10. RESOULTION OF NECESSITY:_____________ moved, seconded by ____________ the Bluffton Exempted Village Board of Education approve the following resolution.

The Board of Education of the Bluffton Exempted Village School District, Counties of Allen and Hancock, Ohio (the "Board of Education"), met in regular session at 7:30 p.m., on the 19th day of November, 2012, at Bluffton Elementary Media Center, Bluffton, Ohio, with the following members present:

______________________________ moved the adoption of the following resolution:BLUFFTON EXEMPTED VILLAGE SCHOOL DISTRICT

RESOLUTION NO. _______________________

RESOLUTION DECLARING THE NECESSITY OF RAISING $600,000 ANNUALLY FOR SCHOOL DISTRICT PURPOSES

WHEREAS, this Board of Education intends to renew its three (3) year school district income tax currently due to expire on December 31, 2013 and collected for the purpose of permanent improvements.

BE IT RESOLVED by the Board of Education of the Bluffton Exempted Village School District (the "School District"):

SECTION 1. That pursuant to the provisions of Section 5748.02 of the Ohio Revised Code as enacted in Substitute Senate Bill 28 of the 118th General Assembly (the "Act"), and as amended, it is necessary to raise $600,000 for school district purposes (as defined in the Act). The income that is to be subject to the tax is taxable income of individuals and estates as defined in divisions (E)(1)(a) and (2) of Section 5748.01 of the Ohio Revised Code.

SECTION 2. That pursuant to such Section 5748.02, this board of education hereby applies to the Tax Commissioner of the Ohio Department of Taxation to estimate the property tax rate that would have to be imposed by the School District in the current year to produce the amount set forth in SECTION 1 hereof and to estimate the income tax rate that would have had to have been in effect for the current year as a school district income tax to produce the amount set forth in SECTION 1 hereof.

SECTION 3. That the treasurer of this board is hereby directed to certify immediately to the Tax Commissioner of the Ohio Department of Taxation a copy of this resolution.

SECTION 4. That it is found and determined that all formal actions of this board of education concerning and relating to the adoption of this resolution were adopted in an open meeting of this board of education, and that all deliberations of this board of education, and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code, and the rules of this board of education adopted in accordance therewith.

In order for the Board to fulfill its obligation to complete the planned agenda in an effective and efficient fashion, a maximumof 30 minutes of public participation may be permitted at each meeting. Each person addressing the Board shall give his/hername and address. If several people wish to speak, each person is allotted three minutes until the total time of 30 minutes is used. During that period, no person may speak twice until all who desire to speak have had the opportunity to do so.
