It is hereby notified to all concerned that public

auctions of rights to manufacture liquor from

cashew juice in respect of various zones located in

North and South Goa in between bidders who

1. No bidder shall be admitted to the auction

unless he/she makes a deposit of Rs. 100/- as

an earnest money separately in respect of

each zone. The earnest money can be

deposited in the Department between 27th

January, 2020 to 04th February, 2020 and

thereafter deposits shall also be accepted at

the place of auction before commencement of

auctions of respective Talukas.

2. At the close of the auction the deposits of

earnest money made by the unsuccessful

bidders shall be refunded to them against the

production of receipts of such deposits.

3. The licence shall be granted to the bidder

who shall undertake to manufacture the

highest quantity of liquor of 25% under proof

or corresponding quantity of lesser strength

after full payment of bid amount.

4. The amount of duty payable on the quantity

of liquor undertaken to be produced by the

bidder shall be paid by him in two equal

installments. The first installment shall be

paid by the bidder on the spot as soon as the

bid is accepted and 2nd installment shall be

paid by him within fifteen days from the date

of acceptance of his bid.

5. The successful bidders shall withdraw the

earnest money deposits in the same manner

as above within 10 days after the payment of

first installment of the bid amount.

6. A bidder shall not be allowed to transfer the

bid once the right to manufacture the highest

quantity of liquor is adjudicated to him/her.

7. Attention to the bidders is drawn to the

provision of Rule 76 of the Excise Duty Rules,

1964. In case the licensee refuses to pay for

the juice supplied by cashew extractors or

fails to obtain such supply from the cashew

juice extractors for any reasons whatsoever,

he shall not be entitled to claim for refund of

duties on these grounds and therefore, the

responsibility of getting the juice from zones

bidded shall fully rest upon him/her.

8. In event of failure to comply with the above

conditions and the provisions of Rule 72 bid

or failure to pay the first installment of the bid

amount as required by sub-rule (3) of Rule 71,

the earnest money of Rs. 100/- deposited

by the bidder with reference to sub-rule (4)

of Rule 72 shall be forfeited. If second

installment of bid amount is not paid within

the period of 15 days as prescribed above, the

first installment paid shall be forfeited in

favour of the Government. Any loss in Excise

Duty caused to the Government by reason of

fresh auction being held as result of

non-payment of the installment, shall be

recoverable from the first bidder as an arrears

of land revenue.

9. As per the Goa (Excise Duty) Rules, 1964 the

accepted bidding price shall be the amount

of Excise Duty for the zone put to auction and

no refund shall be admissible if the duty

assessed on the production in such zones is

less than the amount of the highest offer.

After the duty has been paid by successful

bidder he/she shall declare within 5 days there

from to the Excise Inspector of the respective

Taluka the number of stills and the place where

he/she shall work them as required under Rule 73

of the Goa Excise Duty Rules, 1964.

The price of cashew juice for the purpose of

Rule 76 of the Goa Excise Duty Rules, 1964 shall be

Rs. 4.50 per litre and Rs. 3.50 per kilogram of ripe

cashew apples without seeds conveyed vide

letter bearing No. 1/11-78-Fin (R&C)/Part/4282

dated 26-11-2019.

The licensee shall make use of proper vessels for

storage of cashew juice and distilled liquor and

erect proper still apparatus for distillation. No coal

tar barrels will be used at any stage. The licensee

shall maintain a register in terms of Rule 78.

The license shall be subject to the provisions of

Goa (Excise Duty) Act, 1964 and Rules made

thereunder as amended from time to time.

And whereas, it has been reported by theSuperintendent of Police, South Goa District, Margaovide report No. SP/S-Goa/Reader/231/2020 dated09-01-2020 stating that fear of disturbance of thecommunal peace and harmony in the State of Goais not ruled out in case of entry of Shri PramodMutalik, son of Hanmant Rao Mutalik, r/o KulkarniGalli, Taluka Hukkary, District Belgavi, leader of“Sri Ram Sene” and his member associates in theSouth Goa District. It is apprehended that hiscommunal speeches will promote enmity amongvarious religious communities and will beprejudicial to maintenance of harmony, public peaceand safety;

And whereas, on going through the report ofSuperintendent of Police, South Goa and havingexamined the facts and circumstance brought outin the said report, I am satisfied that there aresufficient grounds for proceeding under Section 144of Cr. P. C., 1973 to prohibit members of “Sri RamSene” and its leader Shri Pramod Mutalik fromentering into jurisdiction of South Goa District andmaking aggressive statement and comments whichcould hurt the communal feeling of groups andlead to violence and in turn result into serious lawand order problems;

