NOTICE OF 2021 REGULAR LOCAL ELECTION

Pursuant to the Regular Local Election Act, NMSA 1978, Sections 1-22-2 to 1-22-19 (1969, as amended

through 2021) I, Amanda López Askin, Ph.D., Doña Ana County Clerk, State of New Mexico, by virtue of

the authority vested in me, do hereby issue the following notice of election:

That a Regular Local Election is called to be held throughout the County of Doña Ana, State of New

Mexico on Tuesday, November 2, 2021; and

That the 2021 Regular Local Election shall be a nonpartisan election, and the names of all candidates shall

be listed on the ballot with no party or slate designation; and

That all municipalities in Doña Ana county have opted to elect their officers on the 2021 Regular Local

Election ballot, where applicable, shall conduct the runoff election pursuant to Section 1-22-16 NMSA

1978, either as a top-two runoff election or as a ranked-choice runoff election; and

That the City of Las Cruces shall conduct a ranked-choice runoff election on the same ballot as the Regular

Local Election to be held on November 2, 2021; and

That the 2021 Regular Local Election shall be held to elect qualified persons to membership of a local

governing body and, where applicable, to elect municipal officers for the following offices:

Shall the Board of Education of the Gadsden Independent School District No. 16 Counties of Dona

Ana and Otero, State of New Mexico, be authorized to issue general obligation bonds of the District, in

one series or more, in the aggregate principal amount not exceeding $38,000,000, for the purpose of

erecting, remodeling, making additions to and furnishing school buildings, purchasing or improving

school grounds, purchasing computer software and hardware for student use in public schools,

providing matching funds for capital outlay projects funded pursuant to the Public School Capital

Outlay Act; or any combination of these purposes, said bonds to be payable from general (ad valorem)

taxes and to be issued and sold at such time or times upon such terms and conditions as the Board may

determine?

HATCH VALLEY PUBLIC SCHOOL DISTRICT –


“Shall the Board of Education of the Hatch Valley Public School District No. 11, County of Doña Ana,

State of New Mexico, be authorized to issue general obligation bonds of the District, in one series or

more, in the aggregate principal amount not exceeding $1,800,000, for the purpose of erecting,

remodeling, making additions to and furnishing school buildings, purchasing or improving school

grounds, purchasing computer software and hardware for student use in public schools, providing

matching funds for capital outlay projects funded pursuant to the Public School Capital Outlay Act; or

any combination of these purposes, said bonds to be payable from general (ad valorem) taxes and to be

issued and sold at such time or times upon such terms and conditions as the Board may determine?”



Shall the Board of Education of the Las Cruces School District No. 2 be authorized to issue general

obligation bonds of the District, in one series or more, in the aggregate principal amount not exceeding

$50,000,000, for the purpose of (1) erecting, remodeling, making additions to and furnishing school

buildings, (2) purchasing or improving school grounds, (3) purchasing computer software and

hardware for student use in public schools, (4) providing matching funds for capital outlay projects

funded pursuant to the Public School Capital Outlay Act, or (5) any combination of these purposes,

said bonds to be payable from general (ad valorem) taxes and to be issued and sold at such time or

times upon such terms and conditions as the Board may determine?


CAPITAL IMPROVEMENTS TAX QUESTION

Shall the Las Cruces School District No. 2 be authorized to continue to impose a property tax of

$2.00 per each $1,000.00 of net taxable value of property allocated to the Las Cruces School District

No. 2 for the property tax years 2022, 2023 2024, 2025, 2026 and 2027 for capital improvements in

the District and New America School-Las Cruces and Raices del Sabor including payments made with

respect to lease purchase arrangements as defined in the Education Technology Equipment Act or the

Public School Lease Purchase Act, but excluding any other debt service expenses, for: (1) erecting,

remodeling, making additions to, providing equipment for or furnishing public school buildings and

pre-kindergarten classroom facilities; (2) purchasing or improving public school or pre-kindergarten

grounds; (3) maintenance of public school buildings or public school or pre-kindergarten grounds,

including the purchasing or repairing of maintenance equipment and participating in the facility

information management system as required by the Public School Capital Outlay Act and including

payments under contracts with regional education cooperatives for maintenance support services and

expenditures for technical training and certification for maintenance and facilities management

personnel, but excluding salary expenses of school district employees; (4) purchasing activity vehicles

for transporting students to extracurricular school activities; (5) purchasing computer software and

hardware for student use in public school classrooms; and (6) purchasing and installing education

technology improvements, excluding salary expenses of school district employees , but including

tools used in the educational process that constitute learning and administrative resources?

REGISTRATION:

Registration Deadline: October 5, 2021.

Online, MVD, and third-party registration closes on October 5, 2021.

SAME DAY REGISTRATION:

Voters will be able to register and cast a ballot on the same day during early voting at all early voting

locations.

Photo ID is required.

At Doña Ana County Government Center 845 N. Motel Blvd. Las Cruces, NM 88007 from October 5

through October 29, 2021, 8:00am through 5:00pm, Monday through Friday, and on Saturday, October 30,

2021 from 10:00am through 6:00pm.

Secured Containers Ballot Boxes

The Doña Ana County Clerk’s Office will have 24-hour, secured containers available to voters for the return of

absentee ballots during the 2021 Regular Local election.

Absentee ballots may be returned by voters as well as voters’ caregivers by mail or in-person using secured

containers or at the Doña Ana County Clerk’s Office. Per state law, “immediate family" means the spouse, children,

parents or siblings of a voter. There will be a space on the ballot envelope where a person returning an envelope

should indicate their relationship to the voter.

