Re: Licensing Under Article IX of the Banking Law
Dear Mr. Bohy:
The Department of Financial Services acknowledges your letter dated April 7, which states that the Omni Financial office located at 26000 US Rt. 11, Evans Mills, NY will begin making loans under the New York Licensed Lender Law. We are writing to confirm that any and all loans issued from said office will be issued by Omni Financial of New York, Inc . (License LL 101522), and no longer through Omni Financial ofNevada, Inc. tl k/a Omni Loan Company, LTD.
Please be advised that the Department has determined that henceforth, any person making a loan to a servicemember stationed in New York, irrespective of the address listed on the servicemembers' Leave and Earning Statem'ents: (i) in an amount of(a) $25,000 or less for personal, family, household or investment purposes, or (b) $50,000 or less for business or commercial loans; and (ii) charges, contracts for, or receives a rate of interest greater than 16% 1 is required to be licensed as a licensed lender, pursuant to Article 9 ofthe Banking Law.