And whereas, the circumstances do not allowserving of notice individually except to Shri PramodMutalik, leader of Sri Ram Sene;

Now therefore, I, Ajit Roy, IAS, District Magistrate,South Goa District in exercise of the powers vestedin me under Section 144 of Cr. P. C., 1973, do herebyprohibit the entry of Shri Pramod Mutalik, s/o ShriHanmant Rao Mutalik, leader of “Sri Ram Sene”and any of his associates or members within thejurisdiction of South Goa District, State of Goa fora period of 60 days with effect from 16th January,2020.

of preceding article is hereditary and perpetual in

the masculine lineage and is transmitted from

generation to generation by consanguinity or by

legal and religious adoption. This right becomes

effective once a person becomes of major age and

is duly enrolled as Mahajan including those who

may be admitted as Mahajans in terms of preceding

article.

(b): The list of all the Mahajans shall be properly

maintained by the Managing Committee and

up-to-date copy of the same shall be displayed on

the notice board of the Devalaya in the month of

January every year.

Article 4(a): All those professing the Hindu

religion irrespective of caste, sect or family group

shall be allowed according to usage and customs

to render worship in the premises of the Devalaya

and also to perform religious acts to institute

festivities and to make donations to the Devalaya.

The right will be reserved to the General Body to

restrict or stop the person/family to perform the

above.

(b): Such acts shall however in no way entitle

them to claim Mahajanship at the Devalaya.

Article 5: There being incurred any extraordinary

expenses which the treasury of the temple cannot

afford or there being a deficit in the ordinary

expenses under resolution of the Mahajan Body a

subscription among the Mahajans will be opened.

Article 6: The member of the managing committee

shall be responsible to carry out the duties and

work relating to the temple without any

remuneration.

Performances of Mahajans and Devotees

Article 9(1): Daily Worship: Every morning there

shall be lighting of permanent nandadeepa, the

prayer and the ceremonies of Abhisheks, pujas and

artis and other ceremonies according to the

religious precepts and practices observed from the

remote parts in the praise of Shree Bhumipurush

Shantadurga temple and its filial Deities. This act

shall be done upto 9.30 a.m. and afterwards Prasad

or Kaul of Shree Shantadurga and other Deities with

the request from Mahajans and Devotees shall be

given. The ceremonies of the mornings shall be

over by the midday by doing Naivedhya and of the

night upto twenty and half hours, but they may be

extended on feast days.

Naubhat will be performed in the main temple of

Shree Shantadurga in the morning and after sunset.

Article 9(2): Weekly Ceremonies: On every

Monday there will be Abhishek, the procession of

Palkhi (Occasionally), Bhajan, Puran, Kirthan from

time to time in the main temple by the Mahajans.

This ceremony is also performed by non-mahajans

after the permission from the managing committee.

Article 10: Annual Ceremonies

1) In the month of Chaitra – Varsha Pratipada,

Gidipadwa Panchang vaschan

2) In the month of Shravan– 4 to 5 Mondays

are celebrated. Morning Abhishek, night

Palki, Mahaprasad, Kirtan, Bhajan etc.

a) 1st Monday is celebrated by all Mahajans

of the temple. Abhishek will be performed

by a single Vangod each year starting

from 1st to 6th Vangod.

b) 2nd Monday will be decided by the

managing committee.

c) 3rd Monday is celebrated by Chari Samaj,

Betul

d) 4th and 5th Monday will be decided by

the managing committee.

3) Vadhya Panchami (Navyam Panchami) at

10.00 a.m.

All Mahajans of village gather near Dasara

stone at 7.00 p.m. to celebrate the annual

function (Shilanghan) and exchange gold etc.