Collections from the containers will be conducted in compliance with state statute and state administrative code at

approximately 7:00 pm each day, beginning on October 6, 2021.

Según el Acto de las Elecciones Local Regular, NMSA 1978, Secciones 1-22-2 a 1-22-19 (según

enmendada), yo, Amanda López Askin, Secretaria del Estado de Nuevo México, en virtud de la

autoridad otorgada por mi, por la presente emito la siguiente proclamación:

Que se convoca a una Elección Local Regular que se llevará a cabo en todo el Estado de Nuevo

México y en cada condado y precinto del mismo el 2 de noviembre de 2021; y

Que una elección local regular será una elección no partidista, y los nombres de todos los candidatos

se enumeraran en la boleta electoral sin designación de partido o lista; y

Que todas las municipalidades que hayan optado por elegir a sus funcionarios en la boleta electoral

local regular, cuando corresponda, llevaran a cabo la segunda vuelta de conformidad con la Sección

¿Se le concederá a la Junta de Educación del Distrito Escolar Independiente Núm. 16 de Gadsden,

Condados de Doña Ana and Otero, Estado de Nuevo México, la autorización para emitir bonos de

obligación general del Distrito en una serie o más, en la suma agregada principal que no exceda

$38,000,000 con el fin de: construir, remodelar, agregar anexos y amueblar edificios escolares;

comprar o mejorar terrenos escolares; comprar software y equipo de computadora para el uso

estudiantil en las escuelas públicas; proveer fondos iguales para los proyectos de desembolso de capital

financiados conforme a la Ley de Desembolso de Capital de Escuelas Públicas; o cualquiera

combinación de estos propósitos, los dichos bonos pagados de los fondos derivados de los impuestos

generales (ad valorem) y emisibles y vendidos en tal fecha o en tales fechas y conforme a los términos

y condiciones que la Junta determine?

general del Distrito en una serie o más, en la suma agregada principal que no exceda $1,800,000 con el

fin de: construir, remodelar, agregar anexos y amueblar edificios escolares; comprar o mejorar terrenos

escolares; comprar software y equipo de computadora para el uso estudiantil en las escuelas públicas;

proveer fondos iguales para los proyectos de desembolso de capital financiados conforme a la Ley de

Desembolso de Capital de Escuelas Públicas; o cualquiera combinación de estos propósitos, los dichos

bonos pagados de los fondos derivados de los impuestos generales (ad valorem) y emisibles y vendidos

en tal fecha o en tales fechas y conforme a los términos y condiciones que la Junta determine?

¿Debe la Mesa Directiva de Educación del Distrito Escolar No. 2 de Las Cruces estar autorizada a

emitir bonos de obligación general del Distrito, en una serie o más, por un monto principal total que no

exceda los $50,000,000, a fin de (1) construir, remodelar, hacer ampliaciones y amueblar instalaciones

escolares, (2) comprar o mejorar instalaciones escolares, (3) comprar software y hardware de

informática para el uso de estudiantes en escuelas públicas, (4) proporcionar fondos equiparables para

proyectos de desembolso de capital financiados de conformidad con la Ley de desembolso de capital en

escuelas públicas, o (5) alguna combinación de estos fines, dichos bonos serán pagables de impuestos

generales (ad valorem) y serán emitidos y vendidos en el momento o momentos en los términos y

condiciones determinados por la Mesa Directiva?

¿Debe el Distrito Escolar No. 2 de Las Cruces estar autorizado a seguir imponiendo un impuesto a la

propiedad de $2.00 por cada $1,000.00 del valor neto imponible de propiedades alocadas al Distrito

Escolar No. 2 de Las Cruces para los años fiscales 2022, 2023, 2024, 2025, 2026 y 2027 para mejoras

del capital en el Distrito y New America School-Las Cruces y Raíces del Saber incluyendo pagos

realizados con respecto a los acuerdos de compra de arrendamiento como se define en la Ley de Equipo

de Tecnología Educativa o la Ley de Arrendamiento con Opción a Venta de las Escuelas Públicas,

pero excluyendo cualquier otro gasto de servicio de deuda, para: (1) construir, remodelar, hacer

adiciones, proporcionar equipo o amueblar instalaciones de escuelas públicas o salones de clase

preescolar; (2) comprar o mejorar instalaciones de escuelas públicas o escuelas preescolares; (3)

mantenimiento de edificios de escuelas públicas o instalaciones de escuelas públicas o preescolar,

incluyendo la compra o reparación de equipos de mantenimiento y la participación en el sistema de

gestión de información de las instalaciones según lo requerido por la Ley de desembolso de capital en

escuelas públicas e incluyendo pagos efectuados en virtud a contratos con cooperativas de educación

regionales para servicios de apoyo de mantenimiento y gastos para capacitación técnica y certificación

para el personal de mantenimiento y administración de instalaciones, pero excluyendo los gastos

salariales de los empleados del distrito escolar; (4) comprar vehículos de actividades para transportar a

estudiantes a actividades escolares extracurriculares; (5) comprar software y hardware de informática

para el uso de estudiantes en salones de escuelas públicas; y (6) comprar e instalar mejoras de

tecnología educativa, excluyendo los gastos salariales de los empleados del distrito escolar, pero

incluyendo herramientas utilizadas en el proceso educativo que constituyen recursos de aprendizaje y

administrativos?
