Applicants being sought for new NCBE Board of Directors members in 2017-18; deadline is May 12th NCBE’s Nominating Committee will be meeting soon and is accepting
applications or recommendations from Builders Exchange members for good candidates to serve on the Builders Exchange Board of Directors.
NCBE Board members serve 3-year terms beginning July 1st and a candidate ideally would be the owner, partner, or senior manager of a Builders Exchange member firm.
Chairing this year’s Nominating Committee is Immediate Past NCBE President Clay Green (CATS 4 U). Serving with him on the committee will be the other four current Officers on the Executive Committee and four Past Presidents. The four other Officers are current President Eric Ziedrich (Healdsburg Lumber Company), 1st Vice President Jeff Scott (Mead Clark Lumber), 2nd Vice President Ken Kreischer (Western Water Constructors), and Secretary-Treasurer Doug Hamilton (Oak Grove Construction).
Board meetings are held monthly on the fourth Monday beginning at 4 p.m. at NCBE headquarters, located at 1030 Apollo Way in Santa Rosa. In addition to good attendance at Board meetings, Directors are asked to serve on at least one of NCBE’s eight committees and to take part in as many of NCBE’s special events as possible.
All nominees who members wish to submit for consideration – including themselves – should be sent to Keith Woods, NCBE Chief Executive Officer, at [email protected]. Nominations must be submitted by Friday, May 12th.

Advanced Security Systems has announced a planned merger with one of Sonoma Counties’ longest established alarm companies- Allied Alarms Inc. NBLC thanks all who contributed to the passing the Road Repair and Accountability Act- SB1 with a historic vote of 54 to 26 in the Assembly and 27 to 11 in the Senate. This bill has been a decade in the making and it is a victory for our state, especially for our commuters. NBLC is pleased that the legislators passed a bill that is fiscally sound, does not rely on borrowing and, provides
$52.4 billion to repair our crumbling transportation infrastructure.
NBLC is especially appreciative of Senator Jim Beall, D-San Jose and Assembly member Jim Frazier, D-Oakley for their efforts in crafting the bills and leading the efforts to pass them in their respective houses. We also praise the North Bay delegation for their determination to get this long overdue bill passed, including Sen. McGuire (a co-sponsor of the bill), Sen. Dodd, and Assembly members Aguiar-Curry, Levine and Wood. Kudos to Governor Brown, Senate pro Tem De Leon and Assembly Speaker Rendon for all their leadership in passing the bill.
And finally, to our colleagues who fought so hard to ensure that our elected representatives knew that passing SB1 was a top priority in the North Bay and kept the pressure on - we are delighted that our teamwork achieved our goal and we look forward to working together in the future.

One of the highlights of the Conference will be remarks by Doug Hamilton (Oak Grove Construction) who will be addressing the critical industry issue of a shortage of qualified workers. He’ll describe a new training program called the North Bay Construction Corps, a successful joint venture of NCBE, the Career Technical Education Foundation, and the Sonoma County Office of Education to recruit and train young workers.

The California CSLB has reached a stipulated settlement that will formally revoke the license of Segue Construction, Inc. (#638854), the general contractor responsible for the building of an apartment complex in Berkeley where a balcony collapsed on June 16, 2015. The collapse killed 6 people and seriously injured 7 others.
The settlement, adopted and signed by signed by the CSLB’s Legal Action Deputy on behalf of the Registrar on April 19, 2017, will become effective on May 19, 2017.
The following are the terms agreed to:
The Segue Construction license is revoked. The license holders cannot apply for reissuance or reinstatement of any license for five (5) years from the effective date of this decision;
Kirk Alan Wallis, Segue’s Responsible Managing Officer (RMO), Chief Executive Officer (CEO), and President from March 4, 1992 to January 11, 2008 has agreed that he is jointly and severally responsible for reimbursing CSLB’s total investigative costs of $99,950, prior to issuance of a new or reinstated license;
David Michael Dunlop, Segue’s Officer from February 7, 2002 to January 11, 2008, and RMO from January 11, 2008 to June 29, 2016, has agreed that he is jointly and severally responsible for reimbursing CSLB’s total investigative costs in an amount not to exceed $15,000, prior to the issuance of a new or reinstated license; and
For Wallis and/or Dunlop to associate with any future California contractor’s license, a disciplinary bond that totals
between $15,000 and $150,000 must be filed with CSLB, for a period of at least two years and for such additional time as the Registrar may determine.
The stipulated settlement, resolves an Accusation filed on November 29, 2016, that alleged that Segue willfully departed from or disregarded building plans or specifications, and willfully departed from accepted trade standards for good and workmanlike construction in the building of the Berkeley apartment complex.
CSLB operates under the umbrella of the California Department of Consumer Affairs, licensing and regulating more than 282,000 contractors in California.