4) Bhadrapadha Shudha Chaturthi: Ganesh

Chaturthi in the main temple in the morning

right to cut 1 to 7 supari trees as holi.

e) Falgun Vadhya Dvitiya Pratipadha:

Morning Holi and at 11.00 a.m. one chatri

will proceed to all Gorvoi Temples and at

3.00 p.m. it will proceed to Betul Khairat.

f) Falgun Vadhya Tritiya; Diwaja Utsav in

the morning, lighting of Diwaja starts from

Pancha Kulgat (Unna fator) from Vaghadi

1st to 5th Vaghadi and at the same time

6th Vaghadi Raut will start the lighting

of diwaja from Ghodamarg-Mahadev

Sateri Devastan. Then one harizan

vasantari will go to the Ghodamarg to

bring the 6th Vaghadi Raut and then all

6 vanghadi will gather at Taranga Pike

and proceed towards main Bhumipurush

temple and religious function such as

“Pan Vido”. Diwaj will be followed and

performed as per priority of the 6

Vaghods. Same day in the evening at 4.00

p.m. Topsho and Gulaloutsav will start

from Pancha Kulgat (Unna fator) of all 1st

to 5th Vangods and 6th Vangod (Raut)

will start from Ghodamarg. Then one

harizan vasantari will go to the

Ghodamarg to bring the 6th Vaghadi

Raut and then all 6 vanghadi will gather

at Taranga Pike and proceed towards

main Bhumipurush temple and perform

the religious function.

g) Falgun Vadhya (Third Day): Kuti Tirth

(Kotambi Udak) in the evening 7.00 p.m.

Vaghadi 1st to 5th will gather at Taranga

Pike. Then one harizan vasantari will go

to the Ghodamarg to bring the 6th

Vaghadi Raut and then all 6 vanghadi

will gather at Taranga Pike and proceed

towards main Bhumipurush temple and

perform the religious function.

h) Falgun Vadhya (Fourth Day): Dharo

(Kombdimaan) once in the year.

i) Falgun Vadhya Amovashya. Shudhikaran

Hom in the temple.

Article 11: The Devotees who desire to perform

the below mentioned religious ceremonies shall pay

besides the respective expenses to celebrate

particular ceremony. The below mentioned fees

subject to such modifications as may be made by

the body of Mahajans from time to time.

Clause (a): The Employees, Staff of the temple

referred in this article shall perform their duties

carefully and with the trust under the supervision

of the Managing Committee and the General Body.

Clause (b): Duties of Purohit

On Every Monday and other festival days it is

the duty of Purohit to be present in the temple to

make Abhishek, Puja etc. also it is his duty to

accompany with the procession of Palakhi and to

attend all the personal functions of the Mahajans of

the village.

Clause (c): Duties of Pujari

It is the duty of Bhat Pujari to collect the flowers,

Tulsi in the morning, cleaning of the temple’s

Devara, oiling and lighting the Nandadeeps placed

in the Gharbagraha and other places to dictate the

puja in Vedic terms, to make Abhishek and other

ceremonies of Mahajans and Devotees at their cost,

to make artis, Prasad etc., to place the image in

Palakhi, to stay in the temple during the respective

time table. To maintain in his possession the objects

and clothes of daily use of the Deity.

Clause (d): Duties of Devidas (Sevekari)

It is his duty to keep clean all the temple before

7.30 a.m. He should bring in the morning the flowers

and Tulasi. In addition to this, whenever there is

any Devakruthya he has to keep everything ready

for the same. Also to tell the devotees to take Prasad

in their turn, closing the doors at night etc.

Clause (e): Duties of Zalmi

It is the duty of Zalmi to be present in the temple

during the religious function and festival and as

per requirement of Mahajans in the village.

Clause (f): Duties of Vazantaries

It is the duty of Vazantaties to perform in the

temple during the Shravan Somvar, Zatroutsav etc.

and as per the requirements of Managing

Committee in the functions of the temple.

Clause (g): Duties of Mudguri (Sudhir Zalmi)

It is the duty of Mudguri to be present in the

temple in the month of Falgun to celebrate the

Divzoutsav of the women. He should also attend in

the village as per the requirements of the Mahajans

in their personal functions.

Clause (h): Duties of Madval (Dhobi)

It is the duty of Madval who shall attend in the

village as per the requirement of Mahajans in their

personal functions.

Clause (i): Duties of Mhalo (Nhavi)

He should attend in the village once in the

month to perform his duties of the villagers. Also

he shall attend in the personal functions of

Mahajans such as Wedding ceremony, death

ceremony etc.

Clause (j): Duties of Chari (Mesth)

Heshould attend and perform the duties of

decorating Palkhis in the month of Shravan Mondays

and decorating all the Rath and Palkhis during

Jatroutsav and as per the requirement in other

temple festivals.

Clause (k): Duties of Gosavi

He should attend and perform his duties during

religious functions of Mahajans in the village such

as “Shraadh”, “Mhal”, Death ceremony etc. and as

per the requirement of Mahajans.

