What is NY Innovates?

NY Innovates is a unique four-day event featuring a developer conference, and health data Code-a-thon that explores the creative use of technology and data to solve the challenges of tomorrow. The first-of-its-kind event will be held December 17-20, 2013 at the Experimental Media and Performing Arts Center (EMPAC) on the RPI campus in Troy, NY and is expected to draw some 300 participants.

The Developer Conference, NYS DevCon 1.0, will be a catalyst event for training IT staff that promises to unleash a wave of technological innovation for the benefit of the public and private sectors. The event will connect IT workforces from Government, Education and Private sector to learn, share, and collaborate on the latest software development tools and technologies. The conference will feature inspiring and thought provoking keynotes and learning sessions, as well as Ignite Talks. Ignite Talks are five-minute, high-impact, multi-media presentations that educate, inspire, and enlighten audiences about an aspect of technology that sparks innovation and exploration.

The goal for the two-day New York State Health Data Code-a-thon is to generate innovative ideas on how to use open data from Health Data NY, OPEN NY, and other open data sites to help stem the “twin epidemic” of obesity and diabetes. The theme for the Code-a-thon is “Healthy Connections = Healthy Communities.” The Code-a-thon challenges developers, designers, and data enthusiasts to turn novel ideas into mobile/web-based tools that will help New Yorkers locate resources that increase their level of physical activity, improve their food choices and find health interventions in their communities. The technology ideas/solutions will be judged and winning projects will receive cash awards. These ideas will help inform the state’s upcoming 2014 Health Innovation Challenge when developers reconvene, this time to bring ideas from concept to prototype.

Running concurrently with the Code-a-thon will be a number of “luminary talks” that discuss: the importance of open data on the health community, critical on-going work by health professionals within New York State’s communities, and how health plans, health care providers and local businesses are doing their part to encourage healthy behaviors among New Yorkers. Renowned speakers and innovative thinkers from the open data community, the public health and health care communities, as well as academia and government will present.

The ideas that emerge from the Code-a-thon are intended to help people prevent obesity, and prevent or delay a diagnosis of diabetes for those who have pre-diabetes. But the event also has significant economic benefits for New York State. The gathering has the potential to lead to a software development economy that spurs job growth. Similar events have been held in other cities and generated fresh, innovated thinking and ideas. The same can happen here in New York, where the state is fast establishing itself as the next Silicon Valley.

Ultimately, NY Innovates represents a chance to bring together the state’s community of technology innovators, foster government and private sector innovation in technology, and inspire intelligent use of health and government data to help reduce diabetes and obesity.

What Does Sponsorship of the keynote speaker mean?

This is your opportunity to provide a featured keynote speaker on Day 1 or 2. The keynote speaker will address all 300 attendees and should be exciting, motivating, inspiring, and thought provoking. The keynote should not be an

overt company or product pitch, but a talk on innovation and trends. The keynote is 60 minutes in length. The keynote can be a resource from within your firm or someone you arrange through your partners. You will work with the NYS Office of IT Services to help shape the keynote and ensure the presentation meets event expectations.

What is involved with a 45 minute session?

The 45 minute sessions are learning or training sessions aimed at exploring new technologies, exposing attendees to new concepts or techniques for developing applications and stimulating thinking. We encourage a hands-on experience as attendees will bring their own devices. Sponsors may also be paired together, when it makes sense, to deliver an engaging 90 minute hands on session. These should not be overt company or product pitches. The NYS Office of IT Services staff will work with you to ensure your session is a success and meets event expectations.

What are Ignite Talks?

Ignite Talks are a fast-paced “geek” event! Imagine that you’re in front of an audience made up of your friends, family, and people from your community, about to present a 5-minute talk on the thing you’re most passionate about. You’ve brought 20 slides, which advance every 15 seconds whether you’re ready or not. You have a few last-minute butterflies, but off you go—and the crowd loves it. Ignite talks offer a unique opportunity for you to deliver your most important messages – to key target audiences – quickly and effectively.

What is the Signage in the Theater?

As a sponsor you will have your company name displayed in the theater - the central gathering space for the more than 300 event attendees during keynotes, Ignite Talks, and Luminary Talks sessions throughout the week.

What is the VIP Reception?

The VIP Reception will take place on Wednesday evening, December 18. Attendees will include event sponsors, industry and community leaders, government officials, special guests of the conference, and others. The reception will also serve as the official kick-off to the Health Data Code-a-thon.

A printed and electronic program will be available to all attendees. Sponsors provide the camera ready advertisement, and we’ll do the rest.

Read and sign the Contract for Sponsorship Terms and Conditions of Agreement (pages 7-8) and the Sponsorship Form (page 6) and submit it to Health Research Inc.

CONTRACT FOR SPONSORSHIP TERMS AND CONDITIONS OF AGREEMENT

EXHIBIT SPACE RULESOne physical exhibit space shall consist of:

The Sponsor agrees to pay for any other services which may be required and/or ordered that are outside of the in conjunction with sponsor’s display. No signs, placards or other advertisement are allowed to be posted outside of sponsor’s space or in any other part of EMPAC by means of tacks, tape, nails or pins to the walls, doors, or woodwork. Dispensing of alcoholic beverages is prohibited.

