TMC’swoodfinishes,likeallwoodfinishes,canbelightsensitive,thereforecareshouldbetakentoavoidplacingyourchairsinareasexposedtointensenaturallight.WeapplyUVblockeronourfurniture,however,expectsomewoodfinishcolorstoshiftovertime.Therearevariationscommontoallwoodspecies,sothecolorandgraincharacteristicsofourfinishsamplesmaynotexactlymatchthefinishofthefurnitureyoureceivefromus.Theanilinedyes,woodstainsandtonerspenetratewood,however,chairseats,furnituresurfacesandedgesmayshowwearingwithuseespeciallyonthedarkfinishcolors.

•TMCfurnishingsaremadeintheUSA,whichlimitsourtransportationneeds(ascomparedtotrans-oceanicimports),thusreducingthecarbonfootprintofourproducts.

Allourproductsarethoroughlyinspectedpriortoshipmentfromourfactoryandpackedtocomplywithcarrierrequirements.Youshouldcarefullyinspectallitemsuponarrivalandnoteanyobviousdamageonthereceiptofdeliveryandifpossible,photographthedamage.Youneedtofileawrittenclaimimmediatelywiththecarrierifyoudiscoveranyobviousorsubsequentlyconcealeddamage.Caution:Whenaclearreceiptisobtainedbyacarrier,thenthecarrierisnolongerresponsiblefordamagesorshortages.Damagedfreightcannotberefusedbytheconsignee(buyer).Processingclaimsfordamageandshortagesaretheresponsibilityofthebuyer.Atnotimecanclaimsbedeductedfromourinvoices.

deferred shipments

Ifyourequestadelayinshipmentofyourorderandyourorderiscompleteorintheproductioncycle,thenweassesschargesfromthecompletiondateinaccordancewithourpolicyfor“StoragebytheManufacturer.”

stOrage by the manufacturer

Ifyoucannotacceptdeliverywhenyourfurnitureisready,accordingtothetermsofouracknowledgement,thenwereservetherighttotransferthemerchandisetostorageatyourexpense,andtheorderwillbeinvoicedatthetimeofstorage.Paymentofthisinvoicewillbedueontheoriginaltermsstipulatedinouracknowledgement.Storagechargesandfreightchargesfordeliverywillbeinvoicedseparatelyuponreleaseofthemerchandisefromstorageandwillbedueuponreceiptoftheinvoice.

Wecharge$3.50netperhundredweight,oraminimumof$35.00,whicheverisgreater,plus$35.00nethandlingforanyitemsthatarerequiredtobestoredformorethanaweek.Iflong-termstorage(i.e.,anythingover30days)becomesnecessary,thenwerequireyoutoarrangeappropriatewarehousingandinsurancecoverageandthemerchandisewillbestoredatyourrisk.

stOrage and use by Owner

Duetothenatureofwoodproducts,wecannotguaranteeanyproductstored,usedorplacedinanenvironmentwheretemperatureandhumidityarenotcontrolled.Temperaturesmustbemaintainedwithinarangeof50°-80°F(10°-27°C);therelativehumiditymustbemaintainedbetween25%and40%.Notsurprisingly,theseconditionsarealsocommonlyrecommendedhumanhealthstandards.

Allofproductsaremadetoorderandarenoteligibleforreturn.Ifbysmallchanceyourproductwasgiventheokforreturnthereisa30%restockingchargeplusfreight.

Sincefurnitureisinstalledandusedunderavarietyofconditions,weurgeyoutomakeinspectionsnolessthaneverysixmonthstolookfordamageorsignsofstructuralfatigueincurredindailyhandling,useandabuse.Yourexaminationshouldincludewelds,machinescrewassembliesandtheshelltobasefasteners.Ifyoudiscoverproblemsthatcouldcompromisethestructuralsafetyofachair,tableorotherproduct,youshouldimmediatelyremoveitfromserviceandTMCshouldbenotified.Coatsandotherarticlesshouldnotbehungonthebacksofchairs.Thispracticemaycausechairstobeunstable.

WARRANTY

AllTMCproductsaremadetoourhighproductionanddesignstandardsandarewarrantedtobefreefromdefectsinmaterialandworkmanshipforaperiodoffiveyearsfromthedateofshipmentfromourfactory.Ourobligationduringthiswar-rantyperiodislimitedtorepairorreplacementatouroption.Thiswarrantycoversdefectsinworkmanshipthatwouldleadtoveneerliftingorpeeling,gluejointfailure,andwoodjointspullingapart.TMC’swarrantycoverstheliftingofplasticlaminate,linoleumorothersurfacematerialfromsubstrate,butwecanonlyunderwritetheoriginalmanufacturer’sguaranteeagainstscratching,chippingandmaterialdefect.TMCusesfinishingtechniquesthathighlighttheinherentbeautyofwood.However,woodisanaturalproductwithnaturally-occurringimperfections:dependingonthespeciesandcutcertainhardwoodsandveneersmayabsorbourstainsdifferently;allfinishescanbeexpectedtomellowwithage;andsomeexpansion/contractionisnormal.Therefore,theforegoingarenotconsidereddefectsinmaterialsormanu-facturingprocessandarenotcoveredunderthiswarranty.TMCdoesnotwarrantproductsmanufacturedtothespecificationsofothersnortheirfitnessforparticularpurposeoruse.Nowarrantyismadefornon-standardmaterialsselectedbyandusedattherequestofthecustomersuchasCOM,COL,oranyothercustomer-suppliedorspecifiedproduct.OurwarrantybecomesnullandvoidonanygoodsrepairedoralteredbyanypersonwhoisnotauthorizedbyTMCorwherethepurchaserhasfailedtofollowpublishedinstructionsforassembly,useorcare.Thiswarrantycoversourproductsundernormaluseandinserviceunderconditionsforwhichtheproductsaredesigned.TMCconsidersnormalusetobesingle-shiftservice(eighthoursperday,fivedaysperweek);extendeduse(multipleshifts,24-hourfacilities,etc.)willreducethiswarrantytotwoyears.Additionally,thiswarrantybecomesnullandvoidonanyproductswhich,inthejudgmentofTMC,havebeensubjecttoabuse,misuse,improperstorage,negligence,actsofGod,orenvironmentalconditionssuchasheatorhumidityordamagetotheproductsthatisnotattributabletothefailureoftheproductsthemselves.Wemakenootherwarrantieseitherexpressedorimpliedregardinganymatterwhatsoever,including,withoutlimitation,theconditionofthemerchandise,itsmerchantability,oritsfitnessforanyparticularuseorpurpose,andinnoeventshallTMCbeliableforincidentalorconsequentialdamages.Anydefectsshouldbereportedimmediately.AllclaimswillbeprocessedbyTMC’sCustomerServiceDepartment,andallreturnsmustbeauthorizedbyusinwriting.Merchandiseauthorizedforreturn,repairorreplacementmustberemovedfromservice,shippedandinstalledattheexpenseofthecustomer.Acopyoftheoriginalpurchaseordermustaccompanyallclaims.Thiswarrantyisnottransferable.