Smart People Practice SMART Safety Measures
SMART urges everyone to practice safety along the initial 43-mile route, from the northern part of Santa Rosa to downtown San Rafael. SMART's testing of the train system will soon end and commuter service will begin. SMART is very concerned that Petaluma has implemented Quiet Zones on 7 of their 9 crossings and is calling for the public to take extra precautions there.
FOR YOUR SAFETY• Never walk on railroad tracks. SMART operates an active railroad and walking on the tracks is illegal.
• Use designated railroad crossings only. Wait for the bells and flashing lights to stop and for the gate to rise completely before crossing railroad tracks.
• Be prepared to stop at railroad crossings. Slow down, look both ways and listen for warning signals.
• When driving, never stop on the tracks and never race a train.

Our congratulations end this session of contractor Q/A. I begin with ‘limited’ help for an attorney, offer a corporate contractor a chance to ‘sole’ source his work and respond with ‘conviction’ to help give hope to a license applicant…
Q: I am an Attorney and you have helped many of my clients in the past. I have a new client who operates as an LLC (Limited Liability Company) and they are interested in obtaining a California Contractors License. I know, from my past experience that when an LLC has another LLC as it’s Member/Manager, both LLC’s are required to be registered and in good standing with the CA Secretary of State. My new client’s LLC is structured with a Limited Partnership as its sole Member. Is the Limited Partnership required to be registered with the CA Secretary of State?
A: It depends. If the Limited Partnership who is the sole
member of the LLC is a California Limited Partnership, then yes, it is required to be registered with the CA Secretary of State. If the Limited Partnership is a foreign entity (formed outside of CA), then it is not required to be registered with the CA Secretary of State. If the LP is foreign, the CSLB will need to see proof that it’s registered to do business in its Home State.
Q: I am currently the RMO (Responsible Managing Officer) for an LLC. Is it possible for me to disassociate from the company license and start an individual
Sole Proprietor business without having to re-take the exams?
A: Yes, once you disassociate from a license you have a period of five years to add yourself to another license without needing to re-take the exams. Let me know if you’d like our assistance with the process of obtaining that Sole Proprietor license.
Q: Can I get a Contractor’s License if I have a felony in my past?

A: The conviction alone does not prevent you from obtaining a Contractor License. Each conviction is reviewed by the CSLB, and in most instances only becomes an issue if they determine that the crime is “substantially related” to the Contractor’s ability to perform work in a safe and responsible manner.
Notice of New Registrar:
The California Contractors State License Board (CSLB) recently announced David Fogt, who is currently the CSLB’s Enforcement Chief, has been selected to serve as the Board’s new Registrar of Contractors, effective May 2, 2017. The current Registrar, Cindi Christenson, recently announced her plan to retire effective May1, 2017. Mr.
Fogt began his CSLB career in 1990 as a Deputy Registrar Contractor. Over the next ten years, he was promoted to other enforcement supervisory positions, and eventually to Enforcement Chief in 2001. Mr. Fogt is also one of the few Registrar’s who is also a licensed contractor. David currently has an Inactive painting license that he earned in 1986.