MUSIC No live music performances or use of recorded music will be permitted unless the sponsor can demonstrate that it has obtained the requisite copyright licenses from ASCAP, BMI, and other appropriate organizations and such performance or use does not in any way interfere with other sponsors.

EXHIBITOR PLACEMENT HRI Inc. cannot guarantee that companies exhibiting similar products or a competitor will not be located in a nearby or adjoining booth space.

DISMANTLE Dismantling of exhibits prior to show closing will result in denial of exhibition privileges at the subsequent conferences.

SUBLETTING SPACE It is agreed by the parties hereto that the license contracted for by sponsor cannot be assigned by the sponsor to any other party.

INDEMNITY Any loss, damage or injury, which may occur to any person or property as a result of any negligent act by the Exhibitor, its representatives, agents, employees, or contractors, shall be the responsibility of the Exhibitor. Exhibitor shall indemnify, defend and hold harmless conference co-hosts: Office of Information Technology Services, New York State Department of Health, The NYS Forum and Health Research, Inc., their officers, directors, employees, agents, and each of them, and New York State from any and all claims made as a result of the negligent acts of sponsor, its officers, directors, employees, agents, or contractors. The terms of this provision shall survive the termination or expiration of this Agreement. The conference co-hosts, or EMPAC, shall not be responsible for any loss, damage or injury which may occur to sponsor, its property, or it representatives, agents or employees unless such loss, damage or injury is caused by the negligent acts of the conference co-hosts or New York State

INSURANCE All property of the sponsor is understood to remain under its custody and control, in transit to or from or within the confines of the EMPAC at RPI, subject to the rules and regulations of the conference. The sponsor agrees to carry liability insurance against injury to the person and property of others in the amount of at least $1,000,000 and shall name the conference co-hosts and the EMPAC at RPI as additional insureds on such insurance policy (ies). The sponsor shall provide conference co-hosts with certificates evidencing such insurance coverage with return of the registration package.

APPLICABLE LAWS The rights, duties, and obligations of the parties, and the validity, interpretation, performance, and legal effect of the Agreement shall be governed and determined by the laws of the State of New York.

Exhibitor acknowledges that it has obligations under federal, state and/or local law such as the filing of State and Federal taxes, compliance with State laws, codes, rules and regulations establishing ethical standards for the conduct of business with New York State such as the New York State Public Integrity Reform Act of 2011, and/or the maintenance of required Federal, State or local permits, registrations, licenses or other governmental authorizations, Exhibitor acknowledges that as a sponsor of the event it is compliant with and has satisfied these obligations under federal, state and/or local laws.

SEVERABILITY Any terms, clauses or conditions which are subsequently adjudged invalid or illegal shall be stricken from these Terms and Conditions never included and all remaining valid and legal conditions, clauses, and terms will thereupon comprise these Terms & Conditions.

FORCE MAJEURE Should any circumstance beyond the control of, and not the fault of, the conference co-hosts prevent or materially affect the NYS Innovates from being held as scheduled, or the exhibit space not being available for use herein specified due to war, governmental action or order, act of God, fire, strikes, labor disputes or any other cause beyond the control of the conference co-hosts, this Agreement shall immediately terminate and no fees shall be returned.

AMERICANS WITH DISABILITIES ACT Exhibitor represents and warrants that its exhibit, and product/service information shall comply with the American with Disabilities Act, its regulations and guidelines (collectively “ADA”). Exhibitor shall indemnify, defend and hold harmless conference co-hosts, its directors, officers, employees and agents, and each of them, from and against any and all claims and expenses, including attorney’s fees and costs, arising out of or related to Exhibitor’s breach of this provision or noncompliance with any provision of the ADA.

CONDUCT OF EXHIBITORS/DRESS OF ATTENDANTS Exhibitors shall be appropriately dressed in business attire. Costumes not regularly associated with the business and professional character of the conference must have the prior written approval of conference management.

PAYMENT TERMS To guarantee your exhibit space, full payment must be received by November 30, 2013.

CANCELLATION OF EVENT New York State may cancel all or any part of NY Innovates or reduce the amount of space allocated to NY Innovates for any reason in its sole discretion. If the NY Innovates is canceled in its entirety, this Agreement shall automatically terminate, and HRI Inc. shall refund to Sponsor all Fees in full satisfaction of all liabilities of New York State to the sponsor. Refunds shall not be made for partial cancellation or reductions in the size or scope of the NY Innovates. Any sponsor who cancels this Agreement prior to any cancellation of NY Innovates by New York State shall be entitled to a refund only in accordance with “CANCELLATION BY SPONSOR,” below.

CANCELLATION BY SPONSOR In the event that the sponsor desires to cancel this Agreement, the sponsor may only do so by giving notice thereof in writing sent to the New York State and HRI with evidence of receipt. Sponsor will be entitled to a refund of fees only if the written notice of cancellation is received by the New York State on or before December 3, 2013.

REMOVAL OF SPONSOR New York State hereby reserves the right to eject and remove a sponsor or its exhibit without notice for violation of any of the terms of this Agreement without New York State being deemed guilty of trespassing in any manner whatsoever, in which case the Space Fees paid by the sponsor shall be retained by New York State as liquidated damages. The sponsor agrees to such additional terms and conditions as New York State may deem necessary for the proper conduct of NY Innovates.
