RESOLUTION: Establishment of Certain County Elected Ofcials’ Annual Salaries, WHEREAS, the Lincoln County Commission has approved a budget for scal year 2018, in which it has designated certain funds for payment of annual salaries for ve of its elected ofcials – State’s Attorney, Sheriff, Auditor, Register of Deeds, and Treasurer; and, WHEREAS, South Dakota Codied Law provides for certain statutory minimum annual salaries for these ve elected ofcials, absent a resolution from the County Commission establishing a different annual salary for each ofcial, pursuant to SDCL 7-7-9.1, SDCL 7-7-12, and SDCL 7-12- 15; and, WHEREAS, it is the sense of the County Commission that these statutory minimum annual salaries are inadequate compensation for the duties discharged by these ofcials; and, WHEREAS, the Commission desires to establish such different annual salaries consistent with its previously-adopted budget; NOW THEREFORE BE IT RESOLVED, by the Lincoln County Board of Commissioners, that the annual salaries of the Lincoln County State’s Attorney, Sheriff, Auditor, Register of Deeds, and Treasurer be established, effective December 24, 2017, the rst day of the 2018 payroll year, as follows: State’s Attorney $110,260.80, Sheriff 93,412.80, Auditor 78,852.80, Register of Deeds 72,675.20, Treasurer $70,990.40. The Lincoln County Board of Commissioners met at 8:30 a.m. on November 14, 2017 with members Dale Long, David Gillespie, Jim Schmidt, Mike Poppens and Dan King present. The meeting was called to order with the Pledge of Allegiance to the Flag. The Deputy Auditor was Clerk of the Board.

ROUTINE BUSINESS:Motion by Schmidt and seconded

by Poppens to approve the agenda with a revision, claims number to $755,543.41. Long: “Aye” Gillespie: “Aye” Schmidt: “Aye” Poppens “Aye” King: “Aye”.” Motion carried.

The Lincoln County mileage logs for Emergency Management was presented.

PERSONNEL ACTIONS:A request for unpaid time off was

brought before the Commission from the Auditor’s offi ce. Auditor Marlene Sweeter informed the Board she was aware of the pre-planned time off.

Carey Deaver, Human Resources, was present to discuss 2018 compensation. Human Resources recommends the full 2.5% budgeted, for the matrix adjustment for employees on the matrix and 2.5 % increase for part time employees, and employees not on the matrix.

Motion by Poppens and seconded by Schmidt to approve a 2.5% matrix adjustment for employees on the matrix and a 2.5% increase for part time employees and employees not paid on the matrix. Long: “Aye” Gillespie: “Aye” Schmidt: “Aye” Poppens “Aye” King: “Aye”.” Motion carried.

Carey Deaver also presented Information to the Board regarding compensation for elected offi cials.

RESOLUTION: Establishment of Certain County Elected Offi cials’ Annual Salaries, WHEREAS, the Lincoln County Commission has approved a budget for fi scal year 2018, in which it has designated certain funds for payment of annual salaries for fi ve of its elected offi cials – State’s Attorney, Sheriff, Auditor, Register of Deeds, and Treasurer; and,

WHEREAS, South Dakota Codifi ed Law provides for certain statutory minimum annual salaries for these fi ve elected offi cials, absent a resolution from the County Commission establishing a different annual salary for each offi cial, pursuant to SDCL 7-7-9.1, SDCL 7-7-12, and SDCL 7-12-15; and, WHEREAS, it is the sense of the County Commission that these statutory minimum annual salaries are inadequate compensation for the duties discharged by these offi cials; and,

WHEREAS, the Commission desires to establish such different annual salaries consistent with its previously-adopted budget; NOW THEREFORE BE IT RESOLVED, by the Lincoln County Board of Commissioners, that the annual salaries of the Lincoln County State’s Attorney, Sheriff, Auditor, Register of Deeds, and Treasurer be established, effective December 24, 2017, the fi rst day of the 2018 payroll year, as follows: State’s Attorney $110,260.80, Sheriff 93,412.80, Auditor 78,852.80, Register of Deeds 72,675.20, Treasurer $70,990.40.

The second reading and hearing was held at 9:00 a.m. for an Ordinance to amend Section 12.09(F) of the 2009 Revised Zoning Ordinance for Lincoln County. Planning and Zoning Director Toby Brown was present to explain the amendment. The Planning and Zoning Commission recommended approval 5-0-1. Cindy Thomas and Anthony Ventura were present as opponents Mr. Ventura requested that the board table the decision until the Planning and Zoning completed the work on the setbacks. Ms. Thomas suggested that the dwellings category be moved down to the churches, schools, business category so that the set backs are not shortened.

RESOLUTION: BE IT ORDAINED BY LINCOLN COUNTY, SOUTH DAKOTA: Section 1. That the following category “Dwellings (other than owner’s or operator’s)” in the chart in Section 12.09(F)), of the 2009 Revised Zoning Ordinance for Lincoln County, SD, is hereby amended to read as follows: Dwellings (other than owner’s or operator’s), Churches, Schools and Businesses. Discussion was held to determine the best option to sell the old highway shop. It was determined that the best option would be to list the property with a local commercial relator. The Board requested that the Auditor send out proposal requests to local commercial realtors, to be put on the December 5, 2017 agenda to choose a commercial realtor to list the property.

NOTICE OF PUBLIC HEARINGNotice is hereby given that the Lincoln

County Planning Commission will hold a public hearing on December 18, 2017 regarding amendment of the 2009 Revised Zoning Ordinance for Lincoln County. Specifi cally, the Planning Commission will be considering a recommendation of adoption to the Board of County Commissioners for amendments to Article 7, I-1 Light Industrial District, Article 12, Additional Use Regulations and Article 19, Conditional Use Permits.

A copy of the proposed amendments to the 2009 Revised Zoning Ordinance for Lincoln County is available for public review at the Lincoln County Courthouse in the offi ce of Planning and Zoning during regular business hours.

This Planning Commission public hearing will be held at the following time, date and location:

7:00 P.M.December 18, 2017

Lincoln County Courthouse (104 N. Main Street, Canton)

The purpose of this hearing is to explain the proposed amendments to

interested persons, to answer questions regarding this item and to hear public comment on this item. The Planning Commission invites all interested persons to attend and offer their comments. Those interested persons not able to attend are invited and encouraged to send written comments, prior to the hearing, to the Lincoln County Planning Director, 104 N. Main Street, Suite 220, Canton, SD 57013.
