. Licences to take water are managed by DoW. If monitoring discovers contamination compliance action is likely to be taken by the DoW.

We as ratepayers of Serpentine Jarrahdale Shire have many concerns about the proposed Cardup Business Park Local Structure Plan as noted below : 1. The noise which will be generated by not only the development of this site but the on going noise. Cardup is quite an acoustic area and SW Hwy noise can be heard from our residence on Soldiers Road. Already at certain times, we can hear the motor cross, the machinery at the super tip. So considering the amount of lots that are Zoned Industrial on this site, this has the potential to be a very realistic concern for Cardup residents. The Buffering for this site is a great concern as we are not sure as to how these companies intend to deal with this problem. We do not believe large steel structures or sea containers will be sufficient and trees can take a long time to grow to be an effective buffer. 2. Firstly, Wormall Civil, which we residents have had to endure the dust from their sandblasting are going to be subjected to approx. 50 employees working at the site on Cardup Siding Rd for the next 6-24 months operating hrs 6.30am-6.30pm Mon-Sat and more than likely Sunday as has previously been the case. 3. Machinery/plant/equipment/truck movements along Soldiers Rd & Cardup Siding

As was stated at the Community Information Session on the 11 Dec 2014 at the Byford Town Hall, the ground sewage for this development will be built under Soldiers Rd due to the Gas supply along the boundary of the site and whether this system will be forced onto the Residents/Ratepayers. 11. We are concerned about what types of industrial businesses will be permitted to purchase and operate on these lots. 12. We are concerned that with the amalgamation into the Armadale Council, will the ratepayers be given a dedicated focal point at the Armadale Shire to follow up

According to the Community Information Session held on the 11th Dec 2014, It was stated that another session will be held for those that were not informed. 18. With future Community Information Sessions and Public Council Meetings, We will expect a representative from the Armadale Shire to be there to listen and be informed of residents concerns in regards to this development proposal. 19. As far as Wormalls total disregard to the residents of Cardup by operating outside the strict structure laws in the past, We would like to know what steps the SJ Shire have / are going to take to ensure all parties conform to the conditions outlined in any development approvals to ensure all parties operate in a safe, efficient manner with limited disruption to ratepayers and NO ground water contamination results from any works being carried out in the Cardup Business Park.

As far as Wormalls total disregard to the residents of Cardup by operating outside the strict structure laws in the past, We would like to know what steps the SJ Shire have / are going to take to ensure all parties conform to the conditions outlined in any development approvals to ensure all parties operate in a safe, efficient manner with limited disruption to ratepayers and NO ground water contamination results from any works being carried out in the Cardup Business Park. We look forward to discussing these issues further at the next community information session and sincerely hope the SJ Shire takes all necessary steps to notify ALL ratepayers as to when this will take place.

We write to express our total support of the proposed Local Structure Plan (LSP) for the Cardup Business Park and in particular the Development Application (DA) for Lot 41/No 17 Cardup Siding Road, Cardup for the proposed C.C. Wormall development. It is our understanding that the close off date for the LSP advertising is 5/01/15 and that the C.C. Wormall DA will be reconsidered at the same time as the LSP at the Shire of Serpentine-Jarrahdale (SoSJ) meeting on 9/02/15. In the case of the C.C. Wormall DA it is high time the silent majority spoke up in support of a true local businessman who is trying to relocate a very successful business to our Shire. The reason for our support of the LSP and DA are listed hereunder: • It is our understanding the process to rezone the area identified as the Cardup Business Park commenced 10 years ago and is not a recent event; due process has been followed for 10 years and the rezoning has been approved by the West Australian Planning Commission (WAPC) and the Shire has amended its own Town Planning Scheme to align with the WAPC's proposed land use; » It is apparent that some residents have purchased land adjacent to the proposed business park during the last 10 years without conducting their own due diligence with the Shire to check on the areas proposed future use and now they have discovered this they want everyone else to bend to their will and block the proposed business park; if they had conducted their own due diligence they could have made the decision to buy elsewhere instead; • The Shire of Serpentine-Jarrahdale is in a state government designated growth corridor and is no longer purely a rural retreat as some would prefer it to remain permanently; • The population growth of the Shire of Serpentine-Jarrahdale community as witnessed by the recent start of construction on the nearby Whitby residential development with the potential for 4000 more residents will require more local businesses to provide employment to this growing population or face growing

unemployment levels and all the social problems this can cause; • The Cardup Business Park will provide an economic incubator and encourage more companies to establish their businesses here to join those already operating there; • With a well prepared and strict LSP in place orderly planning can occur to protect surrounding residences, local residents' amenity and the environment; • We have already seen at least one business leave the Shire due to frustration at not being able to have their DA approved and we don't want to see any more leave or others give up in establishing their businesses in the Shire; o Information supplied to the Shire indicates that currently approximately 20% of Wormall Civil's 250 employees live within the boundaries of the SoSJ, even with the business currently located in Maddington within the City of Gosnells; obviously this number will escalate once the business is relocated to the SoSJ which can only be of significant benefit to the community; • Local service businesses such as service stations, local mechanics/fitters, tyre fitters/repairers, and convenience stores, the bakery, and sundry other suppliers will all benefit from the custom of Wormall Civil and its employees; It is our understanding that the C.C. Wormall DA also includes the provision of a Youth Training Facility that will provide a pathway for our local youth into the civil construction industry via the company Wormall Civil Pty. Ltd., which will operate from the above address; Wormall Civil Managing Director Craig Wormall has also been in regular contact with the local school Principal who along with his staff strongly support this initiative; with the recently announced significant increase in TAFE fees by the government this facility is even more vital to the community's youth, some of whom may no longer be able to afford to attend a government funded technical college; • Contrary to what was claimed at a recent Shire meeting, the Wormall family are well known to us as they have lived and contributed to this community during the last 30 years and I fully support their intentions to provide more employment opportunities and wealth to our local community; • The claim also made by some residents that the Wormall's have come into the Shire recently and disregarded the LSP and Shire regulations are therefore obviously scurrilous, untrue and unhelpful; • We are also aware that a Wormall Civil representative has maintained close contact

with the local Ratepayers Association President Alan Clarkson during the last 12 months and Alan and his Association support Wormall Civil establishing its business at Cardup, provided all SoSJ requirements are complied with; • During their due diligence process prior to purchasing the abovementioned land, Wormall were advised by Shire Planning Officers that if their DA complied with the intent of the proposed LSP, the DA could be assessed separately and approved on its own merits; (in spite of this The Shire's Planning Manager later admitted this was incorrect advice;) • Wormall ensured that their DA did comply with the intent of the LSP by contacting and even contracting the planning consultancy RPS that prepared the Cardup Business Park LSP to ensure the DA was in synch with the LSP in all aspects; • Anyone who has known this local family and its contribution to the local school, football club and BMX club over many years will attest to its community commitment, financial and personal labour donations, all made without seeking publicity; • C.C. Wormall have to my knowledge agreed all along to the conditions stipulated by the SoSJ to comply with all health, safety, environmental and social concerns; • Provided C.C. Wormall do comply with the above conditions and the LSP eventually adopted by the SoSJ, we have no objection to the LSP and C.C. Wormall DA being approved at the SoSJ meeting on 9/02/15 and in fact encourage the Shire to get on with it!