Clause (l): Duties of Harizan

He should attend and perform his duties with

the help of musical drums from Holi Poornima for 3

days.

Clause (m): Duties of Tandel (Gabit)

At the time of immersion of “Khanje”, they should

keep 2 vodi (boats) ready in the sea of Betul and

should assist all the Vangadis till the completion of

immersion of “Kanje” in the sea. This is performed

once in 3 years.

(b) Besides the Pujari or other servants there

may be more remunerated staff if necessary

according to the needs of service. It is being left to

the Managing Committee to engage such staff

fixing the remuneration to be paid to them provided

there are sufficient funds to meet the expenditure

which acts of the Managing Committee should be

later on confirmed by the General Body of the

Mahajans in the immediately next meeting.

Remuneration of the Employees

Clause 1: Purohit

Shall get 1/5 share of fund peti upto Rs. 10, 1/4

share of Prasad Pavati and 1/4 share of Abhishek

Pavati. 1/5 share of coconuts, rice offered to Deity.

Clause 2: Bhat Pujari

He shall be paid Rs. 5000.00 per month. Shall get

1/5 share of Fund Peti upto Rs. 10, 1/5 share of

Abhishek Pavati. 1/5 share of coconuts, rice offered

to Deity.

Clause 3: Devidas (Sevekari)

He shall be paid Rs. 4000.00 per month. Shall get

1/5 share of Fund Peti upto Rs. 10, 1/5 share of

Abhishek Pavati, Prasad Pavati. 1/5 share of

coconuts, rice etc. offered to the Deity.

Clause 4: Zalmi, Vazantaries, Mudguri (Sudhir

Zalmi), Madval (Dhobi), Mhalo (Nhavi), Chari, Gosavi

and Harizan

The salary to all the above will be paid as per

there performance and duties by the Managing

Committee and Mahajans will pay as per their

personal functions.

Penal and Other Dispositions

Article 13: The following are the punishment

prescribed for those servants who will not perform

his/their duties in right manner or disobeying the

others of Mahajan Sabha or Managing Committee

in relation to temple administration.

Clause 1: The servants who do not comply his/

/their duties he/they shall be punished by the

Managing Committee with a warning for first time,

with suspension for the second time and for the

third time his services shall be terminated by the

Managing Committee with prior consent of General

Body of temple who should decide the issue even

in ordinary session.

Clause 2: The Managing Committee or the

General Body shall not inflict any penalties on the

Mahajans or the Employees of the Devalaya unless

they are given opportunities of being heard to

defend their case.

Clause 3: Against the penalties imposed by the

Managing Committee there shall be an appeal to

the General Body of the Devalaya.

Other Dispositions

Clause 4: The Priest shall not solemnize any

worship without prior collection of respective fees

as prescribed in Article 11 by passing a receipt

over a signature of the secretary of the Managing

Committee of the temple.

Clause 5: The religious duties or any other

religious performances shall be performed through

the Priest. In case the Priest is absent then the

Purohit will do the same.

Clause 6: Proceeds of worship not shown in

Article 11 will be distributed at 25% to the temple

Treasury.

Article 14: The Administration of the Devalayas

shall be regulated by the bye-laws and by the

“regulamento das Mazanias” in force as well as by

any general or special laws and regulations

applicable or which may be applicable to such

institution in future.

Clause (a): It is prohibited in the temple for any

person to smoke, to spit, to enter inside any temple

with covered feet, drunk with any stimulating liquid

or any attitude or gesture of arranging conflicts or

quarrels.

Clause (b): It is vested on the General Body of

Mahajans the powers to resolve the matters inherent

to the worship resolution whereof are not

specifically vested on the Managing Committee.

Clause (c): Amendments, changes, alterations or

modifications of legal provision in the bye-laws will

be done by the 2/3 majority of the body of Mahajans.

Notwithstanding the above provision, the bye-laws

regarding customs and traditions possibly will not

be changed.

Clause (d): The Mahajans do not renounce the

right which by any way they have or may for

immovable properties, right, shares, active debts

etc. which shall be declared as integral part of

funds of Devalaya.

The above bye-laws are prepared as per order of

Government – Under Secretary (Revenue-1) vide

order No. 2/2/4/2019-RD-II/2729 dated 19-09-2019

and order of Mamlatdar cum Administrator,

Devasthan of Quepem Taluka vide order No. MAM/

/QPM/DEV/2019/1991 dated 30-09-2019 by following

appointed special committee of the village.
